If you had a permission by someone then this person must send the permission to OTRS, where you can read how to do so. Be aware that persist in uploading copyright violations may lead to a block of your account.

Question...

Based on the information provided, you can download the clip art free, OR link to the site which involves some restrictions. Remember when I asked you to double check this download for me? You said it wasn't free and deleted it, but I didn't bother to follow-up at the time. I'm wondering how I missed the non-free terms for free clip art in a public access section with free downloads or the option to link to the site. Would you be so kind as to provide the link to the terms you read that say the freely accessible downloads are not free? I don't want to make the same mistake twice. What confuses me a little are some of the online sites like Pixabay that I've joined, and they're community operated like the clip art site. Some operate like Flickr (CC licenses), others offer free public domain images with public access sections on their website like clip art.   • The issue in this web site was more the lack of explicit free license. Our licensing policy require that the medias accepted on Wikimedia Commons
are explicitly freely licensed, or
are in the public domain in at least the United States and in the source country of the work.

The images in this web site are indeed "not free" the way we hear it here because they are not explicitly free. And in my understanding this is also a general rule in the world of copyright, an image without license is assumed all right reserved by default. This is highlighted with your exemple Pixabay, the difference is they clearly give a license Creative Commons CC0 and so we know what to expect. Just "free" alone in a text mean nothing, if I come in a shop, I'm free to take what I want.... but likely I will have to pay, therefore "free" is always relative to other conditions that must be explicit.

So yes the upload was a copyright violation, because they never agreed with the publication of one of their images under the license cc-by-sa-4.0 as you did when you have uploaded the image here. Only the copyright holder can give agreement for such a license, example he can give such agreement by saying in the term of use "the content of this web site is published under cc-by-sa-4.0" or just below the image "this image is published under cc-by-sa-4.0" or he can send a permission to OTRS if for one reason or another he does not want to alter the license of the web site.

I noticed you've deleted the photo of Claudio Cominardi which was recently uploaded my me and linked to Claudio Cominardi's page. I can assure there's no copyright violation: I'm the real owner of the photo. Claudio asked me to upload the new one and replace the previous one. The photo you deleted is still present in the web because he used it for his personal page the website of the Italian Deputy Chamber. :-/ So, I'd like to resume your deletion...

In case the image can be found in the web, we require a link to a legitimate publication "explicitly freely licensed", or we require that the copyright holder send a permission to OTRS, where you can read on how to do so. Logos and trademarks are accepted in Wikimedia Commons only, if 1/ they are in Public Domain for a specific reason, 2/ they are freely licensed by their owner or 3/ they are below the Commons:Threshold of originality. If your have the necessary rights to license an image of the logo, then you must send a permission to OTRS, where you can read how to do so.   • Hello, I think CommonsDelinker is a tool removing automatically the wikitext inside different Wikimedia projects, that match with the name of an image that have been deleted here on Wikimedia Commons. And the tool changes also the wikitext name of files, inside different Wikimedia projects, that have been renamed here In Wikimedia Commons to match the wikitext with the new name. Photo upload incomplete

Dear Christian,

I tried to contribute to Sam McCready's page by uploading a photo I took personally. But the uploading is partial:

Undeletion Requests

Hello. Recently, I created a page in Wikipedia for the sports association in my college (https://pt.wikipedia.org/wiki/Associa%C3%A7%C3%A3o_Atl%C3%A9tica_Acad%C3%AAmica_do_Instituto_de_Economia). Here im Brazil, this associations are run by students themselves, therefore, we create and own the images and logos from the club. I would like to know why they were deleted, since they belong to me and my peers, and I cannot violate my own copyright. Furthermore, I also uploaded some photos, shot by me, that were also deleted. I would like to know why. I have already made this questions, but they were not answered, and the images were simply deleted. The files are:

  • Hello, you had sent me a mail regarding the logos, and I already answered in your talk page.

If permissions are received the images will be automatically restored, though this may take some time in reason to a queued, but do not reupload those logos by yourself.

And it is also valid for all the other works (photos, graphes...) that have already been published elsewhere : we must have evidences that the works have been freely licensed by their owner, or the copyright holder must send a permission to OTRS.

  • The copyrights of articles published in newspapers are owned by the newspapers, photos of those articles are derivative works, and in the extend that the articles are not yet in public domain, the newspaper have to agree with a re-pulication here by sending a permission to OTRS. It is the same thing for the photos showing paintings not yet in public domain, the authors (painters) have to send a permission to OTRS.

I don't know if Mongolian Wikipedia allow the fair use, but anyway it's not me who is in charge of the Mongolian Wikipedia rules. Are you making honest edits?

You flagged and deleted an image that I included on a page that belongs to a relative of mine. The same image is still being used but somehow the information is again false and it includes very strange information that can't be cited, for instance "she comes from a westernized tigrinya family". Deletion of my documents

Hi, You recently deleted an image and two documents from a page I created 'Hjelset Motorfabrikk'. The items in question are in my ownership, and I own the copyright as these have been inherited by me. The documents relate to a closed down family owned company which my great grandfather started.

Can you reverse their deletion, so that I can share this interesting local history with other Wikipedia users and people interested in Norwegian maritime history?

The files were nominated for deletion there. No I can't reverse their deletion.

The only way to upload content that have been already published is that:

  1. it is now in public domain (help) for a specific reason, or
  2. the first publication was freely licensed by the copyright holder, please include a web link, or
  3. the copyright holder sends a pemission to OTRS, where you can read how to do so. Even if it you the copyright holder.

Hello Christian, my username is Dreamer2017 and I got a notice from you saying that the photos I uploaded are deleted for the reason of copyright violations. Those pictures that I used are all open for public. You can download them all for free from the institute's website. And the institute allows to use the photos for free and distributes them for public. In this case, is it still under the copyright violations? If so, how can I get your permission to use the picture?   • Hello, Wikimedia Commons only accepts media that are explicitly freely licensed, the fact that a media is available on the web is not the same thing than to be "explicitly freely licensed". If your images have explicit free licenses given in the institute's website, then instead of writing {{Own}} in the source field of your file, you must give a web link that show this license. Hello,

First, to be eligible for hosting on Wikimedia Commons, all files and other content, included logos, must fall within the Commons scope.

Secondly, logos and trademarks are accepted in Wikimedia Commons only if

  1. they are in public domain (help) for a specific reason; or
  2. they are freely licensed by their owner, in such case please include a web link; or
  3. they are below the threshold of originality; or
  4. the copyright holder sends directly a permission to OTRS, where you can read how to do it. Note that even if it is you who are the copyright holder, you must send this permission.

Note also that the permissions system (OTRS) is run by volunteers and there is a queue, if your image has been deleted, and you have sent a permission (before or after deletion), do not re-upload again the erased image yourself, it's forbidden. If the permission is valid and the image meets the criteria of our project scope, then it will be automatically restored.

If the logo does not fit in the categories above, you may upload the file directly into Wikipedia under the "fair use rationale". But I'm not a specialist, you'll have to ask there. You can read en:Wikipedia:Non-free use rationale guideline.

Suppression images

Bonjour, sute à votre message d'hier, j'ai demandé aux auteurs dont j'avais utilisé les images d'envoyer un mail à permissions-fr@wikimedia.org. J'avais préalablement obtenu leur accord (par mail), et les images sont souvent accessibles sur leurs sites respectifs (ou page facebook). Les demandes sont en cours.

Si des permissions sont reçues alors les images seront gardées, sinon les images seront probablement éffacées. Si les images sont éffacées avant que les permissions ne soient reçues, alors les images seront automatiquement restaurées à la réception des permissions. Notez que le service des permissions est géré par des volontaires, et qu'il peut y avoir une file d'attente et donc un certain délai avant qu'ne permission ne soit traitée.

Could you guys explain the rationale behind the deletion? The first one was deleted without reviewing the original comments or showing justification toward those comments. Second time I uploaded it because it wasn't properly reviewed. All images and logos are partially obscured, so why does this not work? It is a conglomerate image of my own making and as far as I can tell doesn't break any of the rules. Leitmotiv (talk) 04:53, 23 October 2017 (UTC)
  • I deleted it because I think it is still a derivative work and the part of artworks depicted are not De Minimis. The fact that there is likely several other derivative works on Wikimedia Commons is not a rationale to keep an image when we are dealing with potential copyright violations.   • Hmmm... De Minimis - nothing in whole or part in this image is of enough substance to likely be challenged in a court of law, nor is enough information possible to replicate any of this partial imagery to reconstruct full imagery. So De Minimis seems like hyperbole. Also, I'm new to this obviously, but how is it band albums are allowed to be used in full and are not De Minimis, but a sliver of an image is not? I'm not trying to justify by comparison, I'm literally confused as to why one is acceptable but the other is not. Leitmotiv (talk) 05:13, 23 October 2017 (UTC)
If I talked about "De minimis", it's because one may think the visible areas of the copyrighted artworks may be considered De minimis, and that maybe the image could be kept for this rationale. Puisque le Français est votre langue maternelle je m'adresse à vous en ce langage pour vous attribuer cette médaille comme reconnaissance de votre travail. En éffet vous avez verifié avec google l'originalité de 18 images dont je suis l'auteur mais dont un administrateur soupçonnait qu'elles étaient une copie et qu'il y aurait la violation de copyright, ce qui est faux. Olá. Vi que deletou duas imagens que carreguei recentemente. As fotos são simplesmente imagens de capa de CDs para ilustrar o artigo referente a elas. Na Wikipédia há inúmeros artigos com esse tipo de imagem. Me explique então como eu posso inserir essas imagens sem ferir direitos autorais, pois já que elas existem em vários artigos da Wikipédia, há de ter uma possibilidade de poder inseri-las. Obrigado!!
