When he repented, way past the 7 days grace, he started to falsify the licensing metadata of his own files, which eventually led to the deletion of some. Please restore all of his files with their original licensing terms.

 Support. I agree with @Usien6: . Apparently the user did not read properly the rules of contest, not won the prize and now wants to delete the photos. But, our licenses are very clear: "By saving changes, you agree to the Terms of Use, and you irrevocably agree to release your contribution under the Creative Commons Attribution-ShareAlike 3.0 license and the GFDL. You agree that a hyperlink or URL is sufficient attribution under the Creative Commons license.". EVinente (talk) 17:07, 3 May 2018 (UTC)

Well, there was some uncertainty, that's why I created a DR, and Jcb seems to agree, as he deleted the files. There were not many comments in the DR. More opinions would be useful. This photo was earlier published here without clear evidence of CC-BY-SA-4.0 license. We need an evidence from the photographer that they wish it published under the specified free license. Either at the initial publication site or via OTRS. @Erikven96: That message concerns File:Tatiana Gelfand.jpg, and was sent by Patrick Rogel, who can be reached via User talk:Patrick Rogel. It appears that Patrick's concern is that the file is low-resolution, has no EXIF metadata, and is attributed to the subject without mention of a timer. These are all classic hallmarks of the copyright violations we see here on a daily basis. So who is the real photographer? Can you upload the high-resolution original version with intact EXIF metadata? Did you get it directly from the subject, or from https://i.vimeocdn.com/portrait/4838176_640x640.webp ? Hi Jeff,

Thank you for your response. I am brand new to Wikipedia and I am having a very hard time figuring out how this thing works from this side. So the picture was taken by Tatiana herself in her studio, and was given to me to be used in the article I am trying to create about her. (she's a theatrical and film director/playwright) This may not be the original pic, but this is what she gave me. The resolution is 640x640 and this is the only version I have, and I think it's perfectly enough for this particular purpose. If this is a problem I am sure she has other pics that are higher res. As for the EXIF metadata, I have no idea what that is, I have no programming experience and I don't even understand most of the language used here. Like even though I understand the individual words, I have no idea what "attributed to the subject without mention of a timer" actually means. I thought Wikipedia was for anyone to work with, who can use a computer. The text I copy/pasted into the description field was what I thought to be a copyright release text which popped up when I looked at this message thread earlier yesterday. In my desperate attempt to make sense of any of this I thought that it was the text I was required to put in the description field to save it from being deleted. So far it hasn't been deleted, which made me think it worked. I was trying to read the help files and the tutorials but when I didn't understand even the first two sentences, I have decided to go by trial and error, which is very frustrating and time consuming. I'm sure I'll figure it out eventually.

Thank you for your comment, and if you have any advice on how I can make the vigilant protectors of Wikipedia believe that I am not infringing on anyone sacred birthrights, I'd love to hear it.

Per file description, the file depicts the armband of en:New_Fourth_Army, which was used by this army between Oct 12 1937 and Jan 23 1947. This deletion was obviously a wrong one: The arguments presented there apply for every insignia (which sometimes includes, in some countries like India also the national flag), as these must not be used without authorization of the respective body - regularly people are fined for using the CoA of the home town in ads. That is why we have Template:Coat of Arms and Template:Insignia (which are unfortunately not used in every file description. So please restore the file and add the warning templates.--Antemister (talk) 08:54, 1 July 2018 (UTC)

  •  Support Clearly a flawed decision to delete this file. The Cayman Islands Government has simply issued a reminder that its devices should not be misappropriated for profit by commercial businesses, which is the position of most governments in the world. There is no implication from the Cayman authorities that their flag or CoA should not be used for identification or illustrative purposes, which would simply be madness.   •  Support Heraldry may traditionally be redrawn by anyone following the public domain blazon, i.e. the heraldic description of the arms. The individual depiction of the first upload was also PD as outlined at the Sodipodi.com page at that time.   •  Support I uploaded the Twemoji file (and redirected the flag link to it) as a temporary stopgap simply because there was no other SVG alternative available on Commons. The way that the flag had been deleted without leaving at least a placeholder despite being used by so many articles was in my view quite irresponsible. I have tried to revert the damage caused by delinking bots, but have only been able to revert the majority of changes on the English Wikipedia and Commons. Joke answer: it’s just an example. Serious answer: perhaps this user made an immense progress since their 2010 achievements, but deletion of the last upload demonstrates that the image was not “uploaded correctly”. Roland311, if this is about File:Adult Cicada Emerging from Nymph Skin.jpg, then it was deleted because the same image can be found at [2], where it's credited to Jim DeWitt and lacks a free license. If you really did take this photo, then you should provide evidence via COM:OTRS that it is yours and that you intend to release it under a free license. clpo13(talk) 17:40, 2 July 2018 (UTC)

Part 1 article 5 of Copyright and Neighboring Rights Protection Proclamation No. 410/2004 states that "any official text of a legislative, administrative or legal nature, as well as official translations thereof" shall not be protected. As this the logo of an administrative agency of the Ethiopian government it is not protected. Furthermore, part 2 articles 11-13 state that the owner of copyright cannot forbid reproduction for teaching, by libraries, archives and similar institutions as well as reproduction, broadcasting and other communication to the public for information purpose. As the logo's use on the Ethiopian Mapping Agency page falls under the protection of these articles it is in the public domain. Turtlewong (talk) 14:54, 1 July 2018 (UTC)
 Oppose As I understand this, the exception is only valid for the text part of official documents whereas images included in such text are still copyrighted. The logo is original enough for copyright protection too, so it is not exempt. As to the reproduction for teaching etc., at Commons we require our uploads to be free for anyone for any purpose anywhere and not just for educational use at Wikipedia. This includes commercial reuse of derivatives which is also not allowed by Ethopian copyright law without permission from the copyright holder. De728631 (talk) 16:11, 1 July 2018 (UTC)
Then how is it possible that the logos of other Ethiopian organizations to be already present on the Commons? For example, Ethiopian airlines or football teams. I think a precedent has been set to allow this. Turtlewong (talk) 17:08, 1 July 2018 (UTC)
If other logos of the same type are available at Commons they need to be checked for possible copyright violations too. For logos in particular you cannot make a general precedence since every logo is different. Every graphic has to be judged individually in terms of complexity and age. File:Ethiopian Airlines Logo.svg is too simple to be copyrighted, and e.g. File:St George SC (logo).png is not hosted at Commons but at the English Wikipedia under a fair use rationale. Good faith uploads of Venezuelan locations, deletion request here. Uploader commented, although in Spanish, that the pictures belonged to her personal travel photographs and that she intended to continue uploading them to Commons. She explicitly said how worried she was about the massive deletion nomination since the uploads were a contribution to the growth of images of Venezuela and Latin America; she even admitted that only one of the pictures was not of her authorship (File:JoséDelgadoCcs.jpg) and that she intended to follow any instructions needed to maintain the images. Because of this, users White Master and Talueses did not support the deletion, but the files were deleted nevertheless.

The user that deleted the images opened yet another request with eight files more, this time about a Wikimedia event. Wikimedia Venezuela's executive director had to confirm that the authorship what hers and several members of the chapter intervene, expressing their frustation over the previous deletion. I know this happened last year, but I learned about the Undeletion requests months later and I've lately been more involved with administrative tasks, both in Commons as in other wikis, so I guessed it wasn't too late to ask for an undeletion. The reason for deleting the image is that it was already published on IMDB (https://www.imdb.com/name/nm1544427/mediaviewer/rm2239186432).

As I am the one that uploaded the image to IMDB, I'm pretty sure that I have the rights to use it on Wikipedia with rights to distribution. This image was provided by Rebecca Massey (the one portrait in the photo), and she has the rights to do distribute the photo as she sees fit.

I hope this decision is reverted.

First, please note, that according to wikimedia project rules, you accept that any text you publish here can be used by anybody for any purpose. And you cannot revoke this permission. So publishing personal data, especially not yours is not smart.
Second, the above is one of reasons why such a permission cannot be accepted and verified on-wiki. We use OTRS system for that; see COM:OTRS.
Third, the above-mentioned permission is not a free license as required by Wikimedia Commons rules. It does not allnow anybody to use this image for any purpose, does not explicitely allow commercial reuse and derivative work creation.
Fourth, in contrary to your words, nothing has been explained on the image description page: the "Permission" field was empty. It should contain either a link to a publicly available permission or an OTRS ticket information. Any of milions Wikimedia users can raise doubts, if the copyright information there is incomplete.
In the case of miniatures permissions from both: the painter and the photographer are required.

@FDRudd1984: I can assure you that nothing illegal has happened here, and we haven't been hacked. The issue concerns our strict licensing policy. When an image is previously published on another site, as these were, we require evidence that the original creator agrees to the license. There are essentially two types of evidence we'll accept. Either add a note to your site to the effect of "Images on this site are free to use under the terms of the CC BY-SA 4.0," or send a permission statement by email to our verification team. This photo was nominated to deletion as "new colored version". Probably it was assumed that a colored 19 century photo means photoshop. In fact, the original photographer Carl Bergamasco (1830-1896) is well known for his coloring work (see [8]: "в основном снимавшим портреты, для "оживления" раскрашенные акварелью." - "mostly took portraits, hand-colored for livelyness with watercolors"). The coloring style looks more like his other color works e.g. File:Alexandra_Iosifovna_of_Russia_by_C.Bergamasco_(1867).jpg than computer manipulation, therefore it can be assumed that the photo was colored by Bergamasco. --M5 (talk) 14:59, 10 July 2018 (UTC)

  1. reuploading deleted files without prior resolving of the deletion reason is a serious violation of Wikimedia Commons rules.
  2. the original site states: "All of my images are under Copyright Theresa Pewal. They may not be reproduced, downloaded, or processed in any way without prior written permission from the copyright holder." which is not a free license
  3. we cannot and may not identify who the wiki user is: anybody is anonymous here. So proving CC license for this photo requires a reference to the theresapewalartistportraits.com site that states so. Claims of free license just by a wiki user (regardless which wiki user claims so) cannot be reliable.
  4. alternatively you cano prove that you are Theresa Pewal, the photographer OR Theresa Pewal can provide a free license for this photo providing it to Wikimedia ORTS using @theresapewal.com email address. See more info in COM:OTRS. But note, that this is a slower way than the one above.

Low resolution is not in and of itself a reason to doubt authorship, especially for images from 13 years ago when it was common for ordinary consumers to reduce file size unnecessarily. And since there's an English Wikipedia article on the subject (that has been kept after an AfD), it's in scope. The file was uploaded by user Ctheorist (talk) who is Chris Widin from the Game Theorists team. That is clear from the livestream of January 3, 2017, when Patrick stated that he had disliked the image on the Wikipedia page and that Widin had changed it (timestamp). He added that Widin also added himself to the Wikipedia page (timestamp) which matches the behaviour of Ctheorist (Ctheorist's edit). So I was told that this photo was created directly in the screenplay of the player's system in the personal computer of the academician Miloša Ćorlomanović from the recording of the show in which he was a guest and for which, as the subject who participated in the show, according to the copyright laws of the Republic of Serbia all the rights to own this image and, consequently, the photographs that come out of it through the screenshots. The photogtaph of the Watelet painitng, owned by members of the Tudor family, is already present in Wikimedia Commons under File:Portrait Henri Tudor.jpg but in bad quality - somebody else put it without my consent. This version, taken from the original picture I took, is designed to replace it. The picture has been published in 2009 and 2012 in my books on Henri Tudor and is also reproduced in the Henri Tudor Museum at Rosport. Suitcasesub: The issue is that accounts here are anonymous, so anyone can claim to represent any company. Therefore, e-mail verification is required.
File:Logo NIKE.svg and File:Apple logo black.svg are a different story, because they're deemed too simple to be eligible for copyright protection in their country of origin, as explained on the file descriptions.
Finally: Nike and Apple aren't "using their own logos on Wikipedia". Their logos are being used in articles about those companies. Hopefully, representatives of those companies have more sense than to astroturf on Wikipedia. @Jeff G.: Delegate Lierman's page on the MSA site, like all materials on that site, is public domain. See the image on that site here.. FWIW, I handled communications for the Delegate during the 2018 Primary, and she has explicitly asked that that image be used. @Jcb: Please don't undelete images that are dated earlier than May 2014. w:Narendra Modi became India's prime minister only by the end of May 2014. Until then, his Flickr account was used for images that are probably owned by government of Gujarat or his political party, Bharatiya Janata Party. For example, File:Advertisment of Mobile application for India272+ launched by Narendra Modi.jpg is an image created for his prime ministerial campaign, while File:Narendra Modi meeting the visiting French business delegation to Gujarat 2.jpg seems to be an image taken for government of Gujarat. {{GODL-India}} will not be applicable to these images as they were not created by an agency of Government of India. —Gazoth (talk) 04:07, 21 July 2018 (UTC)

Gazoth, here we can see NDSAP/GODL is applicable to works by states too. Some states already appointed their Chief Data Officers for State too. For works by BJP, permission (CC license; not GODL) from the operator of that Flickr stream may be enough. Jee 12:47, 21 July 2018 (UTC)

GODL-India also has a similar restriction (emphasis mine):

Following the mandate of the National Data Sharing and Accessibility Policy (NDSAP) of Government of India that applies to all shareable non-sensitive data available either in digital or analog forms but generated using public funds by various agencies of the Government of India[...]

Considering this wording, data officers at state level might have been appointed to handle data from projects that are partially or fully funded by the Government of India. The implementation guide extends the scope of NDSAP to include the states too but due to a lack of such a mention in both GODL-India and NDSAP, I don't think that it is a good idea to apply GODL-India to works by the state governments without explicit licensing such as in data.gov.in For works by BJP, I think a new discussion is required since the discussion so far has been restricted to undeleting GoI images under GODL-India. —Gazoth (talk) 14:44, 21 July 2018 (UTC)

David Frawley asked me to update his picture as the current Wikipedia picture is from 2007. He asked me to do this through email and supplied the image which was a transfer of the picture to me to have copyright to post the picture into the commons. Obviously, as the picture is transferred into the commons, David Frawley understands there is no copyright on the picture. David Frawley is personally aware of this and asked me to do this as his agent. It was he that notified me that the picture had been taken down. So there is no copyright violation and David Frawley is aware of and requested the updated image to be used.

I have consolidated the request. This is an odd situation, then. The individual pages for the judges contain no copyright notice for the images, while the default for images is that they are in the public domain, and exceptions should therefore be accompanied by a notice wherever they are displayed by the government. The solution here should be to temporarily restore the images and then transfer them to Wikipedia, where they can be hosted as fair use images for illustrating the specific articles to which they are relevant. Sobald die Email hier von unserem Team aus Freiwilligen bearbeit worden ist, kann das Logo wieder hergestellt werden. Aber da diese Kollegen völlig überlastet sind, wird das ca. 100 Tage dauern.

I would  Support undeletion and starting standard DR procedure as the image at www.makeleaps.jp is much newer, server date: Feb 2018: so its presence should not be the reason for deletion. However, the image is watermarked and so it still may fall under deletion based on COM:PCP. I would prefer, however, that a non-watermarked version is uploaded, preferably original from camera.  Strong oppose You can be annoyed all you want, but Wikimedia Foundation takes copyright laws very seriously and the post at Flickr states, "Some promotional photos for Adrin's documentary Perpetual Motion, distributed by Galloping Films." As such, Galloping Films would appear to be the copyright holder and only they can release it to Wikimedia Commons. Judging from this blog, it was taken in 1974 but although the photographer is not mentioned, this does not mean that the image was published anonymously before. Even if an image is seemingly "historic", that does not mean that it is already out of copyright. In Poland and the rest of the EU, copyright for photos where the photographer is known lasts for the life of the photographer plus 70 years.

However, photographs made by Polish photographers published without a clear copyright notice before May 1994 are actually not copyrighted ({{PD-Polish}}). As there is a good chance that the photographer was in fact Polish, we need to know when this was published for the first time and whether there was a copyright notice. Hi there. I am requesting the undeletion of the File:Michael Jeffrey Aminoff.jpg The copyright is owned by the subject Michael Aminoff and he has sent an email to permissions-commons@wikimedia.org releasing rights to wikipedia for use on their site. I will forward the release email from my email account as well, if this is what is needed.

Here is a copy of Michael Aminoff's statement. In connection with the above-referenced matter, I purchased the copyright of my portrait from RCL Portrait Design and I am the sole rights holder. Please see attached copyright notice. I am happy to give permission for Wikipedia to use my photograph on its site. It was uploaded by Wikipedia user UnivacTechDweeb.

He also included an attachment in his email to permissions-commons@wikimedia.org showing proof that Michael Aminoff has purchased copyright to the photograph and RCL Portrait Designs has released copyright to him.

  •  Oppose If a free license has been sent to OTRS, then the file will be restored automatically when and if the email is received, processed, and approved. Note that OTRS, like Commons, is entirely staffed by volunteers, and, also like Commons, is shorthanded, so it may be close to 7 days before the email is processed and the file is restored.
If the message was sent to the English language version of OTRS and the email has been properly received there the sender will receive an automatic reply with the ticket number. If the sender has not had a reply, please check that it was sent correctly and try again. Reason: To upload it is that I found the same file on the top of Hangzhou Metro in English Wikipedia seems to be able to use in English one only(I found no way to link to it otherwise), therefore the re-upload is to make it to be used in other projects, especially Chinese Wikipedia. @Guanaco: However, when referenced to File:Guangzhou Metro Logo.svg or MTR logo.svg in Wikimedia Commons, I suppose it could be used fairly in similar topic pages.

Hello there,

I am the current administrator for Ignacio Peña's English and Spanish Wikipedia pages.

Several of the images I have uploaded over the last year, have been deleted because I didn't specify copyright status of the image.

That was my mistake, I thought I had used the CC0 1.0 Universal Public Domain Dedication for all of them.

All images are owned by Ignacio Peña himself and I have received instructions to place them in Commons under that copyright status.

Please undelete all of the following:

@Jeff G.: Hi Jeff, Ignacio is an artist I have volunteered to help, I don't get paid for administrating his Wikipedia pages. He just prefers someone actually keeps an eye on what's being added to it, to make it as consistent and correct as any other artist's Wikipedia page. I do have a letter written and signed by him, giving me authorization to upload all images he owns and provides for the page, releasing them as Public Domain for Commons' purposes. Reason: The file is produced by military, paid for by public tax payers of multiple countries through NATO contributions, and is a part of historical content. Any look-alike of the image would not be a fair representation of history. Since it has been paid for by the public taxes, no one has ever been charged a dime to see, use, reproduce, distribute the image, or denied its usage. The image have been distributed in mass fliers and has been distributed to millions of people at no cost. I highly believe there is a double standard here. I believe the image is being fairly used and is not violating any copyrighted material.
