 Oppose. There is absolutely no mention of the Creative Commons Attribution-Share Alike 4.0 International license on that page, contrary to what you claimed. And the terms that are listed on the page are not at all compatible with that license or any other free license. It's at least close to an acceptable license. The usual question is if the "reproduce accurately" parts strictly related to moral rights (the wording seems to indicate that), or do they really mean to prevent derivative works altogether. They may well be trying to follow the lead of some other governments (UK, Australia) recently to try to license stuff more freely, but that license is just vague enough to make it arguable that it's not "free", as the intent isn't entirely clear. If there was some explicit note that derivative works are allowed that would help, but without it, then it would seem it has not gotten enough consensus here as a free license. It pretty much rests on that issue. If we can get clarification (thanks Yann) that would be great. Carl Lindberg (talk) 18:56, 25 July 2015 (UTC)

The file File:Nagano 2000 Yudanaka 20060531.jpg was speedy deleted as a claimed copyright violation with the comment that "the same picture was published in 2008, http://www.geocities.jp/fuji36fuji9/sub89.html". However, if my memory serves me correctly, the image I uploaded was transferred from this image on Japanese Wikipedia. While it is very similar, and appears to have been taken at the same location, it is pretty clear that it is not the same image (the position and colour of the banner to the left of the train is different), and was taken in 2006 - before the date (2008) the blog image was published. --DAJF (talk) 23:28, 29 July 2015 (UTC)

This is Wikimedia Commons, not Wikipedia. Wikimedia Commons does not host Wikipedia pages. Wikipedia pages are on Wikipedia. Also, no file by the name File:Urangarilla Wiki Image.jpg has ever existed on Commons. Multiple standards being followed. English Wiki page Yakub Memon still contains an image File:Yakub Memon.jpg having the same video snap origin since 2009 and the page is locked from editing. This evidence not enough for restoring the recent File:Yakub Memon.jpg ???? So restore the latest file File:Yakub Memon.jpg that was deleted. JBDVIJASDVI (talk) 15:59, 30 July 2015 (UTC)

At Commons:Deletion_requests/File:Zuckerberg.jpg, it looks like this image was deleted because the source page went dry. It seems to be up now at https://www.facebook.com/photo.php?pid=30054436&id=4&l=ae012 and clearly says "Mark Zuckerberg this photo is released under the creative commons attribution 2.5 license." For obvious reasons, a personally released image of the founder of Facebook is a very valuable image for us to have. --GRuban (talk) 13:58, 31 July 2015 (UTC)

 Support I'm not sure what the original evidence had, but a source page going dry does not mean a work should be deleted (though it would be best to go through Commons:License review so that the license at the source is confirmed).  Not done. The original speedy deletion request at Commons showed that the image was posted in a forum back in 2011 [8]. The disclaimer at the bottom of that forum page translates to "images and information transmitted from more than one location, including Daraa, Syria Net dot com and scattered sites." There is no proof that the uploader Wissam al Sharef at the Arabic Wikipedia who also appears to operate this Flickr account is the original photographer. Instead, the photo used at the Arabic Wikipedia may be a case of licence laundering and copyright infringement. De728631 (talk) 23:23, 2 August 2015 (UTC)

I was given about 6 hours between the notice and the deletion, despite I wrote in the TALK page of the issuer User talk:EugeneZelenko#Ibrahimiah two Files, marked for deletion within 50 minutes from receiving the notice, after completing the missing requested information !!! I made these two files by myself drawing the borders of Ibrahimia district over a free Google image. Is there any problems with Google or is it a mistake? Let me know please, and if Google is not considered free then inform me. I think the problem that Hedwig in Washington has highlighted is that unfortunately the template {{Acrofan.com}} does not accurately reflect the contents of OTRS ticket 2012112610002772, as the ticket only authorizes a single photo to be CC-SA-3.0. If his summary of the ticket is accurate (and I have no reason to doubt him as he is highly reliable in these matters), then I think we might have to delete {{Acrofan.com}} and the files that rely upon that template (except for the one photo authorized, which can be changed to use {{cc-by-sa-3.0|attribution=ACROFAN}} and {{PermissionOTRS|2012112610002772}} directly). —RP88 (talk) 04:08, 2 August 2015 (UTC)

You can upload your image to the English Wikipedia, most likely, following their procedures (en:Wikipedia:Non-free content). Your image cannot be hosted on Wikimedia Commons however, as we are not permitted to host images with a fair use rationale. The image is an obvious deletion here. The image was uploaded with the license permission from the copyright holder, to wit: "All photos on the website are copyrighted to the 12th Armored Division Memorial Museum Historical Collection. Feel free to use them as long as you credit the Museum Collection." This information was included with the file upload, noting the copyright holder allowed free use with accreditation to the copyright holder, i.e. CC-BY and was forwarded to OTRS per protocol. The copyright information and permission may not have been in the Wikipedia template, but the legal use under prevailing copyright law and license permission was clearly explicated and included with the image file. At the very least, it should not have been speedy deletion. The permission as quoted above may not be sufficient -- we generally prefer something more explicit about commercial use and derivative works (note the wording of the suggested permission form on the COM:OTRS page). But it at least should be the subject of discussion. Secondly, a large number of the photographs on that site would apparently be PD-USGov to begin with. If I see it right in Google Cache, I think the source image is in this gallery (page 20). It does not mention it was supplied by a particular contributor as some of the others do (which might indicate a private photo). Seems fairly likely it was PD-USGov. Thank you for your prompt and helpful response. The source you indicated is indeed the provenance of uploaded image. I think you are right that most of the images would be PD-USGov, but when I queried the curator of the Museum Collection, he responded as above, that the Museum held the copyright on all images but free use with attribution was permitted. Even if an image was from a private collection, it wold have been taken by an active duty combat soldier. Nonetheless, the statement from the Museum Curator indicates they are permitting free use as long as they receive credit, which is what is covered by the CC-BY copyright license. I tried to find the original source o f the image you found [12] on the NARA website to show that it was indeed in the public domain, but was unable to find the image online. The Museum image is from the Armored Division historian, Lise Pommois' self-published collection which itself is not copyrighted. What do you suggest in order to make these images available? I agree that this should be undeleted. As noted at Commons:Freedom of panorama#United Kingdom, under UK law a photograph taken of a sculpture in a museum or gallery to which the public have access belongs solely to the photographer. I believe this work is on display at the Dean Gallery in Edinburgh (see also [13]).

There is no Somalian copyright law, basically. That is kind of the point of the tag. If they did, we should at least respect their terms (even if not part of Berne). The last line on the tag is actually the most important, for us. For personal works, it could be touchier -- if a Somali citizen got a work initially or simultaneously published in another country, then it would be protected under the Berne Convention. But these appear to be Somali government works mostly, which probably are the definition of works first published in Somalia. If a country has no copyright law and is part of no copyright treaties... well... it would seem to be PD. Carl Lindberg (talk) 22:35, 9 August 2015 (UTC)

 Support It looks like a French publication. The author died in 1942, so it should have been PD in France since 2013. If it was even copyrightable to begin with -- it sounds like the points were based on what Perrin saw through a microscope, so the copyrightability is probably dubious to begin with (other than maybe the presentation). There are several Brend Smith images and I presume you are talking about those uploaded by User:Brenda Evonne Smith this time last year. Well there don't appear to be any problems with most of the uploads by this user except that 5 images were deleted. Have a look at this log [15]. Exactly what images are you talking about? BTW, all images are copyright and usually the photographer is the copyright holder unless the copyright was transferred to someone else in a contract. If you are the copyright holder you can confirm your copyright by following the procedure found on our OTRS page otherwise get the photographer to do it. In normal situations, since it is a photograph focusing on a poster, the photograph is a derivative work of the other photograph on the Madonna poster. In that case, we need a license for both the photograph (which Flickr provides) plus a license for the underlying work (which we do not have). Some countries have freedom of panorama, which can allow photographs of public works. For this case, we would have to be able to apply {{FoP-Sweden}}, which states that A work of art may be depicted if it is permanently placed on or at a public place outdoors. Buildings may be freely depicted. The Madonna photo is a work of art, and it is in a public place outdoors. However, the question here is permanently placed, which usually is not true if there is a time where the work is intended to be removed. I'm not sure the poster qualifies for that (see Commons:Copyright rules by subject matter#Posters). While it is true such posters are made to be seen as much as possible, that does not mean something is free -- similar to Commons:Copyright rules by subject matter#Press_photos, that often does not include permission to make derivative works, use commercially, etc. Carl Lindberg (talk) 15:18, 1 August 2015 (UTC)

It's the fact that it's focusing on the poster in particular, without much other context, which creates the problem. Most copyright laws are OK with incidental inclusion -- so if you are taking an overall photo of Times Square with whatever ads happen to be there, that is generally OK, but if you are focusing on one ad in particular with an interest for that ad's content, then it would become an issue. There was a somewhat similar issue in the s:Ets-Hokin v. Skyy Spirits, Inc. case -- that was about a photo of a vodka bottle, where one of the claims was that the photo was derivative of the label on the bottle. The judge ruled that since the photo was of the entire bottle, the label was incidental -- but also said that photos focusing on the label could be derivative works. Obviously fair use would mean your photo would be legal in a great many circumstances without getting any permission, but when commercial use is involved -- say if you or someone else tried to sell a postcard of your photo -- that situation would probably change (and part of being "free" is also being OK to use commercially). Copyright can have some pretty twisted corners... there was once a case where a photographer had a model wear a particular pair of fancy glasses for a clothing advertising shot -- the glasses turned out to be copyrighted (they weren't normal glasses), and the photographer (since he intentionally included them to enhance his photo) was guilty of infringement. If you took a photo of someone who just happened to be wearing those same glasses then it should have been OK. But this is basically a photograph directly of a copyrighted poster -- and the Commons:Copyright rules by subject matter#Posters link explains the usual policy. We need solid evidence of its public-domain status; something from 1926 can easily still be under copyright, so we need either a copyright release or evidence that it didn't comply with the requirements for copyright. It hasn't been deleted yet, but it's best to use the procedure at COM:OTRS to verify permission, as we usually require that when images are previously published. I do see photos out there from the same set marked as taken by Luca Perino, and the photographer does seem to use the same username as here on other social media sites, so it's most probably the same person. The OTRS email therefore may just need to confirm that you are Luca Perino; the permission has been given on the image already. Accounts here are basically anonymous so we are more careful about professional photos taken from the web; it's rare that someone would create a fake username just to upload photos by that person, but I think it has happened. The picture you deleted is made by myself (I understood that "own" in the source field would indicate this). It has indeed been published on lieverbeter.nl which is my own site, and the other site you mentioned had quoted my site, (and even mentioned lieverbeter.nl as source. I didn't know of it's existence, thanks for the info :o)

Is the picture too small? I can send a larger one, but didn't want to send too much. What is the preferred size?

P.S. I also uploaded 2 pictures where my camera had inserted my (c) notice. I understand that this is of course confusing. I removed the notice and resent the files. These were "Bach_zonnemethode_Centaury" and "Bach_kokenmethode_Mustard"

In the mean time I understand that the fact that the picture has also been published on my own site is already a copyright violation. Since my previous upload I have added the "CC-BY-SA-3.0/GFDL" license to the page with the picture ([18]). The picture itself does not contain a copyright notice in the jpg's Exif-metadata. This file was nominated by Hedwig in Washington in a mass deletion request and later deleted by Ellin Beltz with rationale that passports are (C) by issuing country. Which may be a general rule, but is definitely false in this case:

  1. The "issuing country" does not exist since 1939
  2. its successor copyright law exclude official documents from copyright (see {{PD-Polishsymbol}})
  3. this type os passports was issed in 1923-1936 (+/- 1 year), so even if it was copyrightable, the copyright expires in 1975 (1924+1+50pma at this time in Poland) and no-way URAA can be applicable here.

Of course, the {{Own}} template does not apply here, but its presence was not the direct deletion reason.

@Yann: I think our time would be better spent getting validly sourced images. None of the images were own work. "Own work" was the only source, and of course they were all self licensed, so who knows where all this came from. During the time they were nominated no one had worked to provide sources. I think time would be better spent seeing if anything removed materially affected our holdings in Category:Passports by country which is comprehensive and stop running ourselves in circles on a pile of files which were uploaded incorrectly and are obviously not own work, and with no idea where they actually came from. If we restore these, we're right bck to where we were - up mystery creek with no clue where the images came from regardless of their possible (c) or non (c) status by decree of each of their governments. Far better to make a project of getting the real ones from each country with official permissions attached than to do the same pile of work on mystery material. Cheers! PD-POL is nonsense. The Free State of Danzig wasn't Polish but a Free State. Hence the name :-) 1920 - 1939 (annexed by Nazi-Germany) Danzig was a Free State, therefore Polish law doesn not apply for this period. Danzig was annexed by Poland 1945. 1920-1939 Danzig was protected by the League of Nations. Only PD-old-70 applies, author is know = State of Danzig. The Danzig passport got steamrolled in this DR by all the other passports missing essential information / bogus own work. Please undelite these 3 photos:

There was a notice that family of a dead actor has all rights for these photos, but photos were deleted. The photographer was hired by family for money and he gave all exclusive rights to a family of an actor. Family gave me the right to post them. Also I did a personal work as a photographer improving these photos in Photoshop: improving scratches, lights ect. In Russian legislation if you improving photo (just photo, not serious piece of art), the right belongs both to physical photographer and to digital photographer. Nowadays nobody doing only photos: it's always work of 2 people at least: photographer and a person who are making changes in Photoshop. And in Russian legislation rights belongs to both.

The file "Biancapenco,jpg" has been deleted apparently because of suspicion of copy-write abuse (and for missing metadata). The picture has been given to me by my brother in law to be put on the web page of a relevant Italian figure (https://it.wikipedia.org/wiki/Bianca_Penco). I missed the discussion. I have all the permission to publish it, especially after the death of the person. The same picture has been published in different newspapers and it is a recognised picture of the person by everybody knowing her.

The file "Carlodallapozza,jpg" has been deleted apparently for similar motives. The picture has been sent to me by Dalla Pozza's students to put it on the wikipedia page – they use the same picture on the commemorating page of their teacher: https://sites.google.com/site/sitocarlodallapozza/home. The picture has been made by a friend who prefers not to appear and kept by Dalla Pozza's companion. The fact that the picture is missing on the wikipedia page is distressing for the students and friends of Dalla Pozza.

It was taken at Collectormania 2010 in a public place where photography allowed. Multiple similar photos from different people are also exist due to the allowance of photography.

The original uploader at the English Wikipedia is a famous Iranian journalist who has a Wikipedia article himself and has interviewed Fidel Castro, among others . He is also a Wikipedian, although hardly active. Peter Avery is an eminent British scholar of Persian language. It seems highly probable that a famous Iranian journalist has interviewed a scholar of Persian language. Please also take a look at this photo which you can see Abdolrashidi, the interviewer and the uploader, as well as Peter Avery, the interviewee. And then take a look at this portrait in Abdolrashidi Wikipedia article. I can't see this file, so I don't know if is in or out of scope, but deletion policy does permit the speedy deletion of files "which very clearly fall outside of Commons' project scope." Presumably the deleting admin felt that this file met that criteria. Of course it is not only on procedural grounds. This image had been before subject of discussion within one of those lazy deletion requests listing dozens of unrelated photos (sometimes filed even by I.P.s — no, that’s not sockpuppeting at all: unregistered users know how to create a mass deletion, they do, yessiree!), under some generic rationale (often a bad disguise for «I don’t like brown people»). In that previous discussion, it was argued that this photo uniquely shows Valentine’s Day practices in India, and should be thus kept on scope grounds. I did not search around to see if this speedy deletion went against the closing decision of that DR (though it happen before with other images), nor if meanwhile better images were newly uploaded and/categorized to enable illustration of Valentine’s Day practices in India, but all that can be publicly assessed and decided upon in a regular DR — after the hereby requested undeletion. -- Tuválkin ✉ ✇ 20:33, 24 August 2015 (UTC)
That's a much better reason for undeletion than the one you articulated originally. Just on procedural grounds alone, if a file survived a previous deletion discussion it is no longer eligible for speedy deletion on grounds of scope per policy: "If a page has survived a prior deletion discussion, it should not be speedy deleted except for newly discovered copyright violations." I can't find the DR in which it was argued that this photo uniquely shows Valentine’s Day practices in India. Do you have a URL for that DR? I did, however, find Commons:Deletion requests/Some unused self-portraits 20131207 in which this file was listed, but never specifically discussed. In that discussion you say File:Me_And_My_Photos_(256387720).jpg is an outstandingly important image, so you might want to request its undeletion as well (it was also deleted as out of scope). Looking at the File:This me and my mum is called veronica wlff 2013-09-24 17-47.jpg which was recently undeleted it looks like the problem was that the admin who originally kept these images did not put {{Kept}} on the file talk pages when he closed the discussion, so the admin who processed the speedy "out of scope" request was not aware that these images had been previously kept in a DR. —RP88 (talk) 22:43, 24 August 2015 (UTC)

 Support. The email to the author was very clear about what rights were being given up. There was a file deleted in 2007 (Commons:Deletion requests/Image:Lanny Barbie.jpg) because the reply didn't specifically say "GFDL" but I don't think that is enough reason -- the email didn't specifically request that, so it's understandable it was not there. The files were uploaded prior to OTRS being really implemented, so they are grandfathered (Commons:Grandfathered old files) and do not need explicit OTRS permission (which was the deletion reason in Commons:Deletion requests/File:Sexy dancer 01.jpg, which was kept at the time). I think the email and permission stuff conformed to the usual practices at the time (which was rapidly changing, to avoid gray areas like this, but I don't think we should impose later standards on these earlier files). As I said in the DR, I think the ad is not the main subject of the picture, and therefore is De Minimis. But if this ad is too prominent, I would suggest that the picture is undeleted with the ad blurred. We are still trying to undelete the photo's you have taken the liberty of deleting.

No one can have published a copyright infringement as its me - the photographer - the artist Nabiha, the management (Pitt Buhl Ltd/Mette Buhl) and record company (DiscoWax/Sony Music) who owns it!

We have all tried to rectify this without luck, which is getting rather frustrating as its damaging for all of us that this issue is being stalled, which right now allows a very bad published picture (not approved by any involved with the project) to be Nabiha's profile pic. -This is harmful for the artist as well...

Similar reason to undeletion of File:Sexy dancer 02.jpg above. These were others deleted on the Commons:Deletion requests/File:Sexy dancer 04.jpg but only one was restored.

It looks like the files qualify for Commons:Grandfathered old files, and were deleted because User:Slarre~commonswiki/Zappel Jazz moved due to a username change but the links were not updated to point to the new location. For the last one, it looks like it was deleted due to Commons:Deletion requests/Image:Lanny Barbie.jpg because the grandfather policy was not yet in place -- the files were uploaded before Commons:Email templates (and the OTRS policy) was created but that was the deletion reason (no OTRS permission).
