 Oppose The description says, "Private photo of Simeon given to his nanny in Euxinograd by Giovanna of Italy, the last Tsaritsa of Bulgaria, for helping her escape the Allied Forces in Varna on September 8, 1944." While you own a copy of the photo, you are certainly not the copyright holder. In order to restore this to Commons, we would need permission from the photographer. .     Jim . . . . The owner - Plamen Kartalov gave me the permission for this and some other photos for posting in Wiki. He is the general manager of Sofia Opera House and I suggested him some updates of his Wiki, then PR office send me 5-6 photos and the official site for more.  Oppose There are two problems with your request. The first is that permission "for posting in Wiki" is not sufficient. Commons and all the WPs require permission for any use, including commercial use. The second is that Plamen Kartalov is the subject of the image. Permission must come from the copyright holder, who is almost always the photographer. Please refer to Commons:OTRS for the necessary steps to have this restored. .     Jim . . . . Recently I noticed that Hon Udaya's Photograph has deleted by the admin INeverCry as an action to the Obi2canibe's request, But I am regretful to say that his conclusion is wrong,As far as I Know Mr Anuradha never does Copyright Violations intentionally and also to mention he is a former politician in Sri Lanka,and comes from a quite powerful political family, This background itself is enough to have a Photograph of a Sri Lankan politician like Udaya with him,or get permission to upload to the Wiki,Even I have uploaded an Official Photographic Portrait of a Sri Lankan Minister with his consent -> http://en.wikipedia.org/wiki/File:Duleep_Wijesekera.jpg.

The Commons:Categories for discussion/2014/03/Category:Curtis M. Scaparrotti discussion was deleted by the same administrator who deleted Category:Curtis M. Scaparrotti. The discussion was deleted as "routine maintenance". The original category was deleted with the explanation "Renamed category".

The contributor who started the new category, Category:Curtis Scaparrotti, subsequently removed all the elements of the old category -- leaving the old category empty. I know some administrators routinely delete empty categories, without caring whether it was a long-standing category that had been unilaterally emptied. I wondered whether this is why the original category was deleted.

Of course sometimes the person who thinks an older category should be replaced by another category with a better name is correct, and the new name is superior. But they aren't always right. In my opinion they should suggest replacing the category at the fora for such discussions, which the contributor here did do -- but they should wait until the discussion concludes before removing any elements from the older category.

Removing the discussion page was not, in my opinion, uncontroversial maintenance. I would like to know why someone thought the original name needed replacing.

Finally, categories suck as an organizing feature, for a bunch of reasons, including that they don't offer a good way to know what files they once held, when they were added, and when they were removed. But, so long as no replacement organizing feature has been introduced we should use categories in a disciplined way. Currently 80 to 90 percent of our categories have no explanation written in text as to what they should contain. But most or all categories should have an explanation, to help prevent gradual content creep. If an older category has even a single sentence of explanation, that explanation should not be cut and paste into a new category, as this does not fulfill our obligations to the individual(s) who drafted that to properly attribute their intellectual contribution. Rather, the older category should have its name changed -- preserving its revision history. Geo Swan (talk) 22:01, 29 March 2014 (UTC)

IMO this is pretty non-controversial. The reason cited on the page was "Delete as a duplicate of Category:Curtis Scaparrottii which is linked from WP". Categories are frequently speedied across all WMF projects for the similar reasons (e.g. being moved/renamed), without any word-for-word public record of the nominator's rationale. I could restore it makes you happy lol, but this is kind of silly. -FASTILY 01:10, 31 March 2014 (UTC)
By the way, the category, in question, Category:Curtis M. Scaparrotti, has been recreated & redirected to Category:Curtis Scaparrotti, so this discussion is mostly moot. -FASTILY 01:12, 31 March 2014 (UTC)

Las monedas ostentan el sello del escudo nacional mexicano, y este está en dominio público, por lo tanto la imagen en la moneda lo está también. De lo contrario hasta las banderas hechas recientemente tendrían derecho de autor. El sello está en dominio público, por lo tanto cualquier otra representación u obra derivada lo está y puede ser usado libremente. Por otro lado las monedas que ostentan la otra cara como la 20 centavos de 1973 corresponde una cara a la imagen de la pirámide que ya estaba en dominio público y la otra cara ostenta en sello nacional también en dominio público. La ley contempla un período de 100 años, pero dicha ley entró en vigencia en 2003 y no fue retroactiva, es decir, las obras que ya estaban en dominio público ya no podrían tener derecho de autor ya que en México dicha protección tenía un período 30 de años después de la muerte del autor hasta el año 1982. A partir de ese año aumentaron las protecciones pero las obras en dominio público y sus derivaciones no podrían ser afectadas por las nuevas modificaciones. Ver [[1]]

There was no deletion discussion at all, unfortunately, but here is the information from the deleted page: a photograph made in Israel in ca. 1950 by an unknown author, no information on when it was published and whether it was in compliance with US formalities. It is PD in Israel since ca. 2000 (50 years after creation). I'd say it is unclear whether it is PD in the US, disregarding URAA, without knowing when and how it was published. --rimshottalk 22:00, 2 April 2014 (UTC)

At 22:00 User:Rimshot wrote " but here is the information from the deleted page: and mention that there is no enough information. At 23:22 User:Fastily closed the request with a decision "notdone". So quickly with out giving me a chance to answer. This is not right. On Commons:Massive restoration of deleted images by the URAA Fastily was again the decision. I hope that his decision here, was not influence by the decision there. If a picture was deleted with the only reason of URAA it must be undelete and if there other problem, the way to do it is to ask for a new deletion request that give other a chance to solve the problem and give more information. From my experience in he:wiki there are user that do not know how to supply the correct information. In such case I do not rush to delete. I first give a chance to supply the information that is missing.

These files were deleted by Ronhjones under the claim of Fair Use, however I can not find any evidence (looking through Ronhjones contributions) of DRs, these appear to have been speedied.

  • The Air Force Ensign is absolutely PD-old as it only consists of the Canadian flag with a blue field and a roundel in the fly. The roundel dates back to 1946.
  • The three other flags' possible offending elements are freely made independent renditions different from the official drawings used by the Canadian Forces, and therefore are not violations of copyright.
  • The CSA coat of arms was a 100% original drawing by Commons users as part of a Graphic Lab request, it is not copyrighted. Fry1989 eh? 00:52, 3 April 2014 (UTC)

@Fry1989: - I'd suggest you ask the deleting admin why, before coming here, or at least notify them that you have done so. In this case, the files were tagged as {{Non-free symbol}} on April 2 and speedy deleted 8 hours later. Speedy deletion of fair use imagery is OK under policy. It doesn't necessarily mean these files should have been deleted.
One thing I would say is if the "offending elements are... different from the official drawing" then these are inaccurate drawings, and therefore out of scope.--Nilfanion (talk) 10:38, 3 April 2014 (UTC)
They were unilaterally and incorrectly deleted without a proper discussion. @Mdann52, They are not Fair Use images and therefore do not qualify for speedy deletion. @Nilfanion, images being a different style does not make them out of scope, there are different ways of drawing heraldic images. We have many many coats of arms on Commons which are drawn differently from the style used by their respective governments, and are fully in scope. Please read Commons:Coats of arms. Now let me break this down:
  • The Canadian Spacey Agency coat of arms was a completely original work by Wikimedia uses as part of a Graphic Lab request, it did not offend the copyright of the official version.
  • The Royal Canadian Air Force ensign is not copyrightable, PERIOD. It consists solely of the Canadian flag in the canton on a blue field, with the RCAF roundel in the fly. The roundel is too simple for copyright, and even if it wasn't it's copyright would have expired under Canadian Crown Law because it is more than 50 years old.
  • The three other flags of the Canadian Forces are similar to the RCAF ensign, they consist of the national flag in canton on a white field, with a badge in the fly. These badges are not copyright violations or Fair Use, they are drawn in a different and free style per COM:COA which means they are allowed on Commons.
These images must be undeleted, they were wrongly tagged by Trackratte but they are not violations or Fair Use. Trackratte also tagged File:Naval Auxiliary Jack of Canada.svg for Fair Use and you can see that they did not provide any source or evidence for this false claim. COM:COA applies to all these images except the Air Force Ensign which is not copyrightable. They also tagged File:Royal Canadian Air Force Ensign (1941-1968).svg as "Fair Use" even though this image is also over 50 years old and too old for copyright any longer under Canadian law. Trackratte has no clue what they are doing, they tagged all of these images wrongly. Fry1989 eh? 17:40, 3 April 2014 (UTC)
Trackratte has marked both File:Royal Canadian Air Force Ensign (1941-1968).svg and File:Flag of the Royal Military College of Canada.svg as copyvios even though these are both too old under Canadian copyright law. This user doesn't actually know what they are doing, it may be in good faith but they don't understand the copyright issues regarding these images. They did not provide any reasoning or evidence in their tagging these images either. All these flags are PD under different reasons, they must be undeleted. Also regarding File:Canadian Forces Flag.svg, the badge in the fly of this flag is File:Canadian Forces emblem.svg, which Trackratte themself marked as PD because the crown copyright has expired, which means that the flag's copyright also has expired even if the emblem itself was not a free version per COM:COA. Current CF flags are protected under copyright and trademark laws of Canada. The Department of National Defence also retains copyright on and reserves permission to fly, use, or show any flag, pennant or banner previously authorized or used by or within any formation of the former Canadian armed services existing until creation of the CF in 1968. Permission must be obtained from NDHQ/DHH (Inspector of CF Colours and Badges) prior to any group, association, or person outside of the CF making use of current or previous CF flags

The statement in that box is not the statement of a free image (having to obtain permission to make use...). If you are all in agreement that the statement has no legal binding, then we can restore the images - alternatively, we could move them to en-wiki.  Ronhjones  (Talk) 19:52, 3 April 2014 (UTC)
In regards to the Air Force Ensign, that image is ineligible for copyright under Canadian law, due to both age and simplicity. As for the Canadian Forces Ensign, the badge in question was marked as PD because it's Crown Copyright has expired by the same user who marked the flag itself as a violation. It can not be both at the same time, and if they believe the badge is PD then that means the flag is too. In the case of these two flags, the actual Canadian copyright law should override any general disclaimers from the website of the Canadian Forces.
As for the other images, there are various other policies which mean these are not copyright violations, including COM:COA. Fry1989 eh? 20:06, 3 April 2014 (UTC)

Reading the actual disclaimer, it doesn't say anything outside of the law, I believe it was poorly written and also poorly interpreted by Trackratte. What it says is that Canadian Forces flags are protected under the copyright and trademark laws of Canada. It doesn't say they are protected in perpetuity, it says in accordance with the law. If the law says something is too old, then it is no longer copyrighted. Trackratte has shown trouble in the past with understanding copyright law and misinterpreting it. Deleted only per URAA, although all said images were in the public domain under Argentine law, were correctly tagged with PD-AR-Photo, and didn't have other information or copyright issues apart from the potential effects of URAA, nor were any of them mentioned in the respective DR. Other than that, the original DR made undocumented claims about what the proposer was purportedly told about the intentions of the Spanish Wikipedia community. Those arguments were taken as valid despite a considerable tendency towards keep within the participating contributors. Should have never been deleted according to the resolution of Commons:Massive restoration of deleted images by the URAA, and thus should now be restored. We need to be a little careful here. It's not immediately clear to me that all of these images were actually PD in the U.S. due to failure to comply with U.S. copyright formalities (and hence had their copyright restored by the URAA). If some of these images were published with a copyright notice, then they probably have always had a valid U.S. copyright (and the US is not one of the countries with the rule of the shorter term). It's my understanding that the recent decision was to not delete images solely because of the URAA, but are still deleting images that have always had a valid U.S. copyright (i.e. Commons hasn't decided to ignore the fact that the U.S. doesn't have the rule of the shorter term). —RP88 11:06, 3 April 2014 (UTC)

This image has been nominated by @Eleassar: as it is a non-free file. I don't know why he have thought that but he have nominated it. I guess he is been randomly nominating files without proper search. I can claim proudly that this photo has been taken by me and I haven't uploaded it elsewhere. He has not stated any proof that it is non-free. He haven't even produced a link so that it can be verified that it is non-free. I have seen in his talkpage that someone else have also claimed that Eleassar have deleted or proposed a file for deletion because it is non free but it was his own work (as far as I know). But what, exactly, constitutes "actual knowledge of infringement"? If community members have researched that a particular image or set of images has to be protected in the U.S. on URAA grounds because of its protection status in the country of origin on the URAA date, couldn't that be seen als "actual knowledge"? Good questions. The Board's statement was quite ambiguous IMO. There has been some clarification since from the WMF:
"[...] very few works on Commons are likely to be affected due to the various requirements of this statute. Indeed, to date, we have not received a single takedown notice under the URAA. A valid notice would provide us with the facts necessary to make a determination under the URAA. It requires information that may not be available to a Commons volunteer trying to make a decision without a takedown notice. So WMF does not see a reason to delete content simply because of general concern about the URAA." (from meta:Legal and Community Advocacy/Wikimedia Server Location and Free Knowledge), and
"Generally, however, community members are not likely to have the facts necessary to make a determination under the URAA. [...] It would be really difficult to know whether a work originally entered the public domain in the US because the author failed to provide proper notice or comply with a manufacturing requirement." This implies to me that they see our research as unlikely in most cases to definitively establish whether the URAA applies, and that they are suggesting that takedown notices provide a better mechanism for establishing when such images need to be deleted. Yann, Russavia's point may have been undermined by tone, however there are legitimate issues:
  1. Have administrators choosing to undelete these images been appropriately advised as to their personal liability for future claims of damages for doing so?
  2. Will the WMF legal fund be used to fully protect administrators taking undeletion actions, or provide a firm guarantee to underwrite financial support, where the URAA is a factor in any future claim?
  3. Has the WMF provided credible legal advice for administrators who choose to ignore the URAA?
  4. Will uploaders be solely liable for all future claims of damage in relation to the URAA or does the WMF underwrite this liability on behalf of all volunteers?

Are you sure on that, the relevant part of 17 U.S. Code § 512 c 1 that says the service provider shall not be liable for monetary relief, if that provider does not have actual knowledge that the material or an activity using the material on the system or network is infringing and upon obtaining such knowledge or awareness, acts expeditiously to remove, or disable access to, the material; a DR here pointing out that a the material is copyright in the US, would clearly be knowledge and then deleting it after the DR would be acting to remove. 3. Uploaders: I think uploaders are responsible for making copyright violations. (It is just like a photographer publish a photo of a new building where "no FOP" is applicable. Here only the photographer is responsible for the crime; not WMF or our other volunteers.) So we need to delete those files if uploder requested. But we need not overact if they are consciously doing so. @: , my tone is actually brutal directness and honesty. The WMF couldn't organise a root in a brothel with a pocket full of cash and a hard-on. Quite seriously, we have the Chair of the Board of Trustees basically advocating a SOPA-like protest against URAA, even though they challenged the law in the courts and lost. We are hosted in the US; and therefore have to abide by US law. This was made absolutely clear in the Legal "brief" to the "community". Advocating a SOPA-like protest is ridiculous...let the BoT put that to this community if this is something they want to pursue---but we should not be using our projects for protest against something that has already been ruled on by the US courts and which will only do damage to our reputation as a reliable host of freely licenced media. Both the BoT and the Legal department only speak on how things will affect the WMF; as editors and projects we are on our own. That quote is still odd to me. It's correct that we may not really know if it ever went into the U.S. public domain in the first place, but in many situations the only two options are 1) it went into the U.S. public domain, but was then restored by the URAA and is now under copyright, and 2) it never went into the U.S. public domain and is therefore still under copyright. In either case, it would still be copyrighted... so I'm not sure how that can leave room for a keep decision. Or are they staying we can never assume it went into the U.S. public domain in the first place? That would actually result in more deletions than before. Las monedas ostentan el sello del escudo nacional mexicano, y este está en dominio público, por lo tanto la imagen en la moneda lo está también. De lo contrario hasta las banderas hechas recientemente tendrían derecho de autor. El sello está en dominio público, por lo tanto cualquier otra representación u obra derivada lo está y puede ser usado libremente. Por otro lado las monedas que ostentan la otra cara como la 20 centavos de 1973 corresponde una cara a la imagen de la pirámide que ya estaba en dominio público y la otra cara ostenta en sello nacional también en dominio público. La ley contempla un período de 100 años, pero dicha ley entró en vigencia en 2003 y no fue retroactiva, es decir, las obras que ya estaban en dominio público ya no podrían tener derecho de autor ya que en México dicha protección tenía un período 30 de años después de la muerte del autor hasta el año 1982. A partir de ese año aumentaron las protecciones pero las obras en dominio público y sus derivaciones no podrían ser afectadas por las nuevas modificaciones.

I met Aled Roberts AM at a local event and, with his permision, took his photograph for the Commons. When the image was flagged for deletion, I sent the message below to permissions-commons@wikimedia.org to clarify that I was the author but got no response.

    The undeletion request is for File:1918 Christmas Seal.JPG, not File:SL bohnfellow.pdf. The latter was linked simply to show evidence of the stamp having been published before 1923: publication in this instance being sale of the stamp to the general public.

Dear Sir,

I am not sure why my photo of Rockie Fresh was deleted. The source was given, Peter Chiapperino, and the uploader was the same person. The photo was taken on November 23, 2013 at Nextdoor, a night club in downtown Honolulu of which I am the house photographer for. This can be confirmed a number of different ways. Please feel free to google image search "Peter Chiapperino." Or look at the Nextdoor HI facebook page on November 23, 2014. You will notice that my work on facebook is watermarked as Photocyclone. My name is Kevin Pereira. I am the owner of the photograph "Kevin Pereira 2012 Headshot.jpg", which was from a commissioned photo-shoot by Miko Lim. Miko has publicly tweeted the photos, and I have uploaded this headshot as it's a higher quality, more recent representation of me than the old photo that has been reverted to on my Wikipedia page.

I have attributed the photo to the best of my ability and tried to select the best "license" for the photo as possible.

If you can offer me some guidance as to how to prove my ownership, I would gladly do so.

Can I print the photo and hold it up so you can see it's me? Do I need to scan a receipt from the photo-shoot? Draw blood?

Please let me know so I can avoid the photo being deleted/flagged and secure a more current picture for my page.

Hi. This is a photo of my daughter Cassidy Wolf. She had won Miss California Teen USA 2013 when this photo was taken. I checked with Raphael Maglonzo the official photographer for Miss California Teen USA. I could not remember if I took this photo myself at the event or if he took this photo. He said he took it and gave me permission to use this photo.

Please advise what other information I need to provide. I worked through updating her information (which has lots of incorrect information) yesterday and someone removed all of the changes that I applied. I updated her photo to reflect one of her crown photos vs. a non approved (audition only) photo that was never approved for any publications. The swimsuit photo was taken only as a snap photo in an intial audition, which she never booked this job, per her choice. It is in appropriate that this photo is currently being used to represent my daughter, it is not appropriate.

I also want to point out that the Flickr page has been active since 2009 and all of their photos are under the same license. I doubt that a intern or publicity agent has been working for them for 6 years made a mistake like that every time. we also have many of their photos on wiki commons and have been using them for years, I'm sure if they didn't want us using their photos they would have contacted us a long time ago and asked us to removed them. so i don't see any reason why this photo had to be deleted. We can't take a vote to ignore a law because we don't like it which is what Commons:Massive restoration of deleted images by the URAA was. If the WMF does not like the law they need to work to change it, perhaps by having the US adobt the rule of shorter term, but ignoring it is not an valid way forward. The reason stated in a previous discussion was that there was suspicion of "Flickrwashing". The user who uploaded this to Flickr, DianesDigitals, has been a reliable source for photos in the past. You can see a list of photos that are from that account, many of which appear to be from the same wrestling event here. The user has uploaded many more photos from the same wrestling event that this picture was taken, including more featuring The Ultimate Warrior, which they chose not to make available for free use. Many of these are of poorer quality, but Warrior appears in the same attire, and it is at the same venue. It's far more likely that the websites which used this picture got it from this very source, otherwise it would be hard to explain how this user was able to take similar pictures themselves only to steal the one which they made available for free.LM2000 (talk) 21:02, 11 April 2014 (UTC)

I was only objecting the deletion reason. If it is used in one wikiproject in any way (maybe to illustrate a point in discussion or to be used in some user's user space) it falls within Commons' scope. Part of that discussion page now lacks context because of the deletion of this photo. I hope you are not suggesting we should delete that discussion page as well because is pretty useless after 8 years? Several weeks ago, I followed the procedure for clearing this photo for Wikimedia publication -- that is, I arranged for the statue's creator to e-mail the stipulated release agreement to Wikimedia. As of today, the photo has not been undeleted. Is there anything else I need to do to get this accomplished, so that I can replace the photo in the Gibson article? I understand that this area is manned by volunteers and may simply still be in queue; but it has been several weeks. Any enlightenment would be appreciated. @Sdegroisse: My French is rather rusty, but it looks like all of the permission checks out, except the images are not released under a particular license. The letter just claims to release them under a "free license" but not a specific one like one of the Creative Commons or PD. I would check with your photographer to make sure of what license the museum and you release the images under. I've responded to the OTRS email, but my French is not so good. It in doubts, please ask another OTRS member (one with commons sysop rights) to revise the ticket (ticket is unlocked). Or, please, send the questionable files to the OTRS for comparison.     • Yes, we know who the user is (identity), but neither the email headers nor the user's stated affiliation are the Living Transylvania Organization. This is like having someone with a verified Coca Cola email address trying to assert permission for an image with a Pepsi watermark. We need the organizations to match - that a Coca Cola affiliation is confirmed is not germane. If he can send provide evidence that he is also an agent of the Living Transylvania Organization, then the issue would be resolved (for the former image anyway). The description on grounding (electricity) about what an earthing mat (also known commercially as an ESD mat) was significantly inaccurate. As someone who works in the static control industry I would not rely on the description that was there. This image illustrates how the parts work together to actually ground static electricity on your skin and the mat's surface.

I would recommend to any patrolling admins to close this as not done. The source given for the file [20] clearly states "Copyright © by Indian Navy Information Resource and Facilitation Centre All Right Reserved". The copyright notice states that "This website is Designed, Developed and Maintained by team of the IR&FC, Integerated Headquarters Ministry of Defence(Navy)... Material featured on this site may be reproduced free of charge in any format or media without requiring specific permission.... However, [this] ...does not extend to any material on this site, which is explicitly identified as being the copyright of a third party." I'm genuinely curious why this user page was deleted. I don't have any skin in this game, so to speak, but I wonder what precedent it sets. Per COM:PSP, "User pages are generally reserved for personal profiles [...]". That's precisely what this is: brief facts and information about this user - not in an article format and not obsessive. How was this profile meaningfully different than some of these (random) admin user pages: user:Alison, user:Cecil, user:Jameslwoodward, etc.? Эlcobbola talk 16:22, 25 April 2014 (UTC)

  • Although I think this was deleted correctly for the reasons given above, it raises a broader question. Should we require that before a user creates an elaborate user page, that he or she actually contribute to Commons? From time to time I see user pages that are the only edits the user has made here. We are not Facebook, and it seems to me that such pages should be deleted. Of course, if they violate COM:ADVERT they will be deleted, but I think that this page should have been deleted even if it did not have private information. COM:PSP gives a little support for this view, "regular Commons contributors are allowed a certain amount of leeway", but I think we might want to go further.
I also think it would be useful to prohibit any personal images until the user had made 50 edits on Commons. This would give us a fast way to deal with the increasing number of selfies that we are seeing from users who do nothing else for us..     Jim . . . . The first of these has not been deleted, although it will be soon if it does not get a proper license. The second does not exist and never did. In either case, being from a family photo album does not make it eligible for Commons -- owning a paper copy of a photo does not give you the right to license it here. This file has a smaller size and no artifacts, but was deleted by request of the original author, Ralf Roletschek, who appears to have a grudge against PNG and SVG files. --Jimbo1qaz (talk) 18:20, 27 April 2014 (UTC)
