Images from Flickr

Hello Tabercil. I am not a native english speaker, and my knowledge about licenses and authorizations is very limited. Images from flckr are often uploaded on Commons, and there is a lot a images of actresses on "flickr" (for example by the user morbisthoughts, here) ; do you know if we can uploaded them too ? WWE Flickr photos

Just to let you know that I've put the Flickr WWE photos you uploaded up for deletion. The author of those photos has changed the licensing over to All Rights Reserved this week, making it no longer free. --Oakster 19:34, 23 January 2007 (UTC)

I'll drop the author a line. I've a number of emails from him which make his intention clear to have the picture available on Wikipedia; the earliest one I can get my hands on is this one:

Subsequent emails also document some frustration with the process of how you go about changing the license on the pics on Flickr. I suspect he went to change the license on the non-wrestling pics to "All Rights Reserved" and accidentally caught the wrestling ones up in the change. In the interim, I will contest the deletions. Image James McAvoy and other pix from lukeford.net

Dear Tabercil, I'm sure you didn't do this on purpose but most of the images you have uploaded from lukeford.net are copyrighted by Getty Images, Wire Image, etc. I read the permission from Luke ford that you have posted which says you can use pix photgraphed by him. the problem is the pictures you have taken from that site have been taken by other photographers.

For example, the photo of James McAvoy was taken on December 9,2007 at the Hollywood's Life Magazine's 7th annual breakthrough awards. If you go to the lukeford.net that you provided on the McAvoy page and click on the link "More pics" just under the photo of James Mc Avoy, you'll be taken to page of photos taken by Getty photographers at the event. On that page you'll see the pic of Mc Avoy that you uploaded. ...under that pix the photographer's name is listed, which is Charley Galloy (not Luke Ford).. so regretfully this great pix of McAvoy must be removed as it owned by Getty

You have uploasded so many pix from that site and frankly, I don't have the time to check out the copyright status of all those pix....I leave that task to you.....but the majority of these pix were not taken by Luke Ford and most of them are owned/copyrighted by Getty, Wire Image, and other stock photo companies.   • Bullshit. Luke is simply linking to photos taken by other people at the events! Look... here is all the photos taken by Galloy which are on Getty Images of James McAvoy. Long list as it's exactly one image. Here is the full set of photos taken by Luke at the event. If you peruse through all those photographs of Luke, you will see only two images: this one and this one. NEITHER of the images present on lukeford.net matches the image present on Getty Images. Image Jennifer Love Hewitt

Dear Tabercil..it's me again, i.e. danwex... the photo of the lovely Jennifer Love Hewitt that you uploaded was taken by Michael Tran for Getty Images and must be deleted.   • This is asinine. The reason Luke Ford was able to take those photos was because HE WAS THERE! Look... here's the list of photos taken by Mr. Tran at the 27 Dresses event for Getty. NOWHERE on that list of images are the ones that are present on lukeford.net! If you're going to accuse Luke of plagiarism, you need to point to specific images which are identical! I've emailed Luke about your statement re: Jennifer Love Hewitt. His reply to me in it's entirity:

Well, on some of the events, I have video as well and you can hear my voice. Not on this one in particular because I did not take video of that event. The guy is nuts. Getty Images pics are watermarked...and decidedly better quality than mine. These photo agencies aggressively police their images. If you had been using their images, you would've heard from them.

You can see the complete list of events that Luke did attend in person here. And one such example of where Luke does have video would when he did the red carpet at the Pink Eye premiere, which can be found here.

There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful informations about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Uploading a new version of the file does not change the description of the file. This page may give you more hints on which license to choose. Thank you.

Odd. Image got deleted although the issue may have been resolvable. When the image was uploaded here, the flickr license was cc-sa. A couple hours later it was changed to cc-nc. I've contacted the flickr user; waiting for a reply. Gimmetrow 11:14, 27 May 2008 (UTC)
I contacted the user about changing the license on the image he had of Cynthia Nixon on his page. Then he emailed me about this image, which we couldn't use. But I spotted a similar image on his page which did have the proper license and uploaded that... let me know what Staneky comes back with. Tabercil 13:14, 27 May 2008 (UTC)

Well the image that I uploaded was a crop of the larger original in order to focus on Kristen. So if we were to change the source of the image from the borderless image to the bordered one, we'd be completely in the clear, right? Tabercil 00:25, 30 May 2008 (UTC)

I wish I could provide you with more info, but to be honest, there's not really anything on OTRS accept for some vague accusations that the images from Luke Ford's site(s) are not his. No site emailed OTRS about false licensing, AFAIK. From what I can gather it was one person's speculation (who could be right) and the only "OTRS" suggestions on OTRS were to put the whole collection up for deletion and not allow future uploads under that ticket until it can be verified—both of which are perfectly acceptable actions and are what should have been done (a deletion req., not a behind-the-scenes speedy deletion). Anyway, I'll encourage those involved to come forward and help us solve the issue. Rocket000 (talk) 06:03, 28 June 2008 (UTC)

Luke Ford thing

Thanks for helping sort this all out.

Following your lead, I had uploaded many additional Mika Tan pics from Luke Ford (and spent considerable time getting her wikipedia page in shape as well).

In any case, I see that most (all?) of the files in the Category:Mika_Tan have been restored, so I'm going to start fixing pages that linked there - unless you tell me not to (e.g. some script will be taking care of it).

Nudity?

Would it be possible to replace some of the photos you uploaded int the 'striptease' section with versions that blur out slightly some of the nudity. It would still be identifiable as to what a striptease really is but just make it a bit more child/family friendly.

Dear Tabercil, Please take a look at the images uploaded by Guzzzz (talk · contributions · Statistics), Baddin (talk · contributions · Statistics), Scoobydoo (talk · contributions · Statistics) and Augusto Penatti (talk · contributions · Statistics). Most of the images they upload are copyrighted. Now, the user has reuploaded some of these images on Flickr with an "attribution license", but in fact the images are not even his! I believe it's an old case of sock puppetry: [3], [4], [5], [6], [7] and [8]. The users Guzzzz (talk · contributions · Statistics), Baddin (talk · contributions · Statistics), Scoobydoo (talk · contributions · Statistics) and Augusto Penatti (talk · contributions · Statistics) cannot be trusted. Joan Allen/Joely Richardson image

Hello Tabercil, I only ask you this because I see that you have worked on this image and I'm not sure what to do.

File:Joan Allen at the Bourne 3 premiere.jpg is named as a picture of the actress en:Joan Allen however an editor has noted that it is not her, but en:Joely Richardson, and I think that is true. I'm not sure how to fix it. Should it just be uploaded again with a different file name and have the incorrect file name deleted? Is it ok to do this and just copy the licensing/confirmation information from the first image to the second. I've never seen this sort of mistake before. Yup, that's her. I checked against Getty Images to see if Joely was there and if so, what she was wearing (and no, we don't seem to have a copyvio here). Defaultsort fouled up filing

Hello! Sorry for not leaving this at enWP but I do not use that project. You added a DEFAULTSORT to 3 images I uploaded: Ewa Fröling, Eva Bysing and Berit Carlberg. The thumbnails then began to appear misfiled on our category page at Category:Southerly Clubs Image Archives. I don't know why that happened, but I had to remove your last input on each image page to get them back in the alphabetical order I want them in there. Any ideas as to what went wrong? Defaultsort applies the sort order to all the categories in question for the picture. I was working on sorting out the pictures in the Category:Actresses from Sweden and hadn't realized that the Southerly Clubs Image Archive had their own sort order. Basically, any free use media is allowable here. This does not mean any old image you may stumble across on the Internet! What it means is it an image which has been placed in the public domain by the author. For instance, this image on my Flickr account has been placed in the public domain by me, as you can tell by the information in the "Additional Information" section. Also, pretty much any image that was created by an employee of the United States government during the duties of their job is in the public domain - that's why we have so many images that were taken by the U.S. Armed Forces (such as File:GuadLungaCleanup.jpg). What I would suggest you do is to read through Commons:Licensing for further details and a more thorough explanation than I can give. Tabercil (talk) 14:37, 28 February 2009 (UTC)

      • I assume you're referring to File:Taylor1.jpg. I looked back and found your original upload - File:Taylor.jpg. That was no my deletion - instead it was tagged by a different person as source missing and deleted on that basis. The problem is, you have only yourself to blame for that. All you other prior uploads of copyrighted material were tagged as "Own work". For example, File:Vinatieri.jpg had a source of "own work" but was found to be from here. Another example: File:Peyton-manning-orchestrates.jpg was found to be from here but you said it was "Own work by uploader". So I guess those admins no longer believed you when you said that Taylor1.jpg was your own work... after all, you lied at least twice about where an image came from. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]
[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

  • It's simple. I deleted the photos as I felt they were out of scope for Wikimedia Commons. As it says there: "Examples of files that are not realistically useful for an educational purpose: Files that add nothing educationally distinct to the collection of images we already hold covering the same subject, especially if they are of poor or mediocre quality." In fact, you're not getting away as easily as an apology and removal of your tag! :-) As penance (and so this doesn't happen again), I would appreciate it if you would go down the following list of PicasaWeb images I've recently uploaded, check that they are, in fact, licensed the way I say they are, and stamp them with the official template:Flickrreview Trusted User Seal of Approval, so the next Flickr-experienced-but-PicasaWeb-unknowing admin doesn't tag them the way you just did. The link to the Creative Commons license is on the right hand side, under "Photo reuse", with the text reading "some rights reserved" and much the same Creative Commons icons as Flickr uses.

No problems. I'm always a shade suspicious of files from Flickr, especially when they're of the "too good to be true" sort. So when an account has a great photo, and only two images present, I'll do the digging needed to prove or disprove it as being a copyvio. I'm looking at Commons:Project_scope#Censorship which says
"Photographs of nudity and male and female genitalia are sometimes uploaded for non-educational motives, and such images are not exempt from the requirement to comply with the rules on scope. Often (but not always) such images add nothing educationally distinct to the stock of such images we hold already, and hence fail the test of being realistically useful for an educational purpose.
"A balance has to be struck between on the one hand accepting legitimate new high-quality educational content that some may find offensive, and on the other allowing Commons servers to become swamped with large quantities of quasi-pornographic images created for recreational rather than educational purposes. The latter would harm the reputation of Commons as a good faith provider of educational content."
That's official policy. If I can look at an image and say "that's an image we can't make use of" specifically regarding a photo of male or female genetalia, then I feel I can speedily remove the image. We are not a photo host - if you want to put your picture of your junk on the net, use Flickr. We are a photo host of educational material - there is a difference. A cookie is a way that a web site keeps information on a web browser, in this case your wikimedia user login status. Your web browser seems to be set up not to accept cookies, so wikimedia can't log you in.
Different makes and versions of web browsers have different places to control whether cookies are accepted. One version of Firefox, has a Preferences dialog under the Edit menu, where, under the Privacy tab, you need to make sure "accept cookies from sites" is selected. (Or you can try to just accept cookies from wikimedia and wikipedia sites, but that can be complicated.) On one version of Internet Explorer, you can find something similar under the Tools menu, Internet Options dialog, Privacy tab. Okay, looking there for the source for the image takes me to this page, where it can be found at the bottom. Comparing that to the American box cover image found at the very top of the page makes it very clear that the image in question is nothing more than the box cover artwork minus all the extraneous artwork, so that only the characters remain. Since the original box cover is definately a copyrighted image, the Mario Bros.png image is equally a copyrighted image. So there's almost no chance of this being undeleted. Sorry dude... Flickr TIFF09

Dear Tabercil, you've recently uploaded images of the tiff09 event from Flickr. Could u just please when naming file use the preexisting scheme? ("Name" "Film" "TIFF09") ? Cause it happens a lot that the same actor/ress stars in two different films at TIFF09 whereby the naming of the Film would help. Umm... that's news to me - that we have an existing scheme. Considering how most files here tend to get named any which way... I mean, take a look at any category featuring a celebrity. The reason I uploaded the files using the names I did was so that I knew that it would be most unlikely that there would be any conflict with an existing image. It also helps that I use Magnus' Flickr bot (which I find works much faster) because it will rename the upload if there is a conflict. Lastly, I think I've had a history of success with getting uploads to Commons. <G> Tabercil (talk) 03:15, 15 September 2009 (UTC)

Commons:Deletion requests/Waffen-SS Sinimäed

Thanks Tabercil for taking care of this. There is still one problem I can see remaining, the image description you chose seems unfortunately misleading: "including Estonian Waffen-SS members" implies like there is/were Estonians who were members of the Waffen-SS - condemned as a criminal organization. Unlike the reqular Waffen-SS that consisted of volunteers, the Estonians who got conscripted into German military forces by the end of the war and were put by the Germans under the Waffen-SS umbrella only because 'racially not pure foreigners' were not allowed to wear the Wehrmacht Uniforms were by no means any 'members' of the Waffen-SS but conscripts drafted during the general mobilization call by the Germans in occupied Estonia. I do think that the vets who were put under the Waffen-SS command against thier will would find it highly offensive to get labeled as the "members of the Waffen-SS". Therefore I'd suggest clarification on the image description: Instead of "including Estonian Waffen-SS members" lets say "former Estonian conscripts in the W:20th Waffen Grenadier Division of the SS (1st Estonian). Just because an image is on Flickr as having a Wiki-friendly license does not mean that it is usable on Wikipedia - see COM:FLICKRWASHING. The NBA logos are all copyrighted images owned either by the team itself, or by the NBA. Movie Poster for No one's normal when you're near

Hello, you've erased the file De_cerca_nadie_es_normal_poster_english.jpg wich I uploaded, saying that it was an infringement, because it was a movie poster.

The thing is that I made that poster myself, and that's why I stated that it had that license. I understand that you might not believe this, but I really don't know in which way I may prove this to you.

(Copy of the answer I left at the User's page): My apologies. When you see so many people uploading clearly copyrighted material and saying "I created it", you grow jaded at the claims...  :/
What I've done is restored the poster, and added an OTRS-pending tag to it. What I would suggest you do is to read the instructions at OTRS to make sure what you need to say. When you send the email, state in it that you are the person who created the poster and as such you have the ability to put the poster in the public domain. (Note: I'd suggest making sure this is okay with the people at NoMade Films first). Once that email is received, then an OTRS volunteer will tidy the image page up and you shouldn't have any future problems with deletions.

If you take a look at the page for the file, you'll see my rationale for the deletion - Flickrwashing. A quick search via the TinEye website shows that the image can be found on 28 other websites, and that's just the ones that TinEye indexes. Given the high number of hits, I would say that the image was not taken by the Flickr user named Math Luis and as such he does not have the authority to issue the image under the Creative Commons license. In fact, I think the image is a publicity photo from the Charmed TV series and that copyright lies with the producers of the show, who are most certainly not Math Luis. Heart Truth Flickr account

I believe she updated licenses for the 4 new images from Feb. 2010 that figure into The Heart Truth Wiki page. I personally take the "Year in Country" as referring to events that happen in that country, not about events that relate to that country and by doing that we help keep focus on what the category is about; otherwise it would get rather diffuse in a hurry. I mean, by your reasoning, if we have someone from a different country in a sporting event, then we would need to add the "Year in Country" to that sporting event. So, no. Ah. Those site are pretty much magnets for images from wherever, and frequently those images will have originally come copyrighted sources. Additionally, the madonnalicious.com site states that "All logos, images and pictures on this site are the property of their respective owners.", so the images are not available under a Wiki-friendly license. Simple. It's the people who originally created the workout show. If you take a look at the YouTube video, you can see there's a blurb at the bottom saying "Aurora". I see that as being a station ID mark, which indicates it's from a broadcast TV show. Since the overwhelming majority of recent TV shows are copyrighted, it's safe to say this clip is copyrighted. You'll need to write to the person whose Flickr account it is and ask them to change the license. Most of the times they'll do the license change on the Flickr page itself - for instance look at this image. You'll see that it has a Wiki-friendly license on the Flickr page; in contrast, the image immediately before it in that set (here) does not have such a license. Other times they'll agree to the use of the image, but won't change the license on the Flickr page. For instance, this image is still tagged as copyrighted, but the user emailed me a statement saying we could use it under our terms. So it's viewable on Wikipedia as File:Anna Wallner.jpg. But there's no guarantee they'll agree to use on Wikipedia - I get a success rate of about 1 in 3 when I email folks asking for the license change. I think I'd better add that the copyright being violated is that of the creator of the waxwork. In many countries people have the right to make 2 dimensional representations (such as photos) of public sculpture, but not in the USA. Because the image can be found elsewhere online - a TinEye search for the image comes up with two results elsewhere. As a result I don't think the person who's account it it has the rights to put the image up with the CC-By-SA tags, and that's called FlickrWashing. Tabercil (talk) 12:34, 15 October 2010 (UTC)

Obama and Snooki images

Which is why I check which articles use a given photo prior to altering it. If I find it being used by articles in which the altered version would be inapplicable, then indeed I will upload the altered version separately. This was not the case with the Obama or Snooki photos, which are only being used in articles where the cropped versions are of better use. This is why I don't see why the considerations you point out apply to those two, nor why you and he decline to answer my quite reasonable question: If uploaded new versions over the old ones is not desired, why does every image file's page present a tool for doing so as an option? Using a tool whose link is on the same page as the image is far easier than one on a different page, and as long as that option is there, I'm disinclined to create new pages for each version of an image, particularly given the number of images I alter (most of which ones I take for use in specific articles). Well of course the Snookie image wasn't used in the terms I had described, but that kind of illustrates my philosophy. In terms of overwriting versus creating a new image, my personal philosophy is that an image should only be overwritten when the changes made are "minor". Now minor is one of those YMMV terms but I see it as more as a non-destructive clean-up (e.g., adjusting the exposure or some noise reduction). Cropping is a more significant change in that it removes data from the image and thus alters where the focus of an image is. I don't make use of the overwrite function given - I use instead the "derivitive version" upload bot for all the stuff which I create. Tabercil (talk) 23:20, 30 October 2010 (UTC)

Very good work, spent already some minutes on that to find it. That kind of contribution - grabbing a press photo and uploading it with some innocent information like 'personal' 'snapshot' (and repeating it 3 times) etc is evil vandalism. Sockmaster Shinas/Anwar Sadaat

Thanks for helping me.:-) This is the SPI report in en.wiki - en:Wikipedia:Sockpuppet investigations/Shinas/Archive. en:User:Anwar saadat is the sockmaster. These are his image uploads in en wiki. Once he was banned he opened the User:Haizum account and uploaded his last two uploads in en wiki to commons. He also opened an account in Tamil Wikipedia. He is currently following me around and disrupting my contributions because i filed the SPI report. What's wrong with the source Flickr account? I checked COM:QFI, and http://www.flickr.com/people/plushev/ isn't on it. The account itself is marked as a professional account, which I thought explained what he was doing backstage at a photo shoot, and the image is large size, and has full camera EXIF data, which isn't usually the case for images just downloaded from somewhere. Hello Tabercil. Sorry to bother you, but you left the "no permission"-badge on the picture mentioned above. I'm a total newbie in Wikimedia Commons and I didn't know who to ask. The picture was taken by a professional photographer commissioned by Family Trümmel (the girls on the picture are Sandra, Susanne and Tanja Trümmel ... a german band of the late 80's called SST) or their music company. Mr. and Mrs. Trümmel assured me, that they are the rights owners and also send this information via mail to permissions-commons-de@wikimedia.org on 04/07/11. There's no problem with the image. It's just that they haven't gotten to the permission statement yet in the OTRS queue. The image was deleted as a probable copyright violation as it could be found elsewhere online, such as here. Indeed, when you compare the image at that site with what you uploaded, there are almost bit for bit identical except for one small difference: the pic at Flixster has a small watermark at the bottom right whereas there is a clear edit made to the same location in yours where presumably that watermark was erased. We need proof that you are indeed the photographer of the picture - easiest thing to do is to follow the instructions here. It'll also be easiest if you were to upload the photo by itself rather than the final CD cover - that way we don't have to contend with issues about whether we need the permission of the graphic artist who designed the cover. Then there is this clear evidence from this Venice festival all taken from the same camera in September 2009 Festival du Cinéma de Venise#page=0 here and all licensed as "cc by sa generic." It seems possible that nicolas genin hid that particular image after he saw it being used on Commons. Secondly, if you are Zil, then you could backdate a flickrpass to your name to December 25 2009 and save everyone from some difficulty. (after all you saw that image 1 day after upload--if it had an uancceptable license, you might have failed it) If not, just say in the image talkpage that you did not flickrpass that image on December 25, 2009...which would mean the uploader typed in a fake flickrpass. The same flickr owner has also hidden/deleted those images now. So can you please just type in a backdated flickrpass for the last photo below to December 25, 2009 and remove the npd tag...as you Typed in a flickr pass for it too. It just didn't show up since there was no closing bracket. I gave you evidence that you passed 2 other images from the same flickr account and that the flickr account owner licenses his photos from his Venice 2009 set as "cc by sa generic." Is that not clear evidence enough. Plus your typed in flickrpass dated to December 25, 2009. If you want, you can cite the evidence I listed above but please save this picture below.

OTRS for images

That may be, but I cannot be sure about it, as anyone can add an OTRS pending tag, even if no OTRS permission was sent at all (yes, it has happened). If a permission was indeed sent, an OTRS person will decide, and any admin looking at the file will ask OTRS before deleting anything. Until then, those are images marked as all rights reserved on Flickr. The tags serve as a reminder to not forget the matter. Regards

Rosenzweig is right in that there's no OTRS statement backing the use of the image up. In general, with images from Flickr I prefer to get the account holder to change the license at their end - avoids the hassle that you're encountering now. If you can't get that license change on Flickr, then you need to pass along the statement of consent to OTRS and in this case, you say you haven't yet. And Rosenzweig is right that the tags do need to stay there as reminders that OTRS clearance is still outstanding. Tabercil (talk) 15:26, 1 May 2011 (UTC)

The problem with the two files I tagged was that you simply stated that the source for the images were "Hamilton County Jail" - we prefer to have a direct link to the exact page(s) from where the images were taken so we can verify where the material came from and what license it is present under. I just called the Hamilton County Jail to confirm my previous understanding and their proceedure is for the individual requesting the mug shot to call in give the name of the former inmate and they e-mail you the mug-shot. They just don't post them on their website (they said they weren't technically set-up that way because of cost).

If they have to email the mug shot to you, the best thing for you do then is to follow the instructions here... though you'll probably have to make sure that the mug shot is public domain first as your earlier uploads were deleted by a different admin with this for the rationale: "alleged source doesn't show the image and anyway is a state (not federal) facility and claims "© 2010, Hamilton County, Indiana - all rights reserved" Tabercil (talk) 17:10, 26 May 2011 (UTC)

Greetings, back on June 14 you issued a final warning to User:Editor2205 regarding multiple copyvios. While it it put a temporary stop, the problem has started again with at least 3 copyvios in the last week. As the user has never used an edit summary either on Commons or English Wikipedia, or responded to any warnings except to delete them from the user page, I suggest a block may be necessary. I think the user in question is trying to do well, given that at Commons:Deletion requests/File:Jennifer Aniston in 2009.jpg he/she agreed that the image uploaded was a copyvio. Back in February you wrote that the owner of the flickr-id from which Obiwolf images were downloaded wrote to you to request the deletion of those images.

Could you please clarify -- how did they write to you? Do you also have a flickr-id, explicitly tied to your Commons-id? Did they write to you using the WMF software's "email" button? Or do you have your real world email published in the clear somewhere?

It has seemed to me that many of the claims to be the subject of a biographical article, requesting deletion, or claims to be the photographer who initially took an image, and requesting deletion, are spoofs, hoaxes. I suspect that some significant portions of the messages sent to the OTRS team, confirming permission for external images are also spoofs, hoaxes.

Many attempts to delete the Obiwolf images have been initiated since you initiated yours. Most or all of those deletion attempts have an IP address claiming to be the initial flickr uploader, claiming he didn't get the right permissions from his models, so the images should be deleted.

Because we are vulnerable to being spoofed I think all claims that a real world individual is weighing in in our discussion should be confirmed through OTRS. I think any claims not confirmed through a thorough OTRS test should be ignored. I think they should be THOROUGHLY confirmed, because apparently some OTRS team members are clueless about how easy it is to create a webmail ID, and have accepted email from joe.blow@gmail.org, or joe.blow@yahoo.com, as confirmation that they were contacted by the real world Joe Blow.

Although this IP address has had six months to confirm their real world identity through the OTRS team, I don't see any evidence they have tried to do so. I suspect the IP address who keeps claiming to be the flickr uploader is actually a regular Commons contributor, a rogue one, willing to use dirty tricks to win arguments. I plan to initiate a check user request on this IP address.

So, would you please indicate how the flickr person first contacted you?

I do have a Flickr account (http://www.flickr.com/photos/44775455@N00/), which is used both to hold my own photographs and also as a means to contact others to ask for license changes for Wikipedia. What I did back in February was wrote to the Flickr account of the original uploader asking for clarification. As far as I know you can't forward the internal Flickr mail conversation to another account that's outside of Flickr, but my Flickr account there is set up that it forwards any Flickr mail I receive to one of my personal email accounts as a heads-up. I sent that forwarding message along to OTRS back in February but I don't think I got a reply back with a ticket # at that time... if you drop me an email, I can kick what I can along to you. It's not your fault that it got deleted - it's just that the image originally came from the American Idol website at http://www.americanidol.com/photos/season_9/finale/finale_performances/47485/ (photo #33). An image I have loaded from the same source at File:JasonBonham2010b.jpg has had a question raised over its permission status, essentially that the licence is valid, but the account is chickswithguns, while the photographer is Karen Curley (in this case with both on a copyright watermark). My question is, when you downloaded this file did you obtain any further clarification over permission? Could you check this image? It's the user's only upload and their contributions on En have only been to one article. They insist that they own the rights to the image and I can't find it on Tineye. It is suspicious, especially given what the EXIF data looks like compared to a proper image and the fact that the uploader had an earlier image of Katie deleted. Hmm... it looks like all the images present on the Hispanic Lifestyle account on Flickr have that copyright satetment, not just the celebrity ones. For instance, if you check this image of a penguin at a zoo, you'll see the same copyright statement on it. Additionally, from what random checking I did, all the images present have the same Olympus E-510 camera model used on it. I'll check just to be certain. The owner of the company, Willie Buck/William Crawford has already had a member of his staff issue the picture to commons OTRS for approval with a shareAlike 3.0 license. The email was sent 2 days ago from my understanding. Also, under the same notion, Delmark Record has done the same for the album covers File:DE805.jpg and File:DE825.jpg. These files were uploaded as File:The Life I Love.jpg and File: Cell Phone Man.jpg accordingly. If you could vet this for me and remove the block on the files I would greatly appreciate it. I am waiting for Blues R Us Productions to send their release. Ah, there was nothing present on the image page which indicated that an OTRS submission had been made. We get a lot of people trying to add CD covers to Commons so they pretty much get cleaned out on sight. Well I can see one immediate issue with the upload - it's not truly Public Domain. If you check the copyright policy on the PETA India website, you'll see that it says
PETA encourages visitors to its websites to spread the animal rights message by copying and downloading website content for personal, non-commercial use. f you wish to use any materials found on PETA's websites (text, videos, photographs, etc.) for any other purpose, you must submit this form and obtain express written consent before using the materials.

Deletion of Photo submitted for Carl Williams

Greeting Tabercil,

I understand a photo submitted from my account was deleted because of a claimed copyright violation.

I am, (James Theodore Tillis), aka James Quick Tillis, aka The Fighting Cowboy.


The other day, my company (TEAM TILLIS) submitted a photo of Carl Williams, selected from my personal collection for his page.. I fought Carl, he was a friend of mine, we thought he deserved a photo.

I find it ironic that my submission was rejected/removed because it was taken from the internet.

After a 28 year Boxing career, I have 8 suitcases of photos from boxing. Many have been scanned and either shared on my Face Book page or posted in other social media... ultimately ending up on the internet.

I'd like to suggest that Wiki require confirmation of identity when a page is first created, to eliminate random challenges on legitimate people.

In closing,aside from my personal wiki page, there will be no further edits or submissions offered for any of my friends or associates in the Boxing Community... the feedback received in the last few days... shows "No Good Deed Goes Unpunished"

  • Unfortunately, we have had imposters in the past claim to be someone when putting images up. Your idea is valid - if you're claiming to be a specific person. Last I saw the English Wikipedia did have that very policy - see EN:WP:REALNAME. In any case, I believe you have been directed to OTRS to handle the licensing issue on the images. Disney Posters

Hi, pictures of Disney that I posted does not violate the rights of the corporation. I added an assignment when I posted the pictures; Disney allows the use of posters, that is not for commercial purposes. And besides, Commons requires that all images uploaded to it be available for all uses, including commercial so as to maximize the potential reuse of its contents. And another point: Are posters, qualifies as fair use under United States copyright law. Posters are images released by the company, to publicize their work, and are used in every part of the globe. Of course, that your use is free as long as it is not modified. According to your logic of thinking, we have to take all the posters of the Lion King scattered in the streets, because they hurt corporate rights ¬¬ You are intransigent

Possible fake "own work" image?

Hi Tabercil, how could I check if File:Buddy_Murphy_&_Wesley_Blake.jpg is really this editor's own work, given the editor's other uploads (Special:Contributions/O_Obilly55) are definitely copyright violations? Ahem, File:Alicia Fox House Show 2011.jpg - you uploaded your cropped file over top of it and at lower resolution. I know because after undoing it, I did a crop of it myself. Take a look at File:Alicia Fox House Show 2011 (cropped).jpg. The key is the file size between the two: your crop was 283 KB in size, mine which was lossless from the original is 899 KB in size. Can you tell me if I'm being too suspicious? I think that this file is probably not licensed correctly. The user only has two uploads and I'm just suspicious that they might have not taken the pic. That said, I notice that it's really high resolution, so maybe they do own the original file and are the photographer. So, what do you think? Hey, just a heads-up: On Commons, the category for people is Category:People by name, not Category:Living people like on Wikipedia. During this round of consultation, we want to discuss the implementation of this policy. As a member of the functionary team of Wikimedia Commons, your opinion on enforcement is of great value. We want to hear from you on how this policy can be enforced on the Wikimedia Commons community and what might be needed to do so. There are a few enforcement questions so you can easily outline your answers based on them. Please do not hesitate to bring any more questions/challenges you think are not yet discussed.
