Grafitti na França

Not OK? FOP = en:Freedom of panorama, e na França é restrito também para obras 2D. Ver também Commons:Deletion requests/Files in Category:Graffiti in Brest. Por cima, o grafitti parece uma obra derivada de uma fotografia com status de direitos autorais desconhecido. Portanto é muito provável que o ficheiro não seja permitido no Commons. German FOP question

Hi Gunnex. Can you take a look at File:Ewald Mataré - Pferd PM14.jpg? I've never really dealt with photos of sculptures on display in German museums. The uploader asked about this one because he's not sure it's ok. Thanks for your time. INeverCry 02:15, 17 March 2014 (UTC)[reply]

But let's see: en:Ewald Mataré, German artist, lived 1887—1965, Germany has 70 pma, from a general point of view, works of this artist are still copyrighted. The photo was taken in the interiors of Museum Kurhaus Kleve which is not covered by COM:FOP#Germany (see also de:Panoramafreiheit#Innenaufnahmen), so the photo can most likely not hosted at Commons. Additionally, the license supplement "Uploaded for educational use only - Please don't reuse this image outside of wikipedia." doesn't combine with COM:L. Btw, at the time I checked the photo, there was no license available, removed by the uploader. Considering all this, we have no license and no permission from the artist, the relative heirs and/or from the Museum Kurhaus Kleve and the file should be deleted per (the easiest way) uploaders request. Dispõe o artigo 48 da Lei Federal 9.610 de 1998, que "as obras situadas permanentemente em logradouros públicos podem ser representadas livremente, por meio de pinturas, desenhos, fotografias e procedimentos audiovisuais.". Tal dispositivo permite que prédios públicos, como os representados nos arquivos excluidos, por exemplo, sejam representados livremente. Das três imagens acusadas de quebra de copyright, a "Fundinopi.jpg" além do disposto pela lei, ainda citava o nome do autor como mencionado no art. 79 da mesma lei. Por sua vez, os outros dois arquivos, "UENP-REITORIA.jpg" e "DIREITOUENP.jpg", ainda que não citassem o nome civil dos autores, apresentava o nome de domínio das fontes, isto é, a autoria. E isso aqui serve para que? COM:Marcas de direitos autorais! Faça-me o favor, todas as imagens são de órgãos públicos e tem o nome vinculado, seja o civil, seja o de domínio. Como se não bastasse, em consonância com o tópico Domínio > Brasil, do Marcas de direitos autorais, pode-se entender que o domínio nesses casos é PÚBLICO "para emblemas, bandeiras, escudos, armas, medalhas e MONUMENTOS oficiais, PÚBLICOS, nacionais, estrangeiros ou internacionais.". Isso, em associação com o quadro que distingue a gradação de licenças, permite concluir que NÃO é obrigatória a elucidação dos nomes dos autores. Então, mais uma vez, POR QUE DA EXCLUSÃO? Aparentemente está confundindo muitos coisas - e confesso que nem entendi completamente o que diz acima. A legislação sobre direitos autorais no Brasil é regulamentada pela LEI Nº 9.610, DE 19 DE FEVEREIRO DE 1998.. COM:Marcas de direitos autorais dá uma visão geral sobre os diferentes tipos de licenciamentos possíveis e apresenta também as restrições relacionadas. Leia Commons:Licenciamento para ver quais licenças Wikimedia Commons aceita.

Então, vamos começar a partir do zero (aqui só para fotografias, não para pinturas/desenhos/filmes/etc.).

Esta foto é uma obra derivada de uma outra obra criada por um outro? --> Não (se for "Sim", é necessário esclarecer se a obra original está protegida por direitos autorais)
Esta foto mostra de maneira promimente detalhes de uma obra criada por um outro? --> Não (se for "Sim", é necessário esclarecer se a obra original está protegida por direitos autorais, COM:DM)

A foto foi criada por um Brasileiro antes de 1 de janeiro de 1937 ({{PD-BR-1937}}, exemplo)?
A foto (criada por um Brasileiro) foi publicada no Brasil antes de 1 de janeiro de 1944 {{PD-Brazil-media}}?

COM:FOP#Brazil permite que no Brasil qualquer um pode tirar fotos de uma construção (por exemplo: um edifício) situada permanentemente em logradouros públicos sem permissão do arquiteto desta construção. Mesmo assim, esta foto é protegida por direitos autoriais do autor da foto. Note que COM:FOP#Brazil NÃO PERMITE que você entra numa galeria de arte no Brasil fazendo fotos de pinturas ali expostas. O artigo pt:Administração Apostólica Pessoal São João Maria Vianney está pra ser eleito destacado na ptwiki e tenho algumas dúvidas sérias sobre os diretos de algumas imagens (algumas das quais eu ajudei a melhorar), pois são de baixíssima resolução e/ou não têm EXIFs ou, se têm, são "estranhos" (váriados tipos de câmeras, por ex.)... Interessante: Eventualmente COM:FOP#Brazil-fail = no meu ver crítico para fotografias tiradas dentro (no interior) de edifícios + óbviamente não "obra própria" já que o usuário não pintou o afresco + obra atual, considerando que a igreja foi construída em 1990. How you realize, some of my images uplouds, before I put here, are on the site "Salvem a Liturgia", and were sent by Hernan Gouveia. Many of the images that are loaded undeniably mine. In fact I asked if I could use Hernan those pictures, and he left, just told me that "they were there and you could use." Understand? There is no reason to exclude them. We have to solve this? Please follow the steps decribed at COM:OTRS (especially the section "If you are not the copyright holder"), how to obtain a permission from "Hernan Gouveia" and/or salvemaliturgia.com and how to forward this permission to Commons. Please notify me when you have sent an e-mail to OTRS and I´ll tag the related files to prevent a deletion (and even if the files got deleted in the meantime, they can be restored later, if everything checks out). Oi Gunnex, tudo bem? Estou aqui pra te encher de novo. Existe algum "Fast Buttons" aqui no Commons que me ajude com nomeações para deleção? Esta imagem foi carregada por um editor que já teve centenas de páginas apagadas e estou certo que não é de autoria dele (com 91 Kb e sem EXIF é provavelmente um thumbnail copiado da web). Aparentemente está procurando por Help:VisualFileChange.js e Help:QuickDelete que adicionam diversos botões/links na sua caixa de ferramentas à esquerda na janela do seu navegador. This Single Panoramio Page

Dear Gunnex,

Can you type in {{Panoramioreview}} tags just to images which were uploaded on this page by this user. User Maliepa did not request a panoramioreview to these images. I have ordered many panoramioreviews to his other panoramio images...but I avoided this single upload page.

I already ordered 70+ reviews for Maliepa's other panoramio images for Malieapa's images. For this and this image, its already too late to save them as the images have been deleted, so its better if the other images on this page be tagged with a panoramioreview template. Well, actually the file has a "source" (even beeing inactive) and instead of tagging the file with "no source" (which looks at first sight to be contradictory) I thought it would be more accurate to iniciate a license review (which - as I mentioned - would eventually fail). Considering the post right below to this one ("This Single Panoramio Page") where I checked multiple Panoramio files, I conclude that the no-source tag is indeed more practical for files from external sites with unknown (historical) license status (broken/404 links). Eu juntei (dentro do possível das aproximações e diferentes escalas) os dois mapas para conseguir os contornos terrestre (a linha entre terra e mar) e viários (as linhas das vias metropolitanas e avenidas). E pronto. O resto é meu. Tenho até mesmo outros mapas/esquemas que seguiram a mesma lógica. O responderia como Fonte/Source para esse novos, uma vez que as imagens de base foram daqui retiradas for falta de licenciamento claro? Own? A query about licence

Hello Gunnex, I used the safe search feature of Google images to find appropriate photographs needed for an article in Wikipedia. I used the "labeled for reuse with modification" filter and found few relevant photographs including this, this and this. However, I couldn't find explicit EXIF tags or notes regarding their licence in order to upload them in Wikimedia. Would you mind helping me with this issue? Neither did I found any license infos at the indicated sites so uploading these photos would not be okay. But both photos at http://www.mannevesht73.blogfa.com/tag/%D8%A7%D9%86%D9%88%D8%B4%DB%8C%D8%B1%D9%88%D8%A7%D9%86 has exif infos. You may contact the copyright holder directly and ask him if he would release these photos under a free license. Follow the steps described at Commons:OTRS#If you are not the copyright holder. Did you also check Commons:Free media resources/Photography, giving an overview of free sources? For what theme/subject you are looking for freely licensed images?

PS: If you ever upload a photo from an external site which appears to be freely licensed please tag the upload with {{LicenseReview}} to initiate a review process for verifying the copyright status of the photo, done by trusted users ("reviewers", details at Commons:License review). То что данное изображение было использовано на http://op46.ru/13/80/ еще раз доказывает, что файл распространяется свободно. Если Вам интересно я могу привести как минимум 3 ссылки где использовано это изображение.

Приведите пожалуйста более веские доводы.

Están sacadas de un vídeo del Ayuntamiento de Albacete y de la Diputación de Albacete, cuyo contenido es libre según la ley. Los vídeos a los que haces referencia son de medios de comunicación de la ciudad que, al igual que yo, se hacen eco de unas imágenes que pertenecen al dominio público según la legislación vigente. Pero esos vídeos no pertenecen a esos medios de comunicación, sino al Ayuntamiento de Albacete y a la Diputación, y tienen licencia libre según la ley española. Did you read the info below the no-permission tag at File:Estemmenosuchus.jpg (uploaded in 08.2013)? I did not find this particular image on http://spinops.blogspot.de/ but it is sourced with this site. And what I found is "All images on this site are copyrighted to Nobu Tamura under a Creative Commons 3.0 Unported (CC BY-NC-ND 3.0) license meaning that you are free to use them for non commercial purposes as long as you properly credit the author (© N. Tamura)."^{my bold} which fails COM:L (and also cc-by-3.0). It appears that (today - and possibly also on upload date in 08.2013) all files available at http://spinops.blogspot.de/ are not (more) compatible with COM:L. In other words: new uploads from this site are copyvios (if they were not uploaded by N. Tamura himself) unless it can be proven that the same image was earlier published by N. Tamura under a free license (allowing derivates/commercial use) because CC licenses are not revocable... upps... (in the meantime)... thanks for giving context to this file. No, I'm not Melissa Ybrahim, neither Juan Ulivarri. But they shared their photos in the web. If the copyright is not the correct one to be in Wikimedia, that's Ok, I've never complained about those two photos, you deleted them, end of the issue. I'm complaining about my own photos, taken by my own cellphone. I shared them in Panoramio, and I shared them in Wikimedia. Do I have to re-upload them now? Do I have to show you my DNI or something to prove it? The photos has their own Meta Data that corroborate that they were taken by my cellphone and here in Villa Adelina, where I live. For me doesn't exist an "end of the issue" if I catch an uploader like you, grabbing files from multiple copyrighted sources. IMHO, you are taken this too frivolously. Well, the easiest way would be (as an alternative to the above e-mail):

Change the licenses of the files available under http://www.panoramio.com/photo/39590101 + http://www.panoramio.com/photo/39587444 to a Commons compatible license, e.g. {{Cc-by-sa-3.0}} (see COM:L#Acceptable licenses for details). After that, reupload the files under the same file name and I do the rest. If this procedure overstrain you (technically), provide all necessary details by e-mail (see above) for the COM:OTRS-team convincing them that you are indeed the copyright owner and/or the owner of the Panoramio-account. You can write in English or Spanish (will take more time). I leave it up to you how to do that but you certainly don't need to present any personal documents :-). Just write your story, as above. Escrevo aqui porque abrimos uma consulta à comunidade sobre os rumos dos projetos Wikimedia e sobre os rumos do Catalisador. Houve algumas discussões na Wikipédia, no Meta e na lista, na terça-feira da semana passada fizemos uma conversa por IRC (veja o log). Queremos conhecer o que pensa e, para isso, criamos um formulário de pesquisa básica, que não deve tomar mais que 10 minutos e cujo objetivo é busca levantar informações sobre como as pessoas estão envolvidas, se não estão o que as fez parar de participar, o que elas conhecem da WMF, programa catalisador e Ação Educativa, e o que gostariam de ver acontecer.

Vamos realizar também um encontro aberto no dia 05 de julho, em SP, na Ação Educativa, para dialogar. Se tiver interesse em participar, por favor, coloque seu nome aqui. Se preferir dialogar de outra forma, diga-nos como e faremos contato.

Tickets of of FIFA World Cup 2014

Oi Gunnex. Para evitar problemas de copyright como aconteceu com as duas fotos que foram deletadas, eu gostaria te consultar se você acha que de minimis aplica para uma foto de uma pessoa segurando o ticket? Eu calculo que o ticket completo não ocupa mais de 10 a 15% da aerea da imagem. A preocupacao é com o design florido, que ocupa boa parte do ticket. O logo da FIFA fica bem pequenininho. In this cat all files sourced with "Danilo Borges/Portal da Copa" are ok as http://www.copa2014.gov.br (= "Portal da Copa") is licensed under cc-by-3.0 (and it seems so, that "Danilo Borges/Portal da Copa" mostly took these photos). Nevertheless, copa2014.gov.br publishes sometimes unfree photos from (example) Getty or other photo (news) agencies, see http://www.copa2014.gov.br/pt-br/noticia/costa-rica-surpreende-e-derrota-o-uruguai-no-castelao ("Foto: Getty Images") = http://www.copa2014.gov.br/sites/default/files/450618800-820.jpg (see also exif), so a bit of attention is needed in checking these files. Sobre borrado de todas las fotos y contribuciones personales

Buen día, acabo de ver que se ha maracado muchas fotos de las cuales en realidad tienen razón para ser borradas, pero otras no y simplemente se ha considerado por el hecho de que no fueron capturadas con el Sony Ericsson WT19i. Esto me parece mal porque no se toma en cuenta que se puede tener contribuciones de otras personas que aportan a Wikimedias Commons a través de mi. Otra cuestión es que escudos realizados con pequeñas herramientas se han marcado también para ser borradas. Por favor le solicito desmarque las fotos que menciono porque no considero válida su opinión de que por subir la mayoría de fotos con marca WT19i las demás no sean de mi propiedad, a menos que lo demuestre (cosa que dudo porque no encontrará ninguna foto igual subida anteriormente en ningún lugar). In terms of copyright there is no difference between http://www.upec.edu.ec/nes/images/UpecContact.png (original) and File:UPEC Escudo.png (derivated work). The question here is: Does this coat of arms pass Commons:Threshold of originality or is it only composed by simple geometry ({{PD-shape}} (it may also be in public domain due to its age - Ecuador has 70 years after death of copyright owner - but es:Universidad Politécnica Estatal del Carchi was created in 2006 so this is unlikely). Considering especially - among others - the complex structure in the center of the coat of arms, I would say that indeed enough originality is available, failing {{PD-shape}}. But the borders are quite fluent so I recommend to wait until the deletion request is closed. You may also contact Commons:Café to get additional feedback regarding the copyright status of this file. La cuestión es que no tengo claro si un escudo de una institución sea motivo de derechos de autor en mi país. Por ejemplo, File:Escudo Instituto Tecnológico Bolívar.png (dejando de lado el hecho de que sea borrado por haber sido sacado de otra página), es un escudo de un instituto con más de 100 años, y no se conoce autor intelectual del mismo, es decir se consideraría al mismo instituto como autor. En ese caso, si yo diseño un escudo basandome en los documentos del instituto, ¿incurriría en motivo para ser borrado?. Per COM:EVID you have to prove that this logo was indeed created 100 years ago. But: usually, even old established organizations are updating/modifying or even completely redesigning their logos from time to time. Apart from this aspect and as an alternative licensing we can apply the same questions as File:UPEC Escudo.png = does this logo pass Commons:Threshold of originality or is it only composed by simple geometry ({{PD-shape}} which is not copyrightable? And in this case I would say: An open book and a hand holding a flame, some stars and decoration flowers floating around (= old symbols) are indeed ineligible for copyright. Nevertheless, you have to provide the details. A simple "own work" doesn't work here. So, try to make a workaround based on File:Associação Esportiva Araçatuba logo.svg. I'll do the rest. And I am very sad for the people who believed in your licening, reusing "your" photos outside of Commons in this faith and are in danger to be confronted with legal/monetary objections by the real copyright holders. Always remember: If you did not take the photo yourself, you need a permission from the person who took the photo (even from a supposed "friend") for licensing the photo under a Creative Commons licensing. You grabbed all your uploads from multiple sources (see details at User talk:Isaacvp), declaring all the uploads with "own work" (which was a lie). Gunnex, você se supera. Por que CERTAS imagens de Cultura/RJ são de terceiros e logo não estão cobertas pela licença CC, você quer deletar TODAS as imagens oriundas daquele site. Quando são de terceiros, consta bem clara que elas são DIVULGAÇÃO. Eu sempre tive o cuidado de só carregar imagens criadas pelo próprio site. Note que os nomes dos fotógrafos - Vânia Laranjeira, Caru Ribeiro e Guga Melgar, principalmente - se repetem, deixando claro que eles são prestadores de serviço para Cultura/RJ. A mesma polêmica foi levantada com relação aos conteúdos da Revista Forum e ali se optou pela manutenção das imagens. Só para tua informação. Eu sei que é inútil, pois tu e teu coleguinha Yangas, de bronca comigo, vão apagar as imagens.
