I work for the press office of Mister Mauro Eugenio Giuliani. The picture belongs to him and there are absolutely no restrictions and/or rights to be written. People can download, edit and publish the picture, also for commercial purposes. The picture, in other words, is for public domain.

@AnnTheKid: Please provide an evidence that it was published under a free license: either at the initial publication site (faster) or through COM:OTRS procedure (slower). You cannot use on-wiki license declaration procedure using {{Own}} for imaged that were published proviously elsewhere. It is up to uploader to provide such evidence. Blombat: No, you have to understand that {{cc-by-nc-sa-3.0}} is a non-free license (which is why it's a speedy deletion tag), and that you can't just arbitrarily drop licensing restrictions and claim that it's been published under a {{cc-by-3.0}} license (which is a different set of terms, which in turn is why they're named differently). —LX (talk, contribs) 12:17, 29 July 2019 (UTC)

Locator maps of Latvian parishes (2)

The following maps were speedy deleted with a dubious reason. A few other maps from the same series by the same author went through regular deletion procedure and were restored eventually. So I believe the following maps can be restored too now. After undeletion I intend to amend author/source info in file descriptions so that it was more explicit.

Someone deleted an image from a page I created - Jonathan Burrows (producer)

This is in regards to https://en.wikipedia.org/wiki/Jonathan_Burrows_(producer)

I was just informed that the photo of Jonathan Burrows (producer) was deleted for copyright. However, that photo was sent directly by Mr. Burrows to me. I had mentioned copyright of the image and he told me that he owns the rights to the photo himself and gave me his blessing to use that image.

We hold full copyrights and usage of the image and therefore, we are quite surprised that it was deleted.

@Trulilo: For already published images we need a written evidence of free license permission from the actual copyright holder (and an evidence of copyright transfer if the copyright holder is not the photographer). Ich bitte um eine Erklärung, warum diese Datei gelöscht wurde. Es handelte sich hier um das Foto einer Holzplastik aus dem 14. Jahrhundert. Fotografiert von dem Museumsdirektor des Trierer Diözesanmuseums und mir 2015 zur Nutzung in Wikipedia zur Verfügung gestellt. Der Fotograf hatte dazu sein Copyright an permissions geschickt. Ohne dies wäre die Datei nicht hochzuladen gewesen. Nun wurde die Datei 4 Jahre später ohne Diskussion oder Benachrichtigung wegen einer fehlenden Lizenz gelöscht. Die Freigabe per Email wurde offenbar nicht richtig weitergegeben, bzw. nicht mit dieser Datei verknüpft. Sie wurde nämlich gerade wegen fehlender Lizensierungsnachweise gelöscht. Kann es sein, dass die Email damals an permissions-de@wikimedia geschickt wurde? Bei Sendungen an permissions-commons passiert sowas nämlich eigentlich nicht. @Steinsplitter: Kannst du da etwas im Archiv finden? @Hps-poll: If EXIF data shows some other author name than uploader's username, we accept {{Own}} on-wiki permission only if the uploader identity was disclosed by the user themselves and verified through COM:OTRS. Otherwise, a written free license permission from the actual copyright holder following COM:OTRS is needed. So in both cases, contacting OTRS seems unavoidable. @Tohlur: So why did you claim that you are the photographer and copyright holder? Reuploading deleted images as well as providing false information is against Wikimedia Commons rules. Any document which was previously published elsewhere need a confirmation via email. Then "for use" is not enough. We need a permission for a free license. The nomination was based in "metadata contains Facebook, as source" but clearly is the same author for both files, and it's possible by the law have different versions of the same file, under different licenses. @Artsidorov: If there's no free license declaration at the site the photo was published initially, the only way is to follow COM:OTRS instructions and convince the responding OTRS agent during e-mail communication that this is your photo. Those older examples don't have the scroll -- so the rendering of the scroll itself, with its particular curls, might be the copyrightable part (and would be the only part which might be an issue in the U.S.). The rest of it is indeed likely OK, probably even in the UK and Hong Kong, given those older examples. I tend to agree this should not have been a speedy deletion, though the age aspect may not have been immediately apparent. Correct, sorry for causing confusion about the filename. I don't know how else license reviewers would check the licenses of pictures (showing the license directly under the picture as a text outside the source code is not always wanted, and not the whole website runs under that license). I proceeded to add an archive link to the file's description page on August 6, along to the source code view-source:http://archive.is/ncSSv which verifies the Creative Commons license. I added a note on the file's talk page indicating this, as Creative Commons licenses are irrevocable. Arthur Crbz deleted the file on August 10 as a copyright violation. I contacted Arthur Crbz asking for clarification for the deletion. I did not receive a response despite this user making an edit about ten hours later. Misleading diagram. Thus no educational value. Explanation: At a latitude of +90° = 90°N, the north summer shows continous daylight, not "continous twilight". Hello,

It's good that you doublecheck the uploaded images, but a more thorough check would have found that this image (File:AL_by_GS.jpg) is clearly uploaded under my name in other websites. The website where my image was found is using it illegally and I've sent them a message to remove it (edit: I now have confirmation that the image is now deleted from the website). I can provide original RAW files if needed, and it is clear that my file is much bigger than the version found online. This is obviously not possible without the original image.

Please let me know what else you might need to undelete my image.

Dans le cas d'un enregistrement publié en 1928, c'est 50 ans pour les productions Européennes et c'est 70 ans au maximum après 1962… Donc que le type soit mort il y a moins de 50 ans, n'entre pas en ligne de compte, puisque seule est retenue la date de parution du photogramme. « Les enregistrements effectués avant le 1er janvier 1963, ne sont protégés que pendant 50 ans (à compter de leur première communication au public…) ». Ok, I have missed that part of what the uploader wrote. @Agrinmbeau: Fair Use is not something that you grant to people, it is a part of the copyright law in the USA and the principle is a part of the international conventions (other countries may call it something different). However, Commons is here to store media that is either in public domain or is released under some free licences and even an unfree licence or two in special cases. Those special cases do not apply here, so you can: 1) Accept that your image cannot be hosted here. 2) Chose at least one licence from the available licences (I personally prefer Free Art License, but majority of people release their work here under Creative Commons Attribution Share-Alike). 3) Relinquish all the rights to an image and release it into the public domain. ℺ Gone Postal (〠 ✉ • ✍ ⏿) 08:05, 20 August 2019 (UTC)

  • I still don't quite understand why the administrator who originally and very helpfully assisted me in uploading the photo, felt it should be called a UK government image. I explained that it isn't a government image, it was in my father's personal collection. During the war pilots and doubtless those servicemen and women in the other armed services took thousands of personal informal photos which were not handed over to the RAF, Army or Navy. I'm advised by the historian who works with the Battle of Britain Memorial Trust that there are probably hundreds or more of such images in Wikipedia. It was a personal photo which belonged to my late father who is the subject of the photo, which has passed to me his son as an executor of his will and his beneficiary regarding his RAF memorabilia.
  • My understanding of the general position is that if my father took the photograph (or in this case a squadron colleague took the photo for him with his camera) then, broadly, copyright rests with him for 70 years after his death. After death, in some cases the use of the copyright material would be decided by "literary executors". Keith like most people didn't have "literary executors", so it would be the normal executors - in this particular case myself and my sister as joint executors of his will.
  • I have also made what I hope are helpful comments on this on this page: https://commons.wikimedia.org/wiki/Commons:Deletion_requests/File:Keith_Lawrence_climbing_from_Spitfire_in_1940.jpg
  • I would be most grateful if you could please change the classification of the photograph to reflect this as I don't know how to do this: both my late father and I were/are perfectly happy for the photo to be in the public domain. Also of course, if you could please undelete the photo from the article, as the article is much enhanced by its inclusion. Although a quiet and modest man, Dad was proud of what he and his comrades did during his and their wartime service, and I share that on his behalf. Thanks.

@Geoffhl: We can assume COM:AGF for user uploads, but only if the information provided by users is consistent and accurate. If it is not (like in this case: you initially marked the image as copyrighted by the government) for any reason, we need an evidence for image copyright status: either based on publicly available resources, or provided following COM:OTRS instructions. Unfortunately, OTRS is a slow way, but probably the only available in this case (eg. I doubt that you can prove basing on public records only, that the anonymous Wikimedia user Geoffhl is the heir of the photographer who made the photo). Ankry (talk) 23:18, 19 August 2019 (UTC)

  • I would like to say a few more words on the 'information provided by user' when the photo was first uploaded. As I was new to contributing to Wikipedia I had difficulty with how to upload a photo. As I remember it (and my memory is not too reliable these days) I managed to have a 'live chat' (interactive) with one of your colleagues. After the 'chat' had gone on for some time, he realised with some surprise I was Keith's son and did what he could to be helpful. I was very grateful for his help. However, I was surprised that he thought the photograph could be government property, as it came from my father's photo album which covered his training in the RAF and is first real posting, to Leconfield, where the photo was taken. I don't have a record of the 'live chat', but your colleague told me how he was going to 'tag' (is that the right word?) the photo, and I went along with what he said, as he assisting me in using the photo on Keith's/Dad's Wikipedia page. I'm sorry to say I still don't really understand the system, which for a non-technical beginner I find pretty complex to understand.
  • I will now do as you recommend and contact permissions-commons@wikimedia.org as set out via the COM:OTRS page. Thanks again for your help.

I uploaded and inserted the logo of the ELF experiment as part of a means to contribute to the article about this experiment, contained in the article about Space Shuttle Columbia mission STS-87.

As the image is already a commonly used and not otherwise protected by limited use copyright in my opinion and as I could not contribute the true author, I understand why this might seem like a violation and subsequent deletion, so earlier today I added the article concerned as a reference as well.


I rather would like to add this image still; not as my own work, understanding the issue here as I only want to contribute to the article and also to Elfquest, whom I loved ever since I discovered the series in 1992 in Belgium.

So I hope you will help me out as I mean no violation nor disrespect. I also added the article regarding publication of the ELF storyon the official Elfquest page.

I point your attention to the following remark from said article as to what may allow as selecting this as 'my' work:

"Dennis Stocker, leader of the NASA Lewis ELF team and avowed Elfquest reader, contacted Warp Graphics publisher Richard Pini in August, 1996, requesting Warp’s assistance in designing a logo for the experiment, perhaps “lending” an Elfquest character to the cause. Because artwork used by NASA is copyright-free, none of the existing characters could be used. The solution? Thank you for replying. Allow me to elaborate on your answers.

  1. I do aknowledge the owning is fake, as mentioned before. I just wanted to contribute to an article in the proper way but I am a little puzzled how to attribute the proper ownership otherwise, so feel free to guide me.
  2. as the image is already being issued for use by NASA, who upholds a copyright-free policy (meaning unless mistaken, all can use it), it means it can be used by all, no?
  3. if this was that much an issue, I wonder how the images used on STS-87 would not be a violation either of said rules and regulations as described, so how can we augment an article with images if they are clearly not the author's property either (I will accept proper validation)

If either is not sufficient, you can always advise me on how I can get the image inserted the proper way as it is not very clear to me how to do it otherwise.

I hope this response will aid in further clearing my request.

@Vikinghammer1979: "issued for use by NASA" does not make anything free. The copyright exclusion we use for NASA works applies to government employees only. So the key question here is: was it created by a person who was a regular NASA employee at that time? Otherwise, we need an explicit license from the actual copyright holder: maybe from the author, maybe from NASA, maybe from somebody else - I do not know. Ankry (talk) 14:10, 21 August 2019 (UTC)

I know that there are a number of contributors here who have their cameras set to automatically include © GreenMeansGo 2019 in the meta data of their images. That doesn't really pertain to whether their CCBYSA license is legitimate (unless it obviously doesn't match the uploader). Whether we assume good faith is a different story, but if you are uncomfortable, you can always archive.org the current version of their page and include that in the source description rather than a live link. I am sorry I just disagree. This is a website I absolutely refuse to assume good faith towards - this is in fact the first ever complaint crowdsoursing database. Apart from this, for me, if I see a copyright sign and a CC-BY-SA license next to each other (as opposed to say copyright sign and a notice that all pictures of elephants are CC-SY-BA), for me this does not mean the material is CC-BY-SA. For me it means the site owner has no clue what copyright means. I mean, regardless, the copyright symbol doesn't pertain in any legal way to the validity of the CCBYSA, and if that's the only issue we are dealing with here, then we should Restore it. The operative bit for our purpose is not the "copyright" bit, but the "all rights reserved bit". Hello. This file was deleted with the reason given that it is on the subject's website. However, this has been uploaded by the owner as CC0 license on flickr so I do not understand how the fact that it also just so happens to be used by the subject on their website. Surely the fact it is uploaded as CC0 on flickr means it can be used anywhere freely? And it is not surprising that the subject would use pictures of themselves on their site.

I don't really understand what the issue is since it is clearly CC0 by the creator / owner on flickr, so the fact that it is used elsewhere should be irrelevant. If I am mistaken please let me know. Thank you.

@Camarmstrong: We must be very careful for Flickr washing cases. Unfortunately, we have no evidence that the CC0 license is granted by the photographer. Especially that this seem to be a single purpose account with no other photos by this author and as the EXIF information is missing. @Ankry: Thank you for responding. I am not sure I can get them to go to all that trouble for something I am choosing to submit. I did correspond with the subject/owner who said it was 100% okay to use freely, but because I thought that may not be enough I had asked them to upload any free to use photo that I can use to flickr with CC0 attribution, which is why they uploaded this photo. I figured this would be the least intrusive and troublesome way based on what I had learned so far about the process (admittedly I am new to this). Would the correspondence COMBINED with the flickr upload CC0 be adequate? I feel like I have troubled them enough and this whole affair seems a little complicated to ask someone to do. Let me know what you think about this? Would the combination of the two suffice? We need hard evidence for any images that have been published before without a free licence, and we have no means to verify your identity or affiliation with Talenom through your Wikimedia account. Please send a permission for this file per email from your working email account at Talenom. See COM:OTRS for more information. Once that mail has been processed and approved by our volunteer email team, the file may be undeleted. However, this is a very slow process because they have a huge backlog.

If the copyright has already expired, then we need clear information why they are PD in the country of origin (country of first publication) and in US. Eg. here you can find rules for Iraq.   •  Oppose for two reasons. First of all, purchasing a photo from the photographer does not automatically make you buy the copyright for it, too. You would need a special written agreement with the photographer for a transfer of copyright, and in some jurisdictions this is not even possible. Second, you seem to be a brand new Wikimedia user without any substantial contributions here or at Wikipedia. Our rules do not allow personal photos for any new users. Hello There is nothing wrong with this file and i don't know why he was deleted, this logo is official and was published by the club, all wikipedia pages were using it and now all those pages are without logo since there is no other source to take this logo from, that logo was published here essentially in commons in order to avoid publishing or creating fake logos looking like it. i hope you'll undelete it, thanks. reasons:

1) no reason given by deletor

2) nor is it even clear they're even an admin

3) As near as I can tell the 'work' is in scope enough for 1.4 mb in a user sandbox - no one is suggesting it needs to remain more than a month or two or even a couple days

4) I'm pretty certain there aren't any copyvios and any there are can be remedied easily enough

5) A pdf wouldn't be necessary if txt formats (near as which I can tell all of which are free) or temporary post to sandbox were possible

6) in fact I have many many many more reasons but I'm not going to bore you unless you tell me you're interested - as my first upload and use of Commons I won't lie to you I'm new to this - not to seem to be trying to invoke a stop biting the newcomer defense or anything. I will say I know for a fact KrakatoaKatie and Mandruss are socks because I saw her use both at her house over her shoulder when she had whats alleged to be her kid drag me in there for the Bobbit stroganoff - and thats how I remember her fritzl room. I'll tell you how I got out of that too if you ask. Not going to tell you I think she had Bonnie Craig and Jael in there.
