Need help updating map

Down-scaling a giant image

File:Khalili_Collections_A_Composite_Imaginary_View_of_Japan.jpg is originally 10,485 × 14,223 px. It shows there are several lower-res images available, but the largest of them is 755 × 1,024 px. An editor has asked (on enwiki's help desk) if an image in between this relatively low-res and the original huge image can be added to this list. I tried simply requesting https://upload.wikimedia.org/wikipedia/commons/thumb/e/e2/Khalili_Collections_A_Composite_Imaginary_View_of_Japan.jpg/1510px-Khalili_Collections_A_Composite_Imaginary_View_of_Japan.jpg , which gave me a 1,510 × 2,048 px image. Trying this with higher res, like 2,097 and 3,495, results in "Error: 429, Too Many Requests at Sun, 01 Nov 2020 06:05:19 GMT". If I try [[File:Khalili Collections A Composite Imaginary View of Japan.jpg|thumb|2097px]] in my sandbox on enwiki, it renders an empty frame, ~2,097 px wide and just a few pixels high.

How do you get additional resolutions to be generated and shown in the list (and hopefully then available on enwiki without it having to scale it on-demand)? —[AlanM1(talk)]— 06:16, 1 November 2020 (UTC)

@AlanM1: Hi, and welcome. We don't add to the automatically generated lists of other resolutions. I got an image 2,000×2,713 px, but all attempts over 2,000 have failed for me with "Error: 429, Too Many Requests". Update: This morning, I was able to get images at 2001 px and 2097 px but then got 500 server errors when I tried 3495 px, 3172 px, and 3000 px. When trying 3495 px after a couple minutes, I got a 429 error, so there are a couple of different things going on. Also, even though the 2097 px image works here now, it renders a ~2000x50 px empty frame in my sandbox with [[File:...|2097px]], as does any value above 1510 px, which may be yet another issue (hard limit plus the rendering problem maybe?). —[AlanM1(talk)]— 18:29, 1 November 2020 (UTC)

  • My apologies, but the above makes no sense at all to me.
    • Can you be clear exactly why you want the first file deleted? We certainly don't have a rule against there being two slightly different SVGs representing the same thing.
    • I have no idea what you mean by one file being "handed over" to another. Can you word that differently?
    • "The document has been processed...": what document?
    • "Another user has already applied...": "applied", in the sense of volunteered to do something and is awaiting a decision whether they will be the person selected to do it? "applied" as a transitive verb, in the sense of they applied [something] to [something else], with both of the things unspecified?

Wyoming does not have any form of public domain, and all state-published material is explicitly copyrighted to themselves or to the original copyright owner. You would have to get an exception published or emailed, see w:Wikipedia:Contact_OTRS. SilverbackNettalk 01:57, 2 November 2020 (UTC)

Creating or deriving a Creator page for John Ball (1585-1640) for Wikisource

I am uploading a book, A Treatise of the Covenant of Grace from Internet Archive to Wikisource.

Wikisource says The author 'John Ball' doesn’t have a creator template.

I gather the creator template should be here at Wikimedia Commons, am I right?

I can't find out how to create a new page at Wikimedia Commons, let alone how to fill out a template in it. It would be nice if there was a click button for this somewhere - maybe there is but I've read the various related articles and can't see one.

There are lots of people (and even authors) called John Ball but the relevant one is:

OK I seem to have succeeded in adding a Creator page for Creator:John Ball (1585-1640), by typing the missing URL into the address bar upon which tools appear.

Uploaded a .djvu book but it won't display

Is there any difference ??

Hi, I know that cartridge sketches are ineligible for copyright because they are just a bunch of lines and text. But if the "sketch" uses CAD ??

For sure, the final quality is much better, but the argument remains the same: it is just a bunch of lines and text the computer put together under someone else (unknown) "orders".

Here is an example: It is not a photo, it is a CAD sketch made by someone unknown. Could it be classified as {{PD-ineligible}} or {{PD-shape}}, or both ???

  • There is quite a bit of creativity in that image, including the particular positioning of the cartridges relative to the box. I think it's copyrightable because of the composition. If you had two cartridges and a box and made a similar image, you'd probably be OK, because the creative element is by the photographer/CAD designer; the cartridges and box are not themselves copyrightable, in my opinion. - Jmabel ! talk 00:54, 4 November 2020 (UTC)

@Marcric: I would think isolating one cartridge would be fine: that removes the composition issue; but I could imagine an argument that because this is CAD rather than photography that introduces some level of creativity that makes it eligible for copyright. @Prahlad balaji: Have you read Help:VisualFileChange.js? Yes, it can help to add categories, and can help to mass-edit descriptions. Typical uses are:
  • Append a set of categories to some or all files found by a particular search.
  • Add a warning template of some sort to some or all of the files in a particular category.
  • Change the attribution requested on some or all of the files uploaded by a particular user.
It's a bit clumsy, but it's powerful.
As to how to install, I think Help:VisualFileChange.js#Step 0: How to Install is pretty clear; please do read that help document and come back here if you still have some specific questions. - Jmabel ! talk 16:11, 4 November 2020 (UTC)

  1. @Pfernandez89: You need Categories.
  2. You say it is licensed under the Creative Commons Attribution-Share Alike 4.0 International. That means someone who holds the copyright and has granted that license, but I see no indication of who holds the copyright. "Source" should not be the vacuous "Company". It should be a page where the logo can be found and where it is indicated that this license is offered.
Assuming that the logo is, indeed, copyrighted (it's right near the threshold of originality to claim copyright), if there is no online indication that this license is offered, you need to go through the COM:OTRS process.
Also, you probably want to add {{Trademark}} to that page.

Sonething is wrong with this image.

It is supposed to show a rural grave. Look at the site it says it's taken from. This picture is of a building on 5th Avenue in Manhattan. I don't know how to fix this or I'd do it. Deisenbe (talk) 00:06, 5 November 2020 (UTC)

The source shows JB's grave, in stereo. Have tried downloading and uploading the 4MB tiff but it fails API verification. Perhaps this is why the wrong image was used in the first place.
The same photo but not the same scan is at https://digitalcollections.nypl.org/items/510d47dc-e1fc-a3d9-e040-e00a18064a99. So it's now possible to use the NYPL catalog entry to update the actual photo we have, and separately someone could work on trying to salvage the TIFF of John Brown's Grave that appears unuploadable for me, but would match the current page text. -- (talk) 10:46, 5 November 2020 (UTC)

Copyright license tags

Hello I have uploaded two images and the bot has informed me that I need to apply copyright tags. Though I have read the documentation I do not understand how to do this. I am however confident that both images can go on Wikipedia. The files are JILA_Journal_of_the_Institute_of_Landscape_Architects_March_1955.jpg [I own the document and took the photo. The original is equivalent to a book cover and, as such, is permitted on Wikipedia. I am happy for it to be creative commons share alike] First Institute of Landscape Architects ILA constitution c1930.pdf [I own the document and took the photo. The document has no author, because it was produced by an organisation (in 1930, so out of copyright after 70 years). I am happy for it to be creative commons share alike] If you agree that both images can go on Wikipedia please advise - which license tags to use, and - how to apply them. The ILA, which produced the original files, no longer exists

Thank you talk. Yes I am a UK-based user and the two images were published in the UK. Re the cover of the March 1955 issue, I took the photograph but did not create the cover. Do you agree that it would be best for me re-upload the images to Wikipedia (instead of to Wikimedia Commons)? @TomTurner2: File:First Institute of Landscape Architects ILA constitution c1930.pdf is probably fine here; tag it with {{PD-old-70}} and remove the warning. Move your remarks on permissions into the permission field: they are sitting where an actual tag belongs.
File:JILA Journal of the Institute of Landscape Architects March 1955.jpg: en-wiki is probably easiest, at least for the next 5 years, till copyright clearly expires. However, as I say, ig the logo predates 1950, we could have it here, as described. In either case, it is not own work, it is a faithful reproduction of a 1955 work. Remember that non-free use on en-wiki would only be valid if the picture is used in an article, and unlike Commons (where we want the highest-resolution version possible) they actually want something low-resolution to minimize the copyright issue. Jmabel ! talk Thank you again. Re the logo: I don't know the exact date but it was designed before 1950 (my guess is 1946). It is appropriate for it to be non-free use. Does this mean that {{PD-old-70}} is OK for both images. I think it would be best to delete the two uploads to Commons and re-upload to the English Wikipedia. This probably refers to File:La Parnasse, by Andrea Mantegna, from C2RMF retouched.jpg, which heads the enWP article on the topic. Since the painting is centuries old, it’s in the public domain, and faithful reproductions thereof are free to use in most of the world—although any image that includes the frame & surroundings may have its own copyright, owned by the photographer. Questioner, note that there are quite a few more choices here in Parnassus by Andrea Mantegna: help yourself! How can I get a misidentified picture corrected?

While looking for pictures for the English wikipedia's black-cowled oriole article, I came across this picture. It has been misidentified. It is a Cuban oriole. These two species were split nearly a decade ago. What is now known as the black-cowled oriole is only found in Central America. This picture was taken in Cuba. @MeegsC: there are three implied changes: editing the description field, changing the category to Icterus melanopsis, and moving the file. The first two you can do yourself by editing the wikitext. To request that a filemover change the title, you add the special template that Jeff linked above (anywhere on the file page, usually at the top) according to the instructions on that page, which will put the file in a maintenance category for attention. You can do this in the same edit as the other changes if you like. It‘s best to propose a minimal change; identification numbers and such should usually be kept. As a pretty ‘conservative’ filemover I’d be inclined just to remove “Black-cowled”—nobody has questioned that it’s an oriole, and the description & category are quite adequate to identify the species, while being easier to change in the event of a dispute—but your “confident” request might look something like {{Rename|Cuban Oriole - Cuba S4E0688 (23262517213).jpg|3|No black-cowled orioles in Cuba, see Talk page|MeegsC}}. The first three parameters are required; the “3” in the second field indicates that you want to correct a substantial error.—Odysseus1479 (talk) 19:56, 7 November 2020 (UTC)

Fair use rationale

The rationale for File:2012_VP113_discovery_image.jpg states that the image will only be used in the "2012 VP113" article. It will be used as a means to illustrate the article in the info box. The latter is not true: The image is not used in the infobox of 2012 VP113, but in the article's body. @Renerpho: that file is on enWP, not here; Commons doesn’t allow fair-use content. uploading a picture file from my laptop

At the commons page, after I select my file, commons only gives me options to add another file or to go Back.

It won't allow me to move forward in the process.

Is this a common problem????

I'm actually at a Panera's if that helps.

All I did was Open my File for upload when I was directed to. But it simply wouldn't allow me to proceed after that.

This is the first time in years that I've tried to upload a photo. But yeah it seems strange that it doesn't give me any options to proceed down the commons wizard

This is weird. I am experiencing the same problem with this particular file and I can't even insert it using source code editing. What is more important though is that your scan may be a copyright violation. The original book may still be copyrighted which is why I have nominated the file for deletion. That aside, we should try to find out why the file is not transcluded to Wikipedia. De728631 (talk) 23:15, 9 November 2020 (UTC)
It may be a coincidence but a new user reported a similar problem today on the French-language help desk Commons:Service d'aide#Photos. I assumed it may have to do with mistakes present on their Wikipedia draft page, although on a quick look I could not identify the problem. That might help an image that doesn’t display (e.g. showing a blank box), but in this case it looks like the page isn’t being found at all, so I doubt that altering the content would have any effect. If you are located in Europe, this might be a similar issue to en:Wikipedia:Village_pump_(technical)/Archive_185#WebP thumbnail rendering issue in Firefox. There is an dedicated cache server in Europe, named ESAMS.--Snaevar (talk) 01:18, 10 November 2020 (UTC)

I am sorry to inform you that you have triggered Special:AbuseFilter/153 by trying to cross-wiki upload a png photo as a new user while leaving the summary intact. Such uploads of png photos are not allowed at all. You indicated it's your own work. Usually when someone uploads a png photo, it's a copyright violation taken from the web. Please upload the full-size original of it, including any metadata, but if you were not the original photographer, that person may need to post Commons:Licensing compliant permission for such work on their website or social media presence or send permission via OTRS with a carbon copy to you. Also, it will look fuzzy when scaled down (due to design decisions discussed in phab:T192744), so you may want to upload a jpg version which will look sharper, too. If you can't get a compliant license, the photo may still be uploaded to English Wikipedia in compliance with en:WP:F because we don't allow Fair Use here. If you change the summary or use our Upload Wizard instead, you should be able to avoid that filter. Also, Special:AbuseFilter/122 worked as intended. Modifying images

Hi, I am a bit confused about my obligations if I edit an image. It seems if I trim off one edge then I have to upload the modified image in my account assigned to the same license as the original.

I suspect that some times to modified image would be useful to others but often it would not.

Could you please clarify what the license means? 1/ Does it mean that if you make an edit to the image then you must upload the new file? OR does it mean: 2/ If I do decide to upload the modified file then I must use the same license as the original? The wording could be ambiguous.

Trying to upload a different version of a file

Hi, I've been trying to upload a cleaner version of File:Château de Tourbillon.jpg but for some reason the changes I make on GIMP won't show on Commons. When I look at the file on my computer the black dots are gone but everytime I upload the corrected version here the dots are still there. Any idea of what the problem could be? Uploading old newpapers

Can I upload a 1925 newspaper page that I found on the microfilm at the university library. I believe since the library, and the collection is open to the public, that places the image of the newspaper in the public domain? 4Henriettaatthecoldcaseorg (talk) 22:28, 8 November 2020 (UTC)

Presuming that it is a US newspaper, is there a copyright notice anywhere on that issue of the paper you mentioned? I do not see any copyright notice, although the microfilm image is not the best quality! Where do I get a license template? Sorry for asking such questions, but this is my first foray into editing! You cannot link the image to this discussion unless it is somewhere on the internet, or you upload a copy here at Common. To do the latter, you first of all need to obtain a digital copy from the image at your photo roll. Then you can use the Upload Wizard to upload the image at Commons:
  • "Select media files to share" and choose the file you would like to upload
  • In the "Release rights" section, fill in the Source (e.g. New York Herald, March 3, 1925, page 10) and Author fields. If there are any authors credited for the text portion or the images, please state their names, otherwise you may just write the name of the paper. Further down that page in "Now tell us why you are sure you have the right to publish this work:", you need to select "Another reason not mentioned above" and fill in a line of code: {{PD-art|PD-US-no notice}}
In the next section, please enter a description for the image and then proceed with the upload process.

Can you correct mislabeling on an image?

RE: https://commons.wikimedia.org/wiki/File:Burned_Books_Monument_-_Berlin,_Germany.jpg This image refers to Berlin's burned books monument in the filename, but the image is of a monument to German printing. The actual burned books monument is nearby in Berlin: a very different monument. A web search for "burned books monument Berlin" brings up this image, along with images of the actual monument. The license holder of the image gave it an erroneous name, but apparently only the license holder (on Flickr) can make the correction. I have a screenshot of the search results, but can't upload it here because I don't own the images shown. If you repeat the search, you'll see what I mean.

      • People count on Wikipedia for accuracy, and that includes images retrieved via Wikimedia Commons.
      • If you cannot persuade the license holder to correct the label, can you delete the image for inaccuracy? So far, it seems there are no pages that use this file, so deletion should be simple.
      • I did search FAQ and other Help resources, but found nothing pertinent to this problem. This "new section" is the closest I could find to posting a question for resolution. I apologize, if this is not an intended use. My own talk page didn't seem to point toward resolution.

@Pro95mustafa: the NEF extension is for a proprietary “Camera Raw“ format specific to your sensor. It allows you to change exposure, colour balance, &c. after taking the picture, but it is not suitable for viewing online. Please export the image to JPEG or another common format; see COM:FT. I need to upload a modified version of a map, but my account is too new

As suggested on the upload file form, i added a new file by changing the name. What templates do i add to the new and old files to make sure that this (replacing old file with new version) is done? There's no identifiable copyright restrictions on the page, and I presume because they're over 150 years old, it should be ok?

Copyright help regarding File:Colonization Cycle.jpg

This is all very confusing, and I am extremely ignorant of the topic of licenses, but I am adding this image in hopes to bolster a project I am working on with a team of fellow students. This image, the Colonization Cycle, was one I clipped from a research paper from 1954 (Link to source: https://gupea.ub.gu.se/handle/2077/48733). After searching through the host website, there is mention of Open Access (https://www.ub.gu.se/sv/publicera/open-access), however, being a website based in Sweden, I do not know. This source (https://commons.wikimedia.org/wiki/Help:Public_domain) says I can use the {{PD-1996}} template for sources outside of the United States older than 1996, but again, I don't know. Not all governments have an exception for the copyright of their works. While governmental works of the United States federal government are free of any copyright, the same is not true for Turkey. Turkish government works are copyrighted and non-free unless a free licence has explicitely been granted at their respective website. So we cannot use the image you uploaded. @Samya90: Remember the overall ethos of Commons is to make files available to be freely used by anyone for any purpose. Anything which detracts from allowing a picture to be reused in this way is not helpful. Invisible watermarks are allowed but really obvious ones are not. Copyright rules in Turkmenistan

Hi, I would like to upload some pictures of buildings I took during my recent trip to Turkmenistan. I was almost about to publish some of the photos of the Türkmenbaşy Ruhy Mosque when I decided that it would have been better for me to check the copyright rules of the country first. According to this page, freedom of panorama is not ok, except in the following example: "Reproduction, broadcasting or communication to the public by cable of works of architecture, photography or fine art permanently located in a place open to public access, except when the image of the work is the main subject or it is used for commercial purposes" (i.e. incidental and non-commercial use, if I'm not mistaken). Does this mean that I won't be able to upload my pictures onto Wikimedia Commons? What about all of these? Why can they be on the site? These pictures, including the ones from flickr, are not covered by any exception to the copyright rules as far as I can tell. They only exist here because no-one noticed yet. Whoops, so it's my fault if many Wikipedias will now suddenly lose many of their Turkmenistan-related images! Are they going to be deleted? Full page scans to individual images

I am extremely new to wikimedia commons and have been part of the wikisource community for about a year so I apologize for my lack of knowledge currently. Through wikisource I was able to locate a pdf file that was scanned and uploaded to wikimedia commons as a pdf. I am attempting to convert the full page scans into just the pictures that show up on these scans so as to add them to the wikisource page. I'm not sure what the proper way to upload the new picture so as to tie it together with the original scan or if I even need to do that. if you could get back to me that would be great. Thank you! Then it is certainly copyrighted, if copyrightable. You'd need an explicit license from the author or authors of the "scheme" (I assume you mean an image of some sort, since we are on Commons), probably via the process outlined at COM:OTRS.

Should we allow everyone to upload photographs posted on facebook to Wikimedia Commons, and no need to send permission via COM:OTRS?

吹笛牧童 told me that it doesn't make much sense for him to request the uploader provide license confirmation from the copyright holder per COM:OTRS. The reason is because of OTRS does not guarantee that photographs are take by the uploader. If the photo itself has been grabbed from somewhere, which he then posted on his Facebook page, no one knows that he is not the author/copyright holder. However, many people are seem unhappy with my work with COM:DR. Reke and Liaon98 both thinks I had Asperger syndrome so that caused this problem. Andrew43 thinks that I shouldn't do nothing after using the template {{Delete}}. Most of what I do is the same as what all of us do, so I don't know what I did wrong to make them unhappy. How to categorize an image that belongs in two different cats

File:US Post Office-Winnemucca - Now used as Winnemucca City Hall.jpg is a NRHP {{NRHP|90000137}} but it is also the current city hall in Winnemucca, according to National Register of Historic Places listings in Humboldt County, Nevada on Wikipedia. Since both of the categories you created refer to the same building, it is better to use a single category. Probably the City Hall category, since it is the current use. There are categories for former post offices which would apply in this case. kennethaw88talk 18:28, 12 November 2020 (UTC)

Hello - I am a very infrequent contributor. I did create the 16th Virginia Cavalry page 10 years ago and add to things that I see once in a long while. Anyway, I did revert the above back to what it said for 9 years. The person who changed it seems to have a deleted profile. I do not see why there is a problem characterizing the significance of the first US soldier killed on non-Confederate soil in Pennsylvania as "regrettable". Casualties of war are all regrettable, as who wants people to die or be wounded? I hope there is regret for violence - and I hope Wikipedia supports this viewpoint as well. I see my phrasing as away from "hate speech" and towards "mourning the loss of a human being" - in this case, a Union soldier named William Rihl. we have no laws, but rules and policies. However, as everybody else we have to respect copyright laws.
When you make a screenshot from TV, a movie or a website, you are copying the work of somebody else, which is (nearly) always copyrighted. Except of cases where the original creator released his work expressedly under a free license (COM:L), a screenshot violates copyright.
You may find images released under a free license for example on Flickr. However, not all material on Flickr is free enough. Commons accepts only images released under CC-BY, CC-BY-SA oder CC-0. How to order categories within categories correctly

Hello,

I have done this before but cannot figure out how to do it now. See Category:Houses in Kansas by year of completion and notice that Category:Houses built in Kansas in 1882‎ and Category:Houses built in Kansas in 1883‎ are in the wrong order. I see: Category:Houses built in Kansas in 1882 and Category:Houses built in Kansas in 1883 are built using a template. Ans they sort correctly in Category:Houses in Kansas by year of completion. I didn't even go look, I just gave an answer that presumed the problem you described actually existed. It does not, at least not on my system. Maybe you have a caching issue? Natural landscapes in Turkmenistan

So, a few days ago, I posted this discussion, which basically made some "forbidden" uploads visible. These images, which have been available on Wikimedia Commons for a while, shouldn't actually be there, since they don't comply with the laws in Turkmenistan (cf. freedom of panorama in Turkmenistan). I have two questions regarding this: (1) Why are the images still on this project? Shouldn't they be removed, since they aren't supposed to stay on the site? (2) I'd like to upload some pictures of the deserts and other natural landscapes on Wikimedia Commons. Does this fall under the rules regarding freedom of panorama in Turkmenistan? Or can I freely do that? What about the Gates of Hell? They're technically manmade... Can I still publish these pictures?   • @Mariadbd13: I'm an admin here and I've literally never heard of "Creative Comments"; are you sure you don't mean something else?
  • When you say, "my photos of him" and "The photo belongs to me" are you saying you are the photographer, or just that you possess a copy of the photo? This will have bearing on whether you need anyone else's permission to legally offer a free license.
  • I'll admit to having zero experience uploading a photo via visual editor; the normal way for beginners to upload photos on Commons is via Special:UploadWizard. Once you've done that, it's easy to use it in a Wikipedia article. - Jmabel ! talk 03:12, 17 November 2020 (UTC)

It being an illustration for the ImportFreeImages extension, it is almost certain that they are free. We should credit the original uploader with enough sense. Je ne comprends peut-être pas bien votre question car je vois que vous avez pourtant déjà correctement modifié des pages dans le passé. S'il s'agit du fichier File:Monsieur le Duc de Chartres (1747-1793).jpg et que l'auteur est bien Nicolas Arnoult, vous pouvez aussi profiter de votre modification pour ajouter le modèle Creator:Nicolas Arnoult, ajouter la catégorie Category:Nicolas Arnoult, ajuster la date et modifier le modèle de statut. Il ne faut pas utiliser le modèle CC-zero avec une image qui n'a jamais été placée sous déclaration CC0 par son auteur ou par le propriétaire des droits d'auteur. Seul l'auteur ou le propriétaire des droits d'auteur peut émettre une déclaration CC0. I am sorry to inform you that you have triggered Special:AbuseFilter/153 by trying to cross-wiki upload png and smaller (<50,000 bytes or <2,000,000 pixels) jpg logos as a new user while leaving the summary intact. Such uploads of png logos are not allowed at all. You indicated each is your own work. Usually when someone uploads a logo, it's a copyright violation taken from the web. Please upload the full-size original of it, including any metadata, but it may be judged too complex to be under TOO in the country of origin, so you may need to publish the logo and your permission for it on your website or social media or send them via OTRS. Also, any png image will look fuzzy when scaled down (due to design decisions discussed in phab:T192744) or jaggy when scaled up, so you may want to upload an svg or jpg version, too. If you can't get a compliant license, the logos may still be uploaded to English Wikipedia in compliance with en:WP:F because we don't allow Fair Use here. @Vineyprincess: if it is not your own work, we won’t be able to host it here unless it is too simple to be copyrighted (according to the country of origin), old enough for its copyright to have expired, or published under an explicit free licence. However, if the article you wish to illustrate is already on the English Wikipedia, as Jeff G. said there’s a good chance you can upload the logo there instead, as non-free content (which should not be high-resolution) with a fair-use rationale. Replacing an outdated photo

Hello,

I work for the Town of Indian Trail in North Carolina. The picture on the Wikipedia page for our Town is of our old Town Hall (https://en.wikipedia.org/wiki/Indian_Trail,_North_Carolina). This is what comes up when people do a Google search for Indian Trail.

I have been tasked with getting it changed to a photo of our New Town Hall. I have never had to edit a Wikipedia page before, and I have been trying to read the FAQs and help articles to figure it out on my own. However, it is very confusing to me and I've had no luck so far. Can anyone break it down in layman's terms on how to do this?

What should I do if someone considers my work derivative?

Good afternoon! The other day I uploaded an audiofile. Some member of the community has marked it as a derivative work, although the author has just gifted it to me. Maybe the fact that the audio is performed by a man not by a woman has evoked his suspicion. And, since it is a gift, I suppose that this work is not derivative indeed, but still some formalities are left. @Марина Шумилина: Hello, There are three layers of work, and therefore three potential layers of copyright. 1) The original poem by Пушкин, which should not be a problem. 2) The translation published in 1949. 3) The recording of the audio. Numbers 2 and 3 are possibly not free. About the translation, you should specify who is the author of that translation and explain why you think you can republish it. If it is not free, the written permission of the owner of the copyright will be required. About the audio file, if depends who made the recording. If it is you, no problem. "Structured data", a complete pain in the ****

I've found a whole large batch of files where an incorrect location had been entered (somewhere in tropical Africa, for photos clearly stated to be from a zoo in France). OK, it's easy to change the location in the file text, it enters as 45.7772954|4.8555129 for Lat & Long. Save, fine. Get an error message "There is a discrepancy of 4110892 meters between the above coordinates and the ones stored at SDC (12°20′42″N 23°27′22″E, precision: 111 m). Please reconcile them". OK, now go to the structured data section, scroll down to the end. Enter the correct location. Doesn't work, because it is formatted differently as 45.7772954,4.8555129 with a comma not a pipe mark. So I have to re-edit it. Then I can't get rid of the old incorrect location, until I have saved the change and ended up with two locations, only then can I re-open edit and delete the wrong one, and finally save, for a third time. A complete pain in the ****, takes about 5 times as long as it should. Why isn't there an easy, automatic way of doing this, so that the first edit throws up a note "Do you also wish to change this in the structured data? How to delete a deletion template?

Hi, How does one remove a deletion template added by a bot to an image upload? I have uploaded a file with a copyright description, however a bot named "User:AntiCompositeBot/NoLicense" has tagged the image as not having sufficient information - (or perhaps because the information is in the wrong place in the metadata?). I have since added more copyright details. However I can't find a way to remove the bot's tag and could not find relevant advice in the forums. Please can someone advise how to remove the tag? @RottenBoroughs: Hi, and welcome. "Released to the public" does not equate to "Public Domain". Perhaps the information is subject to the OGL or some other government license in the UK, but I doubt it since the police's website is marked "© Copyright 2020. All rights reserved." in the lower left corner. It is incumbent upon uploaders to make sure what they upload complies with all applicable laws and policies before upload. The correct place for the license for File:Cleveland Police, UK - Force Structure.png is in the Licensing section of that page or on the "permission=" line of the Information template on that page, nowhere else. In the UK, information of any form released by a 'public body' - such as local or central government or any other public body - is considered 'public information'. This material does not attract any copyright limitations by default. (The rules differ for material published by a 'Crown body', or in the case of a public body releasing others' material protected by a previous copyright claim.). Regarding the Cleveland Police organisation chart, the file is able to be reposted lawfully. @RottenBoroughs:  Disagree The Cleveland police terms and conditions section of their website explicitly says copyright applies and permission must be sought. The final paragraph on page 2 of the document you yourself quoted above states: ”The supply of documents under FOI does not automatically give the person or organisation who receives the information a right to re-use the documents in a way that would infringe copyright" and that "copyright will still subsist in the information provided" in the immediately preceding paragraph. Also the police are not listed as a Crown body where Crown Copyright applies and therefore the OGL will not apply either. Freedom of Information (FOI) requests are also excluded from being covered by the OGL anyway - see section on exemptions in the terms of that licence. So I think express permission will be required from Cleveland police via the COM:OTRS process. By the way - please sign your posts with four tildes. Replying to 'Crep1711'  Disagree Thank you for your response. To address each of your points in turn. First, any copyright claimed by Cleveland Police in relation to content hosted on their website does not (necessarily) apply to information they are obliged to release by the terms of the Freedom of Information Act, 2000; in the same way that different information released by Cleveland Police by any other means may be done so under differing terms, licenses or legislation (for example to a court). The claim of website copyright is essentially irrelevant to released FOI material. However the website does expressly discuss copyright of material released under FOI, which I will address momentarily.

Second, the two quotations you kindly cited from the penultimate and last paragraphs on p.2 refer to a scenario where information released in an FOI response may *already* be restricted under a claim of copyright. I would agree with you that release under FOI does not automatically remove copyright and this has not been claimed.

Regarding your third point, perhaps there was a misunderstanding - I noted that the police are a public body - and do not represent a Crown body; hence restrictions or licenses (e.g. OGL) pertaining to Crown bodies do *not* apply.

Addressing the Cleveland Police's statement on copyright of FOI-released material on their website, here: <https://www.cleveland.police.uk/foi-ai/af/accessing-information/publication-scheme/>, the police (as a public body) give their consent for their material to be published provided they are cited and reproduction is done so accurately:

I would dispute that, as a public body, they have a right to claim copyright of their work, however this is a moot point as they have provided re-publication consent. The only real issue I can foresee arising is if a public body released information for which the copyright was held by a third party, e.g. a private individual or company. The mention of the website was to illustrate that Cleveland police do consider their material (in general) to be copyrighted. That said it can only be used with permission / under a licence. We both agree that OGL doesn't apply. You kindly linked to their own scheme. Unfortunately, the publication scheme you linked to isn't an example of of a 'free' licence. That is use by anyone, anytime, for any purpose. Wikimedia Commons can only accept files that can be so used. The problem with these narrative permissions are that they are often bespoke, with unacceptable clauses, and not universally recognised free licences. In this case the telling sentence comes right at the end: ”Material made available through the Publication Scheme must not be reproduced, copied or otherwise used for any commercial purposes." Uploading an image without an author/photographer

I am hoping to upload an Australian image to wikimedia commons but I am unable to find the author. The image is from a government website and it was taken before 1955 meaning any copyright has expired according to Australian copyright laws. Am I able to upload the image without an author? The image also has a watermark at the bottom showing it is part of the National Archives of Australia. An old painting with lost source

I have an image of Kunti from Pinterest (which is Painted by Nandalal Bose (3 December 1882 – 16 April 1966), and is very old (probably more than 60 years). @Ruslik0: I believe the Indian copyright term is 60 years p.m.a., which would only last until the end of 2026. However, since the paintings were not PD by 1996, they have URAA copyrights in the USA for 95 years after their first publication. So I would conclude that we can host pre-1932 paintings by this artist beginning in 2027, but his later works could remain inadmissible until about 2060, according to their dates.—Odysseus1479 (talk) 00:27, 22 November 2020 (UTC)

Can't upload image!

I am trying to upload an image to go with the "Popham Colony" page. The Post Office issued a stamp in 1957 commemorating the 350th anniversary of the founding of the colony, bearing an image of the 30-ton pinnace "Virginia", a ship built there in 1608.

I see I can't even add the image here. (It's my own file, that I made.) Disappointing.

Anyone can look at this image at http://www.jamesdire.net/popham.tif....you'll have to figure out how to open it. Windows 10 is now blocking all such files.

@AshlyJethro: Are you familiar with en:WP:COI? I'm guessing that your work on en-wiki involves a conflict of interest you have not disclosed.
Given that Transdev Blazefield owns the relevant copyrights (which would have to mean they have been signed over by the photographer or graphic artist to Transdev Blazefield), there are two possibilities here:
  1. On a website clearly under Transdev Blazefield's control, where these images are displayed, they can indicate an appropriate free license. I recommend {{CC-BY-SA 4.0}}. It possible, this is much simpler than the OTRS approach.
  2. They can go through the COM:OTRS process either to give licenses for a specific set of images or to indicate that you are authorized to upload on their behalf, and that licenses you indicate for their work can be trusted.

Hi @Timetorockknowlege: and welcome to Wikimedia Commons. I think the problem is, a reviewing editor doubted File:Ivanka Trumps Speech at RNC 2016.png was your "own work" based on their experience of the nature of the image. The tag "own work" has its usual meaning of work that is your own i.e. not somebody else's. In this case, it means that you took the photograph yourself. It seems that you may now be starting to understand this as I see you have since added it's true source, from the internet. However, you still have the author as yourself. When uploading files to Commons all information about it e.g. source and author must be accurate, with links if appropriate so anyone can check. In this case, the reviewing editor tagged it to get to the true source, even though 'own work' was already there. Unfortunately, now we have the source, I can see the source website does indeed carry a copyright © line in the footer, so the file in question will shortly be re-tagged, this time for speedy deletion as a copyright violation. Please take some time to familiarise yourself with the requirements of Commons as per your welcome message on your talk page, and Commons:Licensing is a good place to start. Hello! SVG issues.

I've been attempting to download the file "File:Coat of arms of Hungary (1896-1915; angels).svg" for a while now. My problem is that, starting today, files that are too large have been displaying as text when I try to open the SVG page. I've tried many external converters from text to SVG, because the text isn't downloadable. What do I do to fix this?

Uploading and Publishing

I uploaded images over a month ago and they have not been published. Obviously I am not going to spend a lot of time and effort taking any more photos if they are likely to be rejected for being inadequate for some reason. I need to know what was wrong with the last lot, so that I can either learn from it before taking any more, or stop submitting them if either my skill or the camera are unsatisfactory. If there wasn't anything wrong with them, but the delay is caused by the approval process being exceedingly slow, I would probably just stop submitting them as it wouldn't be practical to wait months for feedback between batches. There is no approval process here. As you upload them, they should be visible. Do you have any example filenames that could be looked into? I'll just point out that Commons has no control over how picture competitions are run, in case they haven't appeared on the relevant pages, but I see some competition entries from past years have made it OK. I went in and added the image I want to insert in Wikidata into Wikimedia Commons and copied the link from there for wiki to the Statements part for images and then get a message that "Could not save due to an error. File extension is missing." Unfortunately, the Copyright section of their website explains all copyright rights are reserved and there can only be limited reuse without permission. This is not compatible with Commons which requires files to be freely available for reuse - see Commons:Licensing. The website does say you can seek formal permission, so you could try asking if they are prepared to release a particular image under a fully unrestricted, free to use for any purpose, licence? I am still of the belief that it would fail a licence review for the reasons I first stated above. The fact you have found just 1 file, sourced from that website, out of more than 127,000 using {{GODL-India}} does nothing to change my opinion and previous advice. I'm writing in here as I think most uploads by Walter Grassroot is completely out of scope - He's uploading news videos from a Chinese Media at YouTube, and surely out of project scope. These news videos should be placed on WikiNews instead of here, and there are also concerns of propaganda here, especially these videos being used on the Chinese Wikipedia. I uploaded and contributed more than 8000 documents at Commons in the last 10 years, which include these 500 videos from China News Agency under CC 3.0 permission. Half, about 200 documents have been used in Chinese Wikipedia, including the news articles, folk cultures, ethnicities, industrialization, conferences, and social development also COVID-19 in modern China. In the meantime, I faced a series of personal abuses and attacks from Pro-HK-Protesters this year - unfortunately, 1233 is an outstanding representative. I should admit your excellent leadership in Wikipedia HK User Group because your members have waged over 50 battles against me in 2018-2020, including these documents usage in certain articles. I ought to express sympathy for some of your users who are still blocked by Zh-Wikipedia admins and appreciate your capability of igniting this disagreement at Wiki Commons. I really had no idea what abuse you faced - as it seemed more to be made up - but this amount of documents being uploaded (seemed to be mass uploaded) while some weren't used, and not assuming good faith, is much more of a serious issue. I'm not telling that all of the content should be deleted, but there are surely some (at least) out of scope as it is both news content and not used elsewhere. There are far more than 500 videos, and I do think that it is best to plan out where to use these content before it gets uploaded. The remaining content is more of a personal attack than anything contributive. I'll not reply, and the list of users who are at HK user group can be obtained from meta directly, and none of them are blocked at Wikipedia right now (plus I'm not leading the group now). Is it really that hard to not do the reverse as it is out of project scope and should be deleted if it is not used in Wikipedia.--1233 (talk) 15:38, 25 November 2020 (UTC)
I am confident that I have a higher comprehension of what a "project scope" is than 1233, who had uploaded almost no files onto Commons (less than 0.3% of my contributions at Wiki Commons). Meanwhile, I have my right to upload videos from Chinese state media with proper licensing, and you can feel free to upload as many videos from Voice of America or whatever anti-China outlets as you wish (and yes, please sir.). But you probably will not do that because you are less interested in actually contributing Wikimedia projects and go through the laborous encoding, uploading, and sorting process, but just fingerpointing at anyone you disagree with politically. Wikimedia Commons is a place where videos can be uploaded for archival and reference purposes without being used on any other Wikimedia projects. Offhand, I see no reason to think any of these are out of scope. Most files on Commons are not used on any other WMF projects. If Walter is running 50% use on WikiNews, that would suggest a very high ratio of highly relevant files. @Jmabel: , that's why I put here first: I would hope to discuss before I really start the deletion process/request and he started accusing without real context. Few things here:
  1. 500-1000 files are uploaded this way, and it is mostly used in Wikipedia not Wikinews. (And I don't know why news content is allowed there already)
  2. Political content from the source shows somewhat a propaganda message. And, if you really look into the webm content he uploaded, it came from a source controlled by the Chinese government.
  3. There are better archive sites, and Wikimedia projects are not for these content. There are locations, such as archive.org, to do what you hope to do: archiving. I'm just starting the discussion because it is a way broader issue than I've expected.--1233 (talk) 10:01, 26 November 2020 (UTC)

Hi! I have this category page I want to link to this Wikidata item. They are only linked by the Commons category statement in the Wikidata file, since there is no WP article. Move updated file to existing name

Hi! I tried updating an SVG to fix a typo in a label, but because I created an account just for this and it's too new, I can't overwrite the original file. As suggested by the file uploader, this is a request to move the new file to the existing file name.

May I upload 70+ years old pictures issued by government agencies and manufacturers?

Dear Friends, after reading the FAQ pages, I am still in doubt and I take the liberty to ask your kind help.

I just submitted for publication a Wikipedia page about the famous test pilot, Edwin F. Schoch, dead in 1951 - the World War II hero who flew the XF-85 Goblin.

His son, now 75 years old, provided all the information I needed, plus five pictures:

#01 was taken by a U.S. Navy photographer during Ed Schoch's flight training at Naval Air Station Jacksonville [Florida] which no longer exists, in the early 1940's;

#02 was taken aboard the USS Lexington at the end of Ed Schoch's combat tour (1945) by a Navy photographer, and my understanding is that the copyrights for armed forces photos from World War II have expired;

Is there a way to upload such pictures on Wikimedia Commons?

Transfer of Flickr images from other Wikis to Commons

New version of a picture with completely different content: How to sort out?

The File:S-Bahn in Bonn mit Haltestellen.jpg contains two versions. The second one has completely different content from the first. I couldn’t find out what’s the procedure to clean this up in a proper way. Any help appreciated. --S.K. Hi, well, the second image-version should never have been uploaded over the original image. However, that happened in early 2016! So, this was 4 years earlier than your renaming-request. In addition, the current content of the description-template etc. refers to the first image, as with the renaming nothing from the 2nd image has been transferred. @Túrelio: The File:Strassenbahn66 in Siegburg-Bonn.jpg now has a history and a description that indicates it was uploaded by Stefan Flöper on 23:34, 7. Aug. 2005‎. Rights to Intellectual Property

Hello There,

I am drafting a page for Stages of Learning, a nonprofit organization that I founded in 1995 and ran for several years. It dissolved in 2010 and granted me the rights to all intellectual property in perpetuity. I uploaded the board resolution here: [Resolution Authorizing Floyd Rumohr to Use Stages of Learning Intellectual Property.pdf].

I'm not sure if I'm doing this correctly because several editors are wondering about copyrights, which no longer apply because, as I noted above, the organization no longer exists. My aim with the page is to ensure the important work of the organization does not get lost.

Any advice is greatly appreciated.

  • @Floydrumohr: Under what country's law are you claiming that the dissolution of an organization would mean its copyrights no longer exist? I'm not aware of any country where that is how it works.

To Jmabel An organization that has dissolved can no longer retain any of its property, including intellectual property. All I am saying is that the board granted use of all materials to me in perpetuity whether or they are copyrighted so that the work can be shared in the absence of a formal organizational structure. You can attribute the worker using the author's username, Ro4444. If you want to get in contact with the user and ask if they would like to be credited with their full name, the best way to do that would be using Special:EmailUser/Ro4444. Elles m'ont été léguées par mon grand-père qui était un descendant d'Anton Docher, j'ai décidé d'en faire don à Wikipédia et elles sont présentes sur le site depuis 2011 sans aucun souci et pour cause... et soudain quelqu'un (qui?) veut les supprimer par je n'en suis pas l'auteur (forcément elles datent du 19ème siècle pour certaines !). On peut les supprimer au fond, si ça peut faire plaisir à certains, et ça ne me gêne pas, mais je trouve ridicule de se priver de ces photos pour de mauvaises raisons. Voilà, si quelqu'un peut aider ? En tout cas ça ne motive certainement pas pour continuer à abonder la base de données de Wikimedia Commons. Merci.

Hello, a Commons user is questioning the source of my Anton Docher's photos. These photos belong to me in my own (I possess the originals for decades). They were bequeathed to me by my grandfather who was a descendant of Anton Docher, I decided to donate them to Wikimedia and they are present on this site since 2011 without any worry (and for good reason)... User:Reke feels that my actions are destroying the precious and valuable works of other users

My response to User:Reke was bring your proposal to Commons talk:Copyright rules by territory/Taiwan, but he has been bothering me there for days. See: [6]. It is because of he is disgusted with the way that I was submitted this file to COM:DR per COM:FOP Taiwan. In fact, here he removed this paragraph: "works and outdoor 2D artistic" on freedom of panorama. I don't think there is anything wrong with my way, but he claims that the burden of proof lies with me and repeatedly asking me to check through the way in which I click on the url provided by the original uploader that to see the copyright notice on the website. Although I submitted file for deletion per COM:FOP Taiwan, he insists that 5P5 (which it means "Wikipedia has no firm rules") is right. In summary, he feels that my actions are destroying the precious and valuable works of other users. Did I really do something wrong? I need to say that Kai is not the first time to request a disputed action in commons. I got so much complain from several Taiwanese Wikimedian, most of they feel negative because Kai's action. However they even don't know how to appeal on here, in English especially.

Let me supplement some background about the case this time. Though the COM:FOP Taiwan said 2D works are not included, however it's easy to find some official document with opposite. And also, the picture was not uploaded by author but imported from a website of Ministry of Culture Taiwan. In most cases, Government departments will be more careful about copyright issues. If I was Kai, I would search more references about FoP to make sure the interpretation on Commons is right or not, instead of requested deletion without checking.

When I complained to him about his action, he answered me that he serves Wikimedia Commons, not any works uploaded from others. The thinking turned him into a Wikilawyering. Seriously, I don't like to discuss with him because it always spent me so much time. But if I don't be the bad guy, more and more volunteers would leave Commons. Please take a look at File:Memorybank2019-萬安國小振興分校.jpg. I think that the licensing information on the file indicating that the uploader gave permission for the photograph to be issued with a {{Cc-by-sa-4.0}} licence. As per the previous discussion, only he knows that photograph was imported from a website of Ministry of Culture Taiwan and quoting from the rule page: "(一)所有參與徵件之作品都應以CC授權 姓名標示-相同方式分享4.0國際(CC BY-SA 4.0)及其後版本進行釋出。". However, what I see is the licensing status of the file still using {{Cc-by-sa-4.0}}, so how can we expect that everyone will not submit it to delete in this case? Further, even if I have checked copyright and FoP, I'll still not see he see the rule page at https://memorybank.culture.tw/event/zh-tw/event_004/943 If what he said is true, why didn't he face the problem and try to solve it rather than ignore it or comes to my talkpage and quarrel with me.--Kai3952 (talk) 12:01, 23 November 2020 (UTC)
 QuestionCOM:FOP Taiwan stated that Reproductions of artistic works are thus only for non-commercial purposes. Note that "reproduction" in this context means reproducing the work in its original form... I wonder if the "reproduction" in the example given (aka Mural->Image->Postcard (for sale)) fulfills the "reproduction" meaning given in that section? According to the Article 58, if you want to reproduce a building as another building or copy a mural to another outdoor wall, you need to be authorized even for non-commercial. Reke has provided the Copyright Act of 2019 to me at Commons:Deletion requests/File:Memorybank2019-萬安國小振興分校.jpg, but as a matter of interest, I can't find anything about 2D art work.

There is nothing in the law that I see which restricts "artistic works" to 3D. They are separate from photographic works, and graphic works, etc., but I would think a sculpture or painting or mural would fall under "artistic works". However... point 4 of article 58 says that reproductions of public artistic works are not permissible if you are selling copies (i.e. one type of commercial use). By the wording in COM:FOP Taiwan, it's that clause which causes artistic works to (previously) be marked NotOK. For that matter, I would think photos of sculptures would also be problematic -- those are also "artistic works" per the law it would seem. It's just photos of buildings that would be OK, by the terms of article 58 and our definition/policy of "free", unless we interpret the 4th term to just mean exact copies. The question would be, if someone selling a postcard with this photo would violate the 4th part of article 58 -- if so, they are not "free", and therefore against policy, even though it's legal to upload the photo.   • Article 58 of the Taiwan 2016 Copyright Act explictly disallows reproduction of buildings or sculptures in the form of new buildings or new sculptures. It also does not allow reproduction of artwork in public places "solely for the purpose of selling copies". That leaves some ambiguity over whether a photograph of a building or sculpture would be considered a reproduction.       • Interesting. That would appear to be an interpretation that basically only pure copies (taking a photo of a painting, which amounts to a reproduction) are a problem -- that would then correspond to the general Berne Convention rule that any FoP conditions not allow a work to compete with the original in the marketplace (specifically, provided that such reproduction does not conflict with a normal exploitation of the work and does not unreasonably prejudice the legitimate interests of the author). One would think that that would also cover the second condition, a sculpture of a sculpture, but I guess you can't do that for any reason, whereas other artwork "copies" are allowed unless you are selling copies. It's also interesting because I think Japanese FoP has very similar wording in their law, which have also interpreted as building-only FoP. I'm not sure if any Japanese court cases have interpreted that, or not. But the Google Translate result of that Taiwanese government interpretation does seem to imply that it's only reproductions which amount to copies which are a problem, given that it's legal to sell copies of photos which depict works in their public setting.         • I read that as a narrow exception for graffiti on exterior walls in the painted villages, which are seen as decorative elements of the buildings as opposed to fine art works in their own right. The English version here is published by the Ministry of Justice and Article 58.4 explicitly prohibits "Reproduction of artistic works solely for the purpose of selling copies". If a photograph of a 2D artistic work could be cropped, resized etc. to make it into a commercial poster, a cheap alternative to buying the original, it does not belong on Commons.           • @Aymatth2: I can't quite agree with that. We keep de minimis and other types of FoP works even though it's possible to crop them to something that would infringe copyright (see the {{De minimis}} tag); I don't think this should be any different. Much like we keep photos of the Louvre plaza, even though the copyrighted pyramid is prominent in them -- it's only photos which crop to just the pyramid that we disallow. Agreed yes that a photo of a public painting which is cropped to mainly just that painting (such that its public context was not shown) would not be OK, but a photo of an entire building which contains a mural should be fine -- the same is true of any FoP law really, since Berne does not allow direct competition of the original. A photo which does not have any copyright over and above the original (a {{PD-Art}} situation if the original was PD, i.e. amounting to a copy) should not be allowed of course, or anything close to that. To me, FoP is only ever for works which at least show their public context (you might be able to argue that for closeups of sculpture, but not 2-D works). Also note that "pictorial and graphical works" are a separate category from "artistic works", and are not covered by Taiwan FoP -- the term "artistic works" in this law would seem to be more like "works of fine arts" from other laws (and the choice of words may just be a matter of translation). If we are allowing sculpture, then I don't see any reason we would not allow photos of murals which depict the mural in its public context. If cropped to just the mural, I would agree those are not allowed, but otherwise by that statement, photos like File:Memorybank2019-萬安國小振興分校.jpg should be OK. If someone alters it to remove the public context, well yes they are infringing, just like someone cropping a photo we keep on de minimis grounds, but we don't remove the works just because of that possibility. Yes, a high-resolution image may have a de minimis copy of a copyrighted work that could be wrongly cropped out and used for commercial purposes, but the copyrighted work must not be a significant part of the image. I like the test that the image would be just as good if the copyrighted work was masked out.               • That is a good test for de minimis, but our policy covers a more than just that legal concept -- it is also about elements that are inherently there, when photographing a larger subject. See the France section on the de minimis page, and a couple of U.S. decisions have been ruled the same way. s:Ets-Hokin v. Skyy Spirits, Inc. states that a photo of a bottle is not derivative of the bottle's label, even if quite prominent -- only photos focusing on the label itself. That would fail your "blotting out" test but was in fact ruled to be not derivative. France's ruling was fairly similar. If you feel photos of sculpture is OK, even though there is a prohibition on them being used solely to sell copies, then I think photos of buildings with murals on them are also OK -- they are covered by the same FoP rule. If you are focusing on the mural itself to the exclusion of its public context, I would say only then is that a problem. It sounds like the fourth element is more along the lines of "can't prejudice the normal rights of the author" which is part of just about every other FoP law. There are many FoP laws which cover 2D works just fine that we allow, with the only problem if someone tries to upload a crop that amounts to a copy. Carl Lindberg (talk) 22:17, 7 December 2020 (UTC)
If the billboard was protected and Freedom of Panorama was not allowed, would this violate copyright?
  • A few separate points:
    • We must consider both Freedom of Panorama and De Minimis rules for outdoor photographs in any country. If the law prohibits copies of protected works and we have no examples of De Minimis rulings, we must interpret De Minimis strictly. The test that the protected work could be masked out of the picture without harm is a reasonable one. It is possible that even that is too permissive for Taiwan.
    • s:Ets-Hokin v. Skyy Spirits, Inc. is a poor example. It says "The photographs at issue cannot be derivative works because the vodka bottle—the alleged underlying work—is not itself subject to copyright protection." That is, if the bottle was protected the photo would be derivative and violating copyright.
    • Countries often treat 2D depictions of 3D works as different from 3D copies of 3D works or 2D copies of 2D works, since a 2D depiction of a 3D work is unlikely to satisfy someone who might otherwise buy the 3D work. They want a house or a statue, not a photograph. The 2D depiction is not a "reproduction". The explicit prohibition of 3D copies of 3D works suggests that Taiwan may not consider 2D depictions of the 3D works to be copies and therefore prohibited.
The idea of "focusing on the mural itself to the exclusion of its public context" is too vague. What would be an acceptable ratio of mural to context in the photo? 1:100? 100:1? Can the mural (in its context) be the primary subject of the photo? As far as I understand the situation, when the Taiwanese government recently revised Article 58, it greatly narrowed the definition of outdoor 2D work reproduction. For example, if the artwork is "painted on a wall" instead of "a painting that hang on the wall", the photo is usually not considered a reproduction. Because the material and space of the wall are part of the mural works, and that can't be reproduced on a photo. Only if the painting is applied to another wall based on the photo, that will be regarded as a violation of Article 58.--Reke (talk) 07:56, 11 December 2020 (UTC)
@Aymatth2: Sure, those must all be taken into consideration. On the other hand, "interpreted strictly" should not include the expansion of assumed copyright beyond litigated bounds -- and frankly I have not heard of cases of actual copyright infringement in the "incidental" or "accessory to the main subject" situations. We include the latter in our de minimis policy. The only rulings I'm aware of for those situations have all resulted in non-infringement.
Ets-Hokin is not a poor example. The bottle itself was not copyrightable, and the photo was of the entire bottle. The label happened to also be below TOO in that case, but the ruling pretty clearly stated that the photo would have been fine even if the label was copyrightable -- only photos focusing on the label (i.e. the copyrightable work) would be an issue. If the bottle had been a copyrightable work itself, then yes the photo would have been focusing on that, and would be derivative. Photos focusing on statues have been ruled infringements in the U.S. multiple times. But in addition to Ets-Hokins, there was a similar Florida ruling on a photo of a motorcycle, which had a very copyrightable custom graphic painted on it -- the photo was not derivative (though the case ended up ruling on the contract status). The French ruling was on a photo where a building was quite prominent, but the photo was of the entire street, so was not derivative. As for your photo example above, the photo is focusing on the billboard so yes that would be a derivative work without FoP (which the U.S. does not have outside of buildings) and if the billboard was still under copyright (there does not appear to be a copyright notice, so the billboard was likely out of copyright as soon as it was put up). If we could show court case examples where incidental inclusion when focusing on a larger subject was ruled infringement, that could matter. But I don't recall any such cases being brought up here, over the entire history of copyright. It is true that very intentional inclusion can be a problem -- there was a U.S. case where a fashion photographer had the model wear a pair of copyrighted glasses, and that photo was ruled derivative even though the photo was primarily of the clothing, since the inclusion was not incidental at all and the expression in the glasses enhanced the expression in the photograph. It's not really a matter of "percentage of the photograph" therefore, as opposed to true legal de minimis, where the "blurring" argument is much much better.
Countries often do treat 2D works differently, but not always. In this case, the law makes no such distinction -- just restricts to certain types of work, some of which can be 2D. Most types of 2D works are not covered, of course, but the law makes no specific mention of dimensions. There is the overall Berne restriction that freedom of panorama cannot result in a work which competes with the original; most laws repeat the Berne text almost word for word, but I don't see that in the Taiwan law -- so it's very possible their clause 4 is simply their version of that. There is freedom of panorama for buildings which is outside the scope of clause 4 anyways, so a photo of an entire building may not be derivative of any artwork on it. If the photo is focusing on the artwork itself, then you'd have to rely on the "artistic work" clause -- and in their translation / definition, "artistic work" is a very specific type of work, not just any work, excluding literary and photographic and other types -- seems more like "works of fine art" in most other law translations. That probably should be spelled out better on the FoP page -- most people might assume that the term "artistic works" covers most anything, whereas that's not the case in the Taiwan FoP exception. But murals sound like they are covered by FoP as well, so they may be OK if they are not considered a true copy (clause 4). I find it hard to assume a 2D restriction based on the cited governmental interpretation -- graffiti is 2D and that appears fine. The more official sources the better -- Reke, can you give some reference for the "painting hanging on a wall" versus painted directly on the wall itself? By the translation, both would be "artistic works", but maybe it's only the painting hanging on a wall which could end up being a problem under clause 4, so photos focusing on those in particular may be a problem due to clause 4.
