picture that I own, creator unknown

I own the picture of Portuguese painter. It was taken by a professional photographer sometime in the 1960s. I do not know who took the picture, and I don't think there is a way to find out. The picture came to me as a descendant of the painter. I would like to make it part of wiki commons. Can I do so? — Preceding unsigned comment added by Popov1961 (talk • contribs)

  • The picture would almost certainly still be copyrighted, and without knowing who the photographer was, I don't see how you could possibly arrange a release of rights, so I don't see how you could meet our criteria. The only exception is if it were take in a country with very limited copyright protection for photographs, but I'm not aware of anything unusual about Portugal in that respect. Physical ownership of the photo is completely irrelevant to ownership of intellectual property rights. - Jmabel ! talk 05:05, 2 August 2015 (UTC)

Photographs containing copyrighted content

Howzit all.

I noticed that another contributor marked a file for deletion because it may contain copyrighted/non-free content. The photograph itself was taken by an individual who has released it under a free licence, but there is an emblem somewhere in the picture's context that may be non-free. What exactly is the clear cut policy for free-licenced photographs which capture an instance of a copyrighted work somewhere in said photograph? As this can range from anything to a picture of a car with an ostensibly copyright manufacturer's logo or a crowd shot of refugee children wearing the copyrighted anime Hello Kitty on their shirts I'm more concerned about the slippery slope as opposed to any individual files. There needs to be a very definite, very clear, line drawn on this and if a conclusive judgment has been made in the past I'd appreciate being directed to it.

Thanks, --Katangais (talk) 11:25, 29 July 2015 (UTC)

If the copyrighted image is de minimis, then it can be ignored. There is no hard and fast rule about this, but essentially the copyrighted image can't be the focus of the photograph. For example, if the Hello Kitty T-shirts are not very obvious and the viewer's attention isn't drawn to them, then their appearance in the photograph is probably de minimis. On the other hand, if it is quite obvious (and, for example, someone uses the photograph to show the popularity of Hello Kitty all around the world), then arguably the copyrighted images are not de minimis. — SMUconlaw (talk) 13:21, 29 July 2015 (UTC)
Thank you. The context in question involves the Category:Police patches and certain files in a sub-category of Category:Police patches by country, where it was argued that uniform patches worn by law enforcement are considered nonfree emblems - even if the photographs of the patches in question are released under a free licence. I initially disputed this logic because I was concerned about the precedent: so many images on Commons depict law enforcement agencies or their paraphernalia, replete with insignia, that to begin deleting one was to challenge the legitimacy of all. Hence, I argued that the photographer's free licence should take precedence over the question of the insignia's status.
If the rule of de minimis is applied, then - as unlikely as it seems - I wonder if all the files in both categories I linked to could be called into question. --Katangais (talk) 16:28, 29 July 2015 (UTC)
I'm afraid the police patches are definitely not de minimis. The only ways a particular photograph could be retained would be if the design on the patch depicted were so old as to be out of copyright, or if the police department in question agreed to license the copyright in the design under a free licence. — SMUconlaw (talk) 16:37, 29 July 2015 (UTC)
It's not safe to question all images in these categories, at least without checking first. If File:Philadelphia Police - gang with vehicle.jpeg had been taken more zoomed-in, showing just the officers and their uniforms, it would have been reasonable to put this in Category:Police patches of Pennsylvania because they're wearing an interesting assortment of patches, but in such a case the content is clearly de minimis. Also, note that some US police patches are by definition in the public domain; federal police agencies' patches would be some form of {{PD-USGov}}, for example, and anything in Florida would be {{PD-FLGov}}. Strange {{Tfd}} tags on files

A bunch of image pages have a {{Tfd}} tag [1] but whose link points to a COM:DR for the image and I don't see any template on those file pages that is undergoing deletion-discussion either. Possibly stray material left over from an en.wp→commons migration? There are only a few dozen, easy enough to remove, but I wanted to get a second opinion in case there was some detail I was missing. Grab Image and Upload to Commons

I have obtained permission to use an image from a web page to improve a Wikipedia article. Can anyone advise the best method of grabbing the image and uploading to Wikimedia Commons? I have performed a grab using Ctrl + Prt Scrn and then saved the required image in JPEG format using the Microsoft Paint tool but the uploaded result seems to be too small. Assistance appreciated. Clivemacd (talk) 15:44, 3 August 2015 (UTC)

  • You would be best off following the procedures at COM:OTRS to confirm the release under a free licence. Regarding the actual image, you should be able to right click on the image and save it to your computer, from there you can upload it to Commons. ColonialGrid (talk) 15:56, 3 August 2015 (UTC)
    • And you definitely want to right-click and save rather than doing a screen grab. You want the full resolution of the underlying image, not whatever happens to be the display size on your screen. - Jmabel ! talk 17:13, 3 August 2015 (UTC)

Photo Uploaded Prematurely - Can It Be Replaced?

Hello,

I recently uploaded a photo of a living person that was taken by someone else, following the procedure listed here. The procedure under "If you are not the copyright holder" states:

  • Contact the copyright holder and ask them to release the work under a free license
  • If the license authorized by the copyright holder is appropriate to Commons, then upload the image and add the "subst:op" tag
  • Ask the copyright holder to forward the e-mail with a clear statement of permission to permissions-commons@wikimedia.org
  • A volunteer will check the e-mail in the OTRS system to verify the permission provided by the copyright holder and, if the permission is valid, replace the OTRS-pending tag ("subst:op") with the "PermissionOTRS" tag.

I followed this procedure to the point of uploading an image with the "subst:op" tag, but then I realized that I needed to modify the image. The image contains a logo of a company, and I don't feel comfortable including the logo in the image. The image is here: https://commons.wikimedia.org/wiki/File:Rick_Shutter.JPG

The original copyright holder has given verbal permission for the modified image to be used and is willing to e-mail a declaration of content re. the logo-less modified image to the permissions-commons@wikimedia.org e-mail address. But the original image, with a "subst:op" tag but without a followup e-mail from the copyright holder (because I aborted the process), is the one that's on Wikimedia.

Is there any way I can get that original image removed and still use the same URL for the corrected image?

I do apologize for prematurely updloading an image. I should've thought things through better. Thank you for your help Kekki1978 (talk) 07:16, 7 August 2015 (UTC)

The only logo I see in that photo is on the drum, and I think it would count as de minimis and possibly not even copyrightable (since it appears to be just a letter), so it should be fine as it is. If you did want to replace the image, you can use the "Upload a new version of this file" link on the page and ask an administrator to delete (or make invisible?) the old version. I'm not sure if there's a template for that. --ghouston (talk) 08:33, 7 August 2015 (UTC)
Ghouston, thank you for your help. I uploaded a new version. The letter on the drum is the logo of a drum company and I didn't want to get the musician in trouble over any competing endorsement contracts he may have. Kekki1978 (talk) 13:41, 7 August 2015 (UTC)
Once we have permission for the original work we don't need a separate permission for the derivative work with the logo removed. - Jmabel ! talk 17:16, 7 August 2015 (UTC)

How to respond to a message about multiple images in the way the editor is requesting

Where do I write my response(?) -- MarchJuly sez "Put it on your Talk page." -- OK, got that, but where? Do I make a new section or what? Then, when I do, do I supply a link back to the article the images appear in OR to one (or all) of the images in questions OR what? Then, how does MarchJuly know I've responded? -- "MarchJuly sez put a Talkback notice on my talk page." OK, got that. Which one of the dozens of template does this and only this and properly refers back to... um... uh... where I'm supposed to refer back to in order to respond to concerns about copywrite permissions. — Preceding unsigned comment added by Rmark1030 (talk • contribs)

  • I can see no communications between yourself and Marchjuly beyond the templates placed on your talk page. However, I'll address the concerns about the images, as I suspect that is the issue you actually want resolved. You've uploaded a set of images which don't appear to be your own work, they depict art works, so Marchjuly has tagged these images as having insufficient permissions; that is that there is no evidence that the original artworks are available under a free licence, and that your images appear to be derivative works of copyrighted material. As was mentioned in the templates, we cannot host material which is not available under a free licence, hence, unless the images you have uploaded are proven to be free, they must be deleted. If you know the artist (as alluded on your talk page) you should get them to follow the procedures at COM:OTRS and confirm that they are available under a free licence; you should however mention that this would mean that others could sell prints for profit without needing permission, as the images would be available under a free licence (some artists may be uncomfortable about this). If, however, you do wish to communicate directly with Marchjuly, you should place your message here (make sure to write a Subject/headline: to your post). List of all Wikimedia Commons Files

I am trying to get a list of all the file names (not the files themselves, just the names of all the files) in the Wikimedia Commons (this wiki). I know that inside Wikimedia Dumps there is a backup dump called "List of all page titles" for each wiki database. I thought commonswiki would provide me with this information but it does not.

To give an example, here is the complete URL to a picture of Donald Trump: https://commons.wikimedia.org/wiki/File:Donald_Trump_by_Gage_Skidmore_4.jpg. Here is another one of Hilary Clinton: https://commons.wikimedia.org/wiki/File:Hillary_Clinton_official_Secretary_of_State_portrait_crop.jpg. Here is one of the White House: https://commons.wikimedia.org/wiki/File:White_House_06.02.08.jpg. What I'd like is a complete list of every file name in the Wikimedia Commons. Something like this:

. . .
File:Donald_Trump_by_Gage_Skidmore_4.jpg
. . .
File:Hillary_Clinton_official_Secretary_of_State_portrait_crop.jpg
. . .
File:White_House_06.02.08.jpg
. . .

Whether or not the namespace "File:" exists in the list is insignificant. All the ellipses (". . .") would of course be replaced with all the other file names. --Doorzki (talk) 01:46, 9 August 2015 (UTC)

There are Special:AllPages and Special:ListFiles but I doubt that they would be very practical. Considering that Commons has 27 million files a single full list of them would be so long that it would likely brake a normal wiki page. There might be some api or database query but I don't know exactly. MKFI (talk) 07:57, 9 August 2015 (UTC)
  • Why do you want this? If you are looking for something more specific than everything, we may be able to help. But, as it stands asking for incredibly large chunks of data with no explanation probably doesn't endear anyone to digging around a lot for a work around. Access to image description from Wikipedia

Hello. Is it possible to access some image description from Wikipedia. For example I want to get bulgarian description from File:Ocelot.jpg in bgwiki. --Termininja (talk) 10:50, 9 August 2015 (UTC)

  • There is currently no automated way to access the descriptions from other sites such as Wikipedia. And I think that's as it should be: you wouldn't want a modification to the description on Commons to change Wikipedia content. As an editor, you'd have to copy and paste it as a caption; otherwise, as a user, you'd have to click through. - Jmabel ! talk 16:31, 9 August 2015 (UTC)
Not exactly! The description is one, it describe the image, and it not vary on all different places where the image is used, so it has to be part of the image (they both has to go together) and description has to be changed automatically on every site where the image is used when it be changed here in commons. This is normal and what editors want, because it is unproductive description to be changed by hand on every place where the image is used. Of course, if the editor want to change description it has to be possible, but by default description has to be taken from here, where the image is stored. --Termininja (talk) 22:31, 9 August 2015 (UTC)
  • But this would override the descriptions used in different articles, which may be highlighting different parts of the image. It's best to leave the editors of content on Wiki's (and other re-users) decide what caption would be best for an image in each specific instance of its use. Another consequence would be Wiki editors bringing content disputes from article pages to our file-pages. ColonialGrid (talk) 05:34, 10 August 2015 (UTC)
Of course, but this are private, rare and unusual cases, and this is why I said "if the editor want to change description it has to be possible", but the normal case is: one image - one description which describe it. For example let take the Picture of the day - "Sculptures of the kings of Judea at the west front of Notre-Dame, Paris, France.", Great! How much can vary this in different pages, in 90% of the cases this will be the right description. Furthermore the description is already pinned to the image, why to not be possible editors to access it, I don't see any reason...
Ok, this was how I see the things, it not depends on me, you decide it, I just made a suggestion. Thanks for the information:) --Termininja (talk) 06:08, 10 August 2015 (UTC)
  • Do you simply mean that you want to add a Bulgarian description to an image page? Or, do you want the description to automatically become the caption for an image on all Wikis? ColonialGrid (talk) 06:26, 10 August 2015 (UTC)

- — Preceding unsigned comment added by Nina Gille (talk • contribs)

Description field does not appear on uploading screen → upload fails

I have a problem regarding the upload screen: Immediately after the upload page has loaded, I get the same confirmation query which normally appears when trying to leave a wikipedia or commons page before the edit made has been saved. After confirming that I would like to stay on the page, I can continue with the uploding procedure but the uploading screen lacks a description field and so it is not possible to add a description to the file to be uploaded. This results in an error message that appears at the bottom of the page after klicking the upload file button, saying that I have to add a file description. There is no upload allowed without a file description but I can’t add a file description since there is no field on the screen for doing so. What is wrong? How to request that a gallery page be moved to the Category: namespace?

The subject line is fairly self-explanatory. {{Move}} insists that it can only be used in the Category: namespace. I want to propose to move the page Lurë from the gallery namespace to Category:Lurë, since it is a page that is disambiguating categories. However, I can't find where or how to make this proposal. --R'n'B (talk) 21:04, 31 July 2015 (UTC)

The problem is that the empty category that will created as a result of this move may be deleted. Ruslik (talk) 15:52, 1 August 2015 (UTC)
The categories listed as disambiguation options could be placed as subcats. That is, the main topic "Lurë" is the same, and the entities listed are various topics related to it. DMacks (talk) 19:30, 1 August 2015 (UTC)
R'n'B, Ruslik0, and DMacks, more than 5000 of our more-than-6000 disambiguation pages are categories; see Category:Adirondack for an example. I don't think normal users can move pages over redirects here at Commons, but if it can be done, the idea of a disambiguation category should be fine. You're probably best off asking an administrator (COM:AN) to delete the Category:Lurë redirect, because this should enable you to move the gallery page. Nyttend (talk) 19:10, 3 August 2015 (UTC)
Category:Adirondack is an interesting example. The disambiguation category entries are manually entered in the category page itself rather than being category: tags on the entries. Why not use the standard categorization mechanism? That would help avoid having a {{Catredir}} listed (I just manually corrected it to point to the real cat). DMacks (talk) 19:51, 3 August 2015 (UTC)
This is the normal way of disambiguating categories. Glancing at Category:Disambiguation shows that most of the disambiguation categories are empty, and Category:Non-empty disambiguation categories exists to track disambiguation categories that incorrectly have anything put into them; it would be much less functional, much less convenient to use, if the non-ambiguous categories simply became subcategories of the ambiguous one. Nyttend (talk) 20:05, 3 August 2015 (UTC)
Ah now I see. In that case, the only common aspect of the entries is the name (they're not treated as subcategories of the parent idea). I don't think that is a good example for the original case at hand, where the entries share the name because they are all related to the idea with that name (actually sub-ideas, not overlapping generic terminology). DMacks (talk) 20:11, 3 August 2015 (UTC)
DMacks, aside from disambiguation and normal categories with a name as their theme (e.g. Category:Saint Paul churches in the United States, the subjects of which aren't particularly different from Category:Saint Joseph churches in the United States, aside from their dedications), merely sharing a name shouldn't be the basis for categorisation. When two things share a name because they're related, we need to pick some other way of identifying the parent. Here, it's simple: the park can be a subcategory of the municipality, because it was within the municipality until (according to en:Lurë) the municipality was merged into another one. I don't think we need to do anything name-related beyond that. Nyttend (talk) 11:48, 6 August 2015 (UTC)
There's no need to move anything. Just restore the previous version of Category:Lurë that was already a disambiguation and request deletion of Lurë (I think cross-namespace redirects are considered a bad idea?) No significant history would be lost. --ghouston (talk) 22:43, 4 August 2015 (UTC)
Thanks. That's what I've done. --R'n'B (talk) 23:36, 11 August 2015 (UTC)

I am an editor for Wikipedia, but this time I'm writing as a User. The following page

                   https://commons.wikimedia.org/wiki/Commons:Reusing_content_outside_Wikimedia

is absolutely impossible to understand. For me anyway. I just cannot follow it. There is a lot of very specific language that is unfamiliar to me. All I need to know is how to credit the photographer of a pic on Wikimedia Commons, in this instance, https://commons.wikimedia.org/wiki/File:Clethra_barbinervis2.jpg We're a small nonprofit, and I'm going to credit as follows: KENPEI/Wikimedia Commons, but I have no idea whether this is sufficient.

Some examples could definitely help.

Thank you, Bland Crowder — Preceding unsigned comment added by Blandcrowder (talk • contribs) 14:10, 12 August 2015‎ (UTC)

No, that is not sufficient. As Commons:Reusing content outside Wikimedia explains, the file description page (File:Clethra barbinervis2.jpg) includes a link to the full text of the license(s) under which you may use the file. In this case, you can use the file by complying with the requirements of at least one of the following licenses: the GNU Free Documentation License, version 1.2, the Creative Commons Attribution Share-Alike 3.0 Unported license, or the Creative Commons Attribution Share-Alike 2.1 Japan license. Depending on which license you choose to use, there are different requirements, but perhaps the most notable requirement that your proposed attribution fails to meet is that all of them require you to at least mention the license (and the GFDL requires you to include a copy of the whole license). You do not need to credit Wikimedia Commons unless the author has explicitly made it a requirement (and they haven't in this case). LX (talk, contribs) 19:49, 12 August 2015 (UTC)
You can read Commons:Credit_line. The simplest atribution line (for Creative Commons Attribution Share-Alike 3.0 Unported license) will look like User:KENPEI / CC-BY-SA-3.0. Ruslik (talk) 20:06, 12 August 2015 (UTC)

I uploaded photos to commons, can I delete it?

can I delete the pics that I uploaded to Wikimedia Commons? if it is possible how to do that? please help me (WalidMatar (talk) 08:37, 13 August 2015 (UTC)) WalidMatar (talk) 08:37, 13 August 2015 (UTC)

  • Typically no, unless it was a very recent upload, in which case we would allow this as a courtesy. Assuming it is your own work, when you uploaded it, you would have granted an irrevocable license. If there is a specific reason to delete it besides "because I want to", then you can nominate it for deletion just like anyone else's work. - Jmabel ! talk 18:40, 13 August 2015 (UTC)
@WalidMatar: I assume you are talking about these photos:
All of these (except #1) are currently in use on various sister projects of Commons. On the description of all five images you uploaded in 2012 you indicated that you personally took these photos and licensed them under the terms of the Creative Commons Attribution-Share Alike 3.0 license. Is that information accurate, that is, are you the photographer who originally took these photos and did you license them under the CC-BY-SA-3.0 license in 2012 or did you upload photos taken by someone else? —RP88 (talk) 18:49, 13 August 2015 (UTC)
The EXIF data of the above listed files strongly suggest that these photos were shot by several different photographers. --Túrelio (talk) 19:01, 13 August 2015 (UTC)

Can you upload press photos from automakers?

There are no photos of the G11 BMW 7 series, and BMW has posted photos in their press kit. I'm wondering if these can be uploaded. Thanks. — Preceding unsigned comment added by Jaredclce (talk • contribs) 18:17, 13 August 2015‎ (UTC)

Usually not, since it is rare for the photos accompanying a press release to be licensed under a license acceptable on Commons. For example, BMW's press site press.bmwgroup.com has the following terms: "The material provided here may only be used for press purposes. The text, images, graphics, audio data, sound files, video files TV footage as well as any content of this website are all subject to copyright and other intellectual property protection. These objects may not be copied for commercial use or distribution...". This falls well short of the Commons requirement that media be useable by anyone, anytime, for any purpose. —RP88 (talk) 18:39, 13 August 2015 (UTC)

Want to put attribution on images for Facebook

Hi

I would like to attribute the photos from Wikipedia I use on my Facebook profile. I thought I was doing that when I was using the annotation tool. But the annotation does not download with the image. Could you please offer some guidance?

Thanks

NegMawon (talk) 18:53, 13 August 2015 (UTC)

  • I'm not sure what you mean by "the annotation tool". Could you provide a URL or a screen grab or something that makes it clear what you are talking about?
  • This page where you are asking your question is on Wikimedia Commons, not Wikipedia. If your question is specific to Wikipedia in some language (e.g. the English-language Wikipedia) you need to ask it there. I can't tell, since some images are stored there, and some here, and you haven't indicated any specific page.
  • Different images here are differently licensed, so there is no one consistent way to properly attribute them. For example, public domain images do not require any attribution at all. Other images require attribution as specified on the particular file page. For example, my image File:Starry Sky off Westport, WA 01.jpg is licensed under either of two licenses. The simpler of these is the Creative Commons Attribution 3.0 Unported license, which requires you to give my name ("Joe Mabel", as indicated on that page) and, at least, the name and a link to the terms of that Creative Commons license (just like that page does: it links to the terms at https://creativecommons.org/licenses/by/3.0/deed.en).
  • There is more that might prove useful at Commons:Credit line.
  • I could probably give you more specific help if you would indicate what image(s) you are interested in. - Jmabel ! talk 05:02, 15 August 2015 (UTC)

I am an employee of Holy Cross Athletics and need to update the logo of the page.

We conducted a brand refresh last year, but the image on our Wikipedia page does not properly reflect that.

Is there a way I can update our mark without being a verified user?

Thank you! — Preceding unsigned comment added by Holy Cross Crusaders (talk • contribs)

  • You've asked this at the help desk for Wikimedia Commons, but the question would seem to be about the English-language Wikipedia.
  • Commons accepts only public domain and free-licensed images, so Commons would not be an appropriate place to upload the logo.
  • To replace a logo that is used in the English-language Wikipedia on a fair-use basis, you'll need to upload the replacement to the English-language Wikipedia. You can get help there at . I suggest that if you can't upload the logo yourself, you should make a request for someone else to update it, indicating a URL where the logo exists as a file online so that they can upload that.
  • Feel free to ask follow-up questions here if the above doesn't make sense; if the en-wiki people don't solve your problem within a day once you've done what I just suggested, come back here and I'll follow up on en-wiki. - Jmabel ! talk 04:43, 15 August 2015 (UTC)

HOW TO USE SCRIPT TEMPLATE IN WIKIMEDIA ?

How to use script template with ISO code in Wikimedia, if it's not possible, can you please add these template in wikimedia engine  ?

  • I'm confused as to what you are trying to do. As far as I know, you can create a template on Wikimedia Commons just like anyone else can. Did you try and fail, or did you not yet try? Also, I'm unaware of any syntax where there is a space between the curly brackets. Did you really use "{ {...} }" on the page (which won't work) or "{{...}}"? - Jmabel ! talk 04:49, 15 August 2015 (UTC)

If I understand correctly, you would like to link to a term in wiktionary? Template:term is a Wiktionary template (wikt:Template:term) and does not exist in Commons; Template:script does not exist in Wiktionary either. Since wiktionary is another project from Commons you should use {{W}} instead:
{ {W|1=דרג#Hebrew}}|2=דרג|3=wikt} } gives דרג
Hebrew right-to-left text in templates may be a bit clumsy to input in Commons (as seen above), but it does work. There is also {{Ltr}}. You might try to ask more help from other Hebrew speaking users: Category:User he. MKFI (talk) 09:07, 15 August 2015 (UTC)

You can always use <span>. If you could give us some kind of example from Wiktionary as to what you are trying to do we might be able to better help you. Specifically, wikt:template:script does not exist; I really can't see how your original example is supposed to work in Wiktionary either. MKFI (talk) 11:52, 15 August 2015 (UTC)

Reuse of photo

I am a journalist with The Indian Express newspaper, for which I also write a weekly blog. On this blog, I would like to use the photograph of the Beatles' arrival at Kennedy airport. File:The_Beatles_in_America.JPG Your information about the photograph makes it clear that it is now in the public domain, but there seem to be some ifs and buts. How can I protect myself from any infringement claim in the future? — Preceding unsigned comment added by 203.200.81.107 (talk • contribs)

Hi,
We don't give legal advice, but this picture comes the US Library of Congress, and was taken by a unknown journalist of the United Press International. The staff of the LoC checked the copyright and didn't find any, but if you need more information, you either need to contact the LoC or a lawyer. Regards, Yann (talk) 14:47, 16 August 2015 (UTC)
As you can read from the license tag "This work is in the public domain because it was published in the United States between 1923 and 1977 and without a copyright notice. Unless its author has been dead for several years, it is copyrighted in jurisdictions that do not apply the rule of the shorter term for US works." You need to check for yourself whether India falls among the cited jurisdictions. --Túrelio (talk) 14:51, 16 August 2015 (UTC)

What kind of image license does this have?

Alright, so I've decided to replace the image on the Galaxy S6 article on Wikipedia with an image I made on a free app called "Perfect Screenshot".

App: https://play.google.com/store/apps/details?id=com.mikedepaul.perfectscreenshot

Alright, so the image is right here (http://i.imgur.com/K9TBWOD.png) and the black screen is from a wallpaper that's from this website (http://www.solidbackgrounds.com/).

What license does this image fall under? — Preceding unsigned comment added by D13H4RD2L1V3 (talk • contribs) 04:41, 16 August 2015‎ (UTC)

  • Perhaps I'm misunderstanding your question, but what is your basis to say that there is any license at all available for the image of a Samsung phone? Why would that not be all rights reserved by Samsung? - Jmabel ! talk 08:06, 16 August 2015 (UTC)

      • If you are claiming that there is no issue with a Samsung copyright here (I doubt it, but let's concede that for the moment) and that it is your own work, then you decide how to license it. Any license acceptable to Commons would be OK. The least restrictive way to release it would be CC-0 (essentially releasing it into the public domain). The most restrictive acceptable way would be CC-BY-SA. The fact that you used an app to create it should be no more relevant than if you painted it with a patented oil paint. - Jmabel ! talk 17:47, 16 August 2015 (UTC)

i contacted the smithsonian. they state ALL their photos can be used if you meet their terms, which i did.

here are their terms --> http://www.si.edu/termsofuse/

at this point, I want to delete my article because wiki harasses me. and wiki folks don't take the time to READ the notes because if they did, they'd see this had permission. it's frustrating. i published letters from the smithsonian giving me specific permission (which i discovered i don't really need) and i complied with the smithsonian's terms. without this picture the article is useless. now someone at wiki is saying the article is too detailed. never ending harassment.

no one at wiki really helps novices... i'd rather publish somewhere else. is it possible to delete the article so i can publish elsewhere? thank you.

Cubgirl4444 (talk) 15:21, 16 August 2015 (UTC)

@Cubgirl4444: I'm sorry you have had a bad experience here on Commons. However you have repeatedly been told that the standard Smithsonian permissions is for non-commercial use only, and that all files on Commons must allow commercial use. It is not harrassment to tell you that you are breaking our rules, any more than it is harrassment for someone to tell you to stop talking in a cinema. As for your article, that is on Wikipedia, and what the message is saying is that the article may contain trivial detail which is not relevant to the overall article. While having detail is great, it is important to distinguish between what is relevant information and what is trivia. For instance, on the article of a popstar you would not expect a list of every TV show they ever appeared on. However, as this is an issue on Wikipedia, you should contact the person who added that message. -mattbuck (Talk) 16:41, 16 August 2015 (UTC)
  • I apologise for doing so, but I have marked a number more of your uploads for deletion or lacking permissions. Every file uploaded to commons needs to be freely licenced, which includes reuse in commercial contexts. Also, ownership of an image or document does not bestow ownership of copyright; I do not doubt you own copies of the media you uploaded, but unless you own copyright you cannot release them under a free licence. In future, please only upload images that you know are in the public domain (created by US Federal Government, some state governments, or created/published in the US before 1923), that you took yourself, or that you can find with a free licence tag on the internet (but beware of COM:FLICKRWASHING). If you find an image that you want to upload and it doesn't fit the aforementioned criteria, it would be best to ask at Commons:Village pump/Copyright; it would also be good to read over COM:LICENSE to better understand our licencing requirements. Who to ask for permission (or better: who is allowed to give me permission) to upload a letter by unknown author found in a time capsule from 1948?

I would like to upload a letter from September 23, 1948 which was inside a time capsule in a German city until last week, when it was (re-)discovered. The letter gives no hint to who its author is, so I guess there is nobody who could allow me to upload it to Commons, except if the author of the letter was found, right? Or is there some rule that would allow the city where the time capsule was found to give me the necessary right to upload it(it is currently in this cities archive)?

And if there is no possibility to obtain the necessary rights today, would this be possible after September 23rd, 2018? Then seventy years will have passed after the letter has been written ("published" would sound odd in this context, as it was first shown to the public last week). If I understand Commons:Anonymous works correctly, I would be allowed to upload the letter with Template:Anonymous-EU. But the text in that template makes me doubt again, because it applies only "70 years after the work was made available to the public". Is that the case here?

Any help is appreciated, --Floscher (talk) 14:39, 17 August 2015 (UTC)

Yes, this template could be used, but the copyright will expire on 1st January 2019. Regards, Yann (talk) 14:49, 17 August 2015 (UTC)
I doubt that it will expire 1st January 2019. If this letter was made available to public one week ago, the copyright will expire on 1 January 2086. Ruslik (talk) 10:45, 18 August 2015 (UTC)
OK, so probably you could argue what "available to the public" means in this context, as it was deposited at a public place (buried in the ground) with the intention that it should be shown to the public when dug out. And "the public" could if it wanted dig it out at any time. So in a sense it was published in 1948, but nobody took the chance to read it, because such a letter is only interesting after some time. But anyway, my main interest in this question is rather if I could upload the letter before the 70 years have passed (even if it is in 2019, that's still quite some time). Is there anybody (e.g. the city archive) who is allowed to give me permission to do so (except the author, who obviously could)? --Floscher (talk) 14:02, 18 August 2015 (UTC)
Sorry, but only the copyright holder, who would be the author or next of kin, can release the document under a free licence. Ownership of a work does not, in and of itself, bestow the owner copyright. However, if the copyright was transferred to the relevant authority upon donation to the time capsule, that would be a different matter; but only the city/regional authority would know that. Also, was the contents of the capsule available to the public for viewing before being sealed and buried? If so, that should be enough to demonstrate that it was publicly shown or 'published', if not, then it was only 'published' upon being dug up. ColonialGrid (talk) 14:20, 18 August 2015 (UTC)

Jmabel, the original uploader at the English Wikipedia is a famous Iranian journalist who has a Wikipedia article himself and has interviewed Fidel Castro, among others . He is also a Wikipedian, although hardly active. Peter Avery is an eminent British scholar of Persian language. It seems highly probable that a famous Iranian journalist has interviewed a scholar of Persian language. Do these pieces of information resolve the authorship problem? If not, please guide me what I can do. 4nn1l2 (talk) 21:58, 23 August 2015 (UTC)
Please also take a look at this photo which you can see Ali Akbar Abdolrashidi, the interviewer and the uploader, as well as Peter Avery, the interviewee. And then take a look at this portrait in Ali Akbar Abdolrashidi Wikipedia article. Isn't he the same person? I bet he is. Isn't this a plausible argument? 4nn1l2 (talk) 22:18, 23 August 2015 (UTC)
Sounds reasonable to me. You should probably bring it to Commons:Undeletion requests, as I suggested above. My one concern: it may be that Abdolrashidi has been posting photos taken by his colleagues rather than himself without going through OTRS (and without giving appropriate photo credit). As you probably know, that would be a problem albeit one that could be solved. - Jmabel ! talk 06:20, 24 August 2015 (UTC)

Sources of data

It's not clear to me what the policies are on citing sources of the data included in the file and how these could be cited in the file page. Could someone help? --SynConlanger (talk) 11:21, 22 August 2015 (UTC)

  • Could you give a concrete example? Because the source of a photograph is usually pretty clear, and that's what the bulk of the files here are. - Jmabel ! talk 17:11, 22 August 2015 (UTC)
Yes, sorry. File:Linguistic map of Italy.png provides information on the distribution of languages in Italy, but no source is given for where the data where taken from (actually, it does, but the link is broken). This applies in general to language maps. Due to the "cite the sources" policies in Wikipedia, we need to know where the data where taken from, because sometime the image provides elaboration on data that were not originally given as an image (like, tabular data converted to a map). My question is: which is the prescribe way of citing sources in Wikicommons? Especially if there are multiple sources (like if I merge two maps from two sources). I hope this makes it clearer. --SynConlanger (talk) 12:31, 23 August 2015 (UTC)
It's seems that use has it that the source of data should be put in the description. See File:Northern Amami Oshima linguistic sameness.svg and File:Formosan languages.png. --SynConlanger (talk) 14:50, 24 August 2015 (UTC)
  • Yes, the description would normally be the place to do that. And if it hasn't been done, on an image like this, it does greatly reduce the usefulness of the image. - Jmabel ! talk 05:24, 26 August 2015 (UTC)

Urbanecm, the filter in question prevents anyone from creating a page in mainspace (here on Commons, it's the "gallery namespace") if the page does not have a <gallery> tag somewhere and if the user is new. The filter has no exceptions for redirect creation, so I've asked the filter's creator to add such an exception. I've also created the redirect for you. Nyttend (talk) 18:17, 25 August 2015 (UTC)

NOGALLERY display option?

I periodically find it useful to obtain a list of filenames from a category, but in order to do this, I must either open all the files individually or edit the page by adding __NOGALLERY__, copypasting the filenames into a document, and then revert. The first takes a lot of time when there are many images, and the second requires a pair of useless edits. Is there some way of forcing a category to display the filenames as if NOGALLERY were included, without editing the page? I've never seen such a thing here or at en:wp. Nyttend (talk) 18:22, 25 August 2015 (UTC)

If you like you can use the MediaWiki API, in particular mw:API:Categorymembers. For example, this query returns the first ten files in Category:Felis silvestris catus. If you like, you can use Special:ApiSandbox to build an API request with a GUI, rather than directly. However, even with __NOGALLERY__ you can do a preview to see the non-gallery display; no need to do an edit and a revert. —RP88 (talk) 19:35, 25 August 2015 (UTC)
Okay, now I feel rather silly. I was sure that magic words didn't work in preview mode! Thanks very much for the pointer. Nyttend (talk) 21:58, 25 August 2015 (UTC)

Peruvian Copyright

I need help to see if a picture on the Victor Larco Herrera biography page is Wikimedia Commons eligible for the picture to be uploaded. It's located here. Thank you. Nepaxt (talk) 20:36, 25 August 2015 (UTC)

Peru has a copyright term of 70 years after the death of the author, 70 years from publication for anonymous works. Is there information on when the picture was taken, who took it and when it was published? --rimshottalk 22:17, 25 August 2015 (UTC)
How about government sites? The subject passed away in the early 20th century. Thank you. Nepaxt (talk) 22:22, 25 August 2015 (UTC)

How can I delete my own image

I can't delete my own image so I have nominated it form deletion since 4 days but nobody cares. It is my personal photo and needs to be deleted immediately. The file is File:Red-haired man.jpg . I think I can't delete it by myself, any admins could you please delete this image? Faster if possible. --IllusIon (talk) 04:32, 26 August 2015 (UTC)

  • 4 days is a bit quick for the normal deletion process, so it's not that "nobody cares." But I can't think of any way the image is in scope if you don't want it for a personal page, so I think I can comfortably close & delete. - Jmabel ! talk 05:27, 26 August 2015 (UTC)
  • Damn. It is in use at en:Talk:Red hair where it was used as an example in discussing what constitutes "red hair". Can't delete in less than a week for an image that is in use. - Jmabel ! talk 05:30, 26 August 2015 (UTC)
  • Thanks for your effort! I removed the photo from Talk:Red hair. Does this make it easier or faster to remove?--IllusIon (talk) 06:01, 26 August 2015 (UTC)

Missing uploads

Hello.

I uploaded a second set of photos after my first set was deleted due to copyright issues. I wanted to update one image last week but it never loaded completely. Now I cannot find the new photos at all - they seem to have disappeared. My user Contributions page only shows the old ones. What have I done wrong? Garranes (talk) 07:26, 26 August 2015 (UTC)Garranes

Those are the only ones it shows. Are these the ones (in which case you will need to go through Commons:Undeletion requests or are we talking about other files? If they are other files, they either never go on to Commons at all or you were logged in under a different account when you uploaded them. - Jmabel ! talk 15:34, 26 August 2015 (UTC)

Celbusro

uploading a photo wiki says already there but deleted

Very new to wikipedia - I maintain a website for a band named “The Nightowls”. I’m trying to upload a photo using the wizard – which is named “the Nightowls.jpg” - but I get the message “there was another file already on the site with the same content but has been deleted”. This is the standard pic they use – which is used for their website photo & it’s in a section with several photos for people to use, but this one is that most people use when writing articles, stories, interviews etc. about the band etc. I tried renaming the photo – but I assume it’s looking at the imbedded info from the pic. Not sure what to do. David R AustinTx — Preceding unsigned comment added by David R AustinTx (talk • contribs)

Hi, this picture is part of a book of 1572 - what do I need for liscensing ?

Bereits im Jahr 1562 findet man das Emblem des LR in dem Buch „‪Sphaera Ioannis de Sacro Bosco emendata‬“ der beiden Autoren Johannes de Sacro Bosco und ‪Pedro Nunes (S.14).

most-perfect magic square from
the Parshvanath Jain temple in Khajuraho

Hi! As a simple "hack" of an old PNG file from en.wikipedia I changed only the cell contents / values. The positioning is odd because the numbers are not centered. In order to help please see: test:most-perfect magic square#stepwise improvements.
The page at test provides wiki source code for many non Latn scripts as Deva, Guru. Arab, Armn, Beng, Grek, Gujr, Hans · Hant · Jpan, Hebr, Knda, Kore, Mlym, Taml, Telu, Tibt and maybe some mor. Please feel free to reuse the code.
You are welcome to join test:most-perfect magic square#participants.
Thanks for any help in advance! Best regards lɛʁi ʁɑjnhɑʁt (Leri Reinhart)

  1. the values are reordered according to cell values a1,1, a1,3, a1,3, a1,4 to cell values a4,1, a4,3, a4,3, a4,4
  2. alignment is achieved via:
    <text text-anchor="middle" x="foo" y="bar">foobar</text>

  3. coordinates have been modified by guessing

  • Not sure what museum you have in mind, but you've written this in the page for help with using Wikimedia Commons, so you are not likely to get a relevant response. I suggest contacting whatever museum you actually meant to contact. - Jmabel ! talk 16:07, 27 August 2015 (UTC)

Uploading my own book - encyclopedia about psychoactive drugs history and usage

Hello. Can I upload my own book, which is huge (pdf, 200+ pages, in Russian) illustrated encyclopedia about several dozens psychoactive drugs, their history, usage and psychoeffects? The book was prepared for publishing, but after after adoption of several anti-narcotic laws here, publisher refused to publish book fearing of prosecution and huge fines. So, I have prepared pdf, I own all right on it and I want to publish it here to make it accessible from Russia, and for any russian-speaking user; this book will help to liberalize laws on drugs (like making the cannabis legal). I hope, that the e-book will not be prohibited in Russia and government will not try to block other sites with this e-book (my early website was blocked by Russian Roskomnadzor for this book). Is it enough to me to send OTRS with GFDL 1.2 license on this book to keep it here, on Commons? Is it in Project Scope to provide education book about recreational use of some useful substances (which are prohibited now, but should be free to private use)? `A5b (talk) 02:14, 28 August 2015 (UTC)

How to discuss copyright issue with an image that can be resolved by editing the image instead of deleting it

Recently, I came across File:Lincoln Cents, 1941-1974.png. I believe that the page of presumably non-free text on the right of the image poses a copyright problem. However, I don't think the file should be deleted, because the image could easily be edited to solve the copyright problem. Where should I list a discussion like this? Thanks, RJaguar3 (talk) 03:29, 28 August 2015 (UTC)

  • If the text is, indeed copyrighted, then probably the best thing to do would be to upload a new version with a Gaussian blur over the text, then delete the original. - Jmabel ! talk 06:20, 28 August 2015 (UTC)

--rimshottalk 20:40, 28 August 2015 (UTC)

Copyright question

I am looking to upload a better image of Bernie Sanders and there is an image on his official website under "Media Kit" that I feel would be perfect. This image has an explicit link to "download this image." Does that equate to a copyright release? The website can be seen here. I want to make sure I am not running afoul of any copyright issues before I go ahead an upload the image. Thanks! --Stabila711 (talk) 04:28, 30 August 2015 (UTC)

No, "Download This Image" does not equate to a statement like "This content is release into the public domain by its copyright holder". See Commons:Copyright rules by subject matter#Press photos. LX (talk, contribs) 08:54, 30 August 2015 (UTC)

Copyright question - PD-Art

I have uploaded a file Composition 01 (1979) - Rashid Choudhury per Commons:When to use the PD-Art tag#Examples using Template:PD-Art. I want to make sure I am not running afoul of any copyright issues before uploading another image. Thanks! ~ Moheen (talk) 19:44, 30 August 2015 (UTC)

Hi, That template doesn't work here. PD-Art is for old works, which are in the public domain (usually the author died more than 70 years ago). This is a recent painting, you need a formal written permission from the painter's heirs. Regards, Yann (talk) 20:34, 30 August 2015 (UTC)
Hello, The artist was died in 1986. And the image is a Photograph of a tapestry found on the Internet or in a book which was first published in publicly before 1978 without complying with U.S. copyright formalities or after 1978 without copyright notice here, and then URAA is not working for Bangladesh? ~ Moheen (talk) 02:26, 31 August 2015 (UTC)
The copyright term for works first made available to the public in Bangladesh is sixty years after the death of the author. If this painting was first made available to the public in Bangladesh, its copyright will not expire until the year 2047 (1986 + 60 + 1). —RP88 (talk) 02:57, 31 August 2015 (UTC)
(Edit conflict) The artist’s copyright in Bangladesh (60-year term) won’t expire until 2047, which is a show-stopper here, assuming that’s the country of origin. As for the US copyright, AIUI if the work was indeed published without notice soon after creation (before 1989), it would be public domain there, so meeting half our standard, but if it was first published with notice or after 28 February 1989 it will be protected in the US until 2057. Note that in the US “publication“ means distribution of copies; public display doesn’t count.—Odysseus1479 (talk) 03:24, 31 August 2015 (UTC)
For works prior to 1978, public display counted if copies could be made by the public. In any case, a work first published in Bangladesh that was in copyright in Bangladesh in 1989 will still be in copyright in the US; that was the whole point of that section of the URAA, to restore copyright to foreign works that lost their copyright for reasons like that.--Prosfilaes (talk) 04:37, 31 August 2015 (UTC)
