Tip: Add categories to your files

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]

[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

17 USC 105 states: "Copyright protection under this title is not available for any work of the United States Government, but the United States Government is not precluded from receiving and holding copyrights transferred to it by assignment, bequest, or otherwise."

17 USC 101 defines "work of the United States Government" as "a work prepared by an officer or employee of the United States Government as part of that person’s official duties."

Compendium II: Copyright Office Practices 206.02(b) states "Works of the U.S. Postal Service, as now constituted, are not considered U.S. Government works." RJaguar3 (talk) 01:31, 30 September 2012 (UTC)

Question on copyright?

Hi, RJaguar3. As far as I understand, according to this, most of the contents in Category:State of Washington v. Trump are not in the public domain? Have I understood it right? Thanks --Discasto _talk 23:19, 5 February 2017 (UTC)

It varies depending on what type of document. From my initial assessment:

1. File:Washington v. Trump - Civil Docket.pdf is {{PD-USGov}}.
2. File:Washington v. Trump - Complaint for Declaratory and Injunctive Relief.pdf appears to be non-free (barring a policy by the state of Washington to release government documents into the public domain), the same holds for the apparent duplicate File:Complaint as Filed.pdf.
3. File:TRO as Filed.pdf is also non-free; File:Washington v. Trump - Motion for Temporary Restraining Order.pdf appears to be a duplicate.
4. File:Declaration of Solicitor General Noah Purcell.pdf is non-free.
5. File:Purcell Declaration (Exhibit A).pdf appears to be {{PD-ineligible}} or {{PD-USGov}}, seeing as it's just a trivial republication of census data.
6. File:Purcell Declaration (Exhibit B).pdf is, according to the declaration, a printout of an NPR article, so definitely non-free.
7. File:Purcell Declaration (Exhibit C).pdf is a printout of an article from The Hill, so non-free.
8. File:Washington v. Trump - Declaration of Asif Chaudhry.pdf is non-free (state university employee).
9. File:Washington v. Trump - Declaration of Ayesha Blackwell-Hawkins, Esq.pdf, File:Washington v. Trump - Declaration of Robert Dzielak.pdf, and File:Washington v. Trump - Declaration of Emily Chiang.pdf are non-free (non-governmental employees).

File:Donald Trump attacks Judge (20170204-0512).png, File:Trump tweets his disdain for the Constitution of the United States.png, File:Trump now overruled by Federal Judge tries to scare people.png, and File:Donald questions the independent judiciary (20170204-1537).png are {{PD-USGov}} if you can show the tweets made by Trump on the @realdonaldtrump Twitter account are within the scope of his employment. Otherwise, non-free (but maybe {{PD-ineligible}} because they're so short).
19. File:9th-Cir-Emergency-Stay-Motion.pdf is {{PD-USGov}}, as is the apparent duplicate File:Washington v. Trump - Emergency motion for stay to Ninth Circuit Court of Appeals.pdf.
20. File:Washington v. Trump - 17-35105 amended order.pdf is correctly tagged.
21. File:Washington v. Trump - Memorandum to the Acting Secretary of State, the Acting Attorney General, and the Secretary of Homeland Security.pdf is {{PD-USGov}}.
22. File:Washington v. Trump - Order denying immediate administrative stay pending full consideration of the emergency motion for stay and setting schedule.pdf is correctly tagged.

So, in general, to analyze the freeness, we simply disregard the fact that the document is in a court docket, and consider the other relevant factors (was the author the U.S. government?, is it original?, etc.). RJaguar3 (talk) 04:18, 6 February 2017 (UTC)

In Feist Publications, Inc., v. Rural Telephone Service Co., the court found that one cannot copyright facts only original creativity. And, Sandra Day O'Connor pointed out that a mere synthesis of a certain number of facts doesn't create a new creative thought, this is of prime import to judicial filings; since one in court is pleading the facts to the court and filing briefs which synthesizes the facts of previous cases in relation to the instant case's facts, legal filings are not copyrightable, since nothing of a creative nature was produced in the process it is a mere compilation of facts. -- Jasonanaggie (talk) 07:28, 6 February 2017 (UTC)
