Contemporary art gallery

If I take a picture in a contemporary art gallery that represents the artists, who holds the copyright? Who do I have to ask to use these pictures? --Sebi.ubi (talk) 12:18, 28 January 2019 (UTC)

Copyright help regarding File:Orao IIC.jpg

I uploaded an edited version of the existing File:Jedrilica Ikarus-Letov Orao Iic.JPG which is published under Creative Commons Attribution-Share Alike 3.0 Unported copyright, but am told the copyright info is missing. How do I add this to the modified image? The originator has made it clear that any mods should use the same copyright.

Hi TSRL, fixed: [1] and [2]. The license version of the cc-by-sa tag was not the correct one but you did indicate the source and author - that is a good start. The source file should be linked if possible. Please have a look how I made it and use derivativeFX to upload modifications of existing images - that makes it easier for you (but you still have the duty to check). viewing ogg videos

Two Questions: (1) Why does every video I try to watch cut off at aprx 35-40 seconds? (2) My computer won't play downloaded ogg videos? How can I convert? — Preceding unsigned comment added by Theraz69 (talk • contribs) 2012-04-27T20:57:36 (UTC)

I have that same issue recently. I used to be able to play the full length, after I recieved the 'older version of java' message and selected 'yes'. It may be a browser issue. I have only every used IE8 with WinXP S3 to view them though. I do have other browsers I haven't tried, and Category:VideoLAN is free software that you can play them with after download. Vlan seems to work fine on my 6 7-8 yr old computer.--Canoe1967 (talk) 22:21, 27 April 2012 (UTC)
Well, IE8 is horribly outdated, and Wikipedia uses some horrid Java applet Cortado to make IE and Safari play ogg videos. It seems that now Cortado is broken completely. Use Firefox, Chrome/Chromium or Opera instead -- all of them can play Ogg Theora natively just fine. Frankly, I don't understand people who voluntarily use outdated browsers, making their browsing experience sub-standard. --Trycatch (talk) 13:05, 29 April 2012 (UTC)
I still run WinXP and IE8 is the latest version it will allow. I may have to upgrade to Win7, but only when I have to. My computer is 7-8 years old. I usually wait for all the smoke to leave (computers run on a limited supply of smoke) before I upgrade. I am glad it didn't leave when Vista was the OS by microsoft. Hi there

Could you please advise how to update the Bupa logo that appears here? http://en.wikipedia.org/wiki/File:Bupa.png

As the Bupa Online Brand Manager (world-wide) it's my responsibilty to update this but no one in the Group Marketing department has the authority (i.e. We have accounts but don't make enough edits to your site to have the authority to do so).

Since Wiki is a hugely popular site and has links to other social media site I'm hoping you can help me resolve this asap. Happy to arrange a formal request, and provide on corporate letterhead if needed.

Older image has been tagged for deletion by admin. Only the current image qualifies under fair use. I guess WP does not have a policy allowing 'archives of copyrighed logos' (kidding).--Canoe1967 (talk) 15:59, 1 May 2012 (UTC)
Clarification: I tagged it for deletion (by substituting en:Template:Orfurrev), but I am not an admin. Per en:WP:NFCC#7, all non-free files have to be used in an article somewhere. The old version is not used in any article, so it needs to be deleted. --Stefan4 (talk) 16:21, 1 May 2012 (UTC)

Poster for Elena (film)

I bought a poster of Elena(film) fom Movie Poster DB for my Swedish entry of the russian film Elena. Can I upload it to my article and under what license?

No. Ownership on a copy of the poster does not mean that you can reproduce the poster and distribute copyies on the internet. --Martin H. (talk) 14:24, 1 May 2012 (UTC)
To clarify that slightly: ownership of a physical object and ownership of intellectual property rights are completely separate. In a more dramatic example, if you buy the sole instance of a painting, the artist still retains copyright. - Jmabel ! talk 23:27, 1 May 2012 (UTC)

Are most WF logos copyright?

In that case all the logos in user talk pages on en:WP should not be allowed?

Afaik they do not care about internal usages in Wikimedia projects, like i.e. logos for jubilees or for community meetups, or easter and X-mas versions of the Wiki ball. We have plenty of these. --Martina talk 22:10, 1 May 2012 (UTC)

Are Facebook photos acceptable image sources?

Hi,

Yesterday I uploaded an image to Commons following all the instructions, intending to use it on Wikipedia; however, hours later I received a letter from someone from the OTRS response team telling me that the URL (source) was unacceptable. It's a Facebook link, which I will show here:

As you can see, the source shows very clearly the image that I uploaded, and the copyright owners agreed to release this picture based on that link that I provided (I also added an attachment with the same picture).

A Commons page, found here: http://commons.wikimedia.org/wiki/Template:Image_source says "If someone else created the content, or if it is based on someone else's work, the source should be the address to the web page where you found it,". Well, that's where I found it (on Facebook). One can't always find a clean link to a picture, so I think the source that I provided is fine.

Nevertheless, the person from the response team wrote under my source: "If you wish for text from another website to be included in Wikimedia projects, it must be released by the copyright holder under the terms of the Creative Commons Attribution ShareAlike 3.0 license, which may be viewed at <https://www.creativecommons.org/licenses/by-sa/3.0>.

He said this because the Facebook picture page has comments made by fans, but I didn't upload the comments. No text. I only uploaded a picture. I am not interested in uploading any comments. Please help me with this problem. Can I use the picture in the meantime at Wikipedia?

  • I'm not an OTRS-team member, but as far as I know the best way - sending letter with permission and attached photo directly (not via third person) to OTRS by photographer from his/her public e-mail address. It avoids a variety of misunderstandings. Kobac (talk) 04:12, 3 May 2012 (UTC)

I will try to get a reply from the guy who answered me from OTRS, and see if there's another solution because the twins have already been extremely kind, releasing my favorite picture of them, and I don't want to abuse, but if I don't get help from the OTRS department then I do think the girls will continue to cooperate. Waterphone update

Hi, I am the inventor of the waterphone and have just edited that listing. I now want to replace the photo of Alex Wong playing a cheap knock off waterphone with a more detailed, current photo of one the the patented waterphones (the Whaler) and another photo showing a close up on a waterphone being bowed. Unfortunately, I have not been able to negotiate my way through the long and complex upload process.

Can you simplify this process so I can upload these 2 photos please? Thanks, Richard Waters

  • On Commons, we don't normally replace photos, we add new ones. You can then replace the image in the Wikipedia article by using the name of the new photo instead of the old one. If you were trying to replace a photo on Commons, that was most likely a bad idea, and it's no surprise you couldn't work out how to do it.
  • You don't give any indication of what you are finding difficult (or even which of several methods of uploading you are trying to use), so it's really hard to guess what someone could do to make it easier. Step one: do you have an account? You need an account to upload to Commons (though not to edit text). Assuming you do have an account, please sign your posts here with ~~~~, which will automatically turn into a useful link to that account (and a timestamp) for anyone who wants to follow up and help you. - Jmabel ! talk 23:49, 4 May 2012 (UTC)

Assitance Finding Correct Licensing

Deleted SSMC campus pic - File:Ssmc campus.jpg

After adding a tag stating it was the work of NOAA (forgot to include it in the original image upload), which should have been quite obvious from the included web address, the image was deleted. My question is: why? What more was needed? Thegreatdr (talk) 00:59, 5 May 2012 (UTC)

Hi. I think you probably want to make your page on wikipedia - go to http://en.wikipedia.org/wiki/Your_group's_name_here and click the edit button. However, I should warn you that your group may not be notable enough to merit its own article, and so the article you create may end up being deleted. Can't download 10Mb to 15Mb files

What adjustments should be made to be able to download 10Mb to 15Mb file from Wikimedia Commons? Thank you.

Your question confuses me. Downloading is taking a file from here to your hard drive. Uploading is hard drive to commons. Most files should work up to 100Mb. You could try Commons:Tools/Commonist. I find it better.--Canoe1967 (talk) 00:09, 6 May 2012 (UTC)

This is a follow-up inquiry on "Can't download 10Mb to 15Mb files" I tried to download "Peleș Castle panorama.jpg" with size of 10.87MB. Downloading starts till a quarter , sometimes half of the picture then stops. But in the past I was able to download other image file of up to 22MB. Does this concern with server traffic at the very moment? Is there a way to download using file id? How does this work. Hello

I am a web designer who was asked by an author to write a wikipedia article about him and his work. The client provided me with a word document containing the copy and photographs that he wished to include in the article. I have spent several frustrating hours trying to figure out which copyright tag to use for the three images that I have uploaded. I am not an attorney and I am not versed in copyright law. The help pages on this site are extremely difficult to understand and I have already spent too much time trying to figure out which tags to add and how to add them so the pictures do not get deleted. I just would like to know what code I have to enter for the pictures to not be deleted.

Assuming that w:Wikipedia_talk:Articles_for_creation/Steven_Braun_Schlossstein is the article that you're working on, then you're also going to have significantly issues getting that article created, since it lacks anything approaching independent references which cover the subject in detail. I suggest that you check out w:WP:42.
  • Also, if the author is compensating you to write about him in Wikipedia, you have a clear conflict of interest. But that's more an issue for Wikipedia than for Commons. As for Commons: if you personally are not the copyright holder of the images you are uploading, and they are not in the public domain, then the only way we can host these materials is for the copyright holder to free-license them. See COM:OTRS; if that's not clear, come back here and ask more. - Jmabel ! talk 05:48, 6 May 2012 (UTC)

Asking for an image not to be used?

I took and uploaded the image File:Tame_Iti_at_gallery_opening_13_October_2009.jpg and licensed it very broadly. I understand that I cannot withdraw the licence once granted. Taking pictures of living people in public places requires a certainly amount of good-faith and implied consent. I would like to withdraw the image in good faith, because the conditions on commons have changed since I uploaded / licenced it. In particular File:New Zealand can into Wikipedia.jpg which appears to contain a charature of Iti in frame three and represents the kind of thing the subject has been protesting about for the last 40 years. I do not beleive the implied consent I have is likely to cover the image's use alongside this cartoon. Is there a way I can withdraw my image or mark it as being requested in good faith not to be used? Stuartyeates (talk) 23:43, 5 May 2012 (UTC)

  1. The tag needs to indicate a specific license. What license does the written permission specify? The copyright holder is the one that must issue a specific license.

How can I provide copyright details...?

  • What is the picture of, who took it, how old is it, what country was it first published in? We need all those details before we can be sure it is public domain. If it is a more recent photograph you need to be the photographer or have a free license legally assigned to the work, and there is a procedure for confirming this. Adding images with permission of author

Hi there,

I want to add images to Nicolas Ruston]. I have permission from Nicolas Ruston himself to use images that appear on his website www.nicolasruston.co.uk on the Nicolas Ruston wikipedia page. Please could you advise how to do this, and how to tag them correctly to avoid deletion?

I am sure you can from commons. Images from other WMF sites may have copyright protected images though. Each image you see in commons should have a section about usage and attribution listed.   • And perhaps the most salient thing there is that images here are variously licensed. You should be able to use them all, but you need to check the particular licensing on each image. Probably the majority will either be (1) public domain, (2) Creative Commons licenses that are either "attribution + share-alike" or (2) less stringent Creative Commons licenses that you can handle like "attribution + share-alike" and be fine. - Jmabel ! talk 14:45, 8 May 2012 (UTC)

Copyright for (old) French money?

In Germany and other European countries, stamps, official coats of arms and (pictures of) money a free of copyright because they are issued by the government without copyright; there are already copyright tags for e.g. Germany and Austria etc. Does anybody know how this does apply to France? I find that many old and current pics of French stamps and money are given a personal copyright tag of the person who did upload them, which is, of course, BS. And how does this apply for old money? This is the general part of the question. My specific case is even more complicated and related to this file: File:Grubengeld Saargebiet 1923.jpg. This is money issued by a national authority but only valid in the Saar territory between 1920 and 1930 which was under administration of the League of Nations. So, what copyright does apply? French? German stamps are not free: the government provision only applies to literary works whereas stamps are artistic works. See Commons:WikiProject Public Domain/German stamps review and for details. For the same reason, German money is probably also copyrighted. For coats of arms, also see COM:COA#Coat of arms "found on the internet".
For France, see COM:CUR#France (francs are fine while the status for euros is unknown) and Commons:Stamps/Public domain#France (stamps don't seem to be fine unless they are old enough). --Stefan4 (talk) 15:02, 8 May 2012 (UTC)

I was warned about invalid licence for the picture. Do not understand as the same picture is allowed on the Hungarian wikipedia:

Interesting is, that when I wanted to use this picture on the Slovakian wikipedia, it didnt show up, so I needed to do a new upload. Now the system is telling me, that the licence is not correct.     • You don't indicate how you uploaded this, so I have no way to comment on what the system may or may not have asked for. But you still haven't provide a license template after I let you know that one is needed. We can't have media here with no license. Hungarian Wikipedia doesn't provide any source, so a link to Hungarian Wikipedia is not enough. You need to identify the year of death of the photographer and the year of publication of the photo, and specify those years.
The licence template on Hungarian Wikipedia only seems to state that the work is in the public domain but doesn't tell why it is in the public domain, so the licence statement is not enough. The photo 1940 implies that it was first published after 1925, so the photo is most likely copyrighted in the United States. In that case, the photo will have to be deleted from Commons.

Image not appearing properly...

Hi! I uploaded a new version of File:Ice Trade in New York, 1884.jpg a few days ago. It displays properly on the Commons, although not in the thumbnail version, and not on Wikipedia when I use it in an article in userspace - it still appears as the old version. I'm afraid I'm having the same problem with File:Rosados en mosaico.png. It seems that Wikipedia is displaying a 250px thumbnail of the old version, which refuses to switch to the newer version I've uploaded to Commons. I have been asked to provide a "licence" because, it is said, I have added only a "template". Please note: I have indicated in my description that this is a photograph of a painting of the 14th century in a church in Cyprus. It is the photograph of a (I think) two-dimensional original and so, I understand, is "gemeinfrei", free for anybody. I neither understand why there should be a "licence" nor know what form that licence should take. I had this problem previously with a medieval painting in Cyprus but not with other, essentially similar Cyprus paintings. Pleas help.

Stray bracket symbol below where image used in Wikipedia

The image located at http://commons.wikimedia.org/wiki/File:Brennan_Gilmore_at_Solly%27s.jpg is used on this page http://en.wikipedia.org/wiki/Walker%27s_Run at Wikipedia (in the infobox at top). Just below the image appears a stray right bracket symbol ("]"). I've looked over the code both in the image file page at Wikimedia, and also in the infobox at Wikipedia and don't see what could be making this happen. Can anyone tell me what I might be missing? How do I add a sound file og a video file as "Media of the day"? I know that to add a "Picture of the day" is to find an image that is a featured picture. The way to add a "Picture of the day" can be seen here: Commons:Picture of the day/Instructions, but what about "Media of the day"? File move help request

I cropped an existing very large picture to create a smaller picture of a mountain for an article. I then uploaded the cropped image as File:Knocknadobar Mountain.jpg. Then I realised it is known simply as Knocknadobar ("Mountain" is not part of its name) , so I moved it to File:Knocknadobar mountain with a lower case M. I realised then that I should have moved it to Knocknadobar.jpg but when I tried to move it again, it would not allow me. Then I entered a file move template to request a file move but I was told that Knocknadobar.jpg already exists and to use {{duplicate}} instead, but that won't work, either. I was working too fast and created obstacles for myself in my haste. Apologies. Please help. I just want to move File:Knocknadobar Mountain.jpg to File:Knocknadobar.jpg. Thank you. Yes, thank you, that's perfect. I hoped I made what I wanted clear after the mess I made. I was just working too quickly and tripped myself up and got everything tangled. You could delete Knocknadobar Mountain.jpg and Knocknadobar mountain.jpg now if you like as they are unnecessary redirects and nothing links to them anyway. Klondike page image

Hi,

I work for the advertising agency that handles Klondike's business through its parent company, Unilever. I tried to upload an image that Klondike owns and specifically requested be made the main page image on their page, and it was deleted shortly after because of some kind of infringement due to the product having the packaging on it still. Am I not allowed to upload an image with packaging even though Klondike themselves specifically requested it? Please let me know as soon as possible, this is an issue that Klondike is depending on us to take care of.

The mission of Wikimedia Commons is to host free contents only (please see COM:SCOPE). So, indeed, it is not allowed to upload to Commons an image that is not entirely freely reusable by anyone for any purpose.
However, you could, perhaps, upload a non-free image directly on the site of a project (such as the English-language Wikipedia) that accepts fair use under certains conditions (please see en:WP:NFCC). In that case, you will have to use the image there in a context consistent with the notion of fair use, not by a permission of the company.

How do I get this text to display? Whenever I highlight the name of a page and drag the cursor somewhat down, then copy and paste somewhere else, this text appears at the end; for example, if I highlight the name of this page right now, dragging slightly down, and copy/paste, I get

If you look at the source code, you'll see a div with the id "siteSub". Its display CSS property is set to none for screen media, making it invisible except on printouts and similar. Normally, such text cannot be selected or copied, but results may vary depending on the browser you use. I couldn't replicate the described behaviour in Chromium 17 or Firefox 12. It will be visible if you add #siteSub { display: block; } to User:Nyttend/monobook.css (or whatever skin you use). —LX (talk, contribs) 14:09, 11 May 2012 (UTC)

For a particular photo from the BNF, it could be difficult to figure out 1) the reason why the BNF website says it is in the PD in France, 2) if it was published soon after its creation or only in the recent years, 3) if it is in the PD in the United States. From the available informations about the particular photo, try to determine the best U.S. status tag and the best source country tag. If you can verify that this particular photo was actually published soon after its creation, you can use the U.S. status tag PD-1923 and if, in addition, it is anonymous, you can use the EU status tag Anonymous-EU. What is the policy?

Do illustrations created for Commons need to be supported by verifiable sourcing?

Take File:Loch Ness monster views.svg for example. The description says "Loch Ness monster sightings: 1) single hump, 2) many humps, 3) head and neck, 4) head and back, 5) head, neck and many humps.".

Who says so? The artist/creator? Or is Commons saying this?

The website Cameraslens.com is a fan-run for the fatal frame series and has no official ties with Tecmo inc. I have a problem on the image I sent, and states: This media file does not have sufficient information on its copyright status. Unless the copyright status is provided, the file will be deleted seven days after this template was added: (13 May 2012). The cameraslens site has the banner for creative commons and I am also a member on the cameras lens forums, is there going to be a problem on the copyright status on the image and also I attached the file to the article I created on wikipedia Zero: Shinku No Chou an upcoming fatal frame game.

There are many different Creative Commons licenses, and only some of them are free. Wikimedia Commons only accepts content published under a free license. The Creative Commons license used on http://www.cameraslens.com/fatalframewiki/ is not free because it prohibits commercial uses and derivative works. Furthermore, neither you nor Cameraslens.com can issue any kind of license to works created by Tecmo. Help with official German intwerwar photo copyrights

Background: I'm working on a # of en: articles about political figures in 1918-1938 Germany via translation requests from de:. Naturally photos are desired on new bios, and this period straddles the key 1923 US public domain date so gets confusing. My goal with this request is to get an expert answer then have it implemented on the Commons and en: for consistency. I am also a frequent commons user but very infrequent commons contributor, so apologies in advance if my question seems naive or was already answered.

Problem: To clarify I'll limit the problem to a set of 1938 en:Gauleiter photos, but there are various other known sets. All 1938 photos are on the German wiki and many, but not all, are already on the Commons. Either these are OK, and the rest can be transferred here, or they are inappropriate here and need removal. This is not to find fault as the issue is complicated. To further clarify, these are not Bundesarchiv photos. The source is Der Großdeutsche Reichstag 1938 IV. Wahlperiode, R. v. Decker´s Verlag Berlin 1938, a gov't publisher and the photos have no author. Files for comparison are: [3] on the commons, and one from the same set on German wiki [4] not on the commons.

Details: German Copyright Law 1 January 1966 declares that copyrights on publications by a legal entity expire under public law 70 years after the date of publication when the author is not named, as in this case (§ 134 sentence 2). That means the 1938 copyright expired 2008 and is of course OK on German wiki. However, the PD templates for US state that EU material that was NOT public domain in 1996 is NOT public domain in the US, having had their copyright period re-imposed by the URAA, implying anything after 1923 is not public domain.

Question: 1923 is easy. But for 1938, because these are official photos, does the German public entity law of 1966 apply or does the 1996 URAA date apply. For other sets, such as the 1928 Reichstag, the time consideration is similar minus 10 years. OR! maybe I'm not reading commons policy right: 1938 photos ARE OK here, but not for unlicensed re-use OUTSIDE of Europe. But then (this is my naive part), are such photos usable on the :en: Wiki. Currently there are many such articles using photos from this exact 1938 set, so this will have an impact once answered.

Screenshots from non-free copyrighted films must not be uploaded to Commons, and Commons does not accept fair use content. See Commons:Screenshots and Commons:Fair use. en:Wikipedia:Non-free content#Images is a page on the English Wikipedia project. Should old magazines be uploaded as color or black and white?

I have photographed pages from a now-public-domain magazine. It is on glossy paper and appears to have been originally black ink on white or almost-white paper, but now the paper has turned slightly brown. I'd say it's your choice. If they're text and the B&W is as clear as the sepia, I'd not upload color versions. They take up more space, and we need a few illustrations of the fact that aged paper turns brown, not magazine after magazine of them. (If you can get clear, real black and white, not greyscale, versions of text, IMO, all the better.) If they're pictures, having as close a digital copy as we can might be nice for those graphics people who might be able to pull more out of color images then once graphical editing has been done on them.--Prosfilaes (talk) 19:11, 15 May 2012 (UTC)

Yes. There are some software with non-commercial versions, with EULAs restricting commercial usage of the software, but Paint.NET is not one of them, its EULA is quite permissive -- "Paint.NET is free for use in any environment, including but not necessarily limited to: personal, academic, commercial, government, business, non-profit, and for-profit."
Of course, it's better (and more in line with the spirit of Commons, free media repository) to use open-source software, such as Pinta (open-source Paint.NET fork), GIMP, MyPaint, or Krita, and forget about all these scary EULAs. --Trycatch (talk) 21:48, 13 May 2012 (UTC)

Wenn das Gymnasium nicht wichtig ist, fällt die Datei u.U. aus dem Projektrahmen. Wenn Du dennoch eine Freigabe senden möchtest, reicht es denke ich, wenn die Freigabe-E-Mail von einer offiziellen Schulemailadresse gesendet wird (die Schule wird doch hoffentlich eine eigene Domain registriert haben?) Well, I am not exactly new here, but I just uploaded the linked photo, and after I had uploaded it, I got some doubts whether it was acceptable to license as I have done (CC-BY-SA). Some facts about the photo

  • The photo is taken in Denmark
  • It is a sign which is meant as a joke on a well-known historical building from 1788, which has been the home of a dean. However, prior to that, there was a small bakery at the location of the present building.
  • The golden sign (kringle), not the text part was stolen in 2009 and replaced by a new one crafted by a local builder of boats with assistence from people from Norway, also in 2009.
  • The humorous text originates from the Danish author Peter Seeberg who died in 1999. He was a museum custodian for the town museum as well. It is a rhyme in Danish and translates (approximately to) "The baker is unfortunately dead - so now he is not baking bread", which reflects on the prior location of a bakery there.

I am concerned that the text itself passes a threshold of originality, which makes it copyrighted, but I am not well-versed in this field. If there is any doubt that the license is not OK, feel free to open a DR (or I can do it). Thanks in advance, --Slaunger (talk) 22:13, 20 May 2012 (UTC)

No idea if the text is copyrightable or not, but I see that the sign follows the spelling reform of 1948, so I take it that this is a post-1922 sign. Thus, it may also be necessary to determine if it is copyrightable in the United States or not. --Stefan4 (talk) 15:40, 21 May 2012 (UTC)

Replacing two images

Hi, I made high-resolution (and more nicely colored) images for these two images:

Unfortunately I couldn't figure out how to update/merge these pictures so that the high-res ones will show up in all related articles. Should I change all these articles manually or can someone here replace the old versions with the high-res ones in one keystroke?

One thing is, from the description you wrote, it seems that your images are from the film, not from the trailer. (Or if they are from the trailer, you didn't make that clear in the description). So, you may have a problem with the copyright (unless you source your statement that the film was issued without a copyright notice). Another thing is the pairs of images that you label "old" and "new" are not the same images. There should not be an automatic replacement, as any decision to replace or not to replace is an editorial decision to be taken on each project for each usage. -- Asclepias (talk) 16:13, 18 May 2012 (UTC)
I assumed that the copyright notice on the original screenshots ("Dr. Strangelove trailer from 40th Anniversary Special Edition DVD, 2004") meant that the film itself was issued without copyright notice. Otherwise how could a trailer from 2004 fall into that "published between 1923 and 1977" category? So I copied all the information from the original screenshot. If necessary, can you point me to information on how I can find out if the movie was issued without copyright notice? About the editorial decision - you're right, I couldn't be bothered to find the exact same split second for the screenshot. Ah, I think I understand what you say about the "trailer from DVD" description by the uloader, and how that description can sound ambiguous. You assumed that it was a new 2004 trailer made specially for the DVD from parts of the film that were not used in the original 1964 trailer? I had not thought of that interpretation. Me, I assumed that it meant simply that the uploader made his screenshots from the 2004 DVD, but that the trailer on the 2004 DVD was itself essentially a copy of the original 1964 trailer. Hence the "published 1923-1977" tag about the trailer. The situation of a trailer published without a copyright notice, but (the rest of) the film published with a copyright notice. If the whole film was also in the public domain, we would probably have dozens of screenshots from it on Commons. I don't know where one can find the information about the copyright notices of movies, but someone else will probably be able to answer. About the replacement of images in articles on Wikipedia, my point was only to say that any choice between valid images is individual and depends on the judgment of the contributors to those Wikipedia articles, based on whatever criteria they want to use. Contributors to an article can have all sorts of reasons to prefer one image or another. It is not something that can be decided on Commons or "in one keystroke". I can only say that, in conformity with the general Wikimedia principle, if you, as a Wikipedia contributor, believe in good faith that a modification to an article will be beneficial and not controversial, you can do the modification. I just checked the movie, it says "Copyright (c) MCMLXIII Hawk Films Ltd. All Rights Reserved" right at the beginning. So do I understand you correctly that if I were to find a trailer from 1964 without notice on one of the blurays I could upload screenshots from it instead? However this might be in a different ratio than the movie and probably not in HD. How about fair use, I read that Wikipedias accept that too? Would that work in this case? Yes, you understand correctly, and I suppose that's probably why the images from the trailer were uploaded to the Commons (category:Dr. Strangelove). About fair use on Wikipedia, you'll have to see that with Wikipedia (en:WP:NFCC), but I don't think they would accept non-free high-resolution images, even less if free images are available from the trailer. -- Asclepias (talk) 02:45, 19 May 2012 (UTC)

You can add the Template:Speedydelete in the description page of each file. In the parameter of the template, explain the reason for requesting the deletion. With some luck, the deleting sysop will enter the reason in the logs as a deletion requested by the uploader instead of a deletion for copyright violation. -- Asclepias (talk) 14:55, 19 May 2012 (UTC)

I don't know about anyone else, but when something is scrolling rapidly on the screen it draws my eye and makes it very hard to read anything else. I literally had to go into editing mode to be able to read your remarks. As you can read at a thumbnail "The resolution of the source file is too large." So you could scale it down. However, it is best (since it does not have sharp lines / color areas and PNG would also not thumbnail at this size) to upload a full resolution, low compression jpeg file in addition (new name) - it will show a thumbnail. Copyright help regarding official translations of documents of the Spanish government

I understand you all have a bit more complicated copyright scheme than Wikisource and I'm kind of wary of breaking anything so I figure I should just ask here. The electronic edition File:Spanish Constitution.djvu that is up here is several different varieties of terrible. I'd like to replace it with an electronic edition published by the Boletín Oficial del Estado, found here (PDF). The current one has an unusual license tag based on release statements on the website of the office of the PM. Spanish copyright law makes official documents and translations copyright ineligble (see article 13). You guys don't have a {{PD-SpanishGov}}. So I guess what I'm asking is could someone who knows what they're doing check if this works for Commons and if so make a {{PD-SpanishGov}}? Deeply obliged. Prosody (talk) 23:51, 19 May 2012 (UTC)

I don't think so. Most modern images on the net are copyrighted. You would have to have the photographer email permission or upload the image themselves.

It is generally advisable to make sure that a file can be lawfully hosted on Commons before uploading it. Works by authors who have been dead for less than 70 years are generally not okay to upload, and that's of even more true of works created less than 70 years ago. Thumbnail not updating

The thumbnail for File:Apollo 9 Schweickart EVA with camera.JPG has not updated since I uploaded a hi-res version of the file last night. There may be a few ways to do that. You could ask the uploader to request speedy delete of their file. You could upload yours to replace the older one and see if it gets reverted. In that case you would need to discuss the merits of keeping both files either on the talk pages, or a deletion request discussion. The simplest may be to upload yours to replace the existing. If there is no opposition, then just ask for yours to be speedily deleted as uploader. Reason: better copy of file exists.--Canoe1967 (talk) 20:57, 21 May 2012 (UTC)

Fry1989

I think you have decided to finish the discussion. So I created a new one. You know, Fry again started the war of edits (this file: http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia.svg). He keeps his version of the file despite the fact that another version correctly (as I said it right on the blue (from the site of the Government Code).) On the talk page obschatsya he does not want. User Canoe1967 tried to reason with him, but Fry uploaded the correct version of the file to a file (http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia-edit.svg). I think that we should change places files: upload the correct file in (http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia.svg), and upload the doesnt correct file in (http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia-edit.svg). She does seem to be a difficult editor to deal with and has asked admin to block me for edit warring on the file. You may wish to comment on that page. I agree that your map matches the actual colour of the flag but she has her file protected now. I mentioned above that I started a discussion on the talk page of one of the user box templates that uses it. If you reach consensus there you should be able to have your version used.   • I can't tell what the image is, and "Add caption here" is hardly an informative caption. It looks to me like it might be a contemporary work of art, and therefore presumably copyrighted. Я данные фото скачал с интернета из статей по аналогичной тематике, лицензии, конечно там не было. Через 7 дней фото будет удалено. Что мне делать в этой ситуации? Здравствуйте! Написал 5 статей о писателях Бурятии. Не было их фото. Нашел в интернете, причем на одном только сайте, вот ссылка : http://ayaganga.ru/bardsepic.htm . Взял фото оттуда. Никаких лицензии там , конечно, не было. При загрузке этих фото я написал, что файлы несвободны, что авторы неизвестны. Полагаю, что авторов самих давно нет, учитывая то, что и писатели, которых они фотографировали и рисовали, сами умерли также давно.

Copyright help regarding File:Naga montage.jpg

I created the file File:Naga montage.jpg using ten (10) files from Wikimedia Commons. I used the new Upload Wizard, which I am not familar with on uploading derivative of files from Wikimedia Commons. The file was already uploaded and I couldn't find the correct license option or if I missed it. Could you please help me in licensing this new file or Which copyright tag should I use for files from multiple files?

There are four problems here:
  1. When you make a montage of several photos, you need to list all of them on the file information page. I've now listed the images you mentioned.
  2. You need to list a copyright tag. Based on the images you've used, it seems that the correct tag is {{Cc-by-sa-3.0}}.
  3. You need to include a list of all photographers.
  4. Many of the photos show buildings in the Philippines. Unfortunately, the Philippines lacks freedom of panorama. This means that you need to identify the architect(s) of each building. Unless all architects died before 1962, the image violates the copyright of one or more architect. If that is the case, you need explicit permission from the architect, or else the photo will have to be deleted. --Stefan4 (talk) 00:06, 18 May 2012 (UTC)

having trouble with upload wizzard accepting article

Im having trouble uploading an article that is reliable information as well as privatly owned pictures from private collection. All persons involved have passed away and copyright for pictures are mine. Help - unsigned

Well, I added information that I could find, but I don't think that the two underlying problems mentioned above by Jmabel are fixed, i.e. we don't know who made that bot request (and could be contacted to investigate what happened), and we don't know what was the cause of the malfunction (to check if something requires fixing to prevent future problems). Also, the source isn't exactly mentioned in the log. An unsuspecting user is just directed to a wrong webpage. To get to the source, one must be aware of the systematic transcription mistake that the bot makes when it inserts the URLs in the logs (1). -- Asclepias (talk) 16:56, 26 May 2012 (UTC)
The user who made it is usually mentioned by the bot on the file page. If there would be an emergency somehow I guess the bot takes a log of all its actions for some times - we could ask the bot owner to look there. It may have been one of the many server errors (not the bot's server but the Wikimedia servers) breaking this upload. Maybe the bot does not check if the user operating the bot did create the file desc. page correctly (maybe he clicked the bot order link in the preview but did not save). Yes, one can investigate what went wrong but this specific case is solved. ;-) In principle the bot owner should investigate - but I think he is not active. --Saibo (Δ∇) 00:47, 27 May 2012 (UTC)

Hello. I have uploaded File:Harford Yarra Bank Meeting 1923.jpg, a photo provided by the State Library of Victoria on the condition that it be published on Wikipedia Creative Commons 3.0 conditions. I have a PDF from them to confirm this as the condition of sale to me of the photo. (A) how do I apply a Creative Commons license to the file? For your first question, did they specify which Creative Commons license to use? There are four different options that can be mixed and matched, though only two of the options ("by" meaning "attribution required" and "sa" meaning "share-alike") are permissible on Commons - the other two ("nc" meaning "non-commercial use only" and "nd" meaning "no derivative works") are not permissible on Commons. As mentioned, you should send the documentation that you have to OTRS. There are a few points which will need to be straightened out here, though.
Copyright is the right to decide who may use a creative work and how they may use it. A copyright license is a formal way of specifying who may use a work and how they may use it. The Creative Commons Attribution Share-Alike license is a copyright license that grants anyone the right to use a specified work for any purpose. Only the legitimate copyright holder can issue a valid copyright license. Copyright is an immaterial right, so having physical possession of a copy (even the only copy) of a work does not mean that one holds the copyright. This photo is merely a faithful reproduction of a painting without any creative originality of its own, so the copyright holder in this case would most likely be the painter's heirs.
It's not clear to me what would give the Library the authority to issue a valid copyright license. That it would issue a license granting rights to the world at large as part of selling a copy of a photo to you personally also seems strange. —LX (talk, contribs) 09:09, 29 May 2012 (UTC)

Thanks, LX. I think the State Library of Victoria (who own the original painting) give permission to reproduce photos of it to anyone who asks and undertakes to acknowledge the provenance. What they sold to me was the high-res TIFF and share-alike permission to reproduce it. But as you point out copyright might not necessarily be theirs to sell. The painter died c. 1970 and Australian copyright law on paintings attaches to the creator and heirs if any for 70 years after his death, that is, till 2040. Update. The State Library of Victoria are consulting their copyright people about whether they have copyright as well as ownership of the original painting and will get back to me. If you disagree about simple shapes, it is maybe better to nominate the file for deletion using a deletion request, especially if the uploader deletes no permission tags. I've nominated lots of images for deletion now. I'm not nominating the following since I suspect that they may be simple enough (although I'm very uncertain about the 1966 one):

Thumbnail not updating

Issue with updated version of file -- both in Commons and in the destination page

Hello!

Several of my files don't seem to be updating, either on the [file page] in Commons or on the [destination page]. I've tried clearing my browser cache several times, but that doesn't seem to be it. Sometimes reverting back to old versions and "unreverting" helps, but not sure why. Would love any help!

  1. How can I sort my uploads "Photographs by Bengt Nyman" by upload date or by permission date?
  2. How can I add categories to a batch of photographs?

  • You should see all of your uploads, by date of upload, at Special:ListFiles/YOUR_ACCOUNT_NAME
  • What is a "permission date"?
  • There are a few ways to add categories to a batch; the best way depends on just what you are trying to do. If the pages in question are your own uploads, then from your user page you can use the "perform batch task" tool. It's not the single clearest thing in the world, but I imagine you'll work it out. how to license file uploaded from Wikipedia under a PD license

Hi,

I uploaded this file File:Fisherislandconstruction.JPG from Wikipedia where it had been tagged for transfer by a bot. See[6] It had this license: {{PD-self}}

I was unable to transfer the license. It wasn't one of the choices given by the Upload Wizard. Will it be deleted?

Models of objects may be copyrighted even if the original object is not?

I have had 2 images nominated for deletion recently, the nominator has stated "Models of objects may be copyrighted even if the original object is not." and linked to this discusion http://commons.wikimedia.org/w/index.php?title=Commons:Deletion_requests/File:SVT_137_154_modell_Piko_a.jpg&diff=66670112&oldid=64641281 The images nominated are File:Bachmann Gresley V2.jpg and File:R 455 Hornby industrial locomotive from 1973.jpg the second image shows more of a toy than a model but I don't know if that affects anything. The discussion that the nominator links to seems incredible and a U turn from established decision making, unless it was about packaging. Yes model making requires creativity but in the same way as making an internal combustion engine requires creativity i.e. it has to work. It looks to me that a bad decision has been made, but can't see the actual file to decide what exactly the violation was. So what exactly is going on here are we at commons really going to delete all models and toys that are models? Oxyman (talk) 23:36, 30 May 2012 (UTC)

Touch Pilot Episode Screenshot

I have been having a hard time trying to figure out how to upload a screenshot provided by the the Television company FOX from their pilot episode of the T.V series Touch. What I am really asking is how do I go about uploading an image of a tv screenshot? I have seen things like http://en.wikipedia.org/wiki/File:Cougar_town_100_pilot.jpg work out just fine, just I don't know how to do it.

Commons Commons only uses free files, so a screen capture is almost always going to be unacceptable because that is someone else's copyrighted work--you can't legally spread it around. You can upload it to a Wikipedia project under the pretense of fair use, though. Wikipedia allows some copyrighted material if you can justify its inclusion. Note that simply having a screenshot in order to have a screenshot doesn't count--you have to prove that this significantly adds to one's understanding of the topic. So, a picture of two characters sitting at a table drinking coffee won't cut it because readers can easily imagine that in their heads. A picture like this (warning: gruesome): en:File:Gus dies.png is justifiable because that article discusses the special effects that went into creating that particular image. Without having media to show what it looks like, it's hard to describe it with just words. See also en:File:2001_space_travel.ogv--you can't talk about the special effects of 2001 sufficiently with just text. I don't think there is a way to do that with wiki markup. There's no magic word to determine the file name extension or MIME type of a page in the file namespace, and there's no parser function to extract parts of the title except slash-delimited subpage structures. You could file a bot work request to sweep for such files and possible to patrol for it on a regular basis. —LX (talk, contribs) 19:18, 31 May 2012 (UTC)

I've seen several files like these lately. The quoted permission from XSF IPR Policy in my opinion only talks about the specification, not the artwork. The artist mentions on his website:

Non-Commercial — You may not use this work for commercial purposes.
No Derivative Works — You may not alter, transform, or build upon this work.
Waiver — Any of the above conditions can be waived if you get permission from the copyright holder.

Threshold of originality-related question

Hi, I found this anime logo(http://de.wikipedia.org/wiki/Datei:Shakugan_no_Shana_Logo.png) used in German Wikipedia, and I think the logo does not meet threshold of originality such as File:Googlelogo.png, because the anime name logo consists only simple Japanese and English text. is it okay upload to commons?
