- Hi! I'm Jheald. I'm actually still quite a newbie with Wikidata, but learning more, and particularly interested in how information at Commons will increasingly be stored on / retrieved from Wikidata. There's a big official project about to set off on this (Commons:Structured data), so I've been trying to get a user-space usergroup going for Commons users on Wikidata d:Wikidata:WikiProject Structured Data for Commons as a place for users to get together to discuss and see how we can help the process.
- On Commons, I've most recently been trying to work with the British Library "Mechanical Curator" set of 1 million images scanned from 19th century books with rather weak metadata, trying to get a better idea of what's in there. I also uploaded a set of 430 selected images from British Library Images Online, which turned out to be the first use of the GlamWiki Toolset bulk uploader.
- The Mechanical Curator set includes a number of old maps; as does User:Fæ's recent upload from the NYPL; in addition to a fair set of other maps already on Commons, so I've been trying to liase with the Commons:Wikimaps team to get the WMF maps warper into full production use for presenting and geo-referencing them (including using the georeferencing already done by the BL and the NYPL); as well as trying to organise a Mechanical Curator event at the British Library to let them start another run of georeferencing.
- So that's some of the irons that I have in the fire at the moment, but very interested in any other collaborations I can help in. Jheald (talk) 15:12, 29 August 2014 (UTC)

For example, the English Wikipedia allows fair use of sounds and photographs. This is not the case on Wikimedia Commons; "fair use" materials are not acceptable here.
Please make sure that you only upload educational content you have created yourself, those which are out of copyright, or those for which you have the required permission for the work to be used in all the ways described above. Please note that derivative works of copyrighted material are also considered copyrighted. Files in category Media from the Jean-Noël Herlin Archive Project
Hi,
I notice that you've uploaded a *lot* of files from the Jean-Noël Herlin Archive Project.
The problem- as I see it- is that these are reproductions of what I assume is copyrighted material. Wikimedia Commons can only accept content usable under a "free" license, and it's not sufficiently clear that these images have been released under such terms by the copyright holders.
Typically images and files are considered free either because:
- (1) They've been released under one of the "free" licenses that Commons accepts by the copyright holder, or
- (2) They're public domain due to their age (copyright expired), or
- (3) They're not copyrightable in the first place (typically due to falling below threshold of originality)
Most of them aren't apparently old enough for (2) to apply; (3) might apply to a few, but not to most.
So for most of these images we need evidence that they have been explicitly released under a free license by the copyright holders.
Unless indicated otherwise, I'm assuming that while the "Jean-Noël Herlin Archive Project" is responsible for archiving this material, it doesn't hold the copyright on the material itself?
I don't want to nominate all this stuff for deletion straight away, as it's clear you've put some effort into uploading it, but we need to clear this up. If the content isn't freely-usable, then I'm afraid it doesn't belong at Commons, which is only intended for freely-licensed material. Ubcule (talk) 00:11, 14 June 2016 (UTC)
- Hi Ubcule. Yes I uploaded these photos without fully understanding WP's restrictions, as I was under the impression that taking photos of objects if they have a border, etc.. is considered adding a 'minimum amount of creativity' for it to be under copyright of the photographer and not whoever originally produced the catalogue / zine image. I think I was mistaken and the entire category should be deleted without debate. I would do it myself, but am not sure how to so if you are able, go ahead. - Okay, thanks for clearing it up anyway; I'll arrange to have them deleted.
- That said, I think you still partly misunderstand the situation regarding reproductions of 2D works like this.
- Regardless of whether or not you add the "minimum amount of creativity" needed to claim any additional copyright in that specific aspect of the reproduction, the original artist (or whoever) still retains their copyright stake in it relating to the original source image. You don't get to claim that simply by copying the image in a creative manner- you still need their permission!
- This doesn't apply where the copyrighted aspect happens to be de minimis (i.e. a minor, secondary detail that isn't the intended focus of the image). The situation is also different when it comes to 2D reproductions of 3D works of art such as statues. But none of that applies here.
- (Disclaimer: I'm not a legal expert, and the above should not be taken as gospel; it's a loose paraphrasing of my understanding of Wikipedia's interpretation of the law(s). But I hope it's accurate enough for the purposes of this discussion).
