You misunderstand - I'm here to help (I actually had very good friends from Georgia), but Georgian government adopted a law which prohibits distribution of photographs of recent sculptures/artworks/etc, and we must respect that law. This is called "no COM:FOP freedom of panorama". It is not easy to rationalize that, and some 20 of my lovely photos were deleted for the same reason (snow sculptures in Japan, Atomium in Brussels, etc.). Nothing personal. Take photos of old architecture (author died 70 years ago) or landscape photos where the novel structure/sculpture/etc is not a central part. Materialscientist (talk) 09:45, 8 April 2012 (UTC)[reply]
Yes but it's the Author of the picture who decides the license not the Government. If I or someone take photo by myself and distribute it for the public to use it freely what's the problem? Every source is given and the author of the image has Wikipedia-friendly license to use. What's the problem I don't understand. It's the author who claims the rights here not the Georgian government. --GeorgianJorjadze (talk) 09:49, 8 April 2012 (UTC)[reply]
Copyright to the original artwork (say Alphabet Tower, which does qualify as an artwork) belongs to its author, and in this case, government protects it by not allowing distribution of photos. Thus the photographer does not hold copyright - he is kind of copying work by another artist. Materialscientist (talk) 10:00, 8 April 2012 (UTC)[reply]
The last picture is taken by Lasha Abuseridze who is the author of the picture of Alphabet Tower in Batumi. He is the copyrights holder not the government. He is the author and an author has Wikipedia-friendly license for us to use. What does it have to do with Georgian government? Georgian government has no right as such in this case and an author can do whatever he/she wants to. Please, do cancel the deletion request from these images. --GeorgianJorjadze (talk) 10:07, 8 April 2012 (UTC)[reply]
He is just the author of the photograph, the true copyright holder is the architect of the tower. It is (roughly) like taking a photograph of a photograph by someone else. Materialscientist (talk) 10:31, 8 April 2012 (UTC)[reply]
Are you kidding me? That means that we cannot even takes photos or what? That is nonsense. Everyting what is on the public eye in Georgia everything can be depicted and taken on photo. That is ridiculous. If we go that way then you should delete all the images from Wikipedia database, because everything what is taken by someone was built someone else. Whether it's hotel, cafe, street infrastructure, house etc. Put the Georgian law where it restricts free individuals of its country and its citizens that they can NOT take photo of the places and sightseengs of the country. What a nonsense. And it's not taking a photo of a photo. It's a sightseeng in Georgia which is on public eye and nothing is restricted to take a picture of it or not. --GeorgianJorjadze (talk) 10:44, 8 April 2012 (UTC)[reply]

Take your time to think about it - everyone rejects this idea at first (and I was no exception). (i) Many countries do have "freedom of panorama" (FOP). (ii) If the object is out of copyright (author died more than xx years ago; xx depends on the country, usually 70 years) then it is fine to photograph it, no matter the FOP. (iii) Some objects do not qualify as an artwork and may be photographed no matter the FOP. (iv) You can surely take photos for your own use, but you may not distribute them commercially. Say, you photograph a poster on a street, with some famous photo of Georgian president on it, then put it on the front page of your book, print the book, and start selling it - be prepared for troubles. Currently, wikipedia wants its pages to be reusable by anyone, including small businesses. Materialscientist (talk) 10:56, 8 April 2012 (UTC)[reply]

Are you telling me that NO ONE can take picture of the Georgian Alphabet Tower untill the architect won't DIE? OMG this is NONSENSE. Everything what is in public eye in Georgia is free to take photos or videos or whatever it wants to. Put the LAW of Georgian government where Georgia HAS NOT Freedom of Panorama. Why are you doing this? Everythings allright with the license and the author permission and why are you doing this? Why do you want to delete this images so much, why? Cannot you just cancel the deletion of these pictures? What kind of problem do you have with Georgia or Georgians? --GeorgianJorjadze (talk) 11:02, 8 April 2012 (UTC)[reply]
You are not listening. Read my comments and COM:FOP. You may take any photos, you may not distribute (some of) them commercially. Photos hosted by wikimedia projects must be free to re-distribute. Materialscientist (talk) 11:13, 8 April 2012 (UTC)[reply]
Put the Georgia law which says that taken photo can not be redistributed if the author is giving the permission to redistribute. WHY DO YOU DELETE THIS PICTURE? There are tons of pictures like this of hotels, towers, cafes etc and you're just deleting my pictures? This image needs to stay on wikipedia. Please cancel the deletion now. There are tons of pictures taken in Georgia so what? Are you doing to delete all of them? The author is GIVING THE PERMISSION. The Georgian government has no right to restrict its citizen by not redistributing its OWN images. Author can do WHATEVER it wants to. Are you telling me that Georgian Alphabet Tower will be available for uploading after the architect would die and 70 years would pass after its death? Oh, GOD. --GeorgianJorjadze (talk) 11:23, 8 April 2012 (UTC)[reply]

Anyone can take photos of alphabet tower. But the law forbids commercial distribution of such photos because the law respects the intelectual property of the creators of the original artwork, in this case: the architects rights. This means: You can make photos of the tower and use it at home for personal, non-commercial purposes. But you can not distribute photos under a free content license without the architects written permission. This means you can not upload photos of the tower to Commons. --Martin H. (talk) 11:27, 8 April 2012 (UTC)[reply]

This is unbelievable. EVERYTHING has its author in Georgia if you go this way. Everything was created or built by someone else. How in the WORLD can we get the permission from the offshore company who just built this tower? How in the WORLD can we do that when it's a Spanish company just HIRED by some to do its job and that's it. The boulevards, cafes, hotels also have it's architects. So what should we do? Should we ask them right to distribute the picture or not if their Hotel or something is on my picture? Put the Georgian law where it says that Georgians cannot distribute their own images of these kind of places and artworks. Tbilisi Main Cathedral also has its own Architect so what should we do now? And he is alive. Should we delete the all pictures of Tbilisi Trinity Orthodox Cathedral? --GeorgianJorjadze (talk) 11:35, 8 April 2012 (UTC)[reply]
The simple answer is: Yes. This project is not some personal photo album but a project that collects photos that are free for commercial reuse. This means we must pay attention to the law of Georgia. For the purposes of this project the law of Georgia requires what you just said. Ask architects for permission to publish the photos under a free license. Otherwise, to stay with the example, files in Category:Sameba Cathedral, Tbilisi are not legal. --Martin H. (talk) 11:43, 8 April 2012 (UTC)[reply]
I see you're very much against my pictures. Just tell me in brief. Are you going to delete my pictures or not? --GeorgianJorjadze (talk) 11:49, 8 April 2012 (UTC)[reply]
Commons has some rules. The most important is: Files must be free for anyone to reuse anywhere, anytime for any purpose including commerical purposes.
If the law of a source contry not allows us to host media files under this conditions we will not accept uploads of such media files. If a file is uploaded against the rules of Commons, this file must be deleted. --Martin H. (talk) 11:54, 8 April 2012 (UTC)[reply]

And after all this discussion, you have uploaded File:Radisson Blu Tbilisi Georgia G. Kadagishvili.jpg. Sigh. Please understand, we are here to help, and I was willing to help you understand what files may be uploaded and how to find and select such files. This won't be happening if you boldly ignore our rules. Materialscientist (talk) 22:29, 8 April 2012 (UTC)[reply]

What's wrong with you people? I am not stealing anything. I am only uploading those images which are available for public use and are licensed in a Wikipedia-friendly manner. I am not doing anything wrong. All these images give us the right to distubute the images and the author says that and lets others to use it. What do you want for god's sake? --GeorgianJorjadze (talk) 22:53, 8 April 2012 (UTC)[reply]
Most flickr users are unaware of the "freedom of panorama" laws and are lacking full knowledge of what license they may attach to their uploads (say, there are plenty of copies of commercial CD covers on flickr with a free license); but you are (hopefully) aware of the FOP rules. If you created these pages, please note that the fact that they have been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with them, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!
