Images removed where legit

Hello, the images you removed yesterday uploaded by me are legit, they are all my work, I am the photographer/painter. I understand it looks like my account is new, but I logged in using my wikipedia login (which is pretty old...):

Hi, you deleted the picture, giving "Not own work - Author info clearly visible in EXIF" as the reason. Can you please explain more in detail how and why you conclude from the EXIF info that it is not the work of the uploader? Hi @Rtc: . The exif clearly says Copyright holder: Copyright 2014: Raphael Reischuk. If you are Raphael or if you have permission from the photographer you will need to provide that via COM:OTRS Gbawden (talk)
Well, shouldn't it be sufficient that the uploader is Rapael Reischuk? COM:CSD#F1 is about apparent copyright violation. IMO that means that the picture is okay except if there is evidence that the uploader is different from the copyright holder. That makes it apparent to me. Its something I see regularly - users uploading work claimed as own work but in the EXIF we clearly see copyright or author info. Perhaps I am overly cautious but I would prefer you to confirm that you are Raphael via COM:OTRS Gbawden (talk) 08:21, 14 November 2019 (UTC)

Sorry @Rtc: I got a bit confused. I really do see this regularly. Only upload of a new user, name in exif that doesn't match user name or is a clear copyvio. Some users tag as needing permission but to me this is a copyvio - especially since they claim own work Gbawden (talk) 09:33, 14 November 2019 (UTC)
It is really not true that exif info must match the username. Please undelete the picture. If you google for "raphael reischuck Ricona" you will see that Raphael frequently uses Ricona as his alias. Would you be so good as to undelete one or more of these? We have an article on EN, Anima Anandkumar, about her, that needs an image, and they don't have to have been physically taken by her for her to own the copyright to them. Hi @GRuban: . As I said in the DR these are in scope but they weren't own work as claimed. For example on of the photos was posted here - https://blog.aboutamazon.com/amazon-ai/amazon-at-acl-2018 - so the uploader would need to prove that they have the rights to this photo via COM:OTRS Gbawden (talk) 06:12, 15 November 2019 (UTC)

Don't worry files can be undeleted and an OTRS agent will get back to you one the email has been processed. Question

Hi, Could you please inform me how can I recognise that this file is not F10 (likely personal photo) and its Trusted and active editor on one of wikis? regard Déjà vu 23:08, 21 November 2019 (UTC)

I usually check their registration date and their edits to Commons before marking files as F10. As for activity in other wikis, you can pretty much see a overview of their edits across all Wikimedia projects in Special:CentralAuth. If the edit count is high, I usually drop the file but if the edit count is low/very low, I assess them manually. Google translate is not perfect but helps a lot in patrolling. @Gérald Garitan: When there is doubt it is better to delete than host copyrighted works. Can you tell me when the artist died? The drawing date is not the issue. Hey. You have deleted this file I've uploaded a while ago. Not that I have a problem with that, since it is no longer in use, but just a question. You deleted it because it is a "Personal [photo] of or by non-contributors". I am actually a contributor and this was the picture I used on my main user page. Hi! Just saw your response. If I upload the whole image, will I be able to crop it for use as the profile image? Don’t want to have both of us in the profile image for my page, which was why I had cropped it. Is there some way to post the cropped version? Or to crop it once uploaded? Thank you! @Freeandaware: I am not always on Commons - so post your question about OTRS on the Help Desk and someone will assist. As for cropping, yes you may. @Thebadnewslive: If you take a photo from a site that has a free license you have to provide the source and the license. You claimed those photos as own work, meaning you took them yourself, which was not true. Deleting of photos uploaded by Premek1946

I have reacted on 16 January and presented on the same discussion page the appropriate licences. I observe with high regrets that you did not react. Deleting of anonymous, not artistic portraits older than 70 years has no sense and is purely bureaucratic. I am sure that the user Premek1949 only did not understand exactly, how to apply formal rules. Deletion of Hemal's photos

Hi. I do not get that. Because, these photos have been taken my friend and I listed them according to my friend's wish. Now, you are telling me that it is from facebook. Undeletion Request

The file https://commons.wikimedia.org/w/index.php?title=File:Infobot_Facebook_Messenger.png&action=edit&redlink=1 was deleted but it was a screenshot taken by myself and I believe I have uploaded it to Wikimedia Commons using Creative Commons license. Request: Deletion of copyrighted intellectual property uploaded without permission

Hello Gbawden. I saw your username in the discussions regarding the deletion of this file. As the owner of this file I know when, how, and where it is authorized to be used. The answer is nowhere on Wikimedia at any time. The photograph was uploaded without permission. Wikimedia users then requested permission for it to be uploaded and then for it to remain; both requests were denied. I informed user prolights [name redacted for privacy] that she should not upload the file and request its deletion. Apparently the file was being used on other wikipedia pages, again without permission. I have emailed the Wikimedia foundation multiple times to have this file deleted because permission was never granted for it to be used on any website other than flickr and a company website. It was later deleted from flickr. I reached out again today to request that the file be deleted since it is no longer in use on any page and remains in violation of copyright as permission has not been granted and will not be granted if it is sought. The image in question is not in the public domain, a user unaffiliated with me and/or my company uploaded the file to wikimedia servers without proper authority, and thus stole intellectual property where it remains. I therefore respectfully request your assistance as I have received no reply to the emails I have sent, nor can the user apparently delete her own file, nor can I delete the file. Your assistance would be greatly appreciated at this juncture. I kindly ask that the photo to which there is no permission or authorization be deleted as I assert it is not in the public domain nor does the doctrine of fair use apply to this intellectual property. Both are done and you did deleted it. I declared when i was uploading i took the picture. And HTISA give already permession for all data on there website (in the ticket that was included on the file and the nomination page - 2008111710007855). Both are already done (before the file was nominated) but the files was deleted anyway. I have the feeling that nobody took al look at the ticket. @Vdkdaan: The permission in that ticket doesn't cover the photo (this was mentioned in the Deletion discussion) - so I would suggest re-submitting via OTRS. Once done we can undelete Gbawden (talk) 06:34, 6 February 2020 (UTC)
I asked the exact words of the ticket (in Dutch) and it aplies on the website but without legal code. So i understand that they need more information. But because I took the picture myself I also does not need the permission. Besides permission is too mush troubel (i m not used to work with OTRS). The self-portrait was removed from my page. I have the RAW unedited .arw file of this picture as proof of my ownership.

Musical Apartheid, Fascist style thanks to South African looking to score points for themselves

All of my commons contributions of important musical artists have been flagged and deleted because of over-ambitious fascist editors who are looking to gain higher prestige within the Annals of WIKIPEDIA. Decades of musical legacy has been compromised, Musicians who made an impact on history have had their photos removed with ZERO COPYRIGHT INFRINGEMENT, ALL of the photos are public domain and I have been censored by a brainless system. @Richinstead: Hi. The Carnegie logo is uploaded to Wikipedia as fair use. Commons is not the same as Wikipedia. All files uploaded to commons must be completely free - to be modified and for commercial use and there has to be a statement confirming that on their website or they have to do this via COM:OTRS For logos where that permission doesn't exist, Wikipedia allows upload as fair use, but fair use is not allowed on commons. Both pictures come from the family archive of the person in question (Jovan Radulović) on the pictures. I was asked by his family to put those two pictures up. I was the one who took that portrait picture over a decade ago. As for the picture of the signature - I scanned it directly from unpublished manuscript of the writer (and created .jpg of it). @Skribos: Where there is doubt that the uploader is the photographer then the OTRS process needs to be followed. As you can imagine we get loads of people claiming to have taken photos and OTRS allows us to verify this and in turn protect the photographer. Reversing Deletion of Photos by Gabriel Diamond of Skoll Award winners

You deleted a photo of Maryana Iskander because it existed on the web before the upload. We requested this photo from the staff photographer at the Skoll Foundation, who took the picture. How do we get this undeleted, because we're asking them to upload multiple photos under a CC-BYSA license, and they own the copyright. The fact the photos are used all over the web is not actually a copyright violation. What's the process? It seems to have vanished. Do you need an email from the photographer? Yes @Gbawden: and usage across the internet is not necessarily a copyright violation, and as noted I requested the creator of the media work to provide the Commons a CC-BYSA license, which the creator of a media work is allowed to do. Thanks for pointing us to the additional process step for getting the license to the image recognized, which seems to have worked, although we are still trying to get the file you deleted undeleted and marked appropriately by OTRS volunteers (note: OTRS has just done this and the file is restored). The OTRS ticket number is #2020031010009732.
For future false positives (which I recognize are likely a small percentage of the photos you label as copyright violations), the key point is that if the photo is available on the Internet, even the actual creator needs to go through extra steps with the OTRS process to reassure the Wiki community that the creator is who they say they are, and actually do have the right to grant the required license. And, it also seems that if the creator in question has lots of images they want to helpfully donate to the community under the right license, it is possible to have OTRS label their account as possessing that right so that newly uploaded images don't go through the deletion/restoration process. We have requested that from OTRS and it hasn't been implemented yet. But, we do want Gabriel to feel appreciated for his valuable contributions of excellent images to the Commons. So, if you spot another image uploaded by Gabriel Diamond, please hold off on the fast deletion action and give us a chance to get the required OTRS confirmation. The description translates to "Summer of 2020 a kayak rental opens in central Kalmar. Here you can rent one- and two-man kayaks and SUPar". The image was used on spam-pages such as the users user page here and on other wikis as well as a pure spam-page on svwp. The clauses pertaining to copyrights are contained within a private contract and that is marked commercial-in-confidence. i.e. it is not for public consumption or release. Copyright question regadring my pics

Hi. I don't know why you removed my photo without first confirming me to me its status, but your accusation that it was not my work, but a copyright violation, is false, and your rationale that it was "found elsewhere on the web" ignores the rather obvious possibility that it was found on the web because whoever uploaded elsewhere took it from Wikipedia. I took countless photos of Ms. Milano at the signing in question, and uploaded 91 of them, including the one you deleted, to the Commons the following day. The rest of them are in their own category right here, where my username and real name are given in both the file name of each photo, and elsewhere on each photo's page, just as they were given in the file name and upload page of the one you deleted. Do you plan on accusing me of copyright infringement regarding all of those as well?

Hi Gbawden, I noticed that an image was deleted from the WLM winners for 2019 and found your closure to Commons:Deletion requests/File:Effigie du monument René caillet de Boké1.jpg (opened by Gone Postal) regarding two pictures uploaded by Aboubacarkhoraa. Unfortunately, nobody researched in that DR whether the depicted object is already in the public domain. These are photos from a monument which was erected during the Second French Empire. Quote from [2]:

Sous le Second Empire une stèle fut érigée dans l’enceinte du fortin abritant l’administrateur du Cercle du Rio Nunez, à Boké, pour rappeler à tous cet exploit.

@AFBorchert: Hi. I agree that they're old enought but Commons:Copyright_rules_by_territory/Guinea#Freedom_of_panorama seems to disagree with the PD claim. I will re-open the DR Gbawden (talk) 15:57, 20 June 2020 (UTC)
Hi Gbawden, FOP is an exception of the copyright law in regard to works which are still protected by copyright. As soon as the copyright expires, FOP is no longer relevant.
