Uploading when the publisher, not the author, has copyright .

I want to upload a diagram from a book. The copyright page of the book has the Publisher, not the author, as holding the copyright. Upload Wizard only asks about "The name of the person who took the photo, or painted the picture, drew the drawing, etc." and offers no field that allows me to specify that the copyright holder is the publisher, not the book's author. The publisher (the copyright holder) has granted me permission to upload the diagram to Commons. The author's current state of health prevents him from expressing himself on the matter. @JeddBham64: You still must indicate the author of the diagram (not the publisher and not the author of the book if different from the author of the diagram) in the "author" field, for several reasons, among which the moral rights of the author and because, in many countries, the duration of the copyright of the copyright holder (publisher or someone else at that point) will be based on the death year of the author. You can use the "permission" field to specify anything of relevance about the copyright, including the identification of the copyright holder. Anyway, in a case like this, you must first convince the copyright owner of the diagram to issue a free license for the diagram and have them confirm it themselves directly through the procedure of Commons:VRT. It must be the copyright owner of the diagram, which may be different from the copyright owner of the book, for example if the diagram was copied with permission from another source. Of course, permission is not relevant if the diagram is in the public domain for some reason. You are being secretive about which book and which diagram you talk about, so not much more can be said. -- Asclepias (talk) 13:53, 1 December 2022 (UTC)

We have a deletion policy and the reasons for deletion don't include participating in a contest. You can certainly request deletion, but without a valid reason, your files wouldn't be deleted. —Justin (koavf)❤T☮C☺M☯ 13:22, 1 December 2022 (UTC)

It seems like you did not look at the deletion policy page that I linked, as it answers your first question. As for your second, if you have donated educational media for the world to use and then you are arbitrarily given the ability to remove that access, that is not helpful for others. A Commons admin may personally choose to delete these files, but is not obliged to based on what you have given as a reason. Note that if you license a file with a Creative Commons license, you cannot revoke that license and can only ever make it more free. —Justin (koavf)❤T☮C☺M☯ 13:35, 1 December 2022 (UTC)
@Iryna Hulevata: Your two files are very recent uploads from today. In a case like this, you do not need a reason to ask their deletion. Commons will consider that you made a mistake and will delete them. It is criterion "G7" in Commons:Criteria for speedy deletion. You can just include the template Speedydelete in the description page of each file. However, when you say "participate in a contest *here*", do you mean a contest on Wikimedia or elsewhere? If on Wikimedia, you probably do not need to delete the files if your idea is to reupload them anyway. Assuming you are talking about File:Adult Learning Table.Andragogy.jpg, right? This seems to be screenshot/capture. What was the source and who created it? --Túrelio (talk) 21:10, 2 December 2022 (UTC)
@Pikelake6: The issue is that we will need a license from the copyright-holder. If they have the content somewhere on a site clearly under their own control, then the simplest way to do this is for them to be explicit on that site about the license they are granting for that image. Then you can cite that for the permission.
But there is a further problem here. File:Adult Learning Table.Andragogy.jpg is basically formatted text, not an image, and may therefore be outside of Commons' scope. - Jmabel ! talk 22:24, 2 December 2022 (UTC)

File Deletion and Issues

Possible incorrect way to replace an image

I have a question about this image file from Wikimedia Commons: [File:Michael Weller, author.jpg] found on this web address: https://en.wikipedia.org/wiki/File:Michael_Weller,_author.jpg#metadata: It appears that the recent “new version” is not a new version, but a completely different image by a different artist, which seems to be a good-faith mistake in the way to replace an image, as it affects the copyright agreement, and authorship claim — does something need to be done to straighten this out?Åüñîçńøł (talk) 19:23, 2 December 2022 (UTC)

Hi, problem is that this is on :en-Wikipedia, so it must be dealt with it there, not here. If this had happened here, it would be reverted (per COM:OVERWRITE) and it would be checked whether the new version isn't a copyvio. 3rd issue is that the 2nd uploader simply uploaded a new image without changing the related source/author information, which is a no-go. --Túrelio (talk) 19:40, 2 December 2022 (UTC)

N00b errors when making SVG multilingual

Sorry about making a mess. I was trying to use File:PPV,_NPV,_Sensitivity_and_Specificity.svg on nowiki. Seeing that the file in question did not contain translatable text, I manually edited it in Inkscape and created File:PPV_NPV_Sensitivity_and_Specificity-no.svg, only then did I figure out that SVG has a switch statement and that I might have been better off uploading this version to the original and start creating translations. So now there is a Norwegian version, an English version and another Turkish version, not created by me called File:PPV,_NPV,_Sensitivity_and_Specificity-tr.svg. They all have their different file histories. How do I best merge them into one multilingual SVG? BFG (talk) 12:30, 3 December 2022 (UTC)

@ArtistCommunications: You can upload the image on Commons if you are the photographer. Otherwise the copyright holder needs to confirm the license via email. In that case, please see COM:VRT for the procedure. Always upload the original version with full EXIF data, even if a small thumbnail is used (the software takes care of that). The Upload Wizard is asking me for the exact day, month and year the work was created or first published but I can't seem to get that information anywhere. What should I do? Merge history of images and change file name

Hello,

i tried to find a solution myself, but I don't want to do anything wrong.

In 2006, user @Sgt bilko drew a map of the Salzburg S-Bahn (a local commuter train network): File:S-Bahn_Salzburg,_Netzplan.svg

In 2015, user @Aisano updated the map and uploaded it under a new file name: File:S-Bahn Salzburg, Netzplan 2015-f.svg This file is used on 17 different wiki pages worldwide.

Now I want to upload a new version from 2022 of the map. My suggestion would be to merge the two files under the original name. Then I can upload a new version without "2015" in the file name but still the history is visible. I tried to merge the files with the "Move" function, but it doesn't work. Why would you want to do that? In 2006 there were the lines S1, S2, S3. In 2015 there were the lines S1, S2, S3, S4. I assume in 2022 there will be again other lines. Would you also merge an image of Donald Trump at 5 years of age with images of Donald Trump at 25 ad 85 years of age? C.Suthorn (talk) 07:37, 4 December 2022 (UTC)
Actually, this is best practice for rail maps. Look at New York City Subway, S-Bahn Berlin - Netzplan.svg, Tokyo Metro and thousands more. The reason is simple: The current network plan should always be visible in the info boxes. People want to get information there. It would be crazy to update all Wikipedia articles worldwide with every map update. You can't compare a network map to a photo of a person. Of course, a new photo should not replace an old one. But when updating a network map, that's different. That's not a photo, that's information. And information should never be outdated. --Mediadesigner 11:35, 4 December 2022 (UTC)

Social Media Images Regarding Telegram

I recently wanted to send a picture for the Combat Organization of Anarcho-Communists that they have posted recently on their telegram. They took a picture of their flag with a firearm showing a little in the frame and I wanted to know If I could use it but I do not know about their Copyright for images posted onto their Telegram. Does copyright/plagiarism apply to image descriptions?

Hello, if I download an image from a museum webpage and upload it to Wikimedia Commons, can I copy and paste the museum's description of the image as long as I put it in quotation marks and attribute it to the original source at the end of the quotation and provide a link? I bought several books coming from de personal library of the dutch archeologist Maurits van Loon (see nl:Maurits van Loon (1923-2006)) with Ex Libris. Depicts and quantity

I'm looking at File:Koekjestrommel open.jpg. There are seven different types of cookies, and unknown number of individual cookies (probably between 20 and 30). The seven types is the relevant part, because of the w:Sju sorters kakor tradition. I would like to set up a depicts statement that says the photo depicts cookies (that's easy enough), and specifically that there are seven types of cookies.

I have read Commons:Structured data/Modeling/Depiction. d:Property:P180#Constraints lists an item "quantity". But I suspect that is meant to be used for "about 30 cookies all together" and not for "7 different types of cookies". Does anyone know how to tell Wikidata that there are seven different types of cookies? WhatamIdoing (talk) 20:39, 4 December 2022 (UTC)

Large image version

In my excitement to provide Commons with the "highest resolution file possible" I may have gone too far. I successfully uploaded File:Corianton_lobby_card_1.tif. I want to upload another version of the file that crops out the black and white space surrounding the image. To also show the original image borders, I thought I would upload the cropped version as another version of the original. The cropped version is about 272 MB, but the upload limit is 100 MB. I can think of a few workarounds--reducing the resolution to make the image less than 100 MB, or uploading the cropped version separately and using a template that shows it is derived from the original image. Logo Deletion

Hi. I created a logo for an organization I'm a part of (https://en.wikipedia.org/wiki/New_York_University_Law_Review). I've tried uploading the logo twice and both times they were deleted (https://commons.wikimedia.org/wiki/File:N.Y.U._Law_Review_Logo.png). I indicated that I created the logo both times by adding "{ { Own } }" (delete spaces). I'm not sure what else needs to be done here. Any and all help would be greatly appreciated. Exactly for that reason. They published it. Anyone could have copied it from their publications. image upload

Hello. I've noticed that in several Wikipedia pages, in almost every language (such as German and Spanish, but more), the picture referring to Bolaji Badejo is not accurate. The person depicted is not Bolaji Badejo (who performed the Xenomorph in Ridley Scott's 1979 "Alien" movie) but rather some other person known as Chief Bolaji Ayorinde SAN. I'm not being able to change this picture because of licensing issues, but I think it would be important that someone could correct this mistake. The image is incorrect in almost every language page. @NerdyRas007: That depends on how you license the image. Excerpt from Commons:Licensing:
  • Republication and distribution must be allowed.
  • Publication of derivative work must be allowed.
  • Commercial use of the work must be allowed.
  • The license must be perpetual (non-expiring) and non-revocable.
  • Acknowledgment of all authors/contributors of a work may be required.
  • Publication of derivative work under the same license may be required.
  • For digital distribution, use of open file formats free of digital restrictions management (DRM) may be required.
The recommended license if you're uploading your own work is the Attribution-ShareAlike 4.0 International (CC BY-SA 4.0) license, which requires attribution.

Need help to move/rename the filename to expected one

Hi, I just updated the diagram on this page: https://en.wikipedia.org/wiki/Chain_of_trust, it's to use the general terms/concepts in the diagram to make it easier to understand.

And since my account is too new, I cannot override the existing filename (Chain_of_trust.svg). So I've upload my version of file under a new filename (Chain of trust v2.svg).

As suggested by the error dialog during editing, I'm requesting help to move/rename my file (https://en.wikipedia.org/wiki/File:Chain_of_trust_v2.svg) to the expected/existing/old filename (Chain_of_trust.svg). Please help.

Hello. We usually do not overwrite existing files with substantially different versions, but will only add small changes to one file. So I think it would be best if you kept your "version 2" file as it is and just leave the old file sit unsused. See also COM:OVERWRITE and COM:RENAME. De728631 (talk) 15:39, 11 December 2022 (UTC)
Hey, thanks for the reply. I actually made changes based on another existing file (https://en.wikipedia.org/wiki/File:Chain_Of_Trust.svg).
In that case, should I still keep using the new filename (Chain of trust v2.svg), or should we rename and override this existing file (Chain Of Trust.svg, https://en.wikipedia.org/wiki/File:Chain_Of_Trust.svg)?

The changes in Chain of trust v2.svg with respect to Chain Of Trust.svg are smaller than with respect to Chain_of_trust.svg. But probably the same principle as above. Better to leave separate files and not overwrite. The diagrams are used on several websites. Some websites may prefer one diagram, some may prefer the other. For example, the rounded edges as visual clues to identify the keys are more visible and consistent in Chain Of Trust.svg, the black lettering may be preferred to the blue by some, etc. The choice of the diagram to use is better left to each website. Not Commons to force one diagram. However, if Chain of trust v2.svg is substantially derived from Chain Of Trust.svg, please add a link to Chain Of Trust.svg and credit its author. (Although it's possible that Chain Of Trust.svg was itself derived from Chain of trust.svg without giving credit to the author.) The name Chain Of Trust v2.svg might have made clearer the immediate filiation of the new file with Chain Of Trust.svg instead of with Chain of trust.svg, but that's not important. -- Asclepias (talk) 06:55, 12 December 2022 (UTC)

  • @Cineceleb: Wikimedia Commons does not allow material on a "fair use" basis.
  • In contexts where "fair use" is allowed, fair use is not a matter of where you obtained the material.   1. We don't have articles on Commons. The article you wrote was on the English-language Wikipedia. You'd have to take up the issue there. But offhand, it looks like what you wrote did not cite any references, so it was just changed into a redirect to the relevant school system. Content in the English-language Wikipedia needs citations. The deletion in en-wiki had nothing to do with anything about copyrights.
  2. Presumably where you have written "ll" (lowercase of "L") that should be "II" (uppercase of "i"). And you made that same error in naming the article.
  3. I see that here on Commons you tried uploading a screenshot from Google. Of course, that was deleted as a copyright violation. But a photo you take of the school yourself would be welcome here on Commons. In fact, we have very few images of Cibolo, Texas, so if you want to take some, that would be great.

I would like to add pictures of George Sanderson

I am a George Sanderson enthusiast and have spent much time deliberating on this fact, whereas in the matter of wikimedia commons images can be added in order to enhance the public knowledge of George Sanderson. With a modest inheritance I was able to establish a bicycle shop in the greater Seattle metro area and in that venture I was successful enough to purchase a Cannon EOS 60 Mark II. I have successfully transformed that investment into a portfolio of George Sanderson photographs which I intend to release to the public forthwith. My pictures are of the highest quality and I would like to be credited as the photographer who brought George Sanderson to the forefront of public interest. My belief is that no investment is too great when it comes to the internet benefit of all mankind in regards to George Sanderson. I also run a GoFundMe to offset the travel expenses I incur along my mission and have so far raised over $80 in just 3 months. Who is the foremost George Sanderson authority I would get in touch with on wikimedia commons about publishing my works? I want to make it clear that rather than publish in a book for sale, I am electing as a public service to contribute the body of my George Sanders work for no pay because I believe it is important to give back to the community. Once I sell enough George Sanderson photos, I will be able to upgrade my camera and be able to take even better quality pictures which I will also add. RUmoistyet? If the former, you won't be able to do this, at least not on Commons, because the Disney character is copyrighted, making your photos derivative works. @Sardaka: It depends if the unspecific-named category was actually intended for the Randwick one. Looking at the history, yes it was. So, the move is fine. (From the logs, "Category:Our Lady of the Sacred Heart Church, Randwick" existed at some point and was deleted in 2009 [2]. Don't know why the unspecific name was preferred then.) You will need to move the contents of the category to the Randwick category. Also, now that the unspecific category name is freed, instead of redirecting it to the specific Randwick one, a better use for it might be to use it to redirect it to Category:Our Lady of the Sacred Heart churches. -- Asclepias (talk) 15:23, 11 December 2022 (UTC)

@Anal portrait extravaganza: assuming you are serious, first have a look at Category:Human buttocks and its subcategories. It sounds from your description like you are taking pictures that are even narrower in what portion of the human anatomy is covered. It looks like we could use a moderate number of such images, but I don't imagine we'd want hundreds, let alone thousands. So as not to waste too much effort (yours or ours) you might start by uploading a dozen or so images that would give a fair representation of what sort of images you plan to upload; categorize and describe those appropriately; and then come back here so someone can check your work and give feedback. - Jmabel ! talk 05:25, 13 December 2022 (UTC)

For more certainty, you can research if it is part of a known series or if someone somewhere has more information (e.g. image search, postcard collectors and traders, local history societies, etc.) Is there a mark or indication on the main side (I suppose you would have mentioned it, but you did not tell explicitly)? If after research you do not find information, you can upload to Commons with the status tags PD-UK-unknown and PD-US-expired, applicable to the image of the postcard. Are logos part of copyrights?

Hi, 2b2t have recently updated their logo. I updated the logo and added it on it's Wikipedia page, but was removed by Filedelinkerbot as a potential copyright violation. Now, are logos a copyright violation? How can I update the logo?

Quick answer: I think you should read COM:L as suggested above because you don't seem to understand what the word en:copyright means when it comes to Commons?
More detailed answer: the copyrightability of a logo depends on how much creatively went into creating it and the copyright laws of the country where the logo was created (first published). In order for a logo to be uploaded to Commons, it needs to be too simple to be eligible for copyright protection in the United States (where the Commons servers are located) and the country of origin (country of first publication) where the logo's creator created it or first published it. Complex logos which are considered to be eligible for copyright protection can only be uploaded if they've been released under a free license accepted by Commons or the copyright holder's COM:CONSENT can be verified. -- Marchjuly (talk) 06:48, 15 December 2022 (UTC)

Unsure of the Copyright of an image

I'm currently on a quest to find images of old senators and governors without any. I found an image for Maryland Senator Robert Henry Goldsborough. The problem is, I am unsure if the image is in the public domain or not. According to the site I found it on (https://www.wikitree.com/photo/jpg/Goldsborough-72), images are automatically copyrighted unless the creator permits use. According to the site, the original image was made in 1802, but uploaded in 2020. It also says the image is public, but I am unsure if that means public domain as the help page for Public Images on the site simply mentions being able to freely view it.

How can an out of date logo be removed from infobox and replaced with the new one? This page https://en.wikipedia.org/wiki/Field_Studies_Council has an old logo on, I can't see how to add a new logo that will appear in infobox or take off the old one. @MelCousins: Firstly, you or someone else must upload a new image file with the new logo. If the logo is copyrighted, you can use the upload link in the left sidebar of Wikipedia and choose the option to upload a non-free file. Or, if the new logo is too simple to be copyrightable, it may be uploaded to Commons instead of Wikipedia. Secondly, you edit the page of the article and replace the file name of the image that is currently there (Field Studies Council.jpg) with the name of your newly uploaded file. -- Asclepias (talk) 15:16, 16 December 2022 (UTC)

Categories "airports by country/location"

Hi. Is there a reason why there is for example Category:1981 at airports by country and Category:1981 at airports by location which contain the same category? Same for Category:1990 at airports by country and Category:1990 at airports by location. There might be more, like 1992 and so on. This follows the logic of the (great grand-)parent Category:Airports by location, which has airports by continent, country and city. In principle, there could be by year categories for any of these. "Category:Airports by country by year" is also in "Category:Airports by location by year". If, similarly, "Category:1981 at airports by country" gets included in "Category:1981 at airports by location" (and the same for other years), it will be fine? I suppose you can do it, if you want. Whatever logic gets agreed upon to articulate the relations between the main parent categories such as Airports by location, continent, country and city, should be used also for the whole groups of subcategories. Many of those categories were created about one year ago. Can I remove watermarks on a copyright-free image?

Hello, another individual took a close-up photograph of a paper document that is in the public domain so I believe that it is eligible to be uploaded as ((PD-scan)) but the photographer put a watermark on their photograph. Am I allowed to remove the watermark and upload it to Wikimedia Commons whilst still giving credit to where I got the image from? ThethPunjabi (talk) 21:44, 10 December 2022 (UTC)

Tag for 1935 published photo from Germany?

I have a high resolution image of this photo taken by an unknown photographer in Germany in 1935 [3]https://www.loc.gov/item/95513432/. In Germany, photographs are protected under § 72 UrhG for 50 years after their appearance, so the copyright has expired. My question is whether this tag is correct:

  • I don't think that 50 years is correct. Normally the term of copyright in Germany is life + 70 years. However, if the work is truly anonymous, then it is simply 70 years. The problem is, that means it would not yet have been out of copyright in 1996, so in the U.S. we are up against that URAA restoration of copyright until 2031 (1935 + 95 + 1). - Jmabel ! talk 02:10, 12 December 2022 (UTC)
50 years is not correct, that is only for "Lichtbilder" (simple photographs), and the German courts have defined those as X-ray images, satellite imagery, surveillance camera images, photos from automated photo booths and such. Regular photographs like the one in question are protected for the lifetime of the photographer plus 70 years after the photographer's death (70 years pma). That a photographer is not named somewhere does not necessarily mean that the photographer is "unknown" (as claimed here) btw. --Rosenzweig τ 20:45, 12 December 2022 (UTC)
As a 1935 photo copyrighted by Associated Press in the United States, it probably was published in the United States, not exclusively in Germany. See also the introduction of Photographs distributed by Associated Press. Given which, normally there could be a chance that it could be PD-US-not-renewed. But the AP copyright still mentioned in the description is concerning. Could this particular photo happen to be an exceptional case of renewed copyright on a 1935 AP photo? The album containing the print was confiscated as enemy property, which conveniently makes the album and its contents public domain in the U.S. per U.S. law, for parts of the contents that were actually enemy property. Since this photo is identified as AP photo, what was possibly enemy property was the particular physical print collected in the album, but since the copyright was the property of an American business, the copyright was not enemy property. I have a high-resolution digital copy without any indication of its provenance or publication. Regarding photograph copyright (Lichtbilder), I just wanted to say that I've read that purely machine-generated photographs are in the public domain, such as surveillance cameras - but that's beside the point. Can § 66 UrhG apply here ("(1) In the case of anonymous and pseudonymous works, copyright expires seventy years after publication. However, it expires seventy years after the creation of the work if the work has not been published within this period.")? I have other digital copies of Goering's photo albums that do not contain an AP copyright notice like this one [4]https://www.loc.gov/pictures/item/2009632095/. If you want to use the § on anonymous works, you should be able to tell when and where this was first actually published and if it was published with a named author (photographer) or not. Supposedly there is this "Copyright by Associated Press", but to be able to properly determine the copyright status, we need to know more about the first publication. If we don't have enough information about this, Commons will accept photos that are over 120 years old (with the tag {{PD-old-assumed}}). Which for the 1935 photo means in 2056, for the 1937 photo in 2058. --Rosenzweig τ 13:19, 17 December 2022 (UTC)

Help regarding uploading an Image

The image File:Draupadikichaka.jpg depicts the subject in a pink garment rather than a black one as seen in File:Sairandhri, by Raja Ravi Varma.jpg. The 2nd version (05:02, 12 June 2010 by Redtigerxyz) of File:Sairandhri, by Raja Ravi Varma.jpg has a higher resolution version of the same pink garment painting. As I am unable to overwrite the file, I would request anyone of you upload that picture as a new version in File:Draupadikichaka.jpg. The version of the file mentioned by the IP (12 June 2010) is the same painting (the vertical pink dress painting) but not the same source as the first version (30 September 2005) of the file. (The source of the second version was not disclosed by its uploader, but it can be seen that it's not from the same source as the first version), so indeed apparently it's not really the same image, and one should not overwrite the other. That was the mistake made by the uploader of the second version of the file. The 2005 file should never have been overwritten. Ideally, the file should be reverted to that 2005 version. The second version can be (re)uploaded separately, if its actual source is found. The case gets stangely even much more messy, since in September 2022 a user overwrote everything with the different painting (the black dress painting). I would normally trust that user as I know he knows much about India, however I don't understand that overwriting, it does not seem acceptable. How to get a picture with copyright violation removed?

I had uploaded an image when I first created my Wikimedia Commons account and I was now made aware that it is a violation of copyright (File:Katja_Loos.jpg). I agree and already nominated the picture a few times for deletion. It was also nominated for rapid deletion by the copyright owner and tagged as copyright violation. I also removed the false copyright tag. But all requests of deletion get turned down and user even add the false copyright tag back. How could I get this picture deleted? Thanks for your help. Tom Lehrer has released his songs to the public domain [5] and I feel it would improve the article on that song to embed it directly into the article.   • @Razziabuissa: His lyrics are now released. The tune also should be no problem ("Modern Major General" is PD, as well) but any given recording remains an issue. The source of Tom Lehrer's release seems is his website https://tomlehrersongs.com/ which, among other things, states Performing and recording rights to all of my songs are included in this permission. His release explicitly mentions music and lyrics, and the right to perform or record them, but I understand it to not cover the rights to the recordings themselves. Look for a tab labeled "Export to Wikimedia Commons" in Vector or "export to wikimedia commons" in Monobook. However, I am sorry to inform you that you have triggered Special:AbuseFilter/153 by trying to cross-wiki upload png photos as a new user. Such uploads of png photos are not allowed at all. The following applies to each photo. You indicated it's your own work. Usually when someone uploads a png or smaller jpg photo, it's a copyright violation taken from the web. Please upload the full-size original of it per COM:HR, including any metadata, but if you were not the original photographer, that person may need to license it on their official website or social media or send permission via VRT with a carbon copy to you. Also, any png image will look fuzzy when scaled down (due to design decisions discussed in phab:T192744) or jaggy when scaled up, so you may want to upload svg or jpg versions, too. If you can't get a compliant license, the photo may still be uploaded to English Wikipedia in compliance with en:WP:F because we don't allow Fair Use here. Hi I am not familiar with this site. I work for Topical Television and we would like to use two photos in a BBC daytime programme "Caught Red Handed". These are the two images:

  • The notice for the first image on the National Archives website at https://discovery.nationalarchives.gov.uk/details/record?catid=1977925&catln=6 mentions that it is originally from "INF 14 - Ministry of Information and Central Office of Information: Publications Division: Photographs". The immediate source for the Commons copy is the flickr stream of the National Archives at https://www.flickr.com/photos/nationalarchives/3008584298/. The National Archives tag it as "no known restrictions" for use, so that looks safe to use with no credit, no payment, anywhere.
  • The source of the second image is what looks like the perfectly legitimate flickr account of the photographer at https://www.flickr.com/photos/24736216@N07/2698850060. It is tagged by the photographer with the license CC BY-SA 2.0, so safe to use without payment, anywhere, but with attribution to the photographer (the account is currently identified as "Roger W" but it was probably "Roger Wollstadt" in 2014 when the image was copied to Commons) and the mention of the license and its url (see https://creativecommons.org/licenses/by-sa/2.0/deed.en for details). For more information or if you would want to use the photo without the license, you can ask the photographer, who indicates his contact email on his flickr account.

@Mr. Jaune: there are a few problems here.
  1. From what you say, the claim of "own work" is false, as is the 2017 date.
  2. More importantly, though: who took the photograph? That is the person who presumably owns the copyright, and they (or, if they are no longer alive, their heir) are the only one who can grant a license.
    • Slight exception to that if the copyright has been formally transferred, but then we'd need evidence of the transfer.
  3. See COM:VRT for the way confidential correspondence can be handled so that someone can grant that license without having an account here.
    • If the rights-holder has a site or page that is obviously under their control, they can indicate the license there instead of going through VRT. Then you can cite that as a source.

Point number 1 relates to the photo by Gourgons already on Commons, not to the photo by Agnès Brabo uploaded by Mr. Jaune. The Gourgons photo has the date of the digitization in the date field, a common mistake on files with scanned images of photos originally taken in the 1980s, which I guess may be caused by some automatic insertion by the Upload Wizard, and uploaders probably don't realize that it's something they should change. The presumably correct date mentioned in the file name shows that it is not an attempt to deceive about the date of the photo but it's probably inexperience with the peculiarities of the upload process on Commons. That situation does not imply that the statement of own work is false. Commons already has VRT confirmation for other own works by this account, so I suppose that's a situation where there's nothing basically wrong if the only thing to fix is the date field. -- Asclepias (talk) 19:49, 19 December 2022 (UTC)

Very long time for OTRS?

I have uploaded 5 new pictures for my article (on top). I uploaded on behalf of "Amt für Kulturgüter Fribourg". They have sent an Email to OTRS (see text by any of these 5 newest pictures). Its waiting very long?

There is also a photographer with name. He worked on behalf of the "Amt". The Amt has the copyright (like a publisher). But like an author of a book, the photographer is named too. Is this OK or irritating? For me, the autorisation of the copyright holder "Amt" ist sufficient?

  • Hi Meginrat. Did you read the wording of the {{Permission received}} templates that were added to the files' pages. In general, a 30-day grace period is granted to files tagged with such a template to take into account that VRT verification sometimes takes a bit of time. So, there's still at a few weeks to go before the files will once again be eligible for speedy deletion per criterion COM:CSD#F5. You can, if you want, ask about this at COM:VRTN, but you need to understand that VRT members won't discuss specific details related to the emails they receive anywhere on Commons and they only will discuss details via email with the person who sent in the original email. -- Marchjuly (talk) 01:55, 20 December 2022 (UTC)

@Jeff G.: Thanks for this more clear answer. The „Amt“ used a template for mail (assume you can see) and filled that form in all points. Is there a newer one? The Amt für Kulturfragen in Fribourg has the copyright, the photographer is named in each picture and the mail also. The files are brand new, EXIF is uploaded. Shortly: what shall we do? We start with the bridge and chapel, which date from circa 12th century - we need no more information about them, but it could help (engineer for the bridge, architect for the chapel). Then, we have the painting of the bridge and chapel on wood, dated 1680 - who was the painter? - we need no more information about the painting, but it could help. Then, we have the modern color photo - it appears Alain Kilar was the photographer 10:27, 25 October 2021, may we have permission from them? If they granted copyright to the Amt as a part of the photography contract, we need a copy of the contract, else we need permission from the photographer. Then, we have the restoration - was the painting restored or the photo? Who did the restoration and when? May we have permission from them? I have similar questions about the other four files, plus: What do we know about "Jo'. Achert. The pictures were restored and therefore new fotos were produced. But it would be additional work to describe all in commons and the howto is also not clear.

Lets focus on licence questions first, to use in article If I understand you correct, the photographer also has to send a mail (list of photos, dates):

  • "I worked on behalf of Amt für Kulturgüter Fribourg and made fotos after restoration 2022. With mail from xxx.xxx.xx the Amt für Kulturgüter has already allowed use of these pictures with Licence CC BY-SA 4.0
  • I explain in relation to the pictures whose photographer I am:

@Meginrat: you should be able to edit anything about the image. If there is no clear place to put a piece of information, add it to "description". At worst, someone who knows more about how to do this can move it later. You triggered the filter for small jpegs - usually, these are copyright violations, that's why new users can't upload them. In this case, you have two kinds of issues:
  1. File format: JPEG is a poor format for graphics like these, you should really use a lossless format like PNG, or ideally SVG
  2. License: You need to know the copyright situation for each of the images you want to combine. Official German road signs are public domain ({{PD-VzKat}}). Simple text in a basic shape is PD too, because it is too simple for copyright ({{PD-sign}}). If your effort consists only of pasting these together, no copyright is created at all, and you can use {{PD-because}}, give the above reasoning and add the respective license tags. --rimshottalk 20:32, 19 December 2022 (UTC)

There is no need to contact the user who uploaded it and it would not be useful. He holds no right on the image and claims none. (Don't trust the exif metadata inserted by that user. Falsification of metadata is exactly why he was blocked.) To check the status of an image you find here on Commons, check directly at the source. The description page of this image mentions that it is copied from an auctioneer website. See the link to that source in the "source" field. So, in this case, basically, what is known about this particular photographic reproduction of the artwork is what you can find directly at the source website. When dealing with a photographic reproduction of a public domain artwork, the use that can be made of the particular reproduction depends on the laws of the countries where you want to use that reproduction. Commons does not provide legal advice, but you can read some guidelines on the page Commons:Reuse of PD-Art photographs about what can or cannot be done with a reproduction in some countries. The only way we can have copyrighted material is with a free license granted by the copyright holder and allowing both commercial use and derivative works. I am sorry about not being clear on the image. My question is that the photo was taken by someone I know on their phone of their pet dog. They recommended I wrote an article about the dog breed Double Doodle and then I suggested we used a photo of their dog on the article and they agreed. If you reverse image search my photo you would not get anything besides the article. They emailed me the photograph and the rest of the discussion on the photo was in real life. Hi Tvshowoflife. Since you're not claiming the have taken the photo yourself, you should follow the guidance given in COM:VRT#If you are NOT the copyright holder. This might seem like overkill because the person who took the photo has already said its OK for you to use it on Wikipedia, but what you need to understand is that this type of verbal consent is insufficient for Commons. Basically, what Commons needs is for the person who took the photo to give their COM:CONSENT to allow anyone (not just you) anywhere in the world to download the photo from Commons at anytime and then reuse the photo for any purpose (not just for use on Wikipedia only). By giving their consent, the copyright holder acknowledges that others may end up reusing their photo in ways they might not approve or otherwise like; others may also use the photo for commercial reasons without having to compensate the copyright holder. It's because there's so much involved that email or some other form of written verification is required in many cases by Commons. Finally, even if you get the copyright holder to give their consent, that doesn't guarantee the photo will be used in any Wikipedia articles. How photos are used on Wikipedia isn't really a concern of Commons and sometimes there can be disagreements over whether a photo actually should be used among Wikipedia editors. If that happens with this photo, you may need to seek consensus to use the photo through discussion on the relevant article's talk page. -- Marchjuly (talk) 06:10, 22 December 2022 (UTC)

@Tvshowoflife: If you already know what free license the person chose in the email, you can already include the corresponding license template in the licensing section of the description page. Also add the template Permission pending. It prevents the deletion of the file while the email is processed, which can take a long time or not, depending how busy the VRT team is. If VRT was emailed, things will eventually be sorted out one way or another. I’m not a VRT member. If you have further questions about VRT, try asking at COM:VRTN. One thing about the file you uploaded is that is needs a COM:License and may end up deleted per COM:CSD#F5 if it remains unlicensed. If that happens, don’t reupload the file. A deleted file can be restored at a later date once its licensing has been sorted out. @Alessandro Costrufo: There is no one requirement for an image to be kept. There are many distinct reasons for an image to be deleted. I don't think I (or anyone) could easily describe the precise intersection of what describes an image that does not violate any of the rules that would be cause for deletion. A short (but inevitably incomplete) list would be:
  1. It is within scope, as described by COM:Scope.
  2. It is not a precise or scaled-down duplicate of an image we already have.
  3. It is either free-licensed with respect to copyright (including commercial reuse and derivative works) or is in the public domain both in its country of creation and in the U.S. There are literally hundreds of ways this criterion can be met or not.
  4. It is not libelous.
  5. It does not violate U.S. obscenity laws.
On these last three criteria, if there is doubt we will almost always delete, based on the precautionary principle.
If you have a specific issue in mind, please raise it because, as I said, the above is inevitably incomplete and because criterion 3 breaks down to so many distinct cases. - Jmabel ! talk 23:55, 25 December 2022 (UTC)

Image of Rosette Nebula

Greetings. My family loves my Electronically Assisted Astronomy images so much they think that the rest of the wikiverse would enjoy them too. I created an account and uploaded my image of the Rosette Nebula on the Rosette Nebula wikipage. I added a descriptive caption as well as describing the specifics. I got a rejection that there could not be confirmed that I actually took the picture. It was an image from my astronomy capture software which I controlled much like photoshop, etc. with no modification over that captured by my camera. It has no metadata, unlike simple digital cameras and phones. Please advise on how I can make the wikibot not reject my work. Thank you. DrBobAZ (talk) 19:49, 27 December 2022 (UTC)

Linking to a license

Hi all. What does "linking to a license" look like on a hard copy printout? Does it look like this: https://creativecommons.org/licenses/by-sa/4.0/deed.en

My intention is to print out copies of an image. The instructions on one of the images say I am free to do so as long as I "give appropriate credit, provide a link to the license, and indicate if changes were made." The page says that the file is licensed under the "Creative Commons Attribution-Share Alike 4.0 International license." When I click on that, I go to a page with a web address of: https://creativecommons.org/licenses/by-sa/4.0/deed.en. Do I just include that web address on the printouts of the image?

(1) Are the images here copyrighted by Creative Commons or by the Artist? Is it on a case by case basis? I don't see a reference in the images I am looking at as to who is the copyright holder.

1: By the owner of the copyright, to whom the text of the license refers as "the Licensor". The owner of the copyright is usually the creator of the image (illustrator or photographer). (In more complex cases, additional copyrights may be involved). Creative Commons does not own a copyright on the image and is not the Licensor. Creative Commons provided the text of the license that the Licensor chose to offer.
2: It looks more than sufficient. There is of course nothing wrong if you want to write even more information than the minimum required by the license. The exact information in each case may depend on what exactly the Licensor indicated (does the Licensor require specific notices or not). You did not provide a concrete example of an image you might use, so we can't get more specific here. There might be suggestions in the FAQ on the Creative Commons website.

Hi, Commons is not for your own promotion, even if it's for charity or whatever. If you want to write about yourself, you must be on Wikipedia, but that's an encyclopedia and writing about yourself is not what Wikipedia is about. If someone or something is well known enough to write about, then others will write about it or you. The same with photo's. If you upload a photo only for yourself, to use it for self-promotion (in any way), it can be deleted. If you have a nice picture of something that Wikimedia can use, it's always welcome, but first think what you wanna do with it. If it's only for yourself, that's not what a wiki is about. What is the ideal size for a Windows screenshot?

Hi, if one were to upload a screenshot of Microsoft Windows (which I plan on doing), what would be the ideal size? I'm thinking 320x240, but I'm not sure if its too big or too small. My user account was duplicated and renamed, want to merge it back.

During a period of absence, my user account was renamed to User:Rainwarrior~commonswiki, somehow to avoid a conflict with my account which was already User:Rainwarrior? Not sure why this was done, but now I can't edit that user page or make it redirect to my actual account. Also, all of my past contributions and edit history are associated with the commonswiki account.   • You are the copyright owner, not Commons, so there is not much Commons can do. It's possible to sue, but I presume from you writing in French that you are not in Mexico, so that probably wouldn't be easy. Do you remember the name of the file? Generally, when a file is tagged or otherwise nominated for deletion, a notification message is added to the uploader's user talk page. Is there such a notice on your user talk page for the file? If there is, click on the name of the file (it should be in red if it was deleted). This will take you to the file's page and near the top of the page there should be an explanation as to why the file was deleted as well as the name of the Commons administrator who deleted it. -- Marchjuly (talk) 00:46, 22 December 2022 (UTC)

1918 Ray Byars Harley Davidson Shop

There was a picture that I uploaded and was approved for Tommy Byars, son of Ray Byars and the inherited owner of the Ray Byars Harley Davidson Motorcycle shop. It has been deleted from Tommy Byars and I can't find it to add it to Ray Byars' draft. Where can I find the picture so that I can use it on Ray Byars' draft. I changed my user name because I wanted to go by my nickname rather than my name. When I first uploaded my first pictures, I was very inexperienced and did not understand the language at all; therefore, I used wrong forms but after a lot of eplaining, the pictures were approved. I am still handicapped at learning Wikipedia and Wikimedia and very slow to understanding. I hope that eventually I will get the hang of it. I have only written one article ever and now I am working on my second article and I am starting to learn more, but it is still like reading Greek to me. Sorry if I offended you! I only want to do a good job and contribute historical information and I believe that I have a lot of information to give. @CharlemagneJane: Per COM:HIRTLE, yes if the photo was "Published with notice and the copyright was renewed", the photographer's copyright lasts 95 years from publication in "1927 through 1963". So, what you are saying is that, if the pictures were published 94 years ago (1928) and the photographer died 78 (1944) years ago, they are still protected? Photos that have been reproduced and distributed in the public domain that are not licensed under the copyright law

How to create a new copyright tag

Hi, I want to create a new copyright tag which will be used with files that are work of a government. Various types of governments, like national government, provincial government or local government, allow others to upload their contents under the conditions:- 1) proper attribution and 2) use in non objectionable and respectful manner. Copyright tags for the Governmental works of individual governments exists, like Template:GODL-India for Government of India, Template:PD-USGov for Government of United States. As it is not possible to create copyright tag for every single government, I think a general copyright tag should be created. @Ku423winz1: Hi, and welcome. We have tags for many governments, see COM:CRT. We already have {{Attribution}} (or any of the nine other redirects for {{Attribution only license}}). "use in non objectionable and respectful manner" is a non-copyright restriction we don't concern ourselves with. You are setting a non-existent Category:Governmental work (and, frankly, having Commons set templates is always to be done with a lot of caution unless that is their main purpose). And I would think the issue was more something like Category:Public-domain or free-licensed governmental work.
There really ought to be a way to link a reference for that particular government offering such rights.
I still don't like this. As I wrote above, "it is possible to create a distinct copyright tag for any government that free-licenses its materials," and I still think that is a better way to go. - Jmabel ! talk 16:54, 27 December 2022 (UTC)
@Jmabel: , I got what you are saying, but my main problem is that everyone does not know how to create a copyright tag or template. If a common tag is made then it would be helpful to everyone. Like I myself upload free-licensed files from different governments, making tag for every each one is impossible. To solve the reference problem, I have included the parameter " url " to give it a link to the copyright policy of the website. So, what you are suggesting? Should I change the name of the template and also the category? What is your preference? Ein generisches Template "Regierung von" fände ich nicht schlecht. Dies sollte aber dann nicht von Usern mit einem Parameter "Regierung XY" befüllt werden, sondern von diesem Template sollten Unter-Templates "Regierung von XY" erstellt werden, die dann von Usern verwendet werden. Andernfalls würde ein Wildwuchs entstehen, bei dem zwei Bilder, die von zwei Usern hochgeladen werden einmal den Parameter "Regierung von Xy" und das anderemal den Parameter "Regierung von XY" erhielten, was für alle automatisierten Aktionen (wie das eintragen der SDC durch Bots) sehr hinderlich ist. @Rjdeadly: if it's genuinely useful for an en-wiki article, then it probably falls under one of the allowances there. The only exception I can think of is that there is pretty much no allowance for photographs of living people, unless a particular significant event is being depicted. - 00:16, 5 January 2023 (UTC)

Ok, but what is that license doing there, who claimed to issue it, under what right, to what did they mean to apply it (to the scanned reproduction?)? The book is in the public domain in the United Kingdom and Wikimedia does not care about copyright claims on reproductions. I'm not sure about its status in the United States. It could be Not-PD-US-URAA, but an inner page includes New York as one of the business locations of the publisher, and it could mean that the book was simultaneously offered for sale in the US and be in the public domain in the US as PD-US-no-notice. It seems that the book was reprinted by two other publishing companies in the US in 1973 and in 2010. -- Asclepias (talk) 15:50, 5 January 2023 (UTC)
