Copyright ststus?

Hello,

Could you tell me how to get this uploaded on to Commons for use in Wikipedia articles relating to the National-Anarchist movement? Political symbols, like the hammer-and-sickle, the swastika or the circle-A are in the public domain but the N-A symbol is a recent invention and, while it's used around the world by this movement, the source is on an N-A website whose contents are stated to be fully copyrighted ([1]). What would be the copyright status here? And what precisely would I, or the website owners, need to do or provide in order to comply with the licensing requirements? If the website says copyright, the image has copyright. You can email them requesting they grant permission to license the image under GFDL/CC/etc. - see COM:L. When they respond, you can then forward your email to us - see COM:OTRS for more information. giggy _(:O) 07:47, 1 February 2008 (UTC)

Copyright violation of four images. How they are denounced?

Hi. This four imager can violate copyrights: Comarca Señorío de Molina Guadalajara.jpg , Comarca Serranía Guadalajara.jpg , Comarca Alcarria Guadalajara.jpg and Comarca Campiña Guadalajara.jpg . Really, it's not an own work of Alfonso2 user, but a possible plagiarism of the web of Diputación Provincial de Guadalajara. How can be denounced the copyright violation? Creative Commons from Wikitravel

ILMap-doton-*.png

theres a series of maps with that filename (* as wildcard) which serve no useful putpose that I can see, most of them aren't linked to, and theres a geobox that performs the function of the map. If you mean that Image:Condoleezza Rice.jpg was overwritten by Downstage (talk · contributions · Move log · block log · uploads · Abuse filter log) block user, that's been taken care of. Old coins and banknote

Image:Concussion mechanics.svg

I tried to modify Image:Skull and brain normal human.svg in inkscape (where it looks fine), but when I upload it, the brain image is missing, and all that's left is my modifications. Plus the blur is gone on the parts with fade. I think it's because I've got a reference to an external link in the file, but I can't figure out how to get rid of it without breaking the thing altogether. Help? To get rid of the external link, download the SVG file instead of the png and open it with Inkscape. You should be able to add your changes there. --rimshot^talk 15:14, 2 February 2008 (UTC)

Snoopy drawing in concrete copyrighted or freedom of panorama?

I was at the en:Redwood Empire Ice Arena in Santa Rosa, CA, outside of which various people have signed their names in concrete, similar to what actors have done at en:Grauman's Chinese Theatre in LA (examples here). Charles Schulz did a little drawing of Snoopy and signed it, which I took a picture of. Can I upload it here or is it it's copyrighted? BrokenSphere 22:52, 22 January 2008 (UTC)

To be more exact, as the link provided by LX explains, there is something like freedom of panorama in the United States, but only for photographs of buildings. This does however not apply to copyrighted artwork like statues or a Charles Schulz drawing in public space, therefore the answer remains basically what LX wrote in this case. How can this image of the concentration camp Buchenwald, taken in 1940, be "a work of the United States Federal Government"? Who is Schmuhl that his courtesy makes it PD? He seems to be working at the Holocaust Museum, so I'd guess he didn't take the picture himself. Anyone out there to enlighten me? --Ibn Battuta 07:33, 3 February 2008 (UTC)

May very similar file names cause a problem?

I recently uploaded Image:Maryanderson.jpg and afterwards noticed that there is already a very similarly named image: Image:MaryAnderson.jpg - the only difference being in the capitalisation of "Anderson". I know that they are treated as different files here and in UNIX-like operating systems, but e.g. older Windows versions don't make a difference between Maryanderson.jpg and MaryAnderson.jpg as they ignore capitalisation. Therefore I would like to rename my upload to make the distinction clearer (I requested deletion of the other picture due to copyright concerns, but it seems now that it can stay), but apparently this isn't possible. What should I do? Do you view it as a non-issue or should I re-upload the image under a different name and request deletion of my previous upload? Gestumblindi 00:11, 4 February 2008 (UTC)

Upload a new version and give it what you consider to be a better name, then mark the older version with the badname template like this {{badname|Image:different name.jpg}}. Additionally, when I first started using the plethora of deletion templates which are available for use here, applying the {{delete}} template and viewing it in Preview mode only will display many of the deletion options which are available. -- carol 00:42, 4 February 2008 (UTC)

The newspaper cites "Rexhep Qosja, La question albanaise", so they probably did not make the map themselves, and cannot give permission to use it. If they just used data from the book, and from that created the map, they would have the rights to it. In that case, it could be released if you mail them, but chances are low that they'll do it.

On the other hand, as data cannot be copyrighted, you are free to recreate the map. Make sure that you don't just copy the image, but really create the map as you would given only the data. --rimshot^talk 11:57, 4 February 2008 (UTC)

Category:Books by country - categorize by author or the nation where the image comes from is published?

I'm just clarifying that this would be by the author's country of origin, e.g. anything relating to the Tarzan novel go into Books of the United States because Edgar Rice Burroughs was American, even though the character is British. The reason I'm asking is that User:Mdd4696 has undertaken a project to digitize The Writings of Charles Dickens. These have been categorized in the Books of the United States, I'm presuming because he has been photographing an American edition that is held by the Rochester Institute of Technology library. However shouldn't they been in the UK categories? Note that there is already an existing Charles Dickens category, so there is overcategorization. --BrokenSphere 04:48, 5 February 2008 (UTC)

personality rights

I recently uploaded Image:Chris Taylor cropped.jpg and the user who checked the Flickr review template (User:RedCoat) added the template:Template:personality rights to the page.

From the template: "The use of images of living or recently deceased individuals is, in some jurisdictions, restricted by laws pertaining to personality rights, independent from their copyright status." Hello SpecialWindler. As Giggy has explained, the template itself is more of a "warning", so to speak. As a rule of thumb, the person’s consent is usually unnecessary for photographs taken in public places, but is often needed for photographs taken in a private place. So you can rest assured that the image will not be deleted etc., seeing as it was taken in what appears to be a public place.

The notion of "personality rights" arises largely to protect a subject/person’s moral rights. For example, an image would infringe the subject's personality rights when the subject is being defamed: the usual example is an identifiable girl labelled as an "obese girl". I need help for image license

So yesterday I have uploaded image bu it was deleted [2]. This photo was made by people who worked in our project about Marine Mammal Research in Far East of Russia, and actually belong to our project. This image is free for non commercial use. So when I put this image under Creative Commons Attribution 3.0 Unported. So but its not work... Please help, because I would like to keep this image available for wikipedia.

Hundrends of copyright violations from User:Nttc

Hi, I am very concerned by User:Nttc and their image uploads. Every upload (hundreds of them) are a direct copyright violation that should be subject to speedy deletion.

User:Nttc has listed the licensing on every image I've seen as:

• "Copyrighted free use provided that Tourism NT is always credited as the image provider even when passing it to third parties and where possible a link is provided to the website http://www.travelnt.com".

However if you follow the link and look at the website you will find:

• "Other material contained in Tourism NT web pages, including but not limited to text, images and sound, is subject to copyright. Copyright may be owned by Tourism NT or third parties. Other than as permitted by the Copyright Act, NO PART OF ANY MATERIAL contained in Tourism NT web pages can be reproduced, copied or transmitted in any form or by any means"... http://en.travelnt.com/copyright-and-legal.aspx

This image is according to the description a screenshot from a YouTube video, but the uploader has placed the image in the public domain. Question about using your photos....

Hello There,

Are the photos uploaded on your website Royalty Free Stock Photography? Can I use your photos and if so - What are the limitatios? Do I have to buy a license or Do I contac the author/artist in order to do so?

I work for the Government, the State of Connecticut, which has about eighty agencies and the photos will be display in the State's website for the purpose of enhancing the site.

All photos found here can be used royalty-free on your website. You do not have to ask for permission. Depending on the license, you may have to credit the author of the picture. There can be other restrictions, depending on the particular license. The license for each photo is found of the photo page itself. After the generally favorable responses to my initial announcement, there have been several enhancements made to this script. It is basically finished now. I would like to have some beta-testers try out these new upload forms, especially people not using Firefox/IE6 on Windows. I don't understand why this image Image:Kingdom hearts toy.jpg is going to be deleted. It's not a copyright violation... If images like these... Image:Zelda_oracle_of_ages_gbc_cartridge_by_zeartul.jpg (contains a copyrighted logo), Image:Gold-colored-Legend-of-Zelda-cartridge.jpg (copyrighted logo), Image:Potion 6.JPG (copyrighted artworks/images) or Image:TOYOTA ist Pikachu Car.jpg can be kept, why not the Kingdom Hearts one??? Which license?

Hello again, somewhere above I asked about uploading a copyrighted political symbol. I am now seeking permission from the website but am unsure which license(s) apply. I want to ensure the symbol can't be appropriated or restricted by a distributor somewhere down the line, but at the same time I don't want to put obstacles in the way of its stand-alone use for political purposes.

Ideally I think I'd be looking at a license which stipulates ShareAlike but not FullText or Attribution. The nearest appears to be Copyrighted free use but this does not seem to retain any rights to the work at all. cc-sa-1.0 would have been better, but it's been retired.

I am pondering whether cc-by-sa-3.0 will do the trick, perhaps in conjunction with GFDL. But would the image description page need to append the copyright-holder's explicit permission for unattributed use by groups and individuals in a political context? If so, where should this be inserted and how would it need to be phrased? If not, what's the alternative? Gnostrat 01:50, 12 February 2008 (UTC)

The reason CC-SA-1.0 is retired is because there wasn't a huge demand for it and CC wanted to concentrate their focus on the more popular ones and simplify users options. It's still a valid license so you could use it, however, after talking with some people connected with CC, they advised me to go with CC-BY-SA-3.0 and simply waive the right to attribution (entirely or in whatever context you want), which you can do under any CC license since you remain the copyright holder. →Rocket°°° 01:59, 12 February 2008 (UTC)

Are renditions/recreations the same as replicas?

I sent an inquiry to the en:Rosicrucian Egyptian Museum (Commons cat) in San Jose, CA re. the Egyptian statues in front of the museum and in the surrounding Rosicrucian Park to clarify if these are replicas of PD artworks, the email and the response are below:

Thank you for your interest in the sculpture of Rosicrucian Park. The statue of Twaret in front of the museum, as well as the ram-headed sphinxes (called criosphinxes), are artistic renditions of original Egyptian sculpture. The human-headed sphinxes (androsphinxes) are also recreations from Roman-age Egyptian sculpture. The Horus falcons are replicas of real statues that flank the entrance to Edfu temple in Egypt. I believe most of the statues are true to scale. If you have any other questions, please do not hesitate to contact me.

Search problem

Why is it that a search on Anastas fails to find this image? The image was uploaded in 2005, yet the Commons search still can't find it! The word Anastas occurs both in the title and the description (it is a picture of Paul Anastas). What am I doing wrong, or is this a technical problem? Walkerma 19:39, 12 February 2008 (UTC)

It is a photograph that you took? If so, then you will need to make some decisions about how it gets used. The list of licenses that are accepted here is very long. Commons:Copyright_tags is the full list. Some shortcuts to areas that might be helpful to you on that page: Public Domain {{PD-self}} and {{PD-user|username}} stand out to me, but scroll in that section as there might be something specifically for your country. Commons:Copyright_tags#GNU_Licenses is where the {{GFDL}} licences are with a warning (that I have not read before but kind of knew) about using this license for images. Creative Commons licenses these were made with photographs and images in mind from the beginning. What I have heard and read is that the Creative Commons Attribution-Sharealike is the license that most resembles the 'spirit' of GNU ideology, in that it does not restrict use of the image commercially and requires that the artist/photograph be credited if the image is used. Probably it is best to read the licenses though.

When uploading the images, there should be some sort of interface which allows you to choose one of these licenses (although due to moving images from other wiki to here, the options might seem confusing when compared to the list on the license page).

Well, if it is en:Image:Schuler_Lanier1.jpg, please first figure out whether the sculpture is copyrighted. If so, the image can be opublished under a "free" license only with the consent of the rights owner of the copyright on the sculpture; see derivative works. Sorry, I think you've misunderstood the purpose of Wikimedia Commons.

Most of the images were created by Muslim scholars prior to the conception of the idea that depiction of Muhammed or other individuals was inappropriate. They are historically relevant and useful in illustrating the history of Islamic art. They are in the public domain, and displaying them here does not violate any applicable laws, nor does it constitute racial discrimination. (Muslims are not a race.)

Wikimedia Commons does not censor its contents merely because it could be conceived as offensive by someone. If you are offended by an image, please feel free not to look at it.

Uploading new versions of images

Hi. I'm active on Wikipedia and I need to upload an improved version of this image before nominating it for FP. Before simply uploading a new version, I wanted to see if there was some way to "link" it with the original image—not necessarily replacing it, but it seems redundant to have two of the same images, without a clear record of both, on each photo's page. The information template has a |other_versions= area. When I was uploading repaired versions of images (a task that I found to be very discouraging, btw) I liked to put a thumbnail of the original version in the case that a superior repair could be produced by either someone else or me later. There the rumor of a workshop for how to repair images that is in the making for some time now by User:Durova and you might want to check there for the last word on anything and everything involving the renovation of old images and the uploading of them to commons; a genuine GFDL success story if ever I have seen one.... -- carol 08:40, 18 February 2008 (UTC)

Notification to use on other wiki's

I've just nominated a photo for speedy deltion due to copyright issues. Then, of course, I should inform the involved user. However, the indicated template for doing this only works on wiki commons; not on English wiki where this user has his account. For now I've written a similar text manually, but clearly there must be a better way of doing it. The owner has the copyright & contact the webmaster of the aforsaid webpage for any future use of it. This file uploaded to be included English Wikipedia on the article for Santhosh George Kulangara.

It could read I, the photographer and owner of the copyright, say it may be used on Wikipedia and for any future use The grammar structure is Indic, even if the words are European. To explain his reasons for uploading he has said in the second sentence where the image will be useful. So the intention is classic CC-BY-SA.

More likely, is that user Avineshjose has found an image that is already CC-BY-SA, and wants to know how he writes the licence statement on Commons.

Sadly, image 3 looks as if it was an official NASA photo of the trip and would by PD under US law (I don't know- it wouldn't be if it were a ESA photo), but it could be that the subject of the photo is doing a copyvio placing the photo on his site on a CC-BY_SA. So, I think we must ask Avineshjose for more information about each image before we can give him the answer "Yes, you can" or "No, you can't" ClemRutter 17:25, 18 February 2008 (UTC)

Regarding Image:SGK zerogravity.jpg, Zero Gravity Corporation is a private company, and offer their flights to a lot of private citizens (some of whom, as we can see, bring their own cameras), so there's no reason to assume it's a NASA photo. --dave pape 18:28, 18 February 2008 (UTC)

I would like to contest the deletion and I spoke to the author/owner of the images. They said they are ready to provide copyright (permission) to use in en.wikipedia. how to upload pix to a specific category?

I wish to upload an image which is entirely my own work. I can find the category to which the image belongs: Mexican coins. There are 14 images there. However when I upload an image it apparently will only go to a general category. Searching by image dimensions?

I'd like to find many images that are 800x640 pixels, or the same ratio. How can I do this please? Looking at special:search didn't have that option, neither did Mayflower. Copyright question: Topsys and Turvys by Peter Newell

Hi, my girlfriend got an edition of Topsys and Turvys by Peter Newell and we wonder whether it's eligible for upload on Commons. Here are the facts:

• We're located in Europe.
• Peter Newell was a US citizen who died in 1924.
• His Topsys and Turvys childrens' books were first published in the US in 1893 and 1894. They consist of drawings that can be turned upside down, each of which is accompanied by a small rhyme.
• Our specific edition is a Dover republication, published in the US in 1964. It does not bear a copyright notice. The verso text of the front flap says that it's a "selection" from editions published in 1894 and 1902 in the US.
• There is no copyright renewal record. But I guess 1964 is one year too late for that to have any meaning.

Our concern is that the "selection" may have acquired its own copyright, which, despite being published in the US without a copyright notice, may still be active in Europe. What do you think, can we upload the whole book? If that's not possible, can we at least upload the pages as separate images (so the "selection" is not reproduced)?

The right tag would have been {{Copyvio}}, which is of course a speedy deletion tag. Screenshots of television shows are derivative works of the original copyrighted broadcast. Surya TV does not publish its works under a free licence. {{PD-ineligible}} as you had tagged it does not apply to still photographs or video footage of this kind; it's intended mainly for things like simple diagrams of chemical formulas. —LX (talk, contribs) 21:30, 21 February 2008 (UTC)

Image:Apoptosis pathways poster.jpg. It can take some time before the search engine knows about it. Have you really drawn that thing yourself as worker at that company (and they allowed you to use it your way) or did you just enter your name at the author-field because of you being the uploader. In the first case you should be aware that the picture contains the company logo which is now also licenced the same way as the rest of the picture. In the second case you should be aware that the company has reserved all rights to the things they have published and this thing would be published here without permission. In both cases a permission (see COM:OTRS) is needed to proof that you have the permission of the company to publish it here under a free licence. -- Cecil 18:29, 21 February 2008 (UTC)

New Account: Can someone move this image overtop the old one?

Du kannst bei welt.de nachfragen, wer der Lizenzinhaber ist. Das kann der Fotograf sein, eine Fotoagentur oder sonst eine Firma. Beim Fotografen oder der Firma kannst du fragen, ob sie bereit sind, das Bild unter einer freien Lizenz zu veroeffentlichen. Die Chance, dass sie das tun ist allerdings sehr gering. Wenn das passiert ist, kannst du das Bild hochladen, am besten gleich mit der Vorlage {{Otrs pending}}. Unable to upload

Hi, i can't upload some images since yesterday, i dunno what's wrong. i got sometimes a "request error" message and most of the time i'm just throw back to the upload page. It happens to me with some png, svg and JPG images. (nearly 90% of my uploads are reject).

Ok, more info : it has nothing to do with Commons... i cant upload either on Imageshack.us, and when uploading an image on Yahoo to send it to myself by email, it s truncated around 40 ko. Only a part of the image is uploaded.

Bot help with file renaming?

Somebody uploaded Image:Raúl Catsro.JPG and it came to be used in 189 pages in 54 projects. The problem is there's a typo in his name. I re-uploaded it as Image:Raúl Castro.JPG and tagged the original with {{Duplicate}}, but I'm wondering if there's any bot for handling the mass-updating of links in these projects. Why noncommercial use is bad?

I have tried to find an official explanation for it, but neither {{Noncommercial}} nor the FAQ nor any of our policies I looked at goes into any details. FAQ links discussion (Commons_talk:Licensing/Explaining_why_Derivative_Work_and_Commercial_Use_must_be_allowed) in a footnote but it is hardly a proper explanation, with the second poster stating "This is exactly the wrong explanation" and part of the discussion being in non-English :) So: did I miss some (apparently well-hidden) official explanation of why Commons does not allow non-commercial images, or are we in need of writing one? The founders and participants presumably want the resulting contents to be usable by anyone for any purpose, not just noncommercial purposes. It's a propaganda photo taken by the Soviet Union and evidently taken before 1954 during the Soviet occupation of Berlin (as the globe in the picture, belonging to Hitler, was later either seized by the Soviets and moved to a museum, or taken by an American soldier [5]). As all works by the Soviet Union published before 1954 are currently in the public domain, this picture should be in the public domain as well. --TBC 21:05, 26 February 2008 (UTC)

Question on use of 1909 circa photos from Syracuse University Library Collection

The Syracuse University Library has a collection of glass plate negatives of images from the Erie Railroad circa 1909 (http://library.syr.edu/information/spcollections/digital/erierr/). According to the library the images are in the public domain but they charge publication fees because they own the collection. How do you know that these images are in the public domain? They don't say so. They would only be PD if they were first published before 1923, or from 1923 to 1963 and their copyright was not renewed, or if they were first published 2003 or later. In all other cases, they are copyrighted. In particular they are most probably copyrighted if the were not published before 1978: Syracuse digitized those images in 2001, and if they also published them before December 31, 2002, these images are copyrighted until at least the end of 2047. They are able to still sell the photos if they are in the public domain; that is the definition of public domain: anybody can do anything they wish with the photo. That said, you may also be able to get away with putting a {{PD-old}} tag on the images if you can establish the date of the author's death. If not, the {{PD-US}} would not apply until 120 years after creation as an anonymous work: 2029. However, it would be easiest to try to establish when the works were first published: if Syracuse was the first to do so, or if someone else did so first (most likely). Tornado image

I am hoping to upload a photo of a tornado in 1982 that struck Marion, Illinois. Even though this image is on this National Weather Service page (the large picture) and technically in the public domain, it says the National Weather Service was given consent to use this photo. Signatures broken

Commons picture used by media

Is there any template we can use to indicate that a photo has been used by the media? Something similar to that used in Wikipedia, whereby an article was quoted by the media: en:Template:press. I found this photo taken by wikimedian User:Johnleemk used in the article: here. Kawaputra 10:40, 26 February 2008 (UTC)

While the servers were down I also discovered that 4 of my pics are also being used by a couple websites, 3 of them by WorldNews Network as the images for articles. BrokenSphere 17:45, 26 February 2008 (UTC)
