No Freedom of Panorama in Stockholm metro![edit]

The art in Stockholm Metro is covered by copyright and is not subject to Freedom of Panorama.

  1. Because art in underground stations are not located outdoors.
  2. Because metro stations are not public space.

The statement in the heading is far too sweeping. We probably shouldn't use a party with a commercial interest in the matter as our only source of information. The credibility of the source isn't exactly strengthened by the fact that it references a lobby organisation devoted to eradicating freedom of panorama in Sweden altogether.
The definitions of "outdoors" and "public space" in this context have to the best of my knowledge not been fully tested. The degree of enclosure and ability to restrict access most likely play a part. Keep in mind that many of the Stockholm metro stations are above ground. It should also be noted that the law applies to works placed "på eller vid" (on or by) public places. By explicitly adding "or by", it would seem that the lawmaker intended for freedom of panorama to extend to works visible from public places, regardless of their exact placement. Consequently, files like File:01 Gullmarsplan.jpg and File:Isfantasi Globen 2011.jpg should be perfectly fine.
That said, this category does attract some problematic content, and I've personally nominated files from here for deletion in the past. LX (talk, contribs) 17:52, 24 September 2015 (UTC)[reply]

The term has rather different meaning in different legal contexts, as shown by the Swedish Wikipedia entry. The context of whether SL has the right to put up xenophobic ads on its premises is quite unrelated to whether its premises are a public space for the purposes of freedom of panorama.
