Hi There

i noticed my images were flagged for removal of my brother's wiki page. I guess I am unsure of the laws as one of the pictures was of a picture in our house of my brother and John Candy. It is a picture we took and had blown up and gave to him as a gift. There is another one of his Grey Cup jersey (which he owns as playing for the team) that we had done in a shadow type box and hanging in the family home. It was a picture of it that I took. The other ones are ones the team took and gave to my brother to have, which he in turn gave to me to make up his page. So I am not sure how I have violated anything? I am happy to revisit so he van have he page restored with images.

This appears 'improvisational', yes, but "Hot Dogs and AppleSauce" is a copyrighted song by Rob Potylo. You can see him and Vermin Supreme performing it here in 2012. While they appear to have varied the words, the song itself is copyrighted. Uploading the video without the audio (their 'physical performance' appears to fail to meet the fixation requirement) was correct, and with the audio it's a copyvio. - Reventtalk 23:40, 31 January 2017 (UTC)[reply]

Romain Rolland books

Hello! You've uploaded Romain Rolland's books "Quinze ans de combat" and "Par la révolution, la paix" which you've marked as {{Not-PD-US-URAA}}. As the page Wikipedia:Non-U.S. copyrights shows, France had 50 years copyright term on the URAA-date, which was extended to 70 years in 1997, therefore these files are actually PD-URAA and so you can mark them accordingly. Sorry, I am not really familiar with how it works, but the tagged graphic needs to be deleted, because it is claiming to be our company logo and it is not (we only use SIX and not SIX Group). Copyright violations - KovalamKid

Hi Yann,

Please excuse me. I am quite new to editing in Wilipedia. I sent a request to the permissions email to remove a couple of images that I uploaded without copyrights by mistake. I asked for them to be removed.

Hi there, I understood this. I have been ill and then out of town. I have not "violated" this and I was well aware and all of these artists will be sending in an e-mail to wikipedia. The files you have uploaded were copied from the Internet, so there are not yours. For example, File:Luana Kenap.jpg comes from Instagram, as you mentioned yourself in the source. Dealing with problematic files takes time, both to reviewers and admins. So blocks are a conservative mesure, to prevent Commons to be flooded with copyvios. Actually most blocks are temporary. Category:Atlantic Forest: definition of edit warring?

Hello, Yann. I want to point out that I reverted Category:Atlantic Forest precisely once. User:Wieralee reverted my reversion. How does that make an edit war?

If you hadn't protected the page, I would have just let the page stand as-is (because completely fixing Commons' categorization will take man-centuries of effort, and life is short).

I normally delete all comments on my Commons talk page. I would appreciate it if you would retract your comment (perhaps with strikethrough?) before I delete it, so that my 12-year-long reputation at Commons remains pristine. — hike395 (talk) 20:03, 6 February 2017 (UTC)[reply]

Improper file deletion: File:Patrick J. Ahern House.JPG

I would like to know why the image for the Patrick J. Ahern House was deleted. I originally uploaded it with what I thought was the proper copyright information. Then you flagged it for copyright violation, so I contacted the museum which owns both the property and the image and had them email the release exactly as directed. I know they emailed it because I was CC'ed on it. Yet the image was still removed. What exactly do we have to do to get this image loaded into commons? Logo deleted despite gaining proper permissions

Noticed that the logo File:Wraith Logo Square.png was deleted despite gaining proper permission from the copyright holder. This had happened before but was reversed as it should be again. As per the licence tag, to be valid under UK law you need to "specify in the image description the research you have carried out to find who the author was". Most photographs taken in the UK in 1930 remain under copyright, and without evidence of that research into the identity of the author, the image isn't appropriate for being held on the Commons. Yann, the relevant UK copyright law covering anonymous works is here - section 57 of the 1988 act. This act is fully reflected in the wording of the UK anonymous copyright tag you are attempting to use for the image. An anonymous UK photograph published in 1930 can be considered out of copyright, but only if "reasonable inquiry" has been carried out into the identity of the author or photographer. In effect you can't simply say that you don't know who the author of a photograph is (e.g. "I can't see a name on the image"), rather you have to have reasonably demonstrated that the identity was never known (e.g. "I have checked books, the back of the postcard, the publishers, the internet etc. and can find no reference anywhere, to whom took it"). This aspect of UK law is different to that in France, btw. This is particularly important for a UK image from 1930, as many photographers alive in 1930 will still have been alive in 1946, the UK life + 70 cutoff date at the moment. There's some helpful advice on this for those using UK material here; the Intellectual Property Office in the UK has also issued advice on what constitutes a diligent search, published here. Although Yann and I often disagree on this issue, which is probably why Hchc2009 picked me, I think Yann is right here. This is a postcard -- either there is author information on it or not. If there were author information on it, the uploader would have said so. The only possibility for finding the photographer under these circumstances is a Google hit, and the only Google hits on this image are Commons, WP, or taken from WP. .     Jim . . . . James, the original uploader concerned (Antarchie) doesn't appear to have examined the front of other postcards he uploaded at around the same time; both File:Monmouth Wye Bridge From Air 1920's.jpg and File:Wye Bridge Monmouth Unknown Date.jpg for example, have the publishing house's name (Aerofilms Ltd) clearly displayed on the bottom right, for example, but are listed as author "unknown" and just sourced to "OLD Postcards" (capitals as in the original). File:Monmouth Monnow Mill Before 1923.jpg is listed as author "unknown" and again sourced to "OLD Postcards", but is a well-known postcard by J. File:St Thomas' Square and Cross.jpg is another "OLD Postcards" and "unknown" - on the back of it, though, is the publishing house's details (for what it's worth, this is Photo-Precision Ltd, from St Albans, founded after the Second World War in 1946 by two RAF photo reconnaissance officers, Arthur Smith, and Tom English, so most unlikely to be covered by the life+70 claim in the curent licence tag) I therefore don't think there's any particular evidence to suggest that Antarchie carried out the legally required "reasonable inquiry" into the identity of the Monmouth Bridge postcard either - including examining the back of the postcard.
NB: I've done research into postcards for other Commons files, and there is a lot more you can, and must, do than just looking at the back of a postcard - in particular examining books of published photographs from the period, or examining the webpages that list postcard publishers and photographers associated with particular towns, or perhaps posting a query on some of the websites for collectors. About "copyright violations warning"

Two recent photos were uploaded with the express permission from the copyright holder. Here it is - https://commons.wikimedia.org/wiki/File:Dok-vo_razresheniya.jpg , the permission. The very thing was posted on the freaking image description AND sent to the OTRS team - however, the images were still deleted via rapid deletion procedure (originally meant for obvious copyright violoations - e.g. taking some other person's copyrighted work and claiming it as your own) instead of normal deletion process and I have no say about it. I bear absolutely no responsibility for OTRS team failing to react to my e-mail in any way. About your warning Copyright violation. Help me please

Hi Yann, I'm trying to do things right and follow the instructions when working on wikipedia but it's really frustrating that despite following them I receive warnings like yours. It paralyzes me and I do not even dare upload any related photos. I showed you the link with the photos that its owner has published on Facebook for the media and even added me to his album as a collaborator to make it appear that he is happy with my use of them. Although my nickname is Marjotsy, my name is as there put on that album Margarita Otero Solloso. Can I upload any of those photos to wikimedia commons or not? What can I do if not? Two years ago I had a similar problem and I obtained the authorization of two children of the actor, they sent emails to wikipedia and to me authorizing the use (photos of Manuel Arvide, actor, of which I created in the article). In spite of it somebody erased them and my article continues without photos. They were mere familiar photographs and they did not know the author. I did not know how to solve it. I did two years ago with my other article and they receive the question "Who are the photographers?. They don't knew... It were their family pictures of their father!!! they were children!!. Pour la carte des réseaux SNCB-SNCV de 1966, il s'agit d'un document trouvé sur le net. Je ne sais pas comment faire pour la licence dans ce cas de figure. Yes, I inform the uploader every time. I often convert a speedy request to a regular request, so that the uploader gets a message, and then delete the file if the speedy request is justified. I instructed both Tommy Demenkoff and Katherine Wallace to email permission letters using the Wikimedia Commons email template to the provided email, and they did so as instructed with the photos tagged.

I added the permission to 4 of the images, but for one of them, the EXIF data says "Copyright 2007 by Andrew Gillis/Cascadilla Photography. Permission to reproduce for performance publicity and personal use of actor(s), set designer(s) and costume designer(s) is granted." So a permission from Andrew Gillis is needed.

I indeed have permissions for the three images you identify.

File:WikiD workshop Melbourne.jpg and File:151011-wikiD - 4-desat.jpg both document wikipedia edit-a-thons which I organised and ran as part of WikiD, a program that was funded through a Wikimedia grant to promote the participation of women in Wikipedia. They were submitted as part of our report to Wikimedia, which was fully accepted by Wikimedia. Both photographs were taken by my colleague Charity Edwards as part of this funded program. We have the full rights to these images.

The other file that you query is File:Julie Willis.jpg.

I commissioned this photograph from a professional photographer. The payment for this work included rights to use the photograph. This occurred some years ago and I do not have the agreement formally documented. I will seek this permission form the photographer, but I am very busy with other commitments, so this may not occur immediately.

Yann, my apologies for starting a new section, I couldn't figure out how to continue our dialog in the section where you responded to my response. It seems very unfair to me that a file of a photo I took myself should be deleted on the same day that I receive warning to establish my copyright. I am assumed guilty by this action. I also think it very unfair that one must wait 45 days to have the photo restored. Wikipedia should address this unfairness. I hope it will not require a legal challenge to inspire an improvement in Wikipedia protocol. Where can I officially complain about this unethical procedure. I have explained to him about Wikipedia use and guidelines. This is also my first time as a publisher dealing with Wikipedia.

I recently uploaded 1 image and did not find an option to claim that Eric has usage rights to the image so i selected the first option as owner. As a publisher, i make sure all my clients have usage rights for any images they post on their websites. I am very firm and serious about this and understand the implications as a publisher.

The recent image Theeantidote.jpg does have permissions by the Photographer Aaron as Eric hired him for a photo shoot in which he was granted all rights for usage. Images used by Eric all have permissions but how can i relate to Wikipedia that he does indeed have them? I found the copyright thing confusing because i don't understand if the Photographer or Eric or I can just convey he has permissions via email.

Also, i tried to delete the previous uploaded files and could not. I wanted to delete the list of images to start fresh but Wikipedia says i have to Administrator. I am also confused about this. It says to create an account which we did but then the Delete Image option is still not available. Is creating a User Account different than creating an Administrative account?

Please advise, we appreciate some constructive How-To input. We are not knowing purposely violating Wikipedia but rather need help understanding how to do it proper.

Also, the Sandbox is an pre-edit/preview environment and also understood as a page pre-approve. How do we know when our page is approved? And will the name i assigned Eric Grant be the name of the page verses Theeantidotemma? I'm having trouble with this clarification by Wikipedia. This is not an easy task endeavor so all input by you or others is very helpful at this point to getting started to turning out a acceptable guidelined page.

For each file, the photographer or copyright owner has to send a permission for a free license. Please see COM:OTRS for the procedure. The files can be restored when the permission is accepted. Regards, Yann (talk) 20:57, 29 March 2017 (UTC)[reply]
