Derivative image

Yann, File:Kuvempu-konkani vishwakosh.jpg is a derivative of File:Konkani Viswakosh Vol2.pdf (page 766 I think), I'm not sure how to fix the licensing and review, could you take a look at it please? cheers. —SpacemanSpiff 17:43, 2 November 2015 (UTC)[reply]

@SpacemanSpiff: Hi,
I fixed the source, but I don't know anything more. Regards, Yann (talk) 19:01, 2 November 2015 (UTC)[reply]
Thanks, Sorry for not being clear, I meant to ask whether the "review tag" on the original pdf should be appended to the derivative or not and also whether this should be tagged as a derivative work. cheers. —SpacemanSpiff 19:39, 2 November 2015 (UTC)[reply]
Yes, you can tag this as derivative work. However I am not sure what the license should be, and therefore if the review tag should be added or not. Usually the copyright owner is the photographer, but there is no information. Regards, Yann (talk) 20:06, 2 November 2015 (UTC)[reply]
Ah, right. I hadn't thought of that, I assumed it'd follow the book's license but it's entirely possible that the images used there are fair-use. —SpacemanSpiff 01:56, 3 November 2015 (UTC)[reply]

Hi, File:Екіпажі літаків російської авіагрупи в Сирії.png and materials of the site https://informnapalm.org/ are licensed under a license CC-BY-4.0 as stated in the description at the bottom of each page. Please restore this file. --Yakudza (talk) 14:48, 30 October 2015 (UTC)[reply]

@Yakudza: OK done. Restored, and created DR instead. This one looks OK, but for other files the source needs to be fixed. Thanks, Yann (talk) 14:59, 30 October 2015 (UTC)[reply]
Thanks , I will correct the source. --Yakudza (talk) 15:08, 30 October 2015 (UTC)[reply]

Help Uploading Pictures

Recently my pictures were taken down. I uploaded them through Wikimedia Commons. They were my own personal pictures that I allowed to be published on Wikimedia Commons. Why were they deleted? Did I not upload them properly? Can you tell me the proper way to upload the pictures?--Melissa.leanda (talk) 22:03, 2 November 2015 (UTC)[reply]

@Melissa.leanda: Hi,
"Own work" means pictures or videos taken by you with your camera. Also any content previously published elsewhere, either on the web or paper, needs a formal written permission. Please see COM:OTRS for the procedure. Regards, Yann (talk) 16:21, 3 November 2015 (UTC)[reply]

Your comment that accompanied the edit closing the discussion in Commons:Deletion requests/Files uploaded by DanielPenfield

You wrote "Clear copyright violations". So your claim is that every single icon in each screen capture was more than "simple geometric shapes or text"? -- DanielPenfield (talk) 06:36, 4 November 2015 (UTC)[reply]

@DanielPenfield: Hello, for your question, it depends on the simplicity of the icon. For the icons of your uploaded images (Yahoo!, Google, AOL, Bing) , they are not simple as simple geometric shapes or text, as it is a little bit complex. Also, the icons on your images can't be applied for De minimis, as the images also focuses on the icons. Thanks, Poké95 10:42, 4 November 2015 (UTC)[reply]
1) "they are not simple as simple geometric shapes or text". I like how you proclaim that as if you are the world's One True Authority on what constitutes "level of originality for copyright protection". Wikipedia, Wikicommons, etc. are full of people pretending to be something they aren't. 2) "Also, the icons on your images can't be applied for De minimis " I'm not sure why you addressing this to me as I've never claimed that. Perhaps you should notify User:Taivo as that editor is the only one so far who has made some claim regarding this, presumably because s/he did not read the discussion carefully. -- DanielPenfield (talk) 11:53, 7 November 2015 (UTC)[reply]
@DanielPenfield: 1) I am not like the "One True Authority" you are saying, I am following what is said in Commons:Threshold of originality. The threshold of originality is a concept in copyright law. I recommend you to read it to understand which icons or logos are allowed on Commons, and which are not. So that's why we have logos like this as they do not meet the threshold of originality. Also there is no authority or bureaucracy in Wikimedia. See WP:BURO.
2) Even though you never claimed that, it is still connected with the deletion discussion. De minimis is just a support in the deletion discussion.
3) Can you just move on? Deletion discussion is over, I don't see any reason to continue that issue.

Dr.Kamel Farhan Saleh — Preceding unsigned comment added by Kamel saleh (talk • contribs) 16:58, 08 November 2015 (UTC)[reply]

@Kamel saleh: Hi,
The copyright of book covers is usually owned by the book publisher (or sometimes by the designer). As for all previously published content, the copyright owner needs to send a formal written permission for a free license, then the files can be undeleted. Please see COM:OTRS for the procedure. @Wikiplayer99: Hi,
You are not allowed to copy files from the Internet, unless 1. you have a permission from the copyright owner, or 2. the file is in the public domain, and you have to show why it is not under a copyright. I fixed your first upload, which was fine, but others are not. File:Muerte de Anita Garibaldi.jpeg may be in the public domain due to age, but you need to provide the author, date, and source. Freda Dudley Ward images

Thank you for undeleting File:Freda Dudley Ward.jpg per Commons:Undeletion requests/Archive/2015-10#File:Freda Dudley Ward.jpg. Unfortunately the other two images in the same DR (File:Freda Dudley Ward01.jpg and File:Freda Dudley Ward - 1918.JPG) which were also undeleted are not also by Bassano, they are by photographers who died less than 70 years ago so are still unfree in the UK. Please could these be re-deleted – I will list them for undeletion in the appropriate years? January (talk) 08:30, 12 November 2015 (UTC)[reply]

Echinocereus reichenbachii

Hello, Yann. I tried File:Echinocereus reichenbachii by RO.jpg at featured pictures, but it failed. Can I try again, or is it one time and out? Rationalobserver (talk) 23:53, 12 November 2015 (UTC)[reply]

@Rationalobserver: Hi,
There is no rule which prevent a failed nomination to be done again. But experience shows that unless there is some improvement, renominating failed pictures usually get even less support votes than the first. In short, you better try something else. Figura 1118.jpg and copyright violations

Hello Yann

I'm having several problems to upload files and attach images on my work.

I created a picture (Figura 1118.jpg) and you send me a messenge to perform some changes.

That was did.

Now i've some doubts about copyright violations and upload files.

I Found (Figura 1111.jpg,Figura 1112.jpg,Figura 1113.jpg,Figura 1114.jpg,Figura 1115.jpg,Figura 1116.jpg,Figura 1117.jpg) In a public forum and i used that to explain my work, these pictures completed the main goal of the page.

So if that was a copyright violations, have i another way to share these pictures on wikipedia ?

Thanks — Preceding unsigned comment added by ClaudiaSasaki (talk • contribs) 17:38, 13 November 2015 (UTC)[reply]

@ClaudiaSasaki: Hi,
It seems that your files are scanned from a book. So the book author and/or publisher owns the copyright. If you are one of them, or have a permission, please send it via COM:OTRS. Regards, Yann (talk) 17:43, 13 November 2015 (UTC)[reply]
I see your point, if i didn't found the copyright permission, how should i procede to show the image or refer that in wikipedia? — Preceding unsigned comment added by ClaudiaSasaki (talk • contribs) 21:02, 14 November 2015 (UTC)[reply]
@ClaudiaSasaki: You may also upload it instead locally at the English Wikipedia. They accept non-free images and fair use, but you must include a fair use rationale there. But don't upload it here at Commons. Commons only accept free content, and doesn't allow fair use. Poké95 04:03, 15 November 2015 (UTC)[reply]

Hi Yann,

I can't seem to fathom what I'm doing wrong with images. I've checked with the publisher of the content who provided email permission allowing us to use the image. I can't find it posted online ANYWHERE other than our personal flickr page. Could you enlighten us to what we are doing wrong? — Preceding unsigned comment added by 375mon (talk • contribs)

Cordialement, — Racconish ☎ 10:11, 17 November 2015 (UTC)[reply]

Yann, this is becoming annoying because the OTRS helpdesk gave HappySquirrel instructions on how to load up our 2 very personal and very important images on to our article. 1 is from Loyola's yearbook which I took and Loyola has told us many times that all of their yearbook stuff is good for public use and the other one is from a newspaper clip Tasos was mentioned on in the Herndon Observer - the newspaper does not exist anymore but that newspaper clip has been distributed in all of Herndon, all of Reston, within high schools and Tasos himself has given us permission to use. Please allow us to complete this wikipedia story the way we want without being such a strict Wikipedia police officer. — Preceding unsigned comment added by Goodfellabear (talk • contribs) 00:27, 22 November 2015 (UTC)[reply]
Also Yann, I see you remove many images from all over - our images our personal images of Tasos Vatikiotis as he himself has give permission to use the Herndon Observer newspaper article as well as his picture in his college's yearbook - happysquirrel and the tea party (both wikipedians) got permission from the OTRS in June, near 5 months ago and everything has been fine until you came along and absolutely deleted both images - if you are so well round and such a good Wikipedian tell us the correct licensing code to put so we can go about our way with peace of mind - *STOP threatening us and embarassing us and HELP us - HappySquirrel helped us back in June and now you have ruined it for us. Thank you in advance. — Preceding unsigned comment added by Goodfellabear (talk • contribs) 00:39, 22 November 2015 (UTC)[reply]
@Goodfellabear: Hi,
As I wrote above, please send a permission and the files can be undeleted. Regards, Yann (talk) 10:15, 22 November 2015 (UTC)[reply]
    • Yann, please undelete the photos and put the correct permissions on there since you are an active Wikipedia editor - these are normal and down to earth photos of the mentioned person playing soccer in college and being highlighted in a local newspaper - we are not creating a gateway to Mars or anything - please get permission via the OTRS or classify them with correct licensing code - these are simple images, nothing complexed about them. There is nothing private about them - they are public images that have been printed by the thousands. Please lead by example and get this sort it out. Thanks.
    • Yann, please lead by example and help with this issue. As Ghandi said, "be the change you want to see in the world" and as your front page reads - A novice was once curious about the nature of the Edit Count. He approached the Zen master and asked, "Zen master, what is the nature of the Edit Count?" "The Edit Count is as a road," replied the Zen master. "You must travel the road to reach your destination, and some may travel longer roads than others. But do not judge the person at your door by the length of the road he has traveled to reach you." And the novice was Enlightened.

Cordialement--Amage9 (talk) 16:54, 26 November 2015 (UTC)[reply]

@Jbrasseul: Bonjour,

My apologies for my mistake in trying to fix an error on my part. When I created the image file "SW Asia Memorial, United States Military Academy.jpg", I incorrectly titled it as the "SW Asia Memorial", when it actually should be the "SOUTHEAST Asia Memorial". I was contacted by a member of the Class of 1962 who asked me to rename the file correctly. In my attempt, I just made it worse. My apologies and I request that you or another admin change the name of the image to accurately reflect the name of the memorial.--Ahodges7 (talk) 11:54, 28 November 2015 (UTC)[reply]

@NoahPuroresu123: Hi,

Just for your notification: Bwag doesn´t want to discuss with me. Chaddy (talk) 15:45, 28 November 2015 (UTC)[reply]

Your early closure

You deleted a whole bunch of car wash images recently. You seem to have deleted them early, without allowing a full discussion. User:Tm had just added a whole bunch more images on November 23rd, and you deleted the whole lot, just two days later.

I just voiced a keep opinion on the discussion of the category for these images, and was going to slightly modify it for the discussion of the individual images, only to find the discussion seems to have had an early closure.

I think the point someone else made, as to how policy does not place a limit on how many in scope images we have is a good point. We have thousands of images of monuments like the Statue of Liberty. I don't come here to be an art critic. I don't think it is our role to judge the artistic merit of our images.

A few years ago an image of an excursion vessel that plied the Danube was nominated for deletion. The nominator's justification was that we had a dozen other images of that excursion vessel, and they thought that this image was of inferior quality, because it showed some tourists, in the background. Well, of course, a dozen images is not actually that many. Further, as a vessel employed to carry tourists, I thought that the tourists in this image enhanced its value, rather than detract from its value. It was this discussion which made me critical of the argument repeated here -- that we already have enough images of this type.

In your closure you did not explain why you supported the reasoning of the "we already have enough images of this type."

So, I am going to ask you to re-open the discussion, to allow the usual discussion period. Geo Swan (talk) 19:01, 26 November 2015 (UTC)[reply]

Here is the argument I was going to adapt for the discussion i think you closed prematurely
  •  Keep - I am a proponent for documenting articles and events that seem beneath notice. This kind of car wash, where young, scantily clad women, wash cars, may seem common enough that we should regard it as beneath notice, but I think this is a mistake. It is a common meme in movies and television. I think that makes these events in scope, as images of these events help reach an understanding of today's society -- and the societies of the last several decades.

    For all we know, changes in automotive technology, or petroleum product use, or morality, could mean people stop holding this kind of event. One might argue that anyone who read about this kind of car wash can always look for a movie or TV show that dramatized one. First, images of an actual event are superior to images from a dramatization of this kind of event; second, the movies are all proprietary, and still images from them could not be freely used in an academic paper or newspaper article.

    Two decades ago the arterial streets of the city I live in were lined by individual parking meters. There was one per parking spot. They were coin operated, mechanical devices. It seemed gradual, at first, but over a period of just a couple of years, every one of those rows of old mechanical parking meters was replaced by a computer controlled meter. It could accept credit cards, and bank cards, as well as coins and bills; it was solar powered; it had a little antennae for communicating with HQ. What this meant was that anyone who wanted to study the old style parking meter had to cross their fingers and hope enough people had decided to document an article that seemed beneath notice.

    I think the same applies to these images. What does the genuine scholar, who wants to study this phenomenon, do, if we delete all these images on the grounds they are trivial, and beneath notice? Geo Swan (talk) 19:01, 26 November 2015 (UTC)[reply]

Hi, You are a bit late. See the discussion on the VP. 1. I didn't close the DR early. 2. These files are junk from Flickr, have little education value, and we don't need to have 190 of them. If you want them undelete, please ask on COM:UDR. Regards, Yann (talk) 20:27, 26 November 2015 (UTC)[reply]
  • Okay, now I have looked at the VP discussion. I don't see any explanation, from you, as to why you felt authorized to delete a large number of images that weren't given the normal seven days of discussion.
  • I don't see you offering an explanation as to why you think you can limit the number of in-scope images we have of an event.
  • There is a very uncollegial meme, "never explain, never apologize". I don't like pointing this out to you, but you do recognize that it looks like you choose to follow this model? Geo Swan (talk) 06:40, 27 November 2015 (UTC)[reply]
Hi, Look, I won't repeat myself 36 times. The DR was for the whole category, and this is very clearly stated at the beginning. These images are out of scope. I already said that on the VP. If you want to watch them, there are still available on Flickr, so nothing is definitely lost. Regards, Yann (talk) 09:35, 27 November 2015 (UTC)[reply]
  • If the DR was for the whole category, then every file under consideration should have had a notice placed on it, and should only have been deleted seven days after that notice was placed. Anything short of that means that people who had THAT image on their watchlist weren't given fair notice its deletion was under consideration.
I think it is irrelevant if the nominator encountered some kind of technical difficulty. The files under consideration, are the ones that were properly nominated, and their intentions aren't relevant, particularly since, if it was really important, they could have completed the nomination process, more slowly, through brute force. File:Derri Berkani, "Une résistance oubliée. La Mosquée de Paris de 40 à 44", documentaire, 1991.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

Block/deleted images

Hello, Thank you for your message. When I checked my mail and received 20+ deleted/blocked images, well you can imagine the shock!!! I work hard to contribute to Wiki and wish to continue to do my part. So, I may have more to learn, especially about image sources. I have learned more over the years regarding Wiki copyright rules and I frequently deal with sources worldwide, so there is much to keep up with these days. Thank you for listening. I misunderstood that just because I upload an image, I am not the 'author'. There is often conflicting information on Wiki regarding what is allowed and what is not allowed. The admin that blocked/deleted my images INCORRECTLY told me that collages are prohibited. Collages are permitted, but you must first upload the individual images and then upload the collage. Again, thank you.InfoDataMonger (talk) 20:47, 5 December 2015 (UTC)[reply]

Dear Yann, The said copyright violations occurred a long time ago, the pictures were (are) part of a book (or books), and thus I did not know they were violations. Accordingly, there is no possible way I could get permission for them. Everytime I have receieved these notifications about deleting files, I have repeatedly asked that the files are removed. You should know that for a long time I have not uploaded any photos, thus please do not ask me to stop, I stopped ages ago. In relation your threat to block me, please do not threaten me, if you have authority and must, please do. For avoidance of doubt, will post a copy of this message on your talk page.

Comment s'y prend-on ?

Saludos. --Diego HC (talk) 23:23, 28 November 2015 (UTC)[reply]

@Diego HC: Hi,
Sorry, I don't speak Spanish. The link you give is dead. Anyway, if the photo was published elsewhere previously a formal written permission is necessary. Please see COM:OTRS/es (in Spanish) for the procedure. Regards, Yann (talk) 00:09, 29 November 2015 (UTC)[reply]
Hi! Please forgive me. I was wrong. I hope you continue well. (It had been that it was easier to use the Bing translator to write in English, ha ha ha!) Best regards!!! --Diego HC (talk) 19:55, 12 December 2015 (UTC)[reply]

HR?

Could you decode the HR in "HR with EXIF" for me please? Bazj (talk) 15:02, 12 December 2015 (UTC)[reply]

@Bazj: Hi,
HR means high resolution. And as you can see, there is metadata, so I think it is better to have a regular deletion. Sorry for the jargon. ;o) Regards, Yann (talk) 17:41, 12 December 2015 (UTC)[reply]

Carmen Verlag1460

Hi, I got your last warning because of copyright issues. I am part of the Verlag1460 which owns the licences for the 2 pictures. So I can upload them in their name. I helped also creating them, so how do I proceed to upload them? — Preceding unsigned comment added by Carmen Verlag1460 (talk • contribs) 15:03, 12 December 2015 (UTC)[reply]

Request for right

As you can see, most of the recent copyvios deleted by you were tagged by me. Have been active for quite some time now with 4k edits. I request you grant me patroller and rollbacker rights so that I can do my work more efficiently. Have been a Filemover and Autopatrolled in Commons for so much time and rollbacker in other projects too. Cheers, ƬheStrikeΣagle 17:32, 12 December 2015 (UTC)[reply]

Copyright violations

Dear Yann, Can you tell me what violations are you talking about? thank you. --Doctor01~itwiki (talk) 17:55, 12 December 2015 (UTC)[reply]

@Doctor01~itwiki: Hi,
You uploaded 4 files copied from the Internet without a permission from the copyright owner. These are therefore copyright violations. Regards, Yann (talk) 18:37, 12 December 2015 (UTC)[reply]

footage of Hash production

Hello Yan,

My name is Ricardo and I am working on a short web video about different forms of extracting oils from cannabis. I was interested in using your footage of the Indian woman making hashish. Can I use this footage? What would your credit be? "Footage courtesy of Yann, Wikimedia Commons"?

Please respond at your earliest convenience — Preceding unsigned comment was added by 108.47.98.186 (talk) 08:49, 14 December 2015 (UTC)[reply]

sorry

I didn't read all the licenses to upload a photo, I've uploaded some photographs which 're taken by me. And previously some map of out locality. But I did a mistake by uploading the photographs of Oriya film poster from different websites with the source code, but those were deleted. But I've a photograph taken on July 30 about Rasagola has also been deleted. Now, I'm sorry what I did. I never upload those pics.. Gapu (User talk:Ssgapu) 18:23, 13 November 2015 (UTC)[reply]

MORE CARE WITH UPLOADS

Good Afternoon

I wonder if I may consult with an administrator or license reviewer to give approval or not this multimedia file. For example, in the discussion page links to stop a media file and consider the license should have and more information, if it is possible.

My purpose is to continue contributing to Commons as well as I do with Wikipedia, and keep my block because of it, since they never look hurt somehow Commons (not if I did understand), on the other hand hope to contribute much more in the future.

Danyel3096 (talk) 22:19, 16 December 2015 (UTC)[reply]

@Danyel3096: Hi,
For all content created by a third party, you need a formal written permission unless the source has a clear free license. For free pictures depicting a copyrighted work, you need to read COM:DW and COM:FOP (this is complicated and you should probably ask on COM:VPC). Regards, Yann (talk) 22:24, 16 December 2015 (UTC)[reply]
@Yann: Hello!
It is a example of i know you before (i can ask you again, if i think or found "value images" for Commons?), this files are right to upload it on Commons?:
  1. First Image <- I don't know.
  2. Second Image <- Probably OK.
  3. Third Image <- Probably OK.
The next files i are not convenced if are appropiated, because it are books (why we can't upload book's photos?):
  1. First Image <- Probably not OK.
  2. Second Image <- Probably not OK.
  3. Third Image <- Probably OK. We can't see any cover design.
All photos with the next licenses: {{flickrreview}} and {{cc-by-sa-2.0}}.

Danyel3096 (talk) 00:14, 17 December 2015 (UTC)[reply]

@Danyel3096: Hi,
I gave you my assessment. The book design is under a copyright, which remains in the photo. For details, see Commons:Copyright rules by subject matter. I am not sure about the logo, so you better ask on COM:VPC. Regards, Yann (talk) 11:18, 17 December 2015 (UTC)[reply]
@Yann: Hello

Please verify if this files are right to upload it on Commons:

  1. First Image
  2. Second Image
  3. Third Image

This are books that not reveals any cover design (if it are aproved, in the future i don't ask you again about books, because i now to know the valids.)

  1. Fourth Image
  2. Fiveth Image
  3. Sixth Image
  4. Seventh Image — Preceding unsigned comment added by Danyel3096 (talk • contribs) 01:12, 18 December 2015 (UTC)[reply]

@Danyel3096: Hi,
I understand that this account on Flickr is yours. Is that right? But the images are small and don't have EXIF data. You should upload the original unmodified images if they are yours. Regards, Yann (talk) 08:36, 18 December 2015 (UTC)[reply]

Hi Yann, I see you've deleted the logo of Mohun Bagan A.C. I uploaded. Actually I want to understand the need you had to do so because that photo was completely created by me so how could it be a possible copyright violation. So please leave me with a reply quickly because you also know that there needs to be a logo of the club in the infobox of the club. Realmmb (talk) 15:28, 18 December 2015 (UTC)[reply]

But how can it be Yann, I really did it myself...is there any app or something like that so that I can match the pics. Believe me I created it myself. Still if you don't trust me then can you teach me how to upload copyrighted images cause I ain't a good 'commons' editor ☺. Realmmb (talk) 07:11, 19 December 2015 (UTC)[reply]

HELP TO SOLICIT AN IMPORT

@Yann: Good evening I want know how write a solicitude for import a image (specificlly File:Hrsblogo.png), because i think that it can uploaded in Commons with the licenses: {{PD-textlogo}} and {{trademark}}. Other question, i think that this image See Here is in the public domain with the licenses: {{PD-textlogo}} and {{trademark}}, it is right? Danyel3096 (talk) 03:15, 19 December 2015 (UTC)[reply]

-- Asclepias (talk) 15:43, 20 December 2015 (UTC)[reply]

Warning Ni.somrat

Yann, I notice that you warned User:Ni.somrat about copyvios. While I share your concerns, the words you used "... You have done so despite requests from editors not to do so, and despite their instructions... Last warning..." (probably from a template) do not appear to be appropriate. As far as I can see Ni.somrat has not uploaded any further copyvios since he was warned. It is possible that Ni.somrat just did not understand the rules on copyright and a less severe (and accurate) warning would have been appropriate. Can I suggest that you remove the "Copyright violations" section on his talk page? Thanks. Greenshed (talk) 01:27, 22 December 2015 (UTC)[reply]
