Your block of russavia

Would you mind being specific as to what kind of intimidation or harassment did @russavia engage in as to warrant an indefinite block of his account in addition to the currently ongoing office ban, and where can consensus to block him indefinitely be found?

You should realize that given your personal involvement with russavia, you are probably the last person that ought to block him for anything. odder, I don't think there's a neutral admin on Commons. What are you trying to achieve here? All that will happen is the same old polarised comments get made, and russavia will remain blocked, one way or another. In my mind, the only rational conclusion that a neutral admin who investigated russavia could come up with was that he was a bully who engaged in intimidation and harassment and should not be permitted to edit here. My guess is that your mind might conclude differently. But you will only dig up the windbags who love to comment on this situation because they themselves are banned in other forums and would like to retain Commons as the Wild West where troublesome editors are appeased because of their large upload log. This achieves nothing productive. Once again you are fixating on process and procedures and missing the bigger picture. Just drop it and find something more productive and less divisive to do with your time. @Colin: The only person that is working against healing the community is Yann, by unilaterally blocking russavia. As far as I am aware, you can find no evidence that russavia has ever engaged in intimidation or harassment that would warrant an indefinite block (which, if unquestioned, is essentially equal to a community ban). My only aim here it to ensure that no user is blocked punitively for actions that haven't been successfully proven against them, and particularly not by an administrator with hugely controversial personal involvement with said user. This block was made out of the blue, without any evidence at all, and changes nothing, as you can be guaranteed that russavia will continue editing on Commons, as he has ever since his global ban. I have to conclude, Odder, that there wasn't much on TV tonight and you bought some popcorn so decided to create some drama on Commons instead. I ask again: what do you think you will achieve? As someone who unblocked a confessed stalker, I don't think you should be lecturing anyone about blocks. I see you have qualified the "intimidation or harassment" with a "that would warrant an indefinite block". So let's all agree that he was a bully who engaged in intimidation and harassment, for to do otherwise distorts reality too much. So what's your alternative? A one week block? A stiff word? A tut perhaps? You are completely missing the picture. The community is divided over russavia and has no mechanism to achieve consensus over this matter. I thought, for a moment recently, you might be interested in developing such a mechanism. But no. Any post to the AN will simply result in a poll (Commons loves polling) where no effort will be made and no progress made towards any agreement in the community. It will be a crapshoot determined by what mob gets recruited by IRC or who is on holiday just now. The sane, who actually value their limited time on God's earth, will ignore it because -- news break -- russavia is globally banned anyway. Are you trying to get yourself de-cratted (is that a word?) by making the most pointy actions wrt blocks on blocked users? It seems you came here to pick a fight and got an angry response to which you give another angry response. This isn't the behaviour I want from a 'crat. @Colin: I haven't had a telly for about 9 years now, so bad luck there :-) You were there when I unblocked @JurgenNL, you should—and I think you do—know that it had nothing to do with his actions (on which I have never commented), and everything to do with the process itself, which I have explained over and over again. And for my ability to comment on administrators blocking users: every member of this community has the right to do so, and as an active administrator (among others), I think I am in even more of a position to do that.
As far as my qualification of "intimidation or harassment" goes, I changed that because I am aware of a certain number of situations when russavia behaved questionably (to put it mildly) towards other users off-wiki, some of which both you and I know quite well. I'm not trying to get de-cratted, and I'm not planning on acting here in any capacity whatsoever; moreover, I don't think that there is anything inherently evil about asking questions. The idea that my asking questions is not the behaviour someone [would] want from a 'crat continues to puzzle me: so unilaterally blocking a user and then refusing to provide reasoning behind that block is something that you would accept from an administrator? Shouldn't trying to get information on the block actually be actively encouraged instead of criticized? I think you got this one wrong, @Colin.
I am actually trying to understand Yann and the reasons behind his blocking of russavia—perhaps he does deserve an indefinite block and a subsequent community ban—but he's making it considerably hard by responding in the way he demonstrated above ("you are just a dark stain in the whole of Commons") or, as was just the case on IRC, resorting to personal attacks against myself and another administrator present there. odder (talk) 20:30, 26 July 2015 (UTC)[reply]

For others who might not know the whole history of Odder's involvement with Russavia, it may be useful to note that Odder tried to prevent Russavia loosing his admin right, even as he was already banned by the WMF. Which brought him a decrat vote. Or was it for edit warring with WMF staff and stewards about the admin right of another banned user? Does it matter anyway? But it seems he didn't learn the warnings given there. Then again Odder started INeverCry's de-admin procedure after he blocked Russavia and retired from Commons. Please read Colin's post above who explains Odder's drama much better than me. Harassment by Russavia was amply explained here, and Odder knows that very well. So in short, there isn't one bit of good faith in the above request. Just another attempt to create more drama. Playing the virgin while stabbing in the back anyone who does not agree with him. It should, of course, be clarified, that there was no de-crat vote following my re-sysopping of russavia, and that @JurgenNL wasn't banned when I re-sysopped him, and he isn't banned at the moment, either. Commons talk:Administrators/Requests/INeverCry (de-adminship) doesn't contain any conclusive proof of russavia's harassment of intimidation towards @INeverCry, whose de-RfA was started due to his out-of-policy indefinite blocks on @Stemoc and @, and not as revenge for blocking russavia's sockpuppets. Speedy deletion

Hi Yann. With respect to your recent comment on my talk page, could you explain why the speedy deletion request was removed? From my gathering, 4 and 5 listed at criteria for speedy deletion fit pretty squarely for the reasoning. That's especially the case since I'm asking they be deleted as the original uploader. I missed that some images I uploaded in a batch actually had a non-commercial content license rather than the standard creative commons, so speedy deletion seems the way to go. For any file previously published or not personally made by you, you need to send a permission. See COM:OTRS for the procedure. You also need to provide a license for each image. DLI books deletion/undeletion requests

I noticed that the undeletion request was closed, while I was drafting my comment, hence I am adding these here for your feedback. From the deletion discussion, I sense that the question (copied below) posed by User:Storkk was not responded within a week by either the uploader or the first responder to the deletion discussion. This led to deletion by User:Natuur12 with the assumption that the flagging was genuine and the argument questioning the IP nature of the user as ad hominem, without investigating the validity by examining all the files that were flagged by the IP user. I would like to place the reasoning for DLI books to be public domain.

  1. Digital Library of India is run for the Government of India as is clear from the description below the title page.
  2. DLI Copyright policy (click the link on the website) states that the copyright policy is as per the Indian Copyright Act 1957. So a government website can't violate copyright act by making a copyrighted book available for worldwide access.
  3. DLI had a process to contact copyright holders and free up the copyights. Many old timers would know that there used to be a special search button to search for copyright freed titles from the DLI.
  4. DLI is a partner for the Million book project. Hence some of the DLI books were also uploaded to archive.org and other websites in the early period. However, those websites can't be relied on to dispute the copyright status of DLI books, as the sites may not be well synched over time.

Many government websites, including the DLI, make mistakes. We have to independently evaluate if the claim is plausible or not. Seeing the claim for File:Aandhrashaasanasabhyulu.pdf, which is wrong, it is clear that the DLI is not entirely reliable regarding copyright. File:SuprasiddulaJeevithaVisheshalu.djvu is very probably still under a copyright, as the author died only recently, and we have no evidence of the contrary. Regarding the ad hominem, qustioning someone's arguments just because they are an IP is against the spirit of Wikimedia projects in general. The uloader did a bad job doing his homework so it took like 10 minutes to close this DR while a DR normally takes like 1-5 minutes to close unless they are over complicated. It is not the IP who misunderstood copyright law but the uploader did. As the IP user has put up deletion flag even for a file for which a proper OTRS tag was available, and there has been ongoing discussion for years now on Telugu Wikisource about DLI copyrights, I have a suspicion about the intent of the IP user. Hence my response at Commons:Deletion_requests/File:Naa_Kalam_-_Naa_Galam.pdf had a comment/doubt about the seriousness of responding to such user. Thanks for your response regarding User:FelipeFingRios at the vandalism noticeboard. Regarding their remaining upload, File:Junior Seau 55.jpg, it's currently tagged with {{No source since}}, but the source is filled in as "Own work", which is dubious. Will the "no source" tag eventually force the user to submit ownership proof to OTRS, or should this file be formally nominated for deletion? 1945 German Woman

Bonjour Yann!

I recently purchased a picture for 2$ at a flea market. The picture spoke to me. I brought her home and I cherish her. I took her out of her frame and noticed she was an original. There is a stamp on the picture which reads: Carl Lehägher ELBERFELD AUE 93

On the back of her picture, there is something hand written, in german ofcourse. There is a paragraph and we only deciphered the city of Elberfeld along with the date 2.8.45.

Would I be able to post such a picture? I am the owner, although I do not know who is in the picture as well as the photographer. Hence why I would like to post the picture in the first place. I canno find anything about her.

Thank you for your help and guidance. You told me that for uploading a person's autograph in Wikipedia/Wikimedia the person needs to release the image under a free license. I read the commons OTRS page, there it is told that if I want to upload the image on a person's behalf I need to do an email for it and attach the permission from the owner to it but th the image has been published on the actor's Facebook account. So I am not able to understand how to upload the image. I can email the actor and tell him to add a license link under the image he would upload on Facebook and then attach that link in the OTRS permission letter will that help.

Also I have come across one file which is an actor's autograph added by a user stating it own work. I request you to review this file it is used on Karan Singh Grover's Wikipedia page as I believe it is not fair use. The file is en:File:Karan Singh Grover's Signature.jpg.

It does not give us permission to re-license images, but special permission to manufacture and sell hard copy wall art thru our subcontract manufacturers. We therefore mark every image with a copyright notice such as (c)Copyright 2016 George Chernilevsky. In return for the permission as consideration for permitting us this option, we sign a 10 year agreement whereby at the annual renewal, we provide you with 2 poster sized highest quality giclee prints of the images from your archive that you select. That is you select 2 per year for free. Plus, I send you a hard disk or drive of all of your work imprinted withe the copyright notice. This costs you nothing and does not impede you from the SA provision elsewhere as you still own the material. I love your photos if you would be kind enough to work with me, I can send a contract and you can PDF it back.

Public domain, City of San Diego produced picture

Hello Yann, Jeevan Jose suggested contacting you regarding the procedure for uploading a concept picture produced by the City of San Diego in 1991. I originally uploaded it in August 2014 under fair use for the Tijuana cross-border terminal Wikipedia article but found out that was wrong, and then I requested it be deleted. Later I was told that images produced in the U.S. by municipalities/government agencies are public domain but I could not find a template in the Commons Wizard to upload it and do not want to create a problem again by uploading an image incorrectly. It was one of the original TwinPorts concept images that still survives, it is NOT my creation, it was produced by the City of San Diego, I want to be very clear about that. @Theroos827: If the painting is old enough (the painter is dead for more than 70 years), just mention the source, the painter's name, and the date of the painting. About this DR - the user is still uploading images today however they now have EXIFs on. But the EXIF seem to be all the same camera which might be a good thing or might mean that they are photographing pictures with the camera. Images deletion proposal - elucidating rationales for keeping them

Dear Yann, you have flagged several images I had uploaded a while ago. I am traveling now and I can´t recall precisely the rationale I used months ago to upload those images. You have challenged ten files I think, so it will take me some digging to find out what rationale I submitted for the suitability of those images. As I mentioned, I am traveling and I can´t appropriately respond to the overwhelming number of challenges. However, let me try to address some basic points here, and see what you think.

Regarding one of the images I already mentioned above, (File:Victory in War by William C. Martel - 2011 Book cover.png), as I noted above, the original image used on the book cover is an image released by the USG, and is in the PD. I originally indicated the right tag: PD-USGov. The original image can be found here, also in wikimedia commons: File:USS Abraham Lincoln (CVN-72) Mission Accomplished.jpg. But in the past few days I wanted to put pictures into wikipedia articles from the arabic commons website, I wasn't able to do so. So I googled the problem and I read that I can re-upload the pictures into the english commons website. And I did, I provided the source and author and the permission. Harassment

If you have evidence that I am misusing any Wikimedia project or IRC for harassment, then please share it with me, by email if necessary. If you want me removed from this project, please do raise a case with evidence on AN/U. If you have no evidence, then please stop attempting to make others believe that I have ever been part of a campaign of harassment against other contributors, as you appear to be actively doing today here. These smears are false, simply having worked with Russavia to positively create more content for Commons does not make me part of anything he has done that might have got him WMF office blocked (and I still have no idea what the evidence was). I would be happy to be held account against evidence rather than having my confidence eroded or being hounded off this project through a smear campaign. Alleged Copyright Violations

I take strong exception to this claim. As you will note the vast majority of the works alleged as copyright violations are photographs of sculptures taken by myself and/or photos of artworks where no photography restrictions apply (galleries are always asked). Most bizarre of all is to label a photo of myself on my User Page as possible copyright infringement. Your claim in my mind consitutes a libelous statement, and if you pursue this legal action will ensue. I have failed to pursue previous issues raised such as Ebenezer James Macrae which was passed to me by his granddaughter specifically to add or James Braidwood which was a 3 foot high depiction in an exhibition with no restriction of photography. Other examples such as the body cast of Heather Mills is my photograph taken at a private exhibition at which I was present (with Heather Mills) and was expressly consented to take. The ONLY image which arguably raises any issue as far as I can see is Portobello Pier. I am well aware that you take these pictures yourself, but that doesn't allow you to publish them without a permission from the author or copyright holder of the works of art. There is a big difference between "pictures are allowed", and "pictures taken are allowed to be published under a free license". The UK is lucky in that many galleries allow photography. Copyrighted items are expressly marked with no photography stickers. In general I always ask galleries for their consent and when getting images from private collections (universities etc) expressly state my purpose and get their express consent. In general sculpture images are never copyright in UK except for certain new works in private galleries. Special exhibitions (often from outwith the UK or from private collections) ARE often copyright, but my images do not include such works. I am trying to gather as much visual information as possible particularly on sculpture, as there appears huge gaps in this area. Rather than write a book I felt in more public-spirited to add my growing collection of images to Wikimedia, so it is VERY disheartening indeed to get this wave of negative response. The ONLY image which I am unclear on the copyright is Portobello Pier which is from a book published by a friend, where he himself was uncertain on its copyright and was relying largely on its age (which is probably beyond copyright presuming that the sketch was contemporary). As I make great efforts on the permission side, and as all are my own photos, it is all a bit upsetting as I spend a great deal of time and effort sorting these things out. It should be remembered that UK is not as money-orientated in its permissions, and free photography is the norm rather than the exception. To date I have not been asked for any fee for permissions. When you say "if you have such permission, send it" how am I meant to send such?? You can check with the National Galleries with ease on their photography policy. Most of these are images from public galleries with unrestricted photography (save exceptions as already explained). Personal invitations to private galleries and exhibitions are usually organised by phone rather than letter. I have some email chains which link to the image of Heather Mills body-cast (which was at a private viewing) but little else is in writing. But, hopefully as an academic, you realise that a negative cannot be proved. It is simple to prove that something IS copyright but generally difficult to prove that something is not (other than understanding general gallery practices). Also, given the number of images involved over the past years this sets an impossible task, to retrace my steps and get some (I am unclear what) written confirmation from the galleries involved. The approach also implies that all Wikimedia images of art are suspect, unless uploaded by the gallery itself, and leaves a vacuum in the world of sculpture. I had decided to add my vast collection of images to Wikimedia rather than create a book as I felt this is more public-spirited, but the reaction (largely from one Wikimedia Editor yesterday) does lead me to the conclusion of "whats the point". I would hope that anyone could see that a large deal of effort goes into these images, and very much time. Copyright issues are always discussed in advance. ... including some of the already deleted images such as James Braidwood, as fighting copyright claims is not worth the mental effort if people are unable to understand the rules of UK galleries and museums.--Stephencdickson (talk) 23:11, 11 August 2015 (UTC)[reply]
@Stephencdickson: Hi, I removed the copyright warning from your page, but you are wrong about the copyright of statues: "sculpture images are never copyright in UK" is simply false. However there is an exception: see {{FOP-UK}} and Commons:Freedom_of_panorama#United Kingdom. So you are allowed to publish such pictures if the works of art are permanently displayed in a public places. I am going to restore to the pictures, and create regular DRs instead. But if the sculpture is only on a temporary display, or in a private place, then a formal written permission from the art copyright owner is needed. I can only presume that you are not in UK and are not familiar with the legislation. The Scottish National Portrait Gallery (through LAW) must allow public access to all of its artefacts if requested !! as it is a government funded gallery for the public funded by the public! EVEN items not on permanent display may ALWAYS be legitimately photographed by any member of the public IF REQUESTED. The only items not so covered AS I HAVE ALREADY EXPLAINED TO YOU are items ON LOAN from private collections. THE LATTER ARE ALWAYS CLEARLY LABELLED "NO PHOTOGRAPHY". Copyright Law requires to be read in conjunction with other pertinent laws (especially in areas of art which are not explicitly copyright as such). The UK has a spectrum of laws relating to access to art works, which even covers some in private collections, all of which can be seen "on demand". Nothing in the legislation relates to something which is in storage rather than on permanent display. All members of the public can have access to stored items which are "publically owned". In order to avoid Heritance Tax the vast majority of artworks in private houses also fall into this category (but owners do not like to publicise this). I have 30 years contact and experience of UK copyright law, but do not claim to know copyright laws in other countries. What I can explicitly state though is that if it is not copyright in the country of origin it cannot be copyright outwith that country. Something completely absent from this discussion is that except in a couple of images, there was absolutely no indication as to where the photograph was taken and the licenses given were all own work. We cannot "know" that a painting is on public display unless that is stated in the upload form. More careful uploads, with longer descriptions including artists dates of life, location of image, and so on will prevent these sorts of issues in the future.
