VoA

Hi,

I refer to you a question of a user who contacted me about five of his uploads that were deleted yesterday, apparently in connection with this deletion request. The reason the user contacted me is because I had previously replied to a question about this topic on the French-language help desk and on his talk page. In 2014, on the basis of the situation as it was at that time, I had told him that post-2013 material of Voice of America was not uploaded to Commons. In 2016, following the change in the situation, the clarification by VoA, the decision in Commons:Undeletion requests/Archive/2016-08#Original materials of VOA and consequently the removal of the post-2013 restriction in the VoA template, I notified the user on his talk page about this change and that the material can now be uploaded to Commons. Following the deletion yesterday, the user is understandably puzzled.

I looked at the deletion request and the rationale for the nomination seems strange:

  • The nomination rationale for deletion is essentially that the nominator couldn't access to the old terms of use page of VoA. Another user in the discussion judiciously pointed out that this was not a reason for deletion. Even if the old ToU page had simply been removed, the situation had already been documented and reviewed by many Commons administrators. Besides, the present ToU pages state that the VoA material is in the public domain [1]. The nomination's argument that the old page was removed and replaced is not a reason for deletion, it is the opposite.
  • Of the five deletions, four are re-deletions of files that had been undeleted last month (see list). The other file was a new upload after the clarification.
  • The nomination did not explain if and why the nominator thinks that the situation of those five files is different from the hundred of files that were undeleted or recently uploaded.
  • Although the uploader did not mention it in his question, I note that he was not notified of the deletion request. If he had been notified, he could have asked for explanations directly in the deletion discussion.

Could you please reply directly to the uploader on his talk page in the section User talk:Tan Khaerr#Mise à jour au sujet de VOA to tell him more details about why the files were deleted? Thanks in advance. -- Asclepias (talk) 16:12, 29 September 2016 (UTC)

@Asclepias: My French is way too rusty to join in there. Deletions are done by a consensus of editors. I examined the statements there, and the overall view was that Pre-June 2013 were OK, and post was not. I checked the supplied link to VOA ToC (http://www.insidevoa.com/a/1686739.html?nocache=1), and as stated there were none shown. Also Jim stated that "The last time I was able to look at the VOA Terms of Use, they did not allow free use". With no opposition to keep, the files were deleted. Blakey maps

Hello! In 2015 you started a DR concerning several maps by Blakey. Do you remember why the rest of the files in Category:Maps by Ron Blakey weren't part of that DR? Most of them are DWs of deleted files. I ask because someone gave me a link to new files by Blakey and it would be better to know why some files were kept and some not before starting a new DR. Because it only relates to a list of images on one OTRS ticket (I didn't do the original permission), where our standard permission template was not used. Later they wrote in complaining about the re-use, when it was properly fully explained that our license allows commercial, he refused to agree to the license, so I had to go for deletion. Hi Ron - thanks for the email query; Juniperus grandis is a synonym of Juniperus occidentalis subsp. australis. There is a useful summary of the argumemnts over which name is more appropriate here, supporting use of Juniperus occidentalis subsp. australis, with which I fully agree. Sorry to belabour this, but I'm still concerned about this deletion. You say ticket:2016120610022903 confirms that this is not an official SuicideGirls stream, however [2] shows a lot of OTRS-ed SuicideGirls images from the same flickr stream under ticket:2008110310027958. @Mattbuck: I can only state her case. She properly confirmed identity, said the images were only on Suicide Girls web site (which is a pay to view). The Flickr account is bogus, and no images were ever given away. Her image was removed after she complained to Flickr. That was the only image she was interested in, so I assume Flickr left the rest up, until someone else complains. We can only take what she says at face value. The Uploader uploaded with cc-by-sa-4.0, then 4 minutes later removed that and set the license to "Fair Use", he did not specify a textlogo. Template:Fair use defaults to speedy delete, as fair use is not allowed. Ronhjones  (Talk) 01:57, 19 December 2016 (UTC)

Now I was always under the impression that PD started 1st Jan following the full 70 years post death - not sure where I got that from (maybe because I'm in the UK, I knew that already? - I always add 71 to come up with the PD date..., but I could be wrong.) - so that would agree with the comment. Deletion was requested and there is no reason to decline, even if it is for two months, undeletion is just a couple of mouse clicks for me. Why did you delete

this image without any discussion and who has marked it as a possible copyrightviolation? Where is the deletion request??? This image was deleted inbetween one hour. I cannot see it now, but this is a scan of an image which is older than 100 years, the creator itself is unknown. This image is part of an Wikiversity project and the uploader is one of my students. Especially new contributers have the right to be informed, why something of their contributions is going to be deleted. Please show me the discussion and please, be nice to newbies! I don´t think that it is necessary to demonstrate the different shades of importance in this project. One hour deletion time is an affront, nothing else. There are two things wrong with the page
  1. There is no license - that is not allowed. Every image must have a suitable license, it's a fundamental rule here.
  2. If you go to the source it says "This item is available to be shared and re-used under the terms of the IWM Non Commercial Licence" - we do not allow non-commercial usage, and since it has the IWM logos all over it, it would silly to ignore that - I don't know how much image processing has been done by the IWM, the colour scales at the top would suggest they have been adjusting it, and UK TOO is very low (I live here!), so their claim to copyright can be valid. Hi Ronhjones, I just checked the files of user:مصعب. All these photos where taken during an Education Program Event that I participated in. We even gave each of the students a Wikipedia Coffee Mug each. Nothing wrong with phots or the license  :) . Regarding queen Rania Photos I tried calling the university to check the validity of the license, it seems I need to wait till after the weekend (Friday and Saturday in Jordan). For the time being, I closed the current deletion request.

Mosab (مصعب) is a very active admin on Arabic Wikipedia, we even had an article about him on the wikimedia blog. So I guess we need to slow down about the indefinite block. @Tarawneh: It not the first block for copyright issues otherwise I would have set a time. Not to mention the three images of Queen Rania, were all marked as "Own Work", which they clearly wasn't. I don't see that as a simple error. Also you may want to note that I found at least 2 more images in the December upload on other web sites earlier than upload, hence the mass request (which includes them). Web image is dated 05 November 2013 21:35:16 and has a copyright watermark. Anyone can change EXIF data. With an earlier web image, you will have to use COM:CONSENT to get the image permission agreed. Ronhjones  (Talk) 23:05, 22 February 2017 (UTC)

Hi Ronjones. You previously posted a note at User talk:Hishamhmk#Copyright violations advising Hishamhmk to be careful about the files they upload. I'm not sure whether the uploader didn't understand your message or simply decided to ignore it, but they just uploaded File:Amman International Stadium.jpg which seems to be another copyvio. They have also uploaded File:Yarmouk Uni Logo.png and File:Jordanian football league.png as "own work", but the files actually seem to be COM:FU. I've tagged the Getty photo as a copyvio. Uploading a picture

hello, it seems that whenever i upload a picture it's somehow violating the copyright laws/rules. This is become quite inconvenient as there are no clear instructions as to how to upload a picture properly. I always pick a picture that has is on google and is clearly for public use yet it gets removed. Please help and explain what to do since I'm on my final warning. Thanks. @AbdulRahman1997: Images on google are "free to view", but not "free to use". You have to find an image that says "Creative Commons Attribution-ShareAlike 4.0 International License." and/or shows the cc-by-sa logo as seen on https://creativecommons.org/choose/results-one?license_code=by-sa&jurisdiction=&version=4.0&lang=en. If you use Google Images then click "Tools" under the search box, then under "Usage Rights" select "Labelled for reuse with modification", you will find most of the images normally seen will vanish - probably >99% of images normally seen will not list under these conditions. But, then, how am i supposed to even get a picture when nothing that i want exists on google after doing that "Labelled for reuse with modification" ? @AbdulRahman1997: Yup. If there is a usable picture on Google Images, chances are someone else would have found it first! Same with Flickr - suspect all the suitable images there are already here, and panoramio - we have a bot looking for free images automatically. They left a message at File talk:RTP Internacional.png, but it's not in English so I don't know what it says. The same editor has made a number of other posts on talk pages of files they have uploaded (re-uploaded?), but these are also not in English so I'm not sure what they say. @Marchjuly: Just deleted it as re-uploaded without deletion review - talk page said "This image is that of a logo created and used by the company Rádio e Televisão de Portugal, S.A., the public television of Portugal. This logo is available in the section of the RTP site, in rtp.pt, referring to the part of the graphic identities of the radios and the channels. In conclusion, this image is not a creation of its own, as already mentioned, in the description of it, and is given freely to anyone who wants to use it to illustrate the identity of the channel in question." - Thanks to Google Translate. http://www.rtp.pt/ says at the bottom of the page "C RTP, Rádio e Televisão de Portugal 2017" - no sign of any PD or CC license. @Amitie 10g: That's very odd... I was going through the list at Category:Copyright violations, which is where I picked them up - how they were in that category, I've no idea. Hi, you deleted these two photos as being copyright violations, but they are in fact not. Homa was designed in 1961, and as per {{PD-Iran}} the logo fell out of copyright 30 years after being published (Iran Air is the legal entity which holds copyright). Could you please undelete. I have been notified that on Wikipedia:Al-Shorta SC, you have replaced Wikipedia:File:Al-Shorta Sports Club (Iraq) Crest.png (a non-free logo) with File:Al Shorta Sports Club Logo.png (a logo in the public domain) and have nominated the non-free logo for deletion. The truth is, since uploading the logo to Commons as a public domain logo, I have come to realise that this logo should not actually be in the public domain. I thought that 50 years had passed since its publication (which would make it a free logo) but in fact only a few years have passed so it should be a non-free logo. That's why I uploaded it onto Wikipedia as a non-free logo, but I didn't know how to delete the Commons logo. @Mylkomeda: The file on en-wiki is a copyright image used under the US Fair-Use policy as it was first published by Johns Hopkins University. The commons image was deleted, as commons only hosts free images. Non-free images (when they are allowed - all wikis are different) have to uploaded to the local wiki. For it-wiki you will need to read it:Wikipedia:File_non_liberi and see if you can upload the file to it-wiki. Ronhjones  (Talk) 21:50, 6 April 2017 (UTC)

@Leo240: There isn't one. Commons does not allow non-free images like Wikipedia. If it did, we would move the file from Wikipedia, not make a copy. Tropical Depression 1- Previously Deleted Image due to copyright

My sincere apologies for the original upload of the .gif image regarding Tropical Depression 1 (1988). I was trying to find the way to edit the information of the upload so I could include links to the satellite dataset but by the time I was able to get to it, the file was deleted. Carmine Esposito Images

Hi Ronh, could you tell me why you deleted all the images of the article Carmine Esposito? I personally talked with Carmine Esposito who is the owner of this images and awards and he gave me his approval to use it. Could you help me tell me how can I share these images in this Biography when the images are property of the person who is the biography about.

In the case of the awards, how can I put these on the biography if he won these but he by himself shared it on his social profiles. Which is the Creative Commons Licence that I have to use these images. I used a Licence where I said that these images are property of Carmine Esposito but isn't was enought and I don´t unerstand.

Because you uploaded them before and they were copyright violations then. So they still are. If an image is already on the internet then it's far harder to get it uploaded here, as it will be immediately be deleted as a copyright violation. There is no way here of proving identities. You will have to sort out the permission with the OTRS team - see COM:CONSENT, when the team approve the permission then they will undelete the images. Ronhjones  (Talk) 01:10, 21 April 2017 (UTC)

They were uploaded and then deleted as per Commons:Deletion requests/Files uploaded by Domrey sar, the uploader then uploaded them again which is not allowed, so they were deleted again, and appropriate notices added to User_talk:Domrey_sar. This template only had minor changes in the description as well as a secondary source pointing to the updated copyright amendments in the law. Photo deletion: Oliver Harrison.jpg. The licence agreement for photo sent on 11 Feb 2017 (revisited)

Hi Ronh, I was just wondering, it’s been over two months and I haven’t heard anything about the photo - mentioned above - being restored. A fully signed Wikipedia licence was signed and sent to ‘permision-commons@wikimedia.org ‘ on the 11th Feb by the photographer Richard Townshend. @Underground Art: Well that's very odd. It travelled all around OTRS... It went straight into Queue "Probably-Spam", they get checked and it got manually moved to Queue "permissions::permissions-en", I've now moved it into Queue "permissions::permissions-commons" (where it should have dropped into). Because of that wacky treatment, it did not issue the auto-answer message. I've no idea why the system called it spam, It looks like the permission image was pasted into the e-mail body, rather than made it as a proper attachment - that would be my guess of what has happened, the large HTML section has triggered a spam filter, whereas a small HTML message with a separate attachment would not. Copyright violations

May I know what copyright violation did I do. The Lulu mall dawn.jpg which was deleted now & the Lulu landscape.jpg which was deleted before that(Both are the same image uploaded twice when one was deleted) is the photo which I took with my N8 mobile phone. I had uploaded the same image long back from a different account, for which I forgot the credentials, due to which I had to create a new account. I don't know how it becomes a copyright violation when I upload a photo which I took. And regarding the Kochi collage.jpg, I wanted you to delete that image. I created that collage, not the pictures in it, but it was not being updated in the wiki page, coz a different pic of the same name was already in the Wikipedia site. So I tried to reupload the collage using a different name, but it said the same image already existed. So I had to update my uploaded Kochi collage.jpg with some random image from Google & then had to upload my original image under a new name. So I'm fine with deleting Kochi collage.jpg, coz that's not my creation. But the Lulu landscape.jpg/Lulu mall dawn.jpg was the photo which I took & I think as a user Wikipedia gives you the right to upload it. The irony is that the image for Lulu mall which is being floating around is some random image with watermarks & texts written over it. You've kept that image, but you want to delete an original image. Strange. I want to upload the image again & please let me know what I must do which doesn't make it a copyright violation. Buddy, FWDLife is a lifestyle magazine based in Kochi. They take a lot of images from social media while writing articles on web. I had posted this image as comment on Facebook on Kochi related pages a lot earlier than that, I guess mid 2015. They might have taken it from there. In fact this was actually a slightly bigger image there were 2 workers walking along the road at the bottom, so I cropped it out. I don't remember whether I put the original image or the cropped one on FB, that time. And I don't know what watermark you are talking about. I didn't put any kind of watermark on my image. Hi Ronhjones, I am a bored bot (this is kind of a computer program) that is watching the recent changes and tapping buttons like I did now.

Curious about the reason? Possibly not but I will tell you anyway:

  1. You edited User:Ronhjones/common.js. Glad to see you coding in javascript! Have you ever considered becoming a MediaWiki hacker?
  2. Though, that change appears to introduce 3 new jshint issues — the page's status is now having ERRORS. Note that invalid or ambiguous code often has unwanted side effects like breaking other tools for you. If you cannot find out how to fix it, I suggest blanking the page for now.
  3. To help you understanding where the issues are, I have aggregated a report here and now. If you have questions, don't hesitate to ask users experienced in javascript writing for help. But do not ask the bot's operators (chronically overwrought) unless you suspect an error of mine. @FrancescoSoliani: You cannot prove who you are in commons - people can create any username they like. So we rely on users uploading their images to commons first. If we find a new uploaded image already on the internet then we have to assume it was copied from that page(s). In this case the photo is already on the internet, so (to us) it becomes a copyright violation. If the photo is yours, then you will have to go to COM:CONSENT to verify your identity and copyright ownership of the image - they will undelete the image when they have verified your data, which will take about 60 days (large backlog). Sorry for any inconvenience - but we get a huge number of illegally uploaded images every day - we must be sure that the uploader can donate the copyright. Ronhjones  (Talk) 14:31, 4 June 2017 (UTC)

I have now re-uploaded the sound clips at the correct length but the copyright holder has realized that they do not actually hold copyright on about 150 of them, so i have made another mass deletion request here. Hi Ron- I apologize for uploading incorrectly, as this is my first attempt at creating a new article with an image. I reached out to the org and got permission to use the logo, so I'm looking into how to re-upload with evidence of said permission. I have the email saying "yes, go ahead, here's the image," but after reading the copyright page, I think I may need to reach out with the formal template. Do you have any advice on this? @JPH001: Yes, you are correct. There is quite a choice for this one.
  1. Get the copyright holder to send in the form at COM:CONSENT, to release it under a suitable license (e.g. CC-BY-SA-4.0) - backog on permissions is about 56 days, they will undeleted when permission has been validated.
  2. We could try undeltion and changing the license to {{PD-textlogo}} - it is a bit subjective, as it's then down to the editors whether it's has enough originality or not (COM:TOO), and that varies with country. There is a large graduation of colour in the "blue flash", is that eough for copyright - possibly not in USA (possiby yes where I live, but it is a US logo)
  3. Lastly, if this is only for en-wiki use, then go for the easy option and upload at en-wiki as a fair-use item - it's a logo, and it's size is OK with fair-use. Look at en:Template:Non-free logo and check the "What links here" to see pleanty of examples there. The only criteria that can be an issue, is that the image has to be in use in an article - draft/sandbox articles are not included - for those you have to wait until it is a full article before uploading.

All editors are anonymous and we cannot link any user with a real person. @Rex s dimaala: Every image is copyrighted at creation. If there is no copyright now, then you will have to use the correct licese to show it is not copyrighted - saying you own the copyright is clearly wrong.

I recently uploaded a picture File:Kevin Xu 2.JPG to be used within Wikipedia Commons but it was deleted. @Hvizdalova: You should always get an auto answer to any e-mail to the permissions address - we do that is case people misspell the address (usually wikipedia.org or wikimedia.com instead of wikimedia.org are common). After that it takes 55 days or so - backlog! I've changed the image to reflect the flickr as source, and the license to agree with flickr. Also set flickrreview to run and check all is well (there are lots of blacklisted flickr addresses - probably not yours, but the flickrreview bot will confirm). @Michalovski: You had it as "Own work" - which for an old photo it is not. You do not own the copyright, so cannot claim it. The photographer owns the copyright, unless there is a written formal transfer of copyright - so the person who needs to upload it is your father's friend - if not alive then his descendants. Copyright lasts until 70 years after the copyright holder's death. Or the copyright holder can go to COM:CONSENT to donate the copyright. Nothing else will work. About my "last warning" on the pictures

Hello, I would like to say that first, thanks for leaving me a message, I do support speaking before action. Secondly, The only pictures I have uplodaded have a 4.0 copyright license, which state that you can do virtually anything you'd like with the pictures, except from modifying, stealing credits etc. ( You should know a hell of a lot more than me on that topic, part of the reason why they got deleted ) So, I'm uploading those images again but in a few days and with the correct licensing and proof website, I got hand-to-hand permission by the author/person in the pictures (which was really hard to find) in order to use them.

Please if you have anything to tell me, feel free to leave it on my discussion site/here.

@Fernandosmither: You are not allowed to upload again - you must go to Commons:Undeletion requests and request undeletion - re-uploads are quickly deleted, OR if the image is not yours, then you have to go to COM:CONSENT to donate the copyright and when the OTRS team is satisfied then they will undelete the image. Geekstreet is asking to be unblocked on his talk page. I think there's a good possibility he's innocent as he says. Hi! I cannot see the previous version and why it should be a copyvio. When you look at the blog post, you will see that the creator of this map was asked to upload it to Commons. Regardless of being a re-upload (whose original file could have linked in your deletion summary for those who don't have an admin account, btw.), what do you think about my explanation of the licensing? From what I can see, the original deletion was incorrect in total, thus there should be no need for an undelete request for obvious mistakes. Or do I see this wrong? @DerHexer: Since two admins had decided that the first upload was bad, I didn't go into too much depth. I did note that the blog fails to mention "Based on work by Prof. Konstantin Tishchenko 1980 to 2000" (as stated on the image page), so my view is that more permission is needed and hence the first deletion was probably correct. I was also suspicious that two different accounts had been used to upload the two versions, which did possibly seem like abuse of accounts - but with only one file, it's not a definite proof. So, I am on holiday right now and not logged in but I will rewrite this if necessary. When the file was first uploaded it was uploaded by an account that uploaded a bunch of images and claimed copyright for all of them. When I found the image on commons I corrected the authorship and added a bit of info but was the opinion it was then fine since I had already put a CCBY-SA 3.0 on all my original content of the blog. When the first upload was deleted it was deleted together with all the other images that the account had uploaded. I thought the deletion was unnecessary but I did not want to pu any effort into sorting things out. Now I have uploaded the image and I figure it should stay uploaded. To Prof Tishchenko, I have tried contacting the researcher who is I his 80s? (90s ? On holiday, I am not going to look that up) without any success, but I am the opinion and will argue that no permission is required to publish a graphic that is based on his research. What if a researcher puts the effort into testing the DNA of ~80 monkeys/primates and publishes a list of how far or close their DNA are to each other, and what if I take that list and research population estimates for all those species and draw a similar graphic to the lexical distance graphic. Would I need the permission of the original researcher that determined the DNA- distance to be allowed to publish my graphic? No.

PD-1978/US

Hi,

I have a question pertaining to this template, which states that works published in the United States between 1978 and March 1, 1989 without a copyright notice and were never registered with the copyright office are in the public domain.

This template pertains to all photographs that were first published in the US without copyright notices between 1978 and 1989, including those by foreign photographers (assuming the same photographs weren't ever published in their home country), right?

That does seem to be the gist of this but I wanted somebody more experienced with copyright issues on Commons to confirm.

I guess what I'm trying to ask is which takes precedence, the country in which the work was first published, or the country in which it originated?

@Katangais: My view is where it was first published. So you have to ensure that it was the US first. Also be careful with the date - 1st March 1989 is the cut off, after that we are in standard Berne Convention copyright terms. Note if created before 1978 and published later - it gets even more tricky - en:Public_domain#Unpublished_works. If in doubt, you can always post questions at Commons:Village_pump/Copyright. @Ravi Mundkur: I did not tag or delete the first version File:Tulu patero cover1 a.png, that was tagged by EugeneZelenko and deleted by Yann. Once deleted, you are not allowed to just upload it again, hence the second deletion. By donate - we mean the copyright. All content here is re-useable by anyone, so we have to have the correct copyright license for the image. By default that's always "All Rights Reserved" as soon as the "work" is created. We have to get the copyright holder to change that to at least "CC-BY-SA-4.0" - only the copyright holder can do this. Phaistos glyphs

Hi -- regarding the Phaistos images, yes, they are mirrored, this is done on purpose because the original "text" runs right-to-left, and the images are intended for "citing" the text in a left-to-right environment. It is perfectly possible that the un-mirrored images may also be desired in certain contexts, but then the existing images shouldn't be overwritten, they should be uploaded as variants, under separate filenames. --Dbachmann (talk) 07:37, 27 September 2017 (UTC)

@Obstsorte: We do not re-upload, especially under a different name - it looks like a devious way of getting the image up - all uploads are checked against all deleted images. The correct procedure is to go to Commons:Undeletion requests and ask for the original upload (File:Putsch Hutuktu 28.12.1911. Die Presse. Ostmärkische Tageszeitung vom 31. Dezember 1911.jpg) to be undeleted - then those admins on undeletion requests can see the original reason for deletion and see if those issues have been properly addressed. They may well want to know the writer's name, so that the standard copyright term of 70 years post writer's death can be applied. If unknown they may well decide for 130 years (although that figure is still a proposal, I think) to ensure that the copyright has properly expired. Ronhjones  (Talk) 17:04, 30 September 2017 (UTC)

@Moonian: Always difficult. I would suggest propose then all for deletion as COM:PRP, based on the large number of copyvios found so far. Just because you can't find the big image out there, does not mean it does not exist. A proposed deletion will allow others to make up their minds during the 7 days. @Boy Addi: Since he is apparently uploading his photos all over the web well before uploading at Flickr, then he (as the copyright holder) will have to donate his files via Commons:Email templates/Consent. Thanks. I am seeing the notice now. Perhaps the author had temporarily (accidentally?) removed it. The cache isn't a factor because I am on another computer at the moment. And on the other computer, it was the first time I visited Filetopia.
