Why? It is my own picture, slefmade, it's a work in a public space in the Netherlands, the posters are public domain because they are for elections. The sign is permanently located in a public place, the place that is mentioned with the picture. This isn't different from pictures like File:Belgische lokale verkiezingen 2018 reclame Kortrijk.jpg. It's the same category and kind of picture. So what is the problem?

copyvios[edit]

Hello Patrick. Just saw that several (if not all...) images uploaded by User talk:Amadouibrahim2 were copyvios. Ibrahim is involved in an educational program I run, but unfortunately... was not able to follow the face to face training we organized in fall (during which the copyright issues were raised). He was handed out documents with guidelines and rules, but I guess nothing replace a good old face to face down-to-earth explanation, in particular on the touchy issue of licences... a topic most people are unaware of :( I contacted him in private to explain him more about authorship and rights and asked him to review all images he provided and look for other options. Hello Patrick, you have marked every single photo that I have uploaded as copyrights infringement and have deleted them. Note that I am the Manager, Co-Agent, Coach and Father of Xander Schauffele. Furthermore, please note that I am the creator of http://www.xanderschauffele.com, which you have listed as proof for infringement. Furthermore, please note that I am the grandson of Richard Schauffele. Also, be informed that Kevin Techakanokboon is a close friend of Xander Schauffele. As these facts cannot have been known to you, I must bring them to your attention. I find it somewhat appalling that the "certification of ownership and right of usage" I gave when uploading those images is being so grossly discarded. Why have that form when it is irrelevant? Laws are in place for infringement upon intellectual property rights. In this case I suggest that you as one who seemingly takes his function policing Wikimedia very seriously, have arguably been a bit overzealous when instead of immediately tagging and deleting, you could have simply written to me first. Not everybody is a crook or a hack Patrick. I certainly appreciate your volunteer work in this respect, but at times proper measure is necessary. Read on please to see my reasoning and should you be convinced, kindly remove the tags you have created for Stefantast as well as the tags for all images in question.

He is the owner and copyright holder of the image (photograph), the image is indeed used on other sites (facebook, etc.) as well. Confusing to me the old image just says "Source Own work" - how do I prove "own work" or "in the name of the owner"? Would it be also enough to post it on the website of the owner (resp. person in the picture) with a "CC BY-SA 3.0" license, in the future? Different sites here suggest different solutions/reasons. Since I am Uploading under the Client's approval she needs those image up there and running!! If you can guide me @Patrick Rogel tell me how? If No then tell me why delete, atleast ask why its been deleted, the automated message's wont help me understand at all! or help me out, I am trying my best using on this platform not to be rude and deleting all of the images I uploaded on behalf of my client, can you show me an example of how to upload so to avoid having images getting deleted. Thanks for giving me the opportunity to reply before deleting the images. Since these are promotional images that the publishing company and the film production company puts out there for promotional and marketing use, wouldmt they fall under a public use license. By sending these images out as part of their marketing campaign to the press they have essentially given up claim to the images and made them available for public use. Reply Patrick.. thanks for your reply. There are a couple of inaccurate comments within your reply. On virtually any paid photographic image for marketing the rights are transferred to the subject or the company responsible for the publication of the product... The publishing company, production company, record company or the subject of the photo themselves. This is standard in virtually any contract to hire a photographer. Only in somewhat rare cases are licenses issued where the photographer keeps the rights and then even in those cases the license usually extends to marketing and press for the licensed use. I believe these images fall under the fair use category. Also:

"Specifically, Section 107 of the Copyright Act states that:

The fair use of a copyrighted work for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, historical data, or research, is not an infringement of copyright."

Obviously WikiCommons has their own guidelines which I will have to follow but these images certainly fall under the fair use since they are being used on wikipedia which could fall under news reporting, comment, historical data and research all at the same time. In fact this picture was actually taken by myself ”live” and post produced immediately on the smartphone used with the application Snapseed to enhance its look (texture, contrast and color). The goal was to get a picture that would look realistic and slightly ”back to the future” at the same time. I guess you would’nt have thought it was a ”repro” if it had been cropped a little all around. Furthermore, this artistic adjustment has been suggested and agreed by Bruno Ducourant himself (who is also a photographer). you've deleted a picture I uploaded and I can see why. It has been on the internet, and there even is a poorly rendered version on Wikipedia that looks like a pale ghost version on some devices; lots of digital arifacts, too. The image in the interview you linked to are only a cropped bit of the original. I used the original filed and rendered a higher quality browser-friendly version. The file was provided by the copyright holder as depicted in the image.

If there are administrative steps I need to take, I'm up for that. I would just like to replace the existing wikipedia picture with a better version.

As long as there is no strong evidence that parts of collages are copyvios it makes no sense to mark the entire collage as copyvio. Or in other words: If someboy uploads a collage as "own work" we have not more reasons to doubt his authorship than with a single picture. Regarding the picture of Adam Gase[edit]

Hi there,

Upon further inspection of the image "File:Bills-dolphins-football-jpe-4.jpg" of which I made a cropping called "File:Adam-Gase(cropped).jpg" I did find that this image was indeed taken by a photographer from the Associated Press. Good catch.

I had no idea it had any copyright violations, as I found it on Wikimedia Commons and it had been there for three years and assumed it was fair-use. My bad.

Regarding the pictures of Leslie Weir[edit]

I was given these pictures by the subject [Leslie Weir] at my request for her Wikipedia page, currently in Draft mode.

She is the Librarian and Archivist of Canada designate and this is the official head-shot from the University of Ottawa. In her message to me she says "Here is a recent headshot that was taken by TLSS for official use, so is copyright cleared." Ditto with the other picture. If you need this, I can prove this to you - please let me know what I need to do.

I might add that I was especially sensitive to the copyright issue because the article is about the Head Librarian for the Government of Canada!

Regarding the pictures of Ajahn Sundara[edit]

I was given this picture by the subject [Ajahn Sundara] at my request for her Wikipedia page. I received the email containing that picture of her on September 18th 2018. What would you like me to do to demonstrate that this photograph is out of copyright?

Proposed deletion of picture of Rebecca Roanhorse[edit]

How do I upload the permission sent me by Rebecca and how do I get this approved? How much time do I have to do so. (She has already emailed to thank me for the use of her image on the german wiki, the italian wiki and the english wiki). However, I suspect there may be another problem: Rebecca has used the same image on her official website, which means (perhaps) that copyright resides with the owner of that website and/or the photographer. So before I ask her to do anything could you 1)clarify whether I need an image where the copyright clearly resides with the photographer (perhaps her husband or herself-if a selfie), 2) whether she should forward me the image in one email while forwarding both the image and the permission to permissions-commons

@MargaretRDonald: the photographer holds the rights. Not the subject (unless it's a selfie) and not the website owner. (unless that's the photographer) Permission from the photographer is what's needed. If she mails an image with appropriate permission to OTRS, an OTRS member will upload it.
