It is obvious that I am not clear about the language. These are photos that belong to me. The photographers of the photos of Anne Gamble Kennedy and Matthew Kennedy are deceased. Owning a physical property (photograph) is not the same as owning an intellectual property (copyright). Although, for example, one may purchase and own tangible books, the intangible copyrights remain solely with the authors/publishers. Similarly, intellectual properties can indeed be inherited like physical propriety, but must be bequeathed or passed down by operation of law. Alternatively stated, simply being related to the author of a work and owning a copy of that work is not adequate. To accept these files, we would need a copy (e.g., scan) of the legal conveyance or other document that formally transferred to you the copyrights of these images; you can provide that documentation using the COM:OTRS process also mentioned above. I'm sorry for your loss. Can you find the names and dates of death of those photographers, try to get permission from their heirs, and send a copy of each of your parents' Last Will and Testament via OTRS? There is no way I can find the names of these photographers. They have been dead for decades. Matthew and Anne Kennedy were given these photos for their own use. They were concert pianists, so they needed to distribute the photos for concert programs, newspaper articles, etc. In most cases they themselves hired the photographers to take the pictures, so they certainly had permission to reproduce them. But such paperwork would be more than 70 years old. Their house is sold and emptied so there is no way to find such paperwork. Yes I can send a copy of the Will. By "action", it appears Jcb meant your action in making this edit, clicking or tapping "Publish changes" after composing it. Re File:Dr. Henry Floyd Gamble.jpg, you listed the source as "{{own}}", which evaluates to "Own work" in the reader's language. But the original photo is not your own work, there was an original photographer, presumably much older than you, and they probably sold a print to the subject or their family, and the recipient probably put it in an album or in a box or up on a wall, and you got it somehow and scanned or photographed it, creating a derivative work. In this edit you changed the source to "{{Public Domain}}", which evaluates to "Template:Public Domain" in all languages because we don't have a Template:Public Domain. Why do you think the source is "Public Domain"? Who do you think the photographer was? Why do you think the photographer is dead? Where exactly did you get the print and how did it get there from the photographer? That info on where you got the print and how it got there from the photographer should be in the source field for every derivative work of a photograph you upload. You can post it here or in your ticket and it will appear on your files if and when they are restored. Yes, as I explained before, I mistook the word "own" to mean that I owned the work, which I do. The original framed photo was in my mother's belongings, which I inherited. After Googling the image I saw it was already online years ago. Yann explained to me that the photo was public domain since it had been taken before 1900. He told me to "fix the source," which I tried to do, and then was blocked for a month by Jcb. I still don't know where to fix the source. I tried to fix it in the info on the photo, and was blocked. Nina07011960, your haste to meet a deadline seems to be preventing you from meaningfully engaging with the notices and policies that have been repeatedly pointed out to you. We all started out as brand new users entirely unfamiliar with the rules here, yet tens of thousands of us have managed never to have been blocked. You are simply not acting appropriately; you need to slow down and engage genuinely with our polices and the issues. Certain issues:
  • You say above "Someone needs to inform me of the rules here"; it is, in fact, incumbent on you to inform yourself. Relevant information was provided during the upload process, and the numerous notices above link you to, among others, our licensing policy and copyright rules. I myself have tried to explain what "source" means, including with citation to relevant policies.
  • Owning a physical item--like a photograph--has nothing whatsoever to do with owning the related intangible copyright. Just as you may purchase and own a book, you do not thereby own the copyright of the underlying literary work. Similarly, inheriting a physical photograph is unrelated to inheriting the related copyright and, even if it were, would require the deceased to have themselves owned the intellectual property rather than merely the physical property. The former would need to be substantiated and it may be that case that certain photographs in your possession simply cannot be uploaded due to lack of necessary evidence.
  • Yann misinformed you by virtue of an inadequate understanding of English or ignorance of copyright law ("Yann explained to me that the photo was public domain since it had been taken before 1900" is utter nonsense.) United States works can enter the public domain for a number of reasons, which you may observe at COM:HIRTLE--pre-1920 creation is not one of them. Please understand that date of creation and date of publication are very different things. File:Dr. Henry Floyd Gamble.jpg was restored out-of-process, but ultimately spared because I was able to locate evidence of pre-1923 publication.

Yes I do and am. As I explained before, I did not see the notifications from Wikimedia. Even now when I look to my notifications, I have to go to a separate page to find the Wikimedia notices. There was no sarcasm in the comment. We are all volunteers here; if you're going to make bad faith assumptions, I'm happy to be done with you. We have also stated many times that you need to provide evidence that that copyright belongs to you. Being "the sole heir of the estates of Matthew and Anne Kennedy" is not good enough. 1) You need to prove Matthew and/or Anne Kennedy were themselves the copyright holders, which is not likely as they are the subjects of certain of these images; and 2) Once you've done that, you need to prove that their copyrights then transferred to you. The transfer of intellectual property rights, even to heirs, must be explicit, specific to a particular IP and in writing; to-date you have provided no such documentation. It may be the case that the necessary support for the free licensing of these images simply does not exist. Just as a not-for-profit voluntarily eschews profit for philosophical reasons, the Commons eschews works that are not demonstrably free for philosophical reasons. It does this knowing some works will be, unfortunately, precluded. You may wish to consider simply uploading the images to en.wiki with a fair use justification, as it appears evidence of free licenses will not be forthcoming. If you have a fair use claim (see the en.wiki criteria), you can upload the images there for use in en.wiki articles (the Commons is unique in allowing files here to appear on all sister sites. Local en.wiki files can only be used on en.wiki articles/pages.) I do realise that the photos are old (1940s and 50s), which complicates or even precludes documentation of evidence. Indeed, this is why I say "It may be the case that the necessary support for the free licensing of these images simply does not exist" ("exist" intended to mean "be available to us.") If you've submitted the Last Will and Testament, that may resolve point two above if the IPs are listed among assets bequeathed or by virtue of residuary estate, but it does not resolve the more important point one. I am an OTRS member and can see the response(s) you received. You were notified that your correspondence had been received and that a response "may take some time." That the processing did not fit within your desired time frame is no excuse to forge ahead and re-upload deleted content (an image, in this context, has a single copyright - the level of clarity is not relevant. Again, and not sarcastically, surely you do not not believe that the problems pointed out to you were related to the clarity of the image.) Many people are waiting patiently to have their permissions processed; you are neither more or less important than them and will have to wait. I do understand the frustration. No one desires such a delay, but we can't side step necessary processes because they inconvenience us. Further, as I said above, you likely have not submitted adequate permission anyway, as copyright generally belongs to the photographer, not to the subjects and thereby not to the subjects' heir(s). You are blocked on the Commons, not en.wiki; you currently have no restrictions there. The upload process on en.wiki is, in all germane ways, identical. Click the upload file link and follow the instructions or, better, yet, ask for guidance on that project (this is the Commons and our policies and procedures are different.)
