Uploaded images

Hi Magog! I uploaded two pictures that don't have the necessary licenses. I've just noticed it now, please delete them as soon as possible. I also have a question, if an author grants me personal permission to share a picture how can I make wikipedia know that so it doesn't get deleted? @PedroLopFonMarAlves: I have deleted the photographs. If you want to upload a photograph from someone else, it's best to follow the form here: Commons:Email templates. @Usien6 just "Copyleft" is probably too ambiguous for Commons. They don't really define what they mean anywhere, and there's no legal wording for the term, unlike for actual licenses like {{Cc-by-sa}} or {{GFDL}}. It certainly doesn't help that it says "Direitos reservados" immediately after "Copyleft". If you think the authors might be willing to clarify their licensing, see Commons:OTRS/pt and/or Commons:Modelo de mensagem. Magog the Ogre (talk) (contribs) 04:17, 9 December 2015 (UTC)
Wow! That looks like a lot of bureaucracy! Thank you for your prompt answer. The "Direitos reservados" sayings don't help, indeed, and I've actually missed them: they only appear, once, in the footnote; while the "Copyleft" sayings appear twice. I could try to contact the journal asking for a clarification, but it doesn't seem to be worth the effort: it's just an ordinary graph, after all... By the way, does it meet the threshold of originality? Our colleague Vesa Linja-aho claims, in a slideshow he published in 2012, it doesn't (Slide 18: Diagrams, graphs, (...) are generally not subjects of copyright [under the Finnish law].) I'm not saying we must believe everything he says, but his claim makes a lot of sense and he has, at least, a published a book on the subject: this Teacher's Guide to intellectual property (isbn 978.951.792.468-9). @Usien6: most people don't like it, but the legal business is bureaucratic. And copyright is an entirely legal exercise. There is no getting around it. COM:PCP addresses this.
The graph is likely not copyrightable under Finnish or American law, but it is likely copyrighted under Brazilian law (see COM:TOO). If I were you, I would send them a request for permission to use the graph. Otherwise, you could fire up LibreOffice/MS Office/GIMP/MSPaint/etc. and create the map on your own. No, the image was regrettably under the CC-BY-SA-NC license[2], which is not compatible with our licensing policy. Allowed CC licenses are: CC-0 (Zero), CC-BY and CC-BY-SA. --Túrelio (talk) 09:50, 12 December 2015 (UTC)

Many thanks for your feedback. I suppose some troubles happend with the licensing of the images, I've posted in Wikipedia. I still can not understand, what's wrong with that.

Could you please kindly advise:

1) what license I should indicate, if an image has been scaned from a book?

2) what licence should be indicated, if an image has been taken from an outside web-site?

3) what license should be indicated, if the image has been taken from a family archive (provided by heirs)?

@Kabota 13: I saw that, and I'm really sorry! I actually feel very bad about this deletion, worse than almost any other deletion, because I think your contributions were actually quite helpful. But it seemed like your images were not actually public domain, though. The ones you scanned from the book have a copyright which lasts for 70 years after the death of the photographer (or 74 years if the copyright fell to Russia and the photographer fought in the Great Patriotic War; 64 years if the copyright fell to Ukraine). If we don't know the author, then they just become public domain 70 years after initial publication. That is why we asked about the author.
As for family archives, again, the photographer is the copyright owner, unless the photographer was working for someone else. For example, if these were taken by a member of the Soviet armed forces as part of their duty, then the copyright may have already expired. If you could ascertain the date the photograph was taken and who you think took it, that would be really helpful.
If you genuinely don't have any idea who the photographer is and there is absolutely no way we'll ever know, I will ask around to see if there's not something we can do about it. It will get a bit more complicated in that situation.

Upload Deletion (2)

Hi! How are you? Look, I know a National Copyright law (11723 on public domain pictures published in Argentina), indicating that if an author photograph, that image recognized as such until after the 25 years of taking that picture. From there, already the image happens to be public domain, so that any citizen can use it without having to request authorization. That's what I know about the law regarding photographs. About logos and others, I understand that are in the public domain, since its authors leave them free to do so. I hope you have been helpful my message. Greetings and successes in the discussion. Ah! @Diego HC: Merry Christmas. According to {{PD-Argentina}}, photographs are public domain 25 years after they were taken and 20 years after they were published, whichever happens latest. From en:List of countries' copyright lengths, you can see that, if the copyright belongs to an individual, its persists for 70 years after the individual's death. About File:Mapa de 'El Fortín de Sta. Rosa'.png

Hello, sorry for my bad english. The photo called 'Mapa de "El Fortín de Sta. Rosa".png' is an edited Google Maps screenshot. The locality 'Fortín' is a very small place. So small, that Google Maps don't show the streets names, squares names, neither shows too short streets.

Therefore, I decided edit a Google Maps screenshot, and add the street names, the missing streets, squares, etc. I thought a photo, with a half of mine job, I was able upload in Wikimedia. Is not like this?

Why not clearly copyright?

File:Tn 545 vintage mission side.jpg, File:Tn rb5012qn.jpg and File:Tn 3115.jpg are all exact copies with the same file names from The Amish Store. How much more copyright can you get than that? Secondarywaltz (talk) 06:53, 1 January 2016 (UTC)

@Secondarywaltz: those files have been on Wikimedia for 8 years now. I can only see the Amish Store on the internet archive for 5 years. It also seems likely to me that this is the the uploader is the same person who owns the site, given that he is expert enough to start the English Wikipedia article on the subject ([5]). do you have an idea how pictures like File:Bujáki remetelak.jpg, File:Zaragoza - Basílica del Pilar y río Ebro.jpg and File:Canons russes sur rocher Corneille.jpeg do end up in Category:Pigeons to be shown on User:PigeonIP/Tauben/2016 January 1-10? @PigeonIP: this happens from time to time with galleries. If you are curious, you'll want to check toollabs:magog/category-files-blame.php. In this case, you can see from here that the link was Category:Sculptures of the Holy Trinity => Category:Sculptures of the Holy Spirit as a dove. According to § 201(a), Ownership of copyright, described within Title 17, chapter 2, of the Copyright Act, " a work protected under this title vests initially in the author or authors of the work." Further, according to Justice Thurgood Marshall in the case, Community for Creative Non-Violence v. Reid, which outlines a majority view on the definition of the term, author, "As a general rule, the author is the party who actually creates the work, that is, the person who translates an idea into a fixed, tangible expression entitled to copyright protection." Now, I took and own this photo. In fact, I took it on July 8, 2015 with my gold iPhone 6. When uploading this image I was prompted to state the author of the image. I selected myself. Further, I selected the appropriate license which I chose to be, a fairly broad use of this image. So, I'm really quite baffled as to why this image has a ton of infringement postings attributed to it. Again, I am the author of this image as defined by numerous court cases and according to § 201(a) of the Copyright Act. Thus, if there is a "tagging" issue, which would be quite frustrating as WikiMedia Commons should make that clear upon upload, then please let me know how to properly edit the image as there is absolutely NO copyright infringement occurring here. — Preceding unsigned comment added by Lilyelisevocals (talk • contribs) 23:14, January 16, 2016‎ (UTC)

@Lilyelisevocals: sorry for the confusion! It looks like we got a little overzealous and there was a mixup in your case, and your file was deleted prematurely. Please understand that we're badly understaffed on this project, so mistakes like this are bound to happen.
Anyway, we do still request that you can provide proof of authorship since the image was published elsewhere first. I have left a note on your talk page explaining how you can do so. It shouldn't take more than a few minutes to complete.

This image is still included in my contributions as an active file with a "notice" of impending deletion due to permission issues on it. I actually just uploaded a more hi-res version of the image. The issue I'm now having is that It is extremely unclear as to how to add the appropriate license to the pre-existing file. When I go to the image, there are no areas within which to apply an edits. I believe the appropriate "license" tag is {{self|GFDL|Cc-by-sa-4.0,3.0,2.5,2.0,1.0}}. @Lilyelisevocals: Copy this exact text and add it to the description page beneath the information template: {{self|GFDL|Cc-by-sa-4.0,3.0,2.5,2.0,1.0}}. This will not make the problem templates automatically disappear from the page or from your talk page; those have to be removed manually. In this case, I tagged the image as missing proof of permission because we found it on a third-party site. If you could send us a private email from an official address, then someone will remove that template from the file page. After we've done that, feel free to remove the warnings from your talk page. More sock puppets uploading Maiko photos?

Hi. I noticed you recently blocked a number of accounts as Sockpuppets of Haruo.takagi. Given the timing and identical styles, I was also suspicious about all the new accounts suddenly appearing to re-upload images previously uploaded by KyotoFlowertourism. Anyway, a number of new accounts have since been created to continue their work (Na.Mizuno, T.watasan, Takehiro Fujisawa, Tigertakashi). I have tagged these accounts as suspected sock puppets, but you may wish to have a look and possibly block the IP to prevent further account creations, if that is possible. I've blocked a bunch more.[7] I don't have a clue what this guy/gal's doing; the uploads don't seem disruptive in and of themselves (although I could be missing the point). Hi. Thanks. My understanding is that that KyotoFlowertourism uploaded a whole bunch of photos late last year taken by various photographers at photo sessions he/she organizes. These were all deleted as not having permission from the individual photographers, and he/she was recommended to get the actual photographers to contact OTRS to verify permission in future. The same photos were then re-uploaded (by the various sock-puppets) in the past few days with exactly the same file names (which is why I spotted them immediately) and identical styles, so presumably KyotoFlowertourism just thought it would be easier than going through the OTRS process. It's a shame, as the images would be welcome on Commons if only their authors can be reliably confirmed. Anyway, thanks. --DAJF (talk) 23:13, 17 January 2016 (UTC)

Image question

Greetings Magog,

I noticed you did some changes to a few files such as this one. Do you do that based on a regex script or is that just a manual thing? Also, the weblink that lists is broken. Also, I can't edit ENWP as you probably know. If someone wants to add the Now commons template to the files I have migrated they can be found at Category:Files uploaded by Reguyla.   • Si encuentras una imagen en el internet, casi nunca es aceptable subirla en Commons. Hay ciertas excepciones: algunas de Flickr tienen licencias libres que sí se pueden usar. Este es un ensayo que tenemos en inglés: Commons:Flickr files.
  • Ni la Wikipedia en español ni Commons permiten el uso legítimo. Esto significa que no puedes subir los logotipos que encuentres en la Wikipedia en inglés.
  • Hay ciertos logotipos que son muy sencillos que sí se permiten porque son bajo la umbral de originalidad. Si sigues a esa enlace, verás unos ejemplos.

Improvements ideas for User:Magog the Ogre/PD ineligible

Thank you for great tool!

I think will be good idea to add file and uploader name; to sort files inside days by uploader, and then by file name; for bitmap images it'll be great to have indication of {{Convert to SVG}} and {{Use TeX}}; to add update button and updates counter; indication of deletion/no permissions/etc temaplates.

Licence of a picture.

Hello

I've uploaded a picture yesterday. I did this after I got permission of the author of the picture by mail. I wrote this in my native language (Dutch) at the 'Permission section' of the picture.

Since I have permission to use the picture on wikipedia by the owner, how can I make sure the picture will not be deleted in 7 days?

File tagging help needed

I wanted to ask you for help regarding proper tagging for files Central Library of Serbs of Croatia 1.jpg and Central Library of Serbs of Croatia 2.JPG. I would appreciate if you can spend some of your time to give me instructions what shall be done in order to tagg files appropriately. I wanted to ask if it would be fine if massage from library email (that can be find at official web page) is sent to permissions-commons@wikimedia.org . I don't know if you've done it before, but one of these days you should do an edit check on one of JB27's /16s. I checked edits on a good 20+ of these ranges, and the only IP edits for the full 3 months were roadsigns-related... I don't know if my pages are still up on cu.wiki, but I listed a dozen or so soft 3 or 6 month /16 range blocks I did. This was the only way I ever saw months go by with no JB27 edits except an occasional sock acct and a few phoney unblock requests. Him and Isechika are relentless... Magog hi,

I read that an image that only consists of simple geometric shapes or text does not meet the threshold of originality needed for copyright protection, and is therefore in the public domain. I have seen the same license used for other logos of Israeli political parties.

Is this still true? Can Zehutlogo.png be published under the same terms?

Cleanup of Flickr template usage

Hi Magog the Ogre, i found several errors in files with the {{Flickr}} template that maybe could be repaired by your OgreBot 2. For example i often saw {{flickr| or non-standard date values of the taken parameter. Do you think it is a good idea to run your bot over all that files?
