Is this happening again? Permission is mentionoed directly in teh description of the file. Did you read it? - Alex Kachanov — Preceding unsigned comment added by Alexkachanov (talk • contribs) 2013-10-04T01:30:15‎ (UTC)

Yes it happening again. The copyright holder has to write a mail to the Commons support team - see COM:OTRS - an not the uploader has to write that to th file description page. --JuTa 07:14, 4 October 2013 (UTC)
PS: As soon as you know the copyright holder has sent out the mail to permissions-commons@wikimedia.org you should replace the {{No permission since}} template with {{OTRS pending}}. This will prevent deletion normaly for about 30 days or until the OTRS case gets decided as valid or invalid. regards. --JuTa 19:30, 4 October 2013 (UTC)

Question about the picture CRIlogo.png

Hellow, JuTa. I am a newcomer and I need help. Yesterday you wrote me about the file File:CRIlogo.png. Could you please explain me. This is a logo of international radiostation, I found it in Internet, I found it on their official site and resized it. Also I could make copy of it from their newspaper. I don't know the law. Yes, this is not my own work. Does it mean that we can't put any logos into Wikimedia and Wikipedia? Why then there are a lot of logos of another companies here? For example, English version of China Radio International (this is their logo) has it, and I want Russian page also to have it. What can I do? Is It enough to give the link to their site with this logo? OTRS, etc is rather difficult to me. — Preceding unsigned comment added by Сергей-СПб2013-10-04T09:48:19‎ (talk • contribs)

Hi, I corrected the desfription pag now - see here. The problem was that any license template was missing completly. In this case its valid to use {{PD-textlogo}} but the rules differs between countries - see Commons:Threshold of originality. For the future you better ask i.e.on Commons:Help desk if you are not sure. regards. --JuTa 19:40, 4 October 2013 (UTC)

Thank you for your answer bery much! I'll try to study the rules.--Сергей-СПб (talk) 20:25, 6 October 2013 (UTC)

question

The file [Chrysemys picta distribution in Dutch.png] is derived from another image, what should I do to get the appropriate license? The original license is {own} and I did clarify that recently. Greetings, Bart -B kimmel (talk) 20:54, 4 October 2013 (UTC)

Hi,{{Own}} is not a license, but just a statement that the image was self created. I corrected that now - compare here. regards. --JuTa 21:01, 4 October 2013 (UTC)
I didn't know that, thanx for the intervention, losing the image would ruin the 'distribution' section on the NL;WP. Greeting, Bart -B kimmel (talk) 11:24, 5 October 2013 (UTC)

Hello. You marked my upload of this CoA as missing permission, because I couldn't provide that author of CoA Mr. Poletti agrees with license CC-BY-SA. Isn't enough that bishop Lach as armiger himself agrees with the license? I have sent e-mail to permissions.commons@wikimedia.org, maybe the issue will be solved there. BTW, CoAs of bishops Šašik (Mukacheve) and Hučko (Prague) are on Wiki as originals. CoA of Hučko was created by User:Tomas.urban and he released it, CoA of Šašik is only on Ukrainian Wikipedia and marked as copyrighted. If the forwarded e-mail from Lach doesn't suffice, should I upload Lach's CoA in "Šašik way", i.e. only to Slovak Wiki? And do I need permission for replacing wrong CoA of Babjak (when he wasn't Archbishop) by correct version, formerly official? Thanks and you can join Category_talk:Coats_of_arms_of_bishops_from_Slovakia. Hosmich (talk) 15:49, 5 October 2013 (UTC)

Hi, I modified the problem tag to {{OTRS pending}}. regards. --JuTa 18:42, 5 October 2013 (UTC)

Bobby Dodd & Bobby Dodd Jr. Football Cards

User:JuTa; I saw the notices posted on my talk page regarding Bobby Dodd & Bobby Dodd Jr. Football Cards. The instructions include the following "you must specify where you found it (e.g. usually a link to the web page where you got it), you must provide proof that it has a license that is acceptable for Commons (e.g. usually a link to the terms of use for content from that page)." I followed these instructions for both images. Also, these football cards were published in 1955 and 1961 respectively. The original copyright for these cards expired after 28 years per this website. Finally, the images of these cards can be found on E-Bay and many other card trading websites, so these images are in the public domain. These images are currently being used on Bobby Dodd article on Wikepedia. Therefore please let me know what is required to keep these images from being removed from Wikimedia Commons? Thanks in advance for your help - Mistercontributer (talk) 02:25, 6 October 2013 (UTC)

Hi, the main problem with your images is, that there is just no license template on the description pages. Every image on Commons has to use one or multiple of those templates, which are valid for the imdividual image. In your case it woul be most probarbly {{PD-US-not renewed}}. But normaly this requires some research that the copyright has been realy not been renewed. You better ask on Commons:Help desk because I don't know how to do this research. Once this has been done successfully you can put the license template onto th description pages an remove th problem tags. regards. --JuTa 04:52, 6 October 2013 (UTC)

Frederick Robson

Hi JuTa, I uploaded an image I found on this website http://www.fownc.org/newsletters/no58.shtml The image is of an oil painting of a Victorian actor which dates from c. 1856. It was apparently uploaded to the website by a Robert Smith, a descendant of the subject Frederick Robson: Smith probably owns the original painting on which the image is based, as in a book on Robson dating from the 1970s the painting's owner is listed as Mrs J. Smith, presumably Robert Smith's mother. On the site where the image is displayed Smith neither asserts nor waives copyright. Is it okay to keep it?RLamb (talk) 22:46, 7 September 2013 (UTC)

Hi, I guess you are talking about File:FrederickRobsonColour.jpg. Well, the initial problem is that there is no license template included in the file description page, compare Commons:Licensing and Commons:Copyright tags. The source you stating giving me a "Service Unavailable". If the image was created in 1856 it is probably {{PD-old}}, but we would need a verifiable source for it. regards --JuTa 09:02, 8 September 2013 (UTC)
Hi, - yes I'm sorry, it seems the page I found the portrait on is an overlooked survivor from an earlier version of the website, now disused. The current site is at www.fownc.org (to see the page I saw, click on 'Newsletters' and then choose 'No.58 January 2007'). So, I contacted their secretary to see if they still have an address for Robert Smith - the man who wrote the article for their newsletter and supplied the image, - and she is kindly going to pursue it. But if it's impossible to contact him, I suppose I'll just let the image be deleted. Thanks for your help anyway, RLamb (talk) 14:35, 8 September 2013 (UTC)
Hi JuTa, the owner of the painting has kindly replied to me. On the whole I think he has no objection to the image being used in this article but he would naturally like to protect any reproduction rights he may have; and, like me, he's conscious this is a legal area we know little of. Is there some form of licence we could choose that would allow us to put the image back but still protect his copyright?RLamb (talk) 07:53, 11 September 2013 (UTC)
Well, every license on commons has to allow reusage for anybody in the world for any prupose (incl. commercial) - see Commons:Licensing and Commons:Copyright tags. Recommanded is {{Cc-by-sa-3.0}} which requires attibution of the author. {{GFDL-1.2}} o {{FAL}} i.e. are a bit more restictive but still allowing reusage by anybody. regards --JuTa 18:19, 11 September 2013 (UTC)
I'll get back to him and explain this. His expressed hope was to allow usage on Wikipedia but with the reservation that "the image is of an original picture which is in the ownership of Robson's family and which should not be reproduced without their permission". Clearly it's not possible. Thanks for your advice though, I find copyright tags a source of anxiety and confusion.RLamb (talk) 08:46, 13 September 2013 (UTC)
Hi JuTa, I am still having problems with the last two files I uploaded. One of them was the colour image we discussed above,File:FrederickRobsonColour.jpg. The owner of the original painting is unwilling to allow the image to be used, but I do not know how to delete it. I assumed because it was tagged it would be removed after 7 days, but it's still there. Also, another file I uploaded for the same article,File:Medea1.jpg I found on an academic website with no details as to copyright. Since it was a photograph from c. 1856 I assumed was in the public domain, but it turns out to have metadata showing it is copyright to the National Portrait Gallery - so that needs deleting too. How do I get rid of these images?RLamb (talk) 21:08, 16 September 2013 (UTC)
Hi, the first image I deleted now. The second one looks OK, but I would recommand to change the license to {tl|PD-old}}, because its propably not an US-work. The exif-copyight-notice looks like a classical Commons:Copyfraud to me. regards. --JuTa 21:19, 16 September 2013 (UTC)
Hi JuTa, back again. About my latest upload - I had an email from the man who owns the portrait and who also took the picture available online at http://www.fownc.org/newsletters/no58.shtml. He's okay with me putting a cropped image on the page, and knows it will be available to others to use providing he's credited. If I get him to send the email below to the permissions editors, will it solve the problem?
'I hereby affirm that I, Robert Smith, am the sole owner of the exclusive copyright of the attached image, a cropped version of a picture taken by me of an oil painting in my possession, namely a portrait of the actor Frederick Robson (1821-1864). The uncropped version is viewable at http://www.fownc.org/newsletters/no58.shtml. I agree to publish that work under the free license “Creative Commons Attribution-ShareAlike 3.0 Unported” and the GNU Free Documentation License (unversioned, with no invariant sections, front-cover texts, or back-cover texts.) etc etc'
I apologise for taking so long to get the hang of what is wanted here, I find complying with the copyright requirements confusing. But if we are patient, this article may yet be illustrated with suitable images.RLamb (talk) 09:18, 30 September 2013 (UTC)
Hi, he should send this to permissions-commons@wikimedia.org, but be aware owning a painting does not neccessaraly mean owning the copyright of the painting. This normaly stays by the painter. If the painting is very old and the painter is more than 70 years dead (in most countries) the copyright is expired. Then the license {{PD-old}} would apply. But we would need to know who the painter is and when he lived/died. As minimum we would need to know when the painting was created to check if the painter could have live past 1943 (today minus 70 years). regards. --JuTa 18:32, 30 September 2013 (UTC)
The painting was done when Robson was alive, so at least is pre-1864. But I'm not sure if the owner knows the artist. Anyway, I'll send him an email and see whether it can be sorted.RLamb (talk) 10:35, 2 October 2013 (UTC)
Hi JuTa, the FrederickRobsonColour.jpg file was just deleted, although the author emailed his permission to permissions-commons@wikimedia.org about four days ago. He agreed to its being released under 'Creative Commons Attribution-ShareAlike 3.0 Unported etc'. Is this insufficient? Can I upload it again, or will it be deleted again?RLamb (talk) 19:53, 11 October 2013 (UTC)
Hi, I undeleted the file now and set {{OTRS pending}} with the appropiate date. --JuTa 11:52, 12 October 2013 (UTC)
Thanks for this. I'm not yet sure what OTRS is, but I will look it up and hope that the picture can remain!RLamb (talk) 13:39, 12 October 2013 (UTC)

Copyright status: File:Image 1448-LARLE-crater.jpg

Hi JuTa, I uploaded an image I found on this website http://www.sci-news.com/space/science-new-type-impact-craters-mars-01448.html. Its about a very recent discovery on Mars. Please refer to this image and tell me: 1. Whether I can upload it? (with due image credit and references); and 2. If yes, would this image be considered in public domain? Exactly what options to choose while providing licensing info (for this image). --Jai Ho 00:17, 14 October 2013 (UTC)

Hi, that depents :) File:Image 1448-LARLE-crater.jpg does not look like public domain as the source states: Image credit: Northern Arizona University. The same for File:Argilos-portico-2700.jpg, the source states Image credit: Jacques Perreault, the University of Montreal. Only File:Image 1456-PGC-6240.jpg looks like public domain because Image credit: ESA / Hubble team / NASA; acknowledgement: Judy Schmidt. I would recommand that you search for a direct Hubble/ESA/NASA source and set the license {{PD-Hubble}} in this case. For the other two I see no chance except the copyright holders would send a releasing mail to the commons support team as describted in Commons:OTRS. regards. --JuTa 19:35, 14 October 2013 (UTC)

Hi, I sent a mail to Dr Barlow regarding File:Image 1448-LARLE-crater.jpg. She said - "The image is actually a mosaic of images from the Thermal Emission Imaging System (THEMIS) on NASA's Mars Odyssey mission. All NASA images are public domain and are not to be copyrighted. However, please acknowledge NASA/ASU in any caption. --Dr. Nadine Barlow". Could you please tell me the exact steps to follow regarding this image? Or, is it possible for you to make the necessary changes? Thank you for your time and attention to this matter. --Jai Ho 01:50, 15 October 2013 (UTC)

Then you should forward this mail to the commons support team - see Commons:OTRS, or better if Mrs. Barlow could send herself a mail to there. Once this is done, you should replace the template {{No license}} with {{OTRS pending}} an the template {{Remove this line and insert a license instead}} with {{PD-USGov-NASA}}. regards. --JuTa 07:35, 15 October 2013 (UTC)

Berkas:Aj-ngtmbr.png

Hi Juta

I came across a file in the Indonesian wikipedia, id:Berkas:Aj-ngtmbr.png, which I'd like to put into the Javanese script category. As it turns out, the file is uploaded into wikipedia, not commons. Can I transfer the file to commons?

Alteaven (talk) 11:55, 14 October 2013 (UTC)

Hi, the commonshelper] or its clone might hlp you transfering images to commons. In the current case I don't see any valid source in th id: image. That increases the risk that the image might be deleted after tranfer here on commons. regards. --JuTa 19:40, 14 October 2013 (UTC)
What is TUSC? It's said that I'll need a TUSC user name and password. Alteaven (talk) 01:33, 15 October 2013 (UTC)
Just klick on it, enter your commons username and choos a password. After that you should be able use the commonshelper. regards --JuTa 07:29, 15 October 2013 (UTC)
What you said came true, it said that the files cannot be moved to commons due to invalid source. Is there a way to add licensing in the Wikipedia then transfer it to commons? Alteaven (talk) 09:36, 15 October 2013 (UTC)
Well, you could try to contact the original uploader and ask him to fill out completly a id:Templat:Information within the description page. With a source etc. oit should be possible to transfer the image. --JuTa 20:03, 16 October 2013 (UTC)

Magnus Bromelius

{{Helpme}} Dear JuTa, You justly notified me that Magnus_Bromell.png lacks information on the copywrite status. I usually upload pictures and drawings I produced myself, and this is about the fifth time I uploaded an existing image, so I am very unexperienced in copyright issues. For previous uploads from other sources, I found information on copyright, but not this time. Since Bromell was a public figure in the early 19th century, it may be a reasonable assumption that the drawing was made at that time. Also the source is the Riksarchivet, which really sounds like the Swedish government. Although there is no mention of the date of publication of the source (Anteckningar om svensk läkare, L. Roberg), it is mentioned this work is a handwriting. The handwriting does not seem to be uploaded, nor could I find a transcription. The only L. Roberg I could find in the Nordisk Familjebok is 17th century, so cannot be the right guy. Although I could not find proof, I think it would be reasonble to assume copyright has expired. Could you please help me. Thanks, Dwergenpaartje (talk) 12:12, 23 October 2013 (UTC)

Hi, the image realy looks like created duing his livtime (latest 1731). In this case the drawer is dead for much more than 100 years and its in th public domain. Lebegő karos címer / Crest with a hovering arm / Solymár, Hungary

Dear Colleagues! I scanned this image myself from the local newspaper (Solymári Hírmondó, 1991. january), this was a part of the headline of the newspaper in the year 1991. I offered to my colleagues in the Hungarian Wikipedia to delete this image, if anyone of them find it problematic [no one replied], and according to this, I offer you as well to delete it, if you find any legal problem with it. But if your decision will be a deletion, please let me know, how can I use the image of this crest, if I would like to publish it on Wikipedia? This crest has no other appearance on the internet, since the author had withdrawn his offer (to the municipality of Solymár, Hungary) to use this crest in cca. 1992 or 1993, and we don't have any physical object, in the municipality, which would bear the image of this crest on itself. So please let me know, how I can show the image of this crest (which is a small part, but concrete part of the history of my municipality) on the Hungarian Wikipedia, if the scanned copy of the head of our local newspaper is banned to republish. Sincerely: Solymári (talk) 23:31, 17 October 2013 (UTC)

I know, that it's still not enough, but in his reply, he wrote me that he is ready to fill in any necessery license form. So I hope, today or mx. tomorrow I'll get the correct licence. Hi, I'm sorry, but I don't see a realistic chance to keep this image on commons. The only chance I see that you try to contact the author, Bernard Beaujard according description page, and ask him if he likes to publish this image under a free license. {{Cc-by-sa-3.0}} is recommanded, but there are a more possibilities. If he agrees h has to send an email to the commons support team as describted on Commons:OTRS. Once the mail has been sent, you better replace th template {{No license}} with {{OTRS pending}} which will prevent deletion of the image for about 30 days or until the case will be decided as valid or invalid. regards. --JuTa 16:07, 26 October 2013 (UTC)
