LOC duplicates[edit]

I have no idea why File:Chosŏn chido. LOC 83675009-2.jpg and the 3 others in this sequence were duplicates, the only difference appearing to be a full stop in the filename. If you see LOC map duplicates again, rather than a speedy deletion it would be much more useful to mark them up with a duplicate template or raise a DR, so that I have time to examine them. The LOC maps uploads are deliberately slow, taking months as a project. Due to unpredictable server dropouts there are also re-runs, so such files may well be reuploaded by accident if the problem still exists and the standard API flagging of duplicates is being ignored for some reason I am unaware of.

This weekend, as regularly happens, my access is tablet only, so analysis or investigation of anything technical may take several days. Thanks -- (talk) 08:01, 1 September 2018 (UTC)[reply]

The above mentioned file was an exact duplicate (system detected) duplicate of File:Chosŏn chido LOC 83675009-2.jpg. A user appears to have run a bot to detect them, tagging about 3600 files. See [[Commons:Administrators'_noticeboard/User_problems#Tyler_de_Noche:_abusive_use_of_{{Speedydelete}}_(Thousands!!!)]]. Several admins have been working on this huge nomination for the past 48 hours. Jcb (talk) 09:35, 1 September 2018 (UTC)[reply]

Hello. Thank you for pointing out. I have corrected file information in the pictures. It seems that the picture permission was corrupted while updated 5 languages description.

That syntax correction does not address at all the double copyright problem as mentioned in the DR. Jcb (talk) 19:47, 2 September 2018 (UTC)[reply]

Deletion of Film Poster[edit]

Hello, I noticed you deleted my upload of the poster for the Love Thy Nature. I am curious as to why and how to make the image viable for Wikimedia's terms to be used on the film's Wikipedia page. I have written author consent, which was sent and approved by the Wiki team. What else do I need to do? LMK--Ottamieh (talk) 21:44, 2 September 2018 (UTC)[reply]

What's the OTRS ticket number? Normally if the permission is accepted by an OTRS agent, they will tag the file accordingly. Jcb (talk) 14:43, 3 September 2018 (UTC)[reply]

As far as I remember, there was a case for vandalism at EN wiki going on for weeks. Several admins were involved at EN and Commons. When the vandal or vandals could not be stopped, a strategy was tried to discourage them instead. It worked, the vandalism stopped within a few days. I don't remember all the details. It must have been documented somewhere at EN. Jcb (talk) 14:48, 3 September 2018 (UTC)[reply]

This file does not meet the license requirements as stated in the template. You are well aware of that, you are just ignoring it. Jcb (talk) 16:23, 5 September 2018 (UTC)[reply]

Deletion of M Ross Perkins Hope Con image[edit]

Hi, can you talk to me about why you deleted this image? This image was placed in the public domain by permission of its creator. How has a copyright claim been made on this? W1nds0ck (talk) 00:52, 7 September 2018 (UTC)[reply]

And I just realized you also deleted two other images that were properly tagged for fair use using the standard provided template. These images were also used with explicit direct permission from the copyright holder (SofaBurn Records), whom I received the images from directly via email yesterday.

I understand the need for moderation to prevent copyright infringement and protect intellectual property, and I appreciate this effort, but you appear to be abusing your ability to delete images because I know for a fact that you do not know anything about the use and legal release of these images you've deleted. All 3 of the images you deleted were given to me by their creators specifically for use on Wikipedia. I'd like to know exactly what gave you the idea that these images were being improperly used, and I'd like you to restore them please. Thank you. W1nds0ck (talk) 01:02, 7 September 2018 (UTC)[reply]

You were obviously not the author and there was no evidence of permission. In cases like this verification via OTRS is needed. Please ask the photographers to contact OTRS. Jcb (talk) 09:41, 7 September 2018 (UTC)[reply]

Concern[edit]

Why arent all of my uploads restored? HutheMeow (talk) 04:43, 7 September 2018 (UTC)[reply]

Please see Commons:Undeletion_requests/Current_requests#Sorting_out. The undeletion request is still ongoing, but we have already undelete a part of which we concluded that they are safe. This undeletion request is so large that it takes time to handle. It was considered helpful to already undeleted a part and exclude this part from further discussion. Ticket#2018080810009778[edit]

Hi JCB: Please see User talk:Arthur Crbz#Ticket#2018080810009778. Crbz received the initially incomplete information needed to confirm the copyright ownership of the now-deleted file, File:Keith Ferris painting the mural "Fortresses Under Fire" at the Smithsonian National Air and Space Museum.jpg. Please inform me whether the information supplied was insufficient and what would be needed to resubmit the image, if you cannot restore it. Sincerely, HopsonRoad (talk) 18:46, 9 September 2018 (UTC)[reply]

The ticket is in the queue and it is open. As soon as an OTRS agent handles the ticket and concludes that the permission is valid, this OTRS agent will take care of undeletion. Jcb (talk) 18:48, 9 September 2018 (UTC)[reply]

Attribution-TRGov-Military-Coast Guard[edit]

Jcb, I was just looking at Category:Pages with script errors and Template:Attribution-TRGov-Military-Coast Guard which seems be be broken due to missing Template:Attribution-TRGov-Military-Coast Guard/en. It seems like you deleted that subtemplate years ago without explanation. If Template:Attribution-TRGov-Military-Coast Guard is valid than we need Template:Attribution-TRGov-Military-Coast Guard/en, so we should either restore it or delete Template:Attribution-TRGov-Military-Coast Guard. --Jarekt (talk) 13:56, 10 September 2018 (UTC)[reply]

Thanks for the notification. It's a leftover of Commons:Deletion requests/Files in Category:Attribution-TRGov-Military-Coast Guard. I have deleted the template. It was not included in any file page, so that we are clean now as far as I can see. Jcb (talk) 15:34, 10 September 2018 (UTC)[reply]

Deletion of all files uploaded by User:Schaller GmbH[edit]

Dear Jcb, early September the verified (!) user Schaller GmbH had uploaded a couple of professionally taken product pictures and used them on the German page Schaller GmbH. These were deleted the very same day (3. September) because copy right violation was suspected. After some discussion at least one picture (Schaller M6 Locking.jpg) was restored on 5. September. This was sufficient to illustrate the article. To my surprise all pictures uploaded by this user were deleted and removed today from the article again. Trying to find the reason I only find a closed deletion-discussion, which I can not see at all. What am I doing wrong, or is it not accessible to normal users? Can you help me to find out, why pictures are first deleted, then restored (because the user has proven he owns the rights to them), and then deleted again in the end? Thank you! --Wosch21149 (talk) 21:58, 14 September 2018 (UTC)[reply]

(talk page stalker) @Wosch21149: the deletion discussion can be found at Commons:Deletion requests/Files uploaded by Schaller GmbH. Previously, the photos were deleted because they were suspected copyright violations, but they were restored on September 5 per an undeletion request: Commons:Undeletion requests/Archive/2018-09#Uploads by Schaller GmbH. For some reason, despite the verification, the files were nominated for deletion by EugeneZelenko the same day they were undeleted and then deleted by Jcb today. clpo13(talk) 22:25, 14 September 2018 (UTC)[reply]
Permission should be visible at the image, not at the user page, where closing administrator is not going to look. I have tried to open the ticket, but it is apparently not in a permissions queue, so that I cannot see what's in the ticket. Jcb (talk) 22:39, 14 September 2018 (UTC)[reply]
Ah, I see. The "discussion" was just the request and the deletion in the end. Thank you!
How can the permission be made visible at the image in a case like this? The rights of it belong to a company and the image was uploaded by the verified owner of that company. During the first discussion he uploaded the invoice of the photographer (to his company) on his user page, of course, this "picture" was also deleted meanwhile. And I don't think another picture cannot be added to an image as proof of permission. Shall I recommend him to upload one or two pictures again just stating that he's the owner (but not the person, who created them)? Can this be done? --Wosch21149 (talk) 14:32, 15 September 2018 (UTC)[reply]
Please do not reupload them. Do you know what email address the permission was sent to? Was it e.g. sent to info-de at wikimedia.org? I can only do anything if I can get the ticket. If I know where it is, I can ask somebody to move it to our queue. Jcb (talk) 15:03, 15 September 2018 (UTC)[reply]
I've asked the German OTRS-Team to support. The verification is registered there under the number 2018062710006542, but I don't know which way the verification was done. --Wosch21149 (talk) 17:34, 15 September 2018 (UTC)[reply]
Ok. If a DE Wiki OTRS agent confirms to me that the ticket is valid for these files, I can undelete them. Jcb (talk) 20:13, 15 September 2018 (UTC)[reply]

I undeleted all the relevant files after checking the ticket Ticket#2018062710006542 Groetjes --Neozoon (talk) 21:56, 29 September 2018 (UTC)[reply]

Soldiers (Serbia)[edit]

Is there any way to file a complaint on your work? Nikolai011 (talk) 04:50, 15 September 2018 (UTC)[reply]

What is exactly the problem? As far as I can see I only deleted you uploads for having no valid license 7 days after upload. We do that by policy, so if you don't like it you should request a policy change instead. But I give you little chance, we have been disallowing files without a valid license since 2004. Kelly Clarkson[edit]

Hey,

I noticed you deleted the page I wanted to use for the Kelly Clarkson All I ever wanted tour. Could you please explain? Father of Lies (talk) 11:44, 16 September 2018 (UTC)[reply]

A gallery page contains a gallery with at least two images, or it will be deleted. Feel free to recreate the page with such a gallery. I think Category:Kelly Clarkson - All I Ever Wanted Tour contains sufficient pictures you can use. Please categorize such a page as Category:Kelly Clarkson - All I Ever Wanted Tour instead of Category:Kelly Clarkson, so that it shows up in the correct category. Warning[edit]

Delete without notice[edit]

You had just deleted my three images: File:Horn Gyula & Mórocz Lajos 1990.jpg, File:Mórocz Lajos 1990.jpg and File:File:Nagy Sándor MSZP.jpg. Accordingly, "No OTRS permission since 13 September 2018". Why did not you inform me, the uploader about this process? --Norden1990 (talk) 17:16, 21 September 2018 (UTC)[reply]

The files had a delayed deletion nomination placed by you on upload. You added the {{OTRS pending}} template, which automatically converts into a deletion nomination if we don't receive OTRS permission. Jcb (talk) 22:21, 21 September 2018 (UTC)[reply]
Yes, because I have no right to add the OTRS e-mail. But all of three image were made by photographer Tamás Urbán, who permitted the usage of images at Wikipedia and its projects. Please, could you check OTRS ticket #2017031210011731 and if it is eligible, restore the three images? --Norden1990 (talk) 04:46, 22 September 2018 (UTC)[reply]
As far as I can tell with Google translate, this ticket is not valid for any file. It does not contain a valid permission. If it has been pasted to other files in the past, this has been erroneous. Jcb (talk) 06:37, 22 September 2018 (UTC)[reply]

Hello Johan, can you tell me something whether the (rather weak) permission for that file can be accepted as-it-is? I am just waiting with an SVG conversion for the knowledge that it will not be in vain. I hope the allowance of that guy is sufficient, without all the other sermon? At least, it's not a copyright plea, it is a logo that should be spread for public relation! -- sarang사랑 07:57, 22 September 2018 (UTC)[reply]

New uploads without a license.
Paul Hermans (talk) 14:15, 23 September 2018 (UTC)[reply]

Hello JCB, an image for the page Gretchen Reydams-Schils was uploaded by the subject who holds copyright, but this was deleted by Filedelinkerbot on 22 August as it didn't have permissions. I don't understand how it didn't have permissions; please could you explain this? Apologies for my ignorance; many thanks Srsval (talk) 16:38, 23 September 2018 (UTC)[reply]

"the subject who holds copyright" is a wrong assumption in almost all cases. Copyright generally belongs to the author, not to the depicted person, unless the copyright was explicitly transferred by means of a written document. Please ask the photographer to contact OTRS to provide permission. Jcb (talk) 16:46, 23 September 2018 (UTC)[reply]

Jcb, I saw you recently deleted File:First Full Disk ABI Image from GOES-17 (28600286188).jpg as having no license for a over a week. Sorry! The image source is here, a US Government Flickr account that I should have tagged with {{PD-USGov-NOAA}}. As you probably know, some US government Flickr pages import immediately with the right license, and some only with a generic PD-mark Commons needs a more specific license for, and I guess this one slipped by me. Can you undelete the page and either add, or allow me to add, {{PD-USGov-NOAA}}? Or would it be better if I just re-import it? Thanks! MarginalCost (talk) 13:06, 28 September 2018 (UTC)[reply]

Deleting page File:Lester W. "Cappy" Burnside, Jr.jpg (No license since 22 September 2018)[edit]

Both the license and required e-mail were sent to the permissions e-mail as requested and shortly after uploading. I was told that there is a one-month+ backlog because these are handled manually by volunteers. If that's the case, why don't deletions occur after one month to allow the process? I fully understand why you need proper documentation and why it takes so long, but what should I do? It's the main photo on a Wikipedia page. Must I re-upload under the same file name and start the process over? I understood by the message on the page that it would be deleted so I'm not terribly surprised. I replaced it temporarily with a photo of the same subject that's in the public domain, but it isn't a portrait, which I would like to use. However, the copyright holder has sent the required information to you. I don't want to keep asking her to send the license (I have a copy of that) and her e-mail (I sent her the template but I don't have a copy--I just sent explicit instructions). How do I proceed? I have hoped to reach someone with knowledge about this--if you can just let me know whether to re-upload the photo and expect weekly deletions until the e-mails are reviewed--or what? I really don't like the public domain photo so I'm in the process of uploading a photo I took myself (suggested by a Wikipedia admin). I hope that works for now. Thanks in advance. Appl atcha (talk) 15:24, 30 September 2018 (UTC)[reply]

Do not reupload the deleted file. Instead, please patiently wait until an OTRS agent handles the ticket. Jcb (talk) 15:40, 30 September 2018 (UTC)[reply]

Thank you. Could you do the same for this one: https://commons.wikimedia.org/wiki/File:Redeared_slider.jpg There is no revision for this one but it's not exactly a good picture either. The problem of deletion[edit]

Halo i have a big problem about pictures i uploaded. when i got a warning sign, i sent a email for permissions, but all the pictures were deleted by you, and even i didnt receive the answer about the mail. so today i try to upload all the pictures agian, but the system didn't accept the pictures, becouse the pictures were already deleted. so, i have two question about the situation, firstly how can i recover the pictures?, second, how do i uplad the picture again? — Preceding unsigned comment added by Xxpooun (talk • contribs) 08:22, 1 October 2018 (UTC)[reply]

Don't reupload the files. Unfortunately OTRS has a backlog. As soon as an OTRS agent handles a valid permission, they will take care of undeletion. Jcb (talk) 16:25, 1 October 2018 (UTC)[reply]

De-adminship[edit]

I have started Commons:Administrators/Requests/Jcb (de-adminship 4) as you have refused to revert you're disputed deletions, regards. Please ask me if you have any other questions. Crouch, Swale (talk) 11:23, 2 October 2018 (UTC)[reply]

My only question at this point is: If you don't want to accept the established procedures at Wikimedia Commons, why don't you go back to Wikipedia? Jcb (talk) 14:43, 2 October 2018 (UTC)[reply]
Established procedures? Something you apparently established yourself, despite that not being the case for years. When I did something that was objected to it was reverted and I had to discuss it. I bet if I'd done something you thought was really inappropriate and I just went on, I bet you'd have reverted quickly and blocked me. As an admin you have greater authority to set consensus from prior discussion from others. Why you'd want to do this is beyond me. Crouch, Swale (talk) 11:50, 4 October 2018 (UTC)[reply]

Deletion of "File:Uli Snare sw.jpg"[edit]

Hi Jcb, as far as I see, you deleted the above mentioned picture which I got from the depicted German musician Uli Moritz and uploaded it on May 1, 2018, to Wikimedia. In order to obey the regulations, I asked him to send the referring permission form to Wikimedia (permissions-de@wikimedia.org), and on May 9, 2018, he confirmed that he has sent it to the mentioned mail address. By the way, the same also affects the picture "File:PlastikPortrait 2.jpg", also got from Uli Moritz, uploaded by me, and the permission of which Mr. Moritz confirmed to have sent it to Wikimedia together with the 1st permission already in May: also this picture has been deleted, in this case on September 25 by User:Ronhjones. So what has gone wrong? Have the permissions disappeared on their way to you, i.e. Wikimedia? When I uploaded the pictures, I was told to be patient since the OTRS team is small, and it may take some time to process the issue, so I waited patiently, and now this! Wouldn't it be a good idea to warn the uploader/s in such cases in order to avoid all that trouble? Finally: What should be done now? Both pictures should return to the article as soon as possible. Greetings, --Qniemiec (talk) 22:04, 4 October 2018 (UTC)[reply]

@Qniemiec: The "OTRS pending" template turns into a "no permission" template when the date is longer than the backlog time, by which time the OTRS team will have applied a "Permission OTRS" or a "Received OTRS" template. Sadly the German queue looks like is has become much slower than the main queue. I have found the two e-mails, with only an auto-reply so far. I'll restore and add a "Received OTRS" template. Ronhjones  (Talk) 22:54, 4 October 2018 (UTC)[reply]
Thanks! Yes, the backlog of the German queue is indeed troubling. Jcb (talk) 22:59, 4 October 2018 (UTC)[reply]
Hi there, as I've just seen, both pictures have re-appeared at Wikimedia, with a new template in German below them saying that I should wait until the OTRS procedure is completed. Should, or can I do anything to avoid another deletion, or will I have just to wait? And when may I re-insert the pictures into the article, already now, or not earlier than with the official OTRS stamp below them? Greetings --Qniemiec (talk) 11:14, 6 October 2018 (UTC)[reply]
You may re-insert the pictures, but if OTRS is not completed within 30 days after our first human response, the files will be deleted again. Jcb (talk) 15:47, 6 October 2018 (UTC)[reply]

Why removed?[edit]

Why did you delete my file (https://commons.wikimedia.org/wiki/File:Tya-Sen_Yuri_2.jpg)? It was also written there that his copyright holder sent a letter to OSTR. Unfortunately, for some reason, Russian administrators have not responded to emails for a week and do not respond to what they are writing. Please return my files. You removed them unfair. I have fully completed the necessary procedure for OSTR. If your colleagues do not do anything, then how should I be?

File:Dennis Ace Van (42953870995).jpg has been deleted on 7 October 2018 by Jcb[edit]

Hi, the loss of this image is important to me. I'm sorry it did not have the appropriate licensing. I cannot now find its source. That would be marked on the deleted file. Is there any way I can recover it to find out the source, or can you tell me the source? Thanks, Eddaido (talk) 21:17, 7 October 2018 (UTC)[reply]

The file came from here, where it is marked as Public Domain Mark, which is not a compatible license, see here. This file cannot be used at Wikimedia Commons, unless proper evidence would be provided that this file would really be Public Domain. Jcb (talk) 22:01, 7 October 2018 (UTC)[reply]

Please would you look at this image and its source (noting the licence) and tell me if I have got the Commons licence tag wrong. Many thanks, Eddaido (talk) 04:34, 9 October 2018 (UTC)[reply]

No, the PD claim at the archive is erroneous. Please see {{PD-Australia}} for the PD rules of Australia. Jcb (talk) 14:34, 9 October 2018 (UTC)[reply]
Coupla things,
1. "Commonwealth, State or Territory owned2 photographs and engravings: taken or published more than 50 years ago"
2. Did you not notice the link to Queensland State Archives — as in State or Territory above — and the note on their record of the image "Copyright Expired"? If you cannot find it through this link http://www.archivessearch.qld.gov.au/Image/DigitalImageDetails.aspx?ImageId=18578
which may have again expired, just search for image 18578
3. Would I have asked otherwise?
Eddaido (talk)
I can only guess at the reason for the determined use of PD (the wrong kind, I have argued this through with a notable local archivist) and here is my guess: Museums like to be vague about items where copyright has expired because they do not want their images "cheapened" by appearing freely in public. How about that now. Eddaido (talk) 23:15, 9 October 2018 (UTC)[reply]
The question is: do we have evidence that the author is "Commonwealth, State or Territory"? I did not see such evidence. Unfortunately, archives and museums often are mistaken about copyright situations. I don't think they do it wilfully, it's probably just that the volunteers of these museums do not have sufficient knowledge on these things. Jcb (talk) 08:34, 10 October 2018 (UTC)[reply]
1. Have you actually read what I wrote to you? Eddaido (talk) 09:32, 10 October 2018 (UTC)[reply]
@Jcb: 2. I do not understand what you mean by this "the volunteers of these museums do not have sufficient knowledge on these things". What volunteers are these? The evidence that the photograph is "Commonwealth, State or Territory owned"

3. "Creating Agency — Agency ID: 1995 — Lands Department, Survey Office, Cartographic Branch, Photographic Section" on this page but the link (as pointed out above) seems to expire so you may have to search for it. Eddaido (talk) 11:43, 14 October 2018 (UTC)[reply]

Not all government organizations are a 'state' or a 'territory'. Jcb (talk) 11:46, 14 October 2018 (UTC)[reply]
    • Umm, I'm not Australian. Commonwealth = the central govt of all Australia which is made up of a number of states, one or two of which are only territories. I still don't understand your "volunteers" and "Not all government organizations are a 'state' or a 'territory'. Why do you say that — Its the State Library, geddit? Undelete request - Tom_Graves_author_headshot.jpg[edit]

Hello-

In April 2018 I had this article on Tom Graves accepted:

https://en.wikipedia.org/wiki/Tom_Graves_(writer)

I uploaded to Wikimedia Commons the file

Tom_Graves_author_headshot.jpg

and Tom Graves sent a proper email (from his business domain/email) giving permission to use the file.

The file was added in the Infobox of the article, but remained in "pending" state for ~5 months, without being formally approved by an OTRS volunteer. Then on September 12 you deleted the JPG, with reason "No OTRS permission for 30 days".

The email from Tom Graves is valid, but the file was never approved by an OTRS volunteer, there was enough time. Can you undelete the file and formally approve it for inclusion in Wikimedia Commons? If the email needs to be resubmitted or anything else done, it can be arranged.

Thank you — Preceding unsigned comment added by TallVenusian (talk • contribs) 17:14, 11 October 2018 (UTC)[reply]

The permission was not sufficient. An OTRS agent sent a reply 13 August, but we never heard back. Please be aware that permission has to come from the author rather than from the depicted person. Jcb (talk) 20:11, 11 October 2018 (UTC)[reply]

Hello, Jcb!

You deleted the file File:ENECOMP 2013 - Hackeando a Wikipédia - 2º dia.jpg. However, everything is fine with it.

The source link leads me to an error message. Also the author is stated to be an event rather than a person, although an event usually does not operate a camera. I think this should be verified via OTRS, where the author will typically be asked to send the original file with EXIF to OTRS for verification. Jcb (talk) 15:49, 12 October 2018 (UTC)[reply]

add Media missing infobox template[edit]

Sometimes I add a mission media infobox as in this case.
Since it is PD I don't need an author and I didn't add a source since the file is not available under the original source, therfore I can't add the original source.
A file that is older than 10years cannot serosly be proved if it was under this lizenze when it was uploaded.
If a infobox template is added this might lead that some Imark the file has missing information and get a deletion-request.
I am not shure if we should check the old files without infobox-template now? I think we should focus on the new files and trust that the old files (befor the infobox got famous) have a valid lizenze.

Now my question: What should I do if I find a file without infobox-template, and I am not able in a reasonable time to find lizenze, author, source.

  • should I start a deletion-request
  • should I add the infobox-template with missing fields or assume the uploader as the author
  • should I do nothing
  • ...

 — Johannes Kalliauer - Talk | Contributions 21:31, 13 October 2018 (UTC)[reply]

If a valid copyright situation cannot be established, a DR should be started. We do not accept files with unknown copyright situation, even if they have gone unnoticed for over a decade. If you add an infobox to a file with an empty source field, I will probably have a look at the file within a few days. If I cannot establish a valid copyright situation, I will normally start a DR. Jcb (talk) 21:35, 13 October 2018 (UTC)[reply]
1)The Lizenze claims that it is from :nl:Open_Clip_Art_Library: If I would add https://openclipart.org/ as a source is it a valid source? The Problem is that it is not on openclipart any more.
2)If this file would get deleted and it had {{DerivativeVersions|Nichalp upload script icon.svg}}, would Nichalp upload script icon.svg also get a DR, since it uses a file without valid source.
 — Johannes Kalliauer - Talk | Contributions 07:44, 14 October 2018 (UTC)[reply]
1) No, the main page of a website is not a valid source. If there is a more precise link to the original file but it's broken, archive.org may help out.
2) Yes, if the file gets deleted for unclear copyright situation, derivative works will have to be deleted as well. Jcb (talk) 10:55, 14 October 2018 (UTC)[reply]

Flowchart[edit]

Hello! What do yo think of this chart? May I upload it to Commons under PD-ineligible? The bottom of the page you can see {{Noncommercial}}. --Regasterios (talk) 07:23, 15 October 2018 (UTC)[reply]

I agree that PD-ineligible would be fine for this image. Jcb (talk) 14:48, 15 October 2018 (UTC)[reply]
@Regasterios: I could (out of context) instantly recognize this as Munroe's work. For the US and Commons this generally doesn't matter, but it does mean this chart is probably eligible for copyright in many other countries. It may be PD-ineligible in the US, but I suggest asking w:en:User:xkcd nicely, he knows Commons exists. If you just want the general idea of a flowchart trap, draw one yourself. - Alexis Jazz ping plz 15:16, 15 October 2018 (UTC)[reply]
Nope, in the vast majority of countries this would not be eligible for copyright, see COM:TOO for reference. Maybe if this would have been an Australian work, but even then I seriously doubt it. Jcb (talk) 15:20, 15 October 2018 (UTC)[reply]
The Netherlands: Om voor auteursrechtelijke bescherming in aanmerking te komen, is vereist dat het desbetreffende werk een eigen, oorspronkelijk karakter heeft en het persoonlijk stempel van de maker draagt
France: French law asserts that a work is copyrightable when it bears the "imprint of the personality of the author."
Which appears to be the case here. If Munroe is willing to drop the NC part for the flowchart (which he probably won't have any serious issues with), it would be freely licensed worldwide. @Regasterios: just drop Munroe a friendly note and ask him to either send permission to COM:OTRS or just log in with his w:en:User:xkcd account and upload it. (addition: or do the same thing he did for https://xkcd.com/739/) - Alexis Jazz ping plz 15:40, 15 October 2018 (UTC)[reply]

Hi, in this change you deleted a no source template. I still see no valid source. Could you please restore the template or provide the required evidence? Thanks a lot. -- (talk) 15:14, 16 October 2018 (UTC)[reply]

It's obvious that this picture was taken well over 120 years ago. If a source is not needed to established a valid PD rationale, you can use {{unknown|source}} if you wish. Jcb (talk) 15:20, 16 October 2018 (UTC)[reply]
"Jcb said it was obvious" is not a rationale to host non-public domain photographs. Assessing copyright status requires more evidence than your personal opinion, unless you can support that opinion with credible analysis. As an example I have used printing technique as a rationale to date scanned prints and postcards, in that context opinions are based on observations that can be explained logically to others.
It's gone to DR, hopefully someone will provide some evidence. -- (talk) 16:06, 16 October 2018 (UTC)[reply]
I have left a clear explanation in the DR, where it belongs. Jcb (talk) 16:11, 16 October 2018 (UTC)[reply]

Image question[edit]

Hi Jcb, Discasto and Xemenendura,
Quick question - Which is better Image 1 or Image 2
Personally I would say 1 is better but I'd rather have others opinions,
(Xemenendura your image was deleted due to the copyright images on the van however the image is still of use so I'm prepared to save it but it cannot be left with the images still on, You're more than welcome to photoshop yourself at a later date and upload over my revision,)
Thanks, –Davey2010Talk 19:35, 18 October 2018 (UTC)[reply]
I would prefer Image 1 as well. Jcb (talk) 20:23, 18 October 2018 (UTC)[reply]
@Davey2010: I could do a better job if I had the original. What would the image be used for? If the image on the van is unrelated to what you need the image for, making it disappear (image 1) is better. - Alexis Jazz ping plz 20:38, 18 October 2018 (UTC)[reply]
Thanks Jcb,
Hi Alexis Jazz, The image wouldn't need to be used anywhere really, I just feel the image could be used or atleast saved,
Here's the original, I do agree a better job could be done however I'm not able to do the door gaps which I feel would matter, The chances of the image being used internally is slim to none but ofcourse it could be used externally but that's a big guess,
Thanks, –Davey2010Talk 21:33, 18 October 2018 (UTC)[reply]
@Davey2010: thanks. I'll have a look. The original panorama doesn't seem to have a free license. File:Brooklyn & Manhattan Bridges (13268861153).jpg was taken in nearly the same place but a very different photo, so I'll have to remove the panorama from the van. - Alexis Jazz ping plz 22:05, 18 October 2018 (UTC)[reply]
You're welcome :), I did try cloning the colour from the rear of the ban but it looked odd, It's a shame they didn't have a simple logo as that would've been easy to go over, Anyway thanks for your help :) –Davey2010Talk 01:24, 19 October 2018 (UTC)[reply]
@Davey2010: To be honest, I don't think any of them are really useful for any educative purpose. We have plenty of images of vans in Commons. Regards --Discasto talk 06:48, 19 October 2018 (UTC)[reply]
The images are in scope and could be used, It's also worth noting there are no black Ducatos at Category:Fiat Ducato (2006) which is why there's even a more of a reason to keep, If it were white truth to be told we wouldn't be here now,
Hi Jcb, Could this image be undeleted so that I can upload the image over the previous image and then the previous image could be revdeled (and Alexis Jazz would be more than welcome to reupload over my image) - Trying to clear memory off of the laptop so would rather get this up sooner rather than later:), Cheers, –Davey2010Talk 13:20, 19 October 2018 (UTC)[reply]

Why do you always delete the images?[edit]

Rather, help improve if something is not good!

Articles are an important part of the pictures! In Hungary, it is not forbidden to use screenshots to show a program! Images are only used for the article in the program!

Help me upload pictures correctly! Tired labor to make up for destruction!

Images are needed for this article. This is permitted by Hungarian law. It's like in the United States the "fair use".

Do not delete please! Give guidance if something is not good!

--WikiHuns (talk) 19:42, 18 October 2018 (UTC)[reply]

For your information: Commons does not accept Fair Use, see COM:FU. But some versions of Wikipedia do, inclusing English Wikipedia. Jcb (talk) 20:25, 18 October 2018 (UTC)[reply]

Hungarian copyright law refers to the right of citation. Please help me to upload the image properly.

I guess wikimedia does not discriminate against Hungarian laws ?! Visitors to wikipedia also have the right to uncensored, full articles!

If I make a screenshot, I have the right to use the article I use when it is on the subject that appears on the picture screen.

Hungarian users are also entitled to the full wikipedia experience as well as residents of other countries.

Interestingly, Chinese, Russian, Indonesian, English, etc. pages were not deleted. — Preceding unsigned comment added by WikiHuns (talk • contribs) 22:25, 18 October 2018 (UTC)[reply]

How was the image size determined? The law does not refer to size at all. What licensing options do I choose when uploading?

I do not want to decipher wikimedia rules, but I would like to illustrate my articles with screenshots.

These programs are free as Gravit Designer or you can try out time-consuming free downloads like WinAce

You cannot upload the file to Wikimedia Commons. Go to Hungarian wikipedia and upload it there. If you have difficulties uploading there, ask for help there. Jcb (talk) 14:59, 19 October 2018 (UTC)[reply]

I'm really sorry! So far, I knew the place of the pictures was wikimedia. Now, I can see that wikipedia also allows uploading files. I apologize! So far I've read it. And, in the case of images, I saw the wikimedia give them space. I recently started writing wikipedia articles. I did not pay attention to the fact that there is a possibility to upload files.

As I understand, wikimedia is more of a place for self-made images. That is, when I make a photo, it has to be done here. Do I understand that?

--WikiHuns vita 16:06, 19 October 2018 (UTC)

If you take a picture yourself, you can safely upload it here. Also, if e.g. a file is in de Public Domain (e.g. work from the federal US government or, for many countries in the word, works of which the author has died over 70 years ago), then you can also safely upload it here. In order to avoid legal problems, we only accept files at this international project that are safe in all relevant jurisdictions. Files that could be used under national exceptions, like Fair Use, are handled locally at the language version of Wikipedia. Jcb (talk) 16:11, 19 October 2018 (UTC)[reply]

It was taken by you, from what website? Jcb (talk) 11:33, 21 October 2018 (UTC)[reply]

Why removed?[edit]

I have downloaded the following files:

https://commons.wikimedia.org/wiki/File:Levanov_and_Vardanian.jpg https://commons.wikimedia.org/wiki/File:Levanov_and_Matvienko.jpg https://commons.wikimedia.org/wiki/File:May_readings_2006.jpg https://commons.wikimedia.org/wiki/File:Levanov_and_Halezin.jpg https://commons.wikimedia.org/wiki/File:Daunoraviciute,_Levanod_and_Doroganod.jpg

They have been removed as files that do not have the correct license for Wikipedia. But the holder was sent to OTRS its resolution of 11 October 2018. Unfortunately, OTRS volunteers are not always prompt. I ask You to restore these files. If this is not possible, please at least send a description of each file, as it is incredibly important for me to be able to upload the images to Wikipedia again.

Sildream1 (talk) 10:12, 21 October 2018 (UTC)[reply]

Deletion of valuable content[edit]

Dear Jcb. Respectfully, may I please ask you to not delete content for the sake of deleting just because a few pieces of information is missing? I do admire the tireless work you do, but deletions such as this and this is in my opinion, quite careless. These images have survived on Wikimedia since 2005 (when proper record keeping was obviously not in place). A simple google search will prove that these historical images are in fact from USBR (which is PD).

If you want to delete a particular file due to bad sourcing (which is a sensible thing), please do so, but put the same effort in actually checking that these files are surely deletable. These small/insignificant images, albeit historical, would have been easily deleted you, me, or another admin, once the DR's 7-day period is over without any opposes. And obviously, no one would look back after that, considering the immense backlog at Commons. So it is absolutely important to that we at least take care of the old/historic content we host. Thank you for your understanding, Rehman 13:37, 21 October 2018 (UTC)[reply]

In the first place, this information should have been looked up before transferring the files to Commons, this is the responsibility of the person who executes the transfer. I did a reverse image search for both files of course, but I did not find any helpful thing. If I nominate a file for deletion, I use the standard script, so that the uploader receives a notification and can fix the part that they forgot on upload. I think these two files are a good example that the process works fine. Jcb (talk) 13:46, 21 October 2018 (UTC)[reply]
Your response is for an entirely different subject. Yes, the notification system works. And yes, the person who executes the transfer has the responsibility to check. (And, for transparency, yes I did the transfer more than eight years ago). Regardless of all that, it is still the responsibility of the deleting admin to put at least some meaningful effort into doing a proper background check, before deleting a 13 year old historic file. Are you telling me that, if Person-A legitimately uploaded a file in 2005, and just because Person-B transfers the file to Commons (which is encouraged with templates and whatnot), we at Commons have the right to delete it just because it does not meet today's information standards?
When I read your DR, I did not remember the file nor the subject of the file at all, but yet a simple google search showed me what I was looking for - a source. My statement still stands; if you're going to delete a file, do so responsibly. Rehman 14:03, 21 October 2018 (UTC)[reply]

SS Stefan Batory derivative picture[edit]

Hi JCB:

Around March of this year you arbitrarily removed my uploaded picture of the SS Stefan Batory. I was not given a chance to give the details or even defend its existence. There is at least one picture on the site that refers to the Polish copyright laws being vague or not applicable during the same time period of the derivative photo. I am not certain how to contact the original photographer of the picture which was used for the major portion of the ship. If the name I have is correct, it brings up nothing in an internet search. My request to the Polish Ocean Lines, who supplied the photo, to find more details went unanswered. I have basically concluded that if I have no way of contacting the original photographer, and the company that provided the picture to myself seems unconcerned, then your concern seems excessive or unwarranted. This digitally created picture should be made available to anyone that can appreciate it. I have seen the quality of many of the pictures of this ship, and decided that an improved picture would be a good thing. I can re-upload it giving mention of the photographer as the source of the derivative work. Thousands of passengers over many years could most likely appreciate a good quality picture of a ship that created countless memories.

Regards,

Rob Sweigard

I am afraid that we cannot do anything without a proper permission from the original photographer via OTRS. The fact that you have difficulties reaching them does not erase the copyright. Jcb (talk) 16:32, 21 October 2018 (UTC)[reply]

Hi JCB:

Being that this photograph fits in the same time frame of at least one other photograph from Polish origin on the Wikipedia site, it would appear that you are being partial. The other photo does not indicate any permission was granted, but rather that the Polish laws of copyright at the time did not give any protection, and therefore it was allowed. Rob — Preceding unsigned comment added by RobSweigard (talk • contribs) 13:41, 22 October 2018 (UTC)[reply]
We do not need to guarantee that all files currently on our servers are clean in order to be able to prohibit the upload of files with copyright problems. We have over 50M files. The fact that I did not personally check all of them does not make me partial. Jcb (talk) 17:13, 22 October 2018 (UTC)[reply]

Hi JCB:

If my photo compilation has a copyright problem, then, if I direct you to photographs on the Wikipedia site that are "in the same situation", will you remove them ? If in fact you do not need to guarantee that all files currently on Wikipedia "are clean" is there going to be a "cleaning" anytime soon ? I am making efforts to obtain permission to use the photograph, but that may be extremely hard to accomplish. Regards, Rob — Preceding unsigned comment added by RobSweigard (talk • contribs) 13:42, 23 October 2018 (UTC)[reply]
If you find such a file, nominate it for deletion instead. Jcb (talk) 15:44, 23 October 2018 (UTC)[reply]

Hi JCB:

Please check out this link https://en.wikipedia.org/wiki/Copyright_law_of_Poland it seems to indicate that the picture I have used as a derivative work is Public Domain. When I found this information I felt I could photo shop a picture based on one I had, and improve it for a public service. There is no copyright, or C to indicate it was protected, and I obtained it from the actual ship in 1976. All inquiries to Poland to clarify this have had no response. My conclusion is that the information provided on Wikipedia regarding the Public Domain must be fairly accurate. Therefore I believe it should not have been deleted, and should be reinstated. Thanks, Rob — Preceding unsigned comment added by RobSweigard (talk • contribs) 13:30, 26 October 2018 (UTC)[reply]

Briefmarkenlöschung[edit]

Moin Jcb, du hast gerade die Commons:Deletion requests/Files in Category:Stamps by Gerhard Stauf gelöscht. Gruss --Nightflyer (talk) 21:33, 24 October 2018 (UTC)[reply]

Undo deletion of 2 files: "Berika - 2a.jpg" & "Berika - 1a.jpg"[edit]

These are paintings of my late father, a renown Georgian artist Zurab Porchkhidze, whose entire heritage belongs to our family and is kept at our home. Photographs of the above mentioned 2 illustrations were made by me. Your deletion is merely insulting to remembrance of the famous person. Please, restore the deleted illustrations.

Please contact OTRS to provide evidence of permission. Jcb (talk) 09:32, 25 October 2018 (UTC)[reply]
I have several time applied to OTRS and respectfully asked them the permission to upload my own photographs of pictures by my late father - the notable Georgian artist Zurab Porchkhidze. Still no reaction from them - only automatic response for receipt. Could you dear Jcb explain the reason why you deleted those 2 files, what isn't a fair action towards the memory of my father and deeply insults the feelings of our family. Once again I kindly ask to restore the deleted illustrations, hope your action wasn't calculated to offend and humiliate us (though my family really feels outraged not to able to defend artistic heritage of Zurab Porchkhidze from deleting). — Preceding unsigned comment added by MayaPor1 (talk • contribs) 15:05, 25 October 2018 (UTC)[reply]
Deletion was not personal at all. For this kind of images, permission via OTRS is mandatory. Unfortunately OTRS has a backlog, but if you received an autoreply, that means that the ticket is in our system and one day or another you will receive a human response. If an OTRS agent handles a valid permission, they will take care of undeletion. Jcb (talk) 15:47, 25 October 2018 (UTC)[reply]

We only allow content with a compatible free license, see COM:L. That means that the photographer has released the file into one of those licenses. If you grab files from Facebook, you can be 99,9% sure that they are non-free. Jcb (talk) 10:48, 25 October 2018 (UTC)[reply]

Please read that one:

This image is of a poster, and the copyright for it is most likely owned by either the publisher or the creator of the work depicted. It is believed that the use of scaled-down, low-resolution images of posters to provide critical commentary on the film, event, etc. in question or of the poster itself, not solely for illustration on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under the copyright law of the United States. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information.

Purposeto serve as the primary means of visual identification at the top of the article dedicated to the work in question.

ReplaceabilityAs film poster art, the image is not replaceable by free content; any other image that shows the same artwork or poster would also be copyrighted, and any version that is not true to the original would be inadequate for identification or commentary.

MinimalityThe image is used for identification in the context of critical commentary of the work, product or service for which it serves as poster art. It makes a significant contribution to the user's understanding of the article, which could not practically be conveyed by words alone. The image is placed in the infobox at the top of the article discussing the work, to show the primary visual image associated with the work, and to help the user quickly identify the work, product or service and know they have found what they are looking for. Use for this purpose does not compete with the purposes of the original artwork, namely the creator providing graphic design services, and in turn the marketing of the promoted item.
