Image captions[edit]

موزیک‌ویدیوهای گوگوش[edit]

درود بر حجت گرامی،

چند موزیک ویدیوی قدیمی از گوگوش در انبار بار کرده‌ام که یکی از آن‌ها نامزد حذف شده‌است نگاهی به قانون حمایت از مولفین و مصنفین ایران انداختم و متوجه شدم که موزیک ویدیو مانند فیلم سینمایی و تصاویر نیست که سی سال پس از انتشار آن‌ها در مالکیت عموم قرار گیرد (مادهٔ ۱۶، مورد اول )، بلکه باید سی سال از مرگ پدیدآور و یا در آثار مشترک از آخرین مرگ پدیدآور (مادهٔ ۱۲) بگذرد تا در مالکیت عموم قرار گیرد. ولی می‌توان به همان مادهٔ ۱۶ ولی این‌بار مورد ۲ استناد کرد و گفت که این موزیک ویدیوها متعلق به شخص حقیقی نیست بلکه متعلق به شخص حقوقی است (مثلا برنامهٔ رنگارنگ و یا استودیویی که در آن ضیط شده است). مایلم نظرتان را در این باره بدانم. خواهشمندم اگر نظر خاصی دارید آن را در صفحهٔ نامزدی برای حذف بنویسید.

اگر با این گفتهٔ من موافقید، از آن‌جا که نمی‌توان آن‌چه گفتم را به خوبی به انگلیسی بیان کنم، خواهشمندم به انگلیسی این موارد را به آن‌ها بگویید

اول باید مطمئن شوید که حق تکثیر آن اثر واقعاً در اختیار خود خواننده نیست و در اختیار برنامه یا استودیو بوده است. تا اطمینان ندارید، چنین ادعایی نکنید. اگر پرونده‌ها به خاطر نقض حق تکثیر حذف شدند هم دلگیر نشوید. این که پروندهٔ ناقض حق تکثیر نداشته باشیم برای خیر و صلاح ویکی است. سلام دوباره،
من چیزی که بتواند نشان دهد این آثار در تملک شخص حقوقی بوده، نتوانستم پیدا کنم. اصولا فکر هم می‌کنم آن‌چه در ابتدا گفتم غلط باشد چون اگر مالکیت این موزیک ویدیوها در اختیار گوگوش نبود، نمی‌توانست آن‌ها را هر شب در کاباره‌ها و مجالس خصوصی اجرا کند (این تنها گمان من است). بنابراین فکر کنم باید از خیرشان بگذرم. به هر حال ممنون. ارادتمد Razghandi (talk) 19:44, 30 May 2011 (UTC)[reply]
ممنون از توضیح. البته امکان دارد که مالکیت آن موزیک ویدئوها واقعاً در اختیار ناشرشان باشد، اما در عین حال موزیک ویدئو هم موزیکش حق تکثیر دارد هم ویدئوی آن و موزیک گوگوش یحتمل حق تکثیر خودش را دارد (دست کم در آمریکا). Huji (talk) 23:43, 30 May 2011 (UTC)[reply]

FOP in Iran[edit]

سلام. من امروز قانون حق تکثیر افغانستان را بررسی می‌کردم که نکته‌ای به نظرم رسید و خواستم با شما مطرحش کنم (با توجه به بحث اخیری که در این مورد داشتیم)، البته با توجه به اینکه در مورد افغانستان است و نه ایران، صلاح ندیدم مستقیماً در همان بحث پیشین بدان بپردازم و ترجیح دادم در بحثی جداگانه و در صفحهٔ بحث خود شما مطرحش کنم.

اولاً اینکه در قانون حق تکثیر افغانستان «اثر معماری» دارای معنای مشخصی‌است که در فصل اول، مادهٔ سوم، مورد ۱۱ بدین صورت معنی شده‌است: «اثری است متشکل از نقشه یا طرح‌های ساختمانی».

مورد دوم که ذهن مرا به خود مشغول کرد در فصل هفتم، مادهٔ سی و نهم به چشمم خورد. در این ماده، «تولید مجدد اثر معماری بشکل عمارت یا ساختمان دیگر» را حتی به مقصُد [همان مقصود خودمان!] استفادهٔ شخصی بدون موافقهٔ پدیدآورنده خلاف قانون به حساب آورده‌است، که به نظر من رگه‌هایی از همان دیدگاه من مبنی بر «حفاظت از اندیشه و طرحی که پشتِ کار خوابیده و نه صرفاً چند تکه کاغذ پاره» را می‌توان در آن دید.

من خیلی دوست داشتم که شما آن بحث را ادامه می‌دادید [البته هنوز هم خیلی دیر نیست!] تا نظرتان را راجع به دیدگاهم بدانم؛ حال که این چنین نشد بگذارید حداقل در این مورد نظرتان را بدانم. استدلال‌های User:Mmxx نیز در این بحث و این درخواست حذف درخور توجه است. اگر بتوانیم fa:کاربر:همان و fa:کاربر:Lawyer532 (دکترای حقوق از پانتئون-سوربن فرانسه طبق صفحهٔ کاربری خودش در ویکی lawwiki.ir) را نیز به مشارکت در این بحث ترغیب کنیم خیلی خوب خواهد شد. این بحث نیازمند حضور متخصصین و افرادی که دارای قوهٔ استدلال و ذهن منطقی‌اند است و نه افرادی که دیدگاه‌ها را فقط به قول خودشان second می‌کنند. سپاس از توجه Americophile 22:13, 26 March 2012 (UTC)[reply]

انتقال تصاویر از ویکی فا به انبار[edit]

حجت گرامی در حال انتقال تدریجی تصاویر آزاد از ویکی فارسی به انبار هستم اما با یک همچون مشکلی مواجه شده‌ام. ظاهراً Gfdl 1.2 در اینجا قابل پذیرش نیست و باید از نسخه های بالاتر استفاده کرد! شاید هم من اشتباه میکنم ولی نمیدانم افزودن دستی این فرمان خلاف قانون است یا خیر؟! نمیشود الگو GFDL را در ویکی فارسی به نوعی تغییر دهیم که پس از انتقال به انبار با این مشکلات مواجه نوشیم؟ --MehdiTalk 12:53, 10 January 2013 (UTC)[reply]

مجوز گنوی مورد استفاده در ویکی‌پدیای فارسی fa:الگو:GFDL-self است که می‌گوید «نسخهٔ ۱٫۲ و یا هر نسخهٔ جدیدتر» و طبق Commons:GFDL 1.3 relicensing criteria اگر تصویر با چنان مجوزی قبل از ۲۰۰۹ بارگذاری شده باشد، قابل تغییر مجوز است. Huji (talk) 14:01, 10 January 2013 (UTC)[reply]
خب پس اکثر تصاویر را میتوانیم منتقل کنیم. یک مطلب دیگر:بسیاری از تصاویر جناب محمدیان و مانی در ویکی فارسی دارای متادیتا نمی باشند و خصوصاً تصاویر جناب محمدیان از کیفیت بسیار پایینی برخوردارند. اگر اینها را به انبار بیاورم مشکلی ندارد؟--MehdiTalk 14:17, 10 January 2013 (UTC)[reply]
