Hello,

I am certain these images are not owned by Shutterstock because they were taken by Endemol Shine UK for Big Brother series 5 (UK) in 2004.

Further to this, I sourced them from this page on the Big Brother UK Fandom website, where they have been uploaded as public domain images.

As such there is no copyright violation here and this image constitutes fair use.

I really don't know how Shutterstock operate as a company but I would contest that they are violating copyright law in this instance by putting their watermark on these photos.

Upon looking at the Shutterstock photos in more detail I have concluded that they do in fact seem to own these images and I apologise for an apparent but unwitting copyright violation and would agree with the deletion.

Hello,

I have the rights to use and distribute the image posted. The video game cover is a design I created (I work for the game company) and, unlike the game itself, does not have any copyright. Can I prove this somehow? Maybe is it the logo inside that makes a problem? This image being the current official art cover of the game, I beleive it makes sense to give it a free license to be used over the Internet.

EDIT: I understand the naming of the file might cause problem as well, as it is not quite specific/unique. I'd like to change it if possible.

Hello Geck1942, video game covers/art/screenshots are automatically copyrighted and there was no indication that you own the copyright for the work, so it appeared as a copyright violation. We do have a process for licensing works like this on Commons, it is detailed at COM:OTRS, simply follow the instructions there and the file will be restored. Alternatively, you can upload the image locally to the French Wikipedia and use it under the fair use doctrine, but this should be done in accordance with the policies at that local project (which is fr:Wikipédia:Exceptions au droit d'auteur on the French Wikipedia, however it is preferred if you freely license it here). Help with Picture Uploading and Copyrights[edit]

Hello Dylsss, I had a few pictures removed and cited as problematic, and I was wondering the best course of action to have them published again. It's the first time I have been using Wikipedia and I am still finding my feet a bit; both images are not my own, but I know that they have been giving the rights to be used in any informational multimedia setting. One is artwork created by someone who has told me they gave express permission to use, the other is a photograph of an actor which has been widely used on many different sites as promotional media for the actor. I would love to upload these pictures correctly and not run into any future problems, so please let me know the best way I can go about uploading again, and thank you for your time! Hi Mcdave mcdougal, files on Wikimedia Commons have to be freely licensed, a common misconception is that it is ok to upload files found off the internet onto Commons, images published on the internet are automatically copyrighted and should not be uploaded to Commons unless they have been explicitly published under a free license by the copyright holder. Another misconception is that files can be uploaded to Commons simply because you asked them and they gave permission "to be used in any informational multimedia setting", this is also not ok because files on Commons need to be able to be used for any purpose and anywhere at any time, including commercial use, there also needs to be evidence that they have actually licensed the work freely, whether that's on a webpage, an account they own, or via COM:OTRS.
These files can only be uploaded to Commons if you ask the copyright holder to explicitly license it under a free license on a website or account they own, or by asking them to email permissions-commons@wikimedia.org explicitly releasing it under a free license as described at COM:OTRS. Hello. Could you please notify me first when you have a problem wih one of my picture rather than deleting my work without any discussion ?? This is extremely rude and non-collaborative, whether you are right or not. Now I can't even check if there was actually a mistake or not, so this is more trouble for everybody, and several pages are probably disfigured but impossible to know which ones. So now I need you to put it back so we can see the problem and fix it without harming the encyclopedia. Please remeber that contributors are not machines... I disagree with you, but the fact of the matter is that no-one other than you and I cares, and, to be honest with you, despite the fact that I disagree with you, I'm not at all sure that I care.
So I'll simply say "It was very polite of you to bring the matter to my attention", and conclude that I will leave it to you to do whatever you think is best.

Deletion of MY photos from commons[edit]

Could you please explain to me how photos for which I own the copyright are a violation?

@Pdfpdf: The photos you uploaded were from "The National Trust of South Australia", and the author was set as "not known", so I am not sure why you are suggesting you own the copyright. Both the message on your talk page, and the deletion summary left by the administrator who deleted the image, explain why the image was deleted. Please read Commons:Licensing#Well-known_licenses, not all Creative Commons licenses are allowed on Commons. All licenses have to be free, to be considered free, they have to allow commercial use, and allow derivative use. The license here is CC-BY-NC-SA, the NC meaning non-commercial, thus it isn't a free license and not allowed on Commons. To clarify and re-state, I took the photos, and I was the one who originally uploaded them to Commons.
How the photos subsequently got uploaded/overloaded/reloaded/whatever 'from "The National Trust of South Australia", and the author was set as "not known",' is a mystery to me. (Are you able to suggest how this could have been achieved?)

I am not suggesting it, I am stating it. I am stating it because I own the copyright, and it appears that someone has "stolen" it/them somehow.

Not well or clearly, or relevantly.
It falsely assumes that the stated uploading and copyright was not the result of theft.
Commons:Licensing#Well-known_licenses is not relevant; when I uploaded those photos, I used the same process (and correct license) as I have done when uploading many other photos, (none of which have been deleted).

@Raimundo Pastor: I am sorry, I do not know Spanish so I am replying in English. Please see Commons:Licensing/es#Licencias_comunes, not all Creative Commons licenses are allowed on Commons. All licenses have to be free, to be considered free, they have to allow commercial use, and allow derivative use, as explained by the message on your talk page. The license here is CC-BY-NC-ND, the NC meaning non-commercial and ND meaning non-derivative, thus it isn't a free license and not allowed on Commons.
