Possible copyright violation

I originally uploaded images from this flickr user in good faith, however I have recently found the image Image:Alfa 158 farina.jpg in a book, "The History of Motor Racing", ISBN 0-356-15122-0, page 135, which predates the uploading by 18 years. The supposed photographer, "Terry Whalebone", is not listed in the photographic credits.

This calls into question other images from the flickr user.

Image:ERA E Type.jpg
Image:Maserati 4clt 48.jpg - which the user confirms is a copyvio (see the image's flickr page)

I'd like to suggest that this user's images are not reliable, should be deleted and the flickr user flagged by the project for uploading questionable images with free licenses.

Thanks, Readro (talk) 17:06, 13 September 2008 (UTC)

As agreed in Commons:Deletion requests/Images from Terry Whalebone on Flickr, most of the above are fine. Image:Maserati 4clt 48.jpg seems to have been overlooked, so I've tagged that as {{Flickrvio}}. The Creative Commons licensing claims on that one has been removed (which isn't sufficient to make it legal for Flickr to host, but it's enough to eliminate our problem with it). I'd also call into question File:Antilles sunset.jpg may be a scanned postcard, as well as File:Maserati works team Aintree 1957.jpg, File:Vanwall VW5 Aintree 1957.jpg, File:1907Standard.jpg, File:1924RollsRoyce.jpg, File:VintageVauxhall.jpg, File:VintageRollsRoyce1924.jpg, and File:VintageBentley.jpg, which were definitely not originally taken with digital camera from Nikon in 2006/2007. I'm not sure whether or not there are a significant enough number or proportion of problem files to justify adding to the list of questionable Flickr sources. Press photos from Nokia

aresjoberg on Flickr has some photos that apparently are official photos from Nokia, for instance Nokia E52 Golden aluminium - high res which seems to be downloaded from here. Nokia writes:

Media Use Only
Copyright © Nokia 2009. These pictures are intended for media use only. The pictures must not be altered in any way. For special permission to edit photos please contact press.services@nokia.com

and the user has chosen the cc-by license. Nokia has not licensed the photos explicitly under the cc-by license so this wont do, I presume? --Luen (talk) 19:44, 6 May 2009 (UTC)

Agreed, but I don't think three bad files out of 42 is enough to justify adding the user to the list. LX (talk, contribs) 11:07, 15 July 2010 (UTC)

Next ones please

Flickr user Mboyot has this Aaliyah image on his photo stream, that was then uploaded to Commons as File:AaliyahLeno.jpg and was Flickr-reviewed positively (!) on 5 February 2009. Now it was found to be identical with this Getty image. Looking at the photo stream of this Flickr user suggests that most of "his" images are like this one. --Túrelio (talk) 06:38, 1 July 2009 (UTC)

Flickr account leatherface_94 seems to be created for Flickr washing. The two images he has currently on his photostream (half an hour ago it were three) are rather clear copyvios and were both uploaded to Commons by Scottdoesntknow (talk · contribs).

licia5 is obviously a Flickr-washing account. 3 images, all uploaded to Flickr on July 8, 2009 and 1 day later to Commons.

Possible collection gathered from external sources?

While going through unreviewed flickr images, I came across File:BUAA_Old_Main_Building.jpg. The flickr author's collection, here, on the surface seems to be okay; all of the same subject and similar-looking images. However, I noticed that there were size discrepancies between a couple of the images; then going through the collection I realized the photos are taken with more than 5 different cameras. This seems a little sketchy to me... the files are all large, however, and don't seem to be taken off a website. What do you guys think - someone with a huge camera collection, or someone gathering images taken by other people and posting them to one flickr account? -- Editor at Largetalk 04:34, 28 August 2009 (UTC)

Here are the cameras used, ordered by date:
A Kodak V603 Zoom in 2006 (http://www.flickr.com/photos/41678986@N05/3844248371/, http://www.flickr.com/photos/41678986@N05/3847622855/, http://www.flickr.com/photos/41678986@N05/3847623787/).

A Canon PowerShot A570 IS in August 2007 (http://www.flickr.com/photos/41678986@N05/3856339034/).

A Canon Digital IXUS 110 IS in September 2009 (http://www.flickr.com/photos/41678986@N05/4136282502/, http://www.flickr.com/photos/41678986@N05/4135523133/, http://www.flickr.com/photos/41678986@N05/3986826701/, http://www.flickr.com/photos/41678986@N05/3915269850/)
A Canon EOS 400D Digital in October 2009 (http://www.flickr.com/photos/41678986@N05/4028653555/)
The descriptions of several of the photos suggest that the Flickr user appears in the photos, which most likely means they are created by other authors (presumably the uploader's friends). For the one's he doesn't appear in, I don't think there's enough information to draw any definitive conclusions one way or the other. LX (talk, contribs) 12:49, 15 July 2010 (UTC)

napolifd

napolifd's photostream may unintentionally have been used for Flickrwashing. File:BC Transit 8605 Kamloops..jpg was uploaded to Commons on June 16, 2009 by User:Secondarywaltz from Flickr to where it had be uploaded on June 13, 2009 as of our upload-log[1]. It had been positively Flickr-reviewed the same day by User:Captain-tucker. Only today, the Flickr-reviwer himself found out that the Flickr image (and consequently also ours) is a copyvio from here to where it had been uploaded on May 12, 2009 in a far less cropped version and with intact watermark "© 2009 George Prior". All the same applies to File:BC Transit 8604 Kamloops.jpg, that had been uploaded from here, but was actually a copyvio from here. In both cases the images on Flickr had the original (C) watermark cropped away, making this Flickr account unreliable as image source. --Túrelio (talk) 14:35, 9 September 2009 (UTC)

The Badder in the World

http://www.flickr.com/photos/29406557@N07/

This is similar to the killerfan619 accout from earlier this year. He's just a fan uploading his favorite images, but the account setting is set to "some rights reserved" by default. None of the photos have metadata, there are all of primarly low resolution, and many of them are were taken by myself, none of which I have allowed to be release on here. Based on all that, images should not be posted here from that account. Mshake3 (talk) 06:07, 7 October 2009 (UTC)

I now downloaded a sample of 20 images from that stream. I found a number of Sony DSC H-5 images with similar camera settings, this are the last uploads in the stream. One can interpret this as a sign of "own work", but given that NO image is in original size I disagree. There are batches of other cameras too. Groups of images grabbed from a random fan or website galleries, the first uploads are more clear not self-created. Most images are small in size and without EXIF.
I already checked the articles of some of the depicted persons in en and es wiki at the time of Flickr upload - I not found any indication of Flickrwashing. However, the comment saying an image was cropped here or here is not very common on Flickr. Any oposing voices not to delete this images? — Preceding unsigned comment added by Martin H. Flickr-washing of Getty images

The Flickr account of fejron aka Artur Andrychowski needs to be taken to the list, as he includes images from the agency Getty Images, who likes to sue everybody who uses their images without paying for. At least one such image, File:Idf ladies remembrance day 1.jpg coming from here, from this Flickr account was uploaded to Commons and only thanks to IP 82.102.146.145, we became aware that this was actually an AFP image, marketed by Getty[2]. This Flickr account offers other images from Getty Images such as this one that still carry a Getty watermark. --Túrelio (talk) 10:01, 30 October 2009 (UTC)

This Getty image was uploaded via this Flickr image by Flickr-user Katth07 to Commons as File:Faith Susan Alberta Watson.jpeg by User:Docekat. Same procedure with this original image via Flickr (already deleted) by the same account to Commons as File:Eugene Robert Glazer.jpg. So, Flickr-user Katth07 obviously is used for Flickr-washing. --Túrelio (talk) 17:20, 12 November 2009 (UTC)

Please add wahlkampf09

The Flickr account of wahlkampf09 needs to be taken to the list, as he includes collages that contain photographs he is not the author of. I have opened a deletion request of a file that was uploaded recently. --High Contrast (talk) 22:21, 1 November 2009 (UTC)

Leriel

Uploads rom the Flickr account of Leriel should be viewed with suspicion as he claimed this image to be his own (it was then uploaded to Commons as File:HotelPlazaMarioPani.jpg), though in reality it was from this Flickr account and fully copyrighted. --Túrelio (talk) 07:28, 20 November 2009 (UTC)

To make things worse, "his" image of Le Corbusier, uploaded to Commons as File:Le Corbusier.jpg, turned out to be from Getty Images. --Túrelio (talk) 14:28, 28 November 2009 (UTC)

Add "Pattrön"

You can find many pictures of Bolivia that were taken from his flickr stream on Wikicommons. Flickr files are from many cameras and all have different resolutions. He is also claiming professional photos of "Miss Bolivias" of different years to be CC by-sa.

Here's his photo stream on flickr.

One of his pictures that should be deleted if I'm right: File:Lago_Chalal%C3%A1n_-_P.N._Madidi_-_La_Paz_-_Bolivia_.jpg

Would it be OK to upload this and use it on en-wiki since the current image is a bit small? The CC-licence made me wonder whether they know they're giving some of the rights away. From [4]: "The images here are free to use for those who have interests in VIA's products or want to know what's happening in the events that VIA has participated in." — Preceding unsigned comment added by Veikk0.ma (talk • contribs) 18:19, 13 June 2010 (UTC)

The licensing on Flickr is actually irrelevant; if uploaded here, it should be tagged {{PD-textlogo}}{{Trademark}}. LX (talk, contribs) 07:56, 23 October 2010 (UTC)

Mark Holloway

Hi, I corresponded with Mark Holloway on September 11 because all his images were licensed under the cc-by-sa-2.0 license, even images from the AP and WireImage that were taken by someone else. I explained why they are problematic for Commons and that his own work can stay under a free license. He has decided to make "All Rights deserved" his new default license but didn't change the licensing for images prior to September 11, even for those he didn't take. Therefore I think his account should be listed here, because there are many copyrighted works freely licensed in his 3,600+ uploads. Hekerui (talk) 13:10, 15 September 2010 (UTC)

It becomes obvious with this image and others. The flickr software adds the description automatically from the image EXIF data, for that reason the caption contains the 'from Getty Images' information and makes it obvious that the flickr user isnt allowed to license the image. Maybe the ugly photos like Gijón - Marejada día 06-11-2009 are own work, I see however no reason to import bad photos of uncertain origin to Commons, the professional surfing photos are indeed press photos. {{qfi|surfglassy|surfglassy|37621253@N07|Surfing press photos, per Commons talk:Questionable Flickr images}}. --Martin H. Please add plushev

Please add http://www.flickr.com/people/plushev/ to this list. The account lists a number of photos from "backstage" at the 2010 Pirelli calendar, marked CC-BY, such as http://www.flickr.com/photos/plushev/4126906167/ but looking further, it seems clear he is not the original owner (he says as much here http://echo.msk.ru/blog/plushev/636341-echo/). I fell into that hole. Thanks. --GRuban (talk) 14:07, 13 January 2011 (UTC)

Not done The problem is the Pirelli images are one small subset of the larger account, which has had a large number of useful images taken from it for use on Commons. If it's listed, then it becomes that much harder to draw from it again. I'll write to the account holder and see if I can maybe get him to change the license on the Pirelli images to something that's not Commons-friendly (lord, that's something I thought I'd never type up) so this issue won't reoccur. This user was at Flickr for one day and uploaded ~400 images of Boeing aircraft. Many/most of them have Boeing as copyright holder in the Exif data but there's no verification this Flickr user belongs to Boeing nor if he has the rights to release the images under a free license. Is there any option to contact this user (or Boeing) asking for clarification ? --Denniss (talk) 05:21, 19 February 2011 (UTC)

Maybe its from boing, maybe not. Pro: The account has >400 uploads, to upload >200 files you have to pay a pro account for flickr. Buying a pro account can mean that there can be a professional interest behind the upload, otherwise someone will not pay money for this. Contra: The account is simply too unprofessional. I'd forego this account untill it is verified that it is them, either by asking them or by waiting for a more professional profile etc. --Martin H. (talk) 23:00, 18 March 2011 (UTC)

It still racks my brain. Because Warholmuze was a problem in February 2011 and this flickr account, http://www.flickr.com/photos/warholmuze/ (note: The individual URL is fix forever once you set it) on Flickr is from 2009. Whats that account for if that guy is using it for flickrwashing, why is the first photo a private photo taken from some other flickr account (http://www.flickr.com/photos/warholmuze/3577902564/ = 3550640080_f724d773c2_b = http://www.flickr.com/photo.gne?id=3550640080). Maybe warholmuze on Commons is an old flickr user deciding to join Commons and completely failed to understand that Commons is free content and not a webhost like flickr (AGF version). Maybe with User:Warholmuze I only catched the tip of an iceberg of an long standing flickrwasher? Maybe Warholmuze on Commons is only an impersonator of warholmuze on flickr or maybe Warholmuze on Commons is warholmuze on flickr who is impersonating someone else with using private photos... I realy dont know. Ill add warholmuze to the list. --Martin H. (talk) 23:28, 8 April 2011 (UTC)
I believe what happened is that Warholmuze was a long-standing Flickr user who registered an account here to add an illustration (File:14587288warholmuse210201115216AM.jpg) to an article using their preferred user name. (People tend to use the same username on multiple sites.) When that didn't work, they looked into ways of circumventing our processes and started Flickrwashing, using their pre-existing Flickr account for convenience. Maybe I'm missing something, though. Some more untrusted users/Flickrwashing accounts to list

Please add sunnyd_57 to the list. Game and movie screenshots as well as promo images tagged with free licenses. --Denniss (talk) 22:53, 8 April 2011 (UTC)

Please also add wmm4u to the list - red carpet images with watermarks or stating Getty as source but tagged with fake free license. --Denniss (talk) 11:38, 9 April 2011 (UTC)

One more to add, just another Paulinho15 Flickrwashing account: Nick Stokes1 --Denniss (talk) 01:00, 20 April 2011 (UTC)

adifans/adifansnet

I see this user on the untrusted users list but I recently saw images from this author reviewd by Flickrreview bot here. Should't a review fail if a Flickr users is on this list ? --Denniss (talk) 14:50, 16 April 2011 (UTC)

P R I T H V I R A J

In an interview with actor Prithviraj Sukumaran, the actor said that the orkut community in his name is operated with his guidance and support. So this makes the flickr user prithviz a legitimate account. The link to the interview is here, but unfortunately this interview is in Malayalam. How can we get this user unblocked with this proof? Will it be enough if a license reviewer in Commons can affirm the claim? --Sreejith K (talk) 12:25, 25 April 2011 (UTC)

The copyright not belongs to the actor or some fan community. They can reuse such images all over the web if they want, but they can not publish the files under free licenses. That the actor supports the fan comunity (isnt any singer or actor supporting their fans??) does not change this. --Martin H. (talk) 16:39, 17 May 2011 (UTC)

Please add another untrusted user (possible Paulinho15 Flickrwashing account)

http://www.flickr.com/people/62350008@N08/ - lots of promo shots with free licenses. Please also update the bot blocklist with the recentently added untrusted users. --Denniss (talk) 16:07, 17 May 2011 (UTC)

Another positive Flickrreview of a listed bad author

File:Jennifer Aniston in 2009.jpg was positively reviewed although the Flickr User is in the bat authors list. WTF is going on here? Flickr source is here. --Denniss (talk) 11:21, 15 July 2011 (UTC)

User:Bryan had responded to my email above regarding User:FlickreviewR/bad-authors on June 30th saying that over the course of the years it must have broken, with no idea how it happened. I guess it won't be fixed and we should expect a lot more Flickr washing from now on. – Adrignola talk 17:27, 15 July 2011 (UTC)
That's really bad news. I suspect something at Flickr has changed, maybe the bot needs to look at the username (text format) as well? BTW - what's the use of this page ?--Denniss (talk) 20:24, 15 July 2011 (UTC)
That page is usefull to identify Commons users who take unfree images from flickr and copy&paste the flickrreview template from other Commons files. That happened in the past, we have a few sockpuppeteers who do this frequently. Regretably the page is cluttered by Zil/Boing-Boing because Zil adds his name to flickrreview although he not reviewed the files his bot uploaded. --Martin H. (talk) 20:32, 15 July 2011 (UTC)

chicagofabulous

A Flickr user of this name is in the untrusted user list but this image was uploaded here and survived the Flickrreview bot check. Please investigate. Maybe the bot's listed of untrusted users needs an update. --Denniss (talk) 19:47, 29 June 2011 (UTC)

46377539@N06 is already in the list at User:FlickreviewR/bad-authors. A serious problem indeed. – Adrignola talk 20:05, 29 June 2011 (UTC)
I can't see the deleted revisions of the file, but PaulditoCujo (who uploaded the file) has an interest in George Eads, and forging review tags is the M.O. of sockpuppeteer and obsessive George Eads aficionado Paulinho15... well, I'd take another look at the actual file history just to make sure. LX (talk, contribs) 20:57, 29 June 2011 (UTC)
The review tag was placed by the Flickr review bot, so it wasn't forged. But it shouldn't have validated because "chicagofabulous" has an underlying ID that's already in the list of bad authors. This was retrieved using http://idgettr.com. – Adrignola talk 21:25, 29 June 2011 (UTC)
Does FlickreviewR look up the numerical ID when given a URL with just a username in it? User:FlickreviewR says that the source code is available at https://jira.toolserver.org/browse/bryan/flickreviewr fisheye, but it's not. LX (talk, contribs) 22:17, 29 June 2011 (UTC)
I tried to send an email to the bot's operator, Bryan. Open source it is not. – Adrignola talk 00:09, 30 June 2011 (UTC)
Any update on this? Just stumbled across another positive review File:Adriana Lima - Modelo brasileira.jpg. --Denniss (talk) 23:33, 30 July 2011 (UTC)
