Possible Copyright Violation

Hi there, I recently saw you marked my 2 images (Penumbra Necrologue OST Albumart.jpg, and Necrologuecover.jpg) as a possible copyright violation. I am the owner of both files, and even created the "Penumbra Necrologue OST Albumart.jpg" myself. These images belong to the modding group that i'm a part of. I will undelete both files.

Can you please explain to me what is right process of removing warnigs? Because I have added information, that your colleagues seemed to be right to be added to files. Should I wait until one of you decides to look at my page and validate, that those changes are sufficient and deletes them on your own?

Problem with permission

Hello Motopark, where is the problem with that file? I know, there has been no permission sended to the official e-mail-adress, but the author gave me the permission to upload the file with this licence, as you can see here. Isn ´t this enough? About images in Spanish Wikipedia article about Rock in Spain

Hello, Motorpark. All the pictures uploaded in the article Rock en España (in spanish Wikipedia) are Public Domain. According to the Spanish Copyright Law, a mere picture (non-artistic image, as a concert or a snapshot) is public domain after 25 years of its creation. Article 128. Title V. Law from April 12 1996. All the images I uploaded are Spanish and they have been taken before 1990, therefore, they are Public Domain. I'd written the text (in spanish) of the Spanish Copyright Law. I repeat it:

Dominio público según la Ley de Propiedad Intelectual española 1/96 de 12 de abril. Título V, artículo 128 "De las meras fotografías"

Texto artículo 128, Título V de la Ley de Propiedad Intelectual Española:

"Protección de las meras fotografías:

Artículo 128. De las meras fotografías

Quien realice una fotografía u otra reproducción obtenida por procedimiento análogo a aquélla, cuando ni una ni otra tengan el carácter de obras protegidas en el Libro I, goza del derecho exclusivo de autorizar su reproducción, distribución y comunicación pública, en los mismos términos reconocidos en la presente Ley a los autores de obras fotográficas.

Este derecho tendrá una duración de veinticinco años computados desde el día 1 de enero del año siguiente a la fecha de realización de la fotografía o reproducción."

I repeat: The Spanish Law says that all that pictures don't need permission because all of they are more of 25 years old and are Public Domain ( http://www.boe.es/boe/dias/2014/11/05/pdfs/BOE-A-2014-11404.pdf and https://www.boe.es/diario_boe/txt.php?id=BOE-A-1996-8930 ). The Spanish Law text is the own persmission. In fact, I can't upload pictures for the following sections in article (Spanish Rock in 90's, 2000's, etc) because the law doesn't allow me (the possible pictures of the bands of this era are shot after 1990, so they aren't older than 25). And I respect the law and the rules of Wikimedia Commons. But, I insist: Every picture I've uploaed in the article till now are shot before 1990).

Hi Moorpark, I got your mail about my picture of Kimmie Rhodes. (Kimmie Rhodes.jpg. As I wrote I got this one personally by Kimmie Rhodes, who had a photographer. She paid this photographer to take this picture. On the same photosessions there were taken a lot of pictures, which were used for the CD "Covers", issued by Kimmie. I did send a mail, where Kimmie exactly wrote this, so I think I have the permission to use this picture here at Wikipedia. So there is not a problem with the permission, only a problem how can I prove that to Wikipedia. Please help me with that, what do I have to do now. Dear Motopark,

The caricature of Kostia Vlasto was created by wikipedia:Georges Goursat (1863-1934), who signed most of his works as SEM. With SEM dying in 1934, his work is already in the public domain, which I think is the reason that I mention in the file details. I will check again.

Please, let me know if something is still ambiguous. I leave it to you to delete the source and copyright tags from the file.

Yordas Cave Gallery marked for Speedy Deletion

The more I use Wikipedia, the less I understand it. I wrote an article on Yordas Cave, and then looked for photographs on Wikimedia to illustrate it. I select one, and then create a gallery for them all so that I can link to them from the article. I am then told that the Gallery is "out of scope", and is marked for speedy deletion. What have I done wrong? What should I have done?

Moreover, I wasn't notified that a speedy deletion notice had been slapped on the gallery, meaning that the link in the Yordas Cave article would suddenly have become incorrect. It appears that Langcliffe had created a gallery but the images were added to Category:Yordas Cave instead. You can have both a category and a gallery but just be aware of the difference between the two. Can you tell me why did you deleted the file? It's a CAPTION from Public TV in Argentina, which I personally made with my computer. It's PUBLIC!!! A public image edited by myself. So, I don't understand the deal with it. Did somebody called blaming about it? I don`t think so, because it's public. May be I've mistaken the license, I should have used PD-AR-Gov. Can it be restored? I'm getting a little tired of getting files deleted, I'm trying to do the best work for Wikipedia and learning from it, you can check my contributions. But if somebody can delete something so easily without taking any care, I'll feel no longer involved with this project. Could you please, explain why did you request permission for images covered by (IMO) valid Crown Copyright and marked as such? :

As I know Crown Copyright is a valid "license" for Wikimedia Commons. Or am I missing something? I can't guess how could expect that the "Crown Copyright" owner would send us an extra permission. If you doubt it is really "Crown Copyright", then you should provide information why you doubt. A DR is a good way to do it. Or a clear explanation on uploader page.

Please note, that current OTRS backlog is about 2.5 month and each day longer. So requesting users to contact there especially without a valid reason is just oppressive and disrespectful to them, against wiki rules and such actions make bad PR to Wikimedia Commons.

Copyright violation for outdated SRS Software??

I created category:Events in Salo and put Alex Ojasti and Maki Kolehmainen there. If they do not live in salo (do tehey???) but only were performing in a concert that took place in Salo, then more exact category probably would be Category:Events in Salo, or whatever, but not in any case without any clarifying explanations directly in the main category, especially when the Category:People of Salo is there for those who happen to live in Salo.

Galery deletion

Thanks for deleting the gallery in [7]
I intended to create a Category, not a Gallery and I couldn't delete it.
I just think the message you posted in my talk page was little understandable, because it was not outside the scope of anything, it was simply an empty gallery waiting for photos (but as it wasn't my idea and I couldn't delete it, I left it like how it was). Also, as a standard message, it's not useful for every case, so you should consider to write specific things for each situation.

John Robert Brown

Well you found that one so quickly (within minutes, while I was still setting things up!). Anyway I have now done it properly via a Creator template and added the five images that were already on Commons to that sub-cat. I note your comment about text on the page. He doesn't have a Wikipedia page etc yet which is why it was added to the page as very brief notes, so I've moved them for the moment to the Talk page (but I have noticed there are loads of categories - see Category:Herbert Railton in same English Illustrators cat - where people have done this so I thought it would be OK). I have removed the 'speedy' tags for the moment as it now all looks in order but I suspect that might not the right way to do things. I couldn't find quickly enough a way to achieve this. If for whatever reasons my request for using this image designed by me and publishing it in Wikipedia under free license has not been approved, can I know why not and how can I correct this situation to comply with your demands? That particular image is for publishing in Russian version of Wikipedia only.

An intervenor deleted confusing it with "Saint Jean Baptiste church in Yaroslavl". These are two different churches and map and geographical coordinates prove it. But they are similar and St John Chrysostom did not yet exist. Why: because we confuse them. It's my fault because of my mistakes of departure in English. In a nutshell, this says that, regarding reproducing articles from La Presse, "the Law on copyright allows people to save, upload, display, share and transmit them (newspaper articles from La Presse) freely on the Internet for educational or informative purposes." One is NOT allowed to reprint and distribute La Presse articles for personal financial gain (obviously not our case). ...thus "prohibiting multiple copying of newspaper articles for other people. Furthermore, La Presse newspaper articles may be integrated into a collection of texts and reproduced for educational and informative purposes".

I hope this helps somewhat to clarify the use of this newspaper article and other newspaper articles, (and our good faith :), articles we uploaded to contribute to users' material in the realm of the classical guitar.

I understand that there was also an issue with our highlighting certain phrases to help users save time and get to the most interesting parts of these newspaper articles. If you wish, we can upload original, un-highlighted versions, of these newspaper articles, if need be.

I noticed that you and another member on Wikimedia Commons have pended some of my Microsoft Chicago images for deletion. I know that they were screenshots of copyrighted software. I know that only free content can be uploaded here. However, this is unfair because I took those screenshots right from my very own computer. I have ISOs of Microsoft Chicago builds 58s, 81, 122, 189, and others, and I can upload them to my Google Drive and show them to you if it is at all necessary.

There are some points I'd like to make. First off, Windows 95 (and the Chicago builds) are over 20 years old now. If Microsoft or anyone else didn't want images of 20 year-old leaked builds of their software on any website, even if the person who uploaded them took them himself, then I would have noticed something a week, maybe two, after I had uploaded those images. But noooo, it took two people over nine months to do something about it. Also, I don't know whether my images looked like someone else's, or if you think I stole those images from an outside source, but I don't think it's viable that someone's tiny little images be taken off a host without asking for source. Had someone done THAT, and I would have given the info, but no one even did that.

Once again, I have the leaked builds, totally legit, and I can give you some of them if you still don't believe me.

@Perumount: the issue is not whether you personally release these screenshots, we don't doubt the authenticity of these screenshots, the issue is that you don't have permission to do distribute them the first place. That Microsoft may not care about 20 year old software is entirely irrelevant. If a photographer dies, their work doesn't suddenly become public domain because by being dead they have ceased to care. The copyright for their work lasts for 70 years after they die. The same is true for software. Until someone from Microsoft states unambiguously that they release the software, or a particular picture, under a free licence, we will not allow it on Commons. -mattbuck (Talk) 11:11, 9 October 2015 (UTC)

Hi Motopark, This picture was taken in 1872 so it is 143 years old. According to dutch law this image is completly free of copyrights. I made a picture of it inthe regional archive, so i am the owner of this picture.

I see that there is a copyright from DBDESTEM.NL This newspaper got the picture from me and could published it with my permission. Because i did research on this event (murder in 1872)

How can I make it so it is evident that it is original work?

Warnings

I didn't remove any warnings only the tutorial dialog from my talk page. I didn't see anywhere on it saying it was a warning. I removed it because I know how to edit because this is my secondary account. Either that or you are just posting a warning dialog to say not to remove the warning dialog you just posted.

I fail to see the point of just posting that unless its just general automated advice. Even so, isn't it just unnecessarily cluttering and spamming somewhat if the user hasn't actually offended?

Self promoting?

I'm confused, I see pictures of movie stars, what they are doing, and many other artists, I am sharing a story about a person and his achievements. I removed the links, what else should I do. Sorry for inconviniences, but I am agreed with that, nobody is self promoting is only introducing himself to what he does and what kind of projects he has. And why and how he uses wikipedia, I am not against copyright, but is true I've got local liscences permissions and my information inside "El Show Debe Continuar", are absolutelly truth. I can't tell something is not. Really akward if I am the creator of these projects and I studied harder inside my country along 30 years of life. Particulary issues must be taken into considerence here. Like these users I also feel confused. But I manage to repost and save a copy of the data here written. I need theroical accesses and I can't upload media I have it on youtube already uploaded. Just try to understand these issues and of course I use english thanks to several years of dedication and study, also bachellor secondary degrees locally. The main text you're seeing are my really issues of familiar members story. Which I am more than authorized to use it on projects such as introduce to others. Why not?. I want explanations here.

Reading your talk page and... commenting on your reports

Dear Motopark, I am surprised of what you 've done so far. I really don't understand why on earth you report every single file you find without copyright reference. There is no doubt that files must have a reference, but if an upload is owned by the uploader without the need to provide special ownership or it's about a public reference (like my case) I find it really stupid to report though. Scrolling down your talk page I've read lots of no copyright provided reports which makes me think of: "DO YOU READ DESCRIPTION AND OTHER RELATED INFORMATION ON A FILE PAGE BEFORE REPORTING FOR NO COPYRIGHT??????????????"

If you think you can help Wikipedia and other projects having this reaction on files uploaded, then I have no reason trying to contribute so as many other users. Furthermore, I think you must pay a visit on the updated page of my upload which you've sent to rubbish (because probably you don't like) and its' nomination page.

Rude behavior

I just find it very rude of you to make modifications or to request deletion of someone's profile page without consulting with them first. Why not send a message to them for more information before making such changes or requests? You know we are not robots. Reviewing the other comments on your page it seems like this is one of your bad habits. Trolling someone's page is not courteous at all and goes against the spirit of this website. Please be courteous to the users on this website as we all have something to add here. Thanks again and I hope I see better conduct out of you in the future. Ultra vires deletion of public domain images

Dear Motopark - I see that you are systematically deleting all the images which I have uploaded, so it would appear to me that I am doing something wrong in the process of uploading. All the images I have uploaded are in the public domain whether by virtue of being coats of arms, a publicly-licensed logo (in the case of the CPA - for use worldwide) and of course the photos of British public parliamentary representatives whose images are put on the UK Parliament website the whole purpose of being available for use elsewhere. I can go into chapter and verse on these matters if required, but should this not be necessary, please advise how to remedy any problems. If the source is stated to be {own}, the {no source} tag cannot be applied. You need to file a regular DR if you doubt the work to be own work. I respectfully don't understand why you wish to delete these image(s):

They are images taken of a public mural in a public space (a public library). This is made clear in the description.

The ORTS page states "The number of active Commons OTRS volunteers is quite small in relation to the number of emails received. The current backlog for tickets in English is approximately 50 days, so apologies for the delay. Experienced Commons editors are encouraged to join our team of volunteers and improve our response times."

Since there is an approximate 50 day delay on ORTS will you please remove the 'speedy delete' to give ORTS time to respond.

Out of curiosity, are you on the ORTS team as they are asking for volunteers?

why don't you try contacting the owner of that website www.lucifer666art.com since you believe this to be a copyright infringement; I don't care if this is deleted. I own and operate www.lucifer666art.com; besides after the last 3 days or so of being a new user I have come to find that Wikipedia and Wikimedia commons are hostile environments which assertion of control and intimidation are most important in maintaining a conformist view of controlling what is posted or shared on these sites.
