Source, author, and licenses for your uploaded photos

[edit]

Davebabsmith, I noticed that you've indicated that you are the photographer and copyright owner of a number of historical photos. For example, you uploaded File:Bernard Babington Smith Cambridge Fencing Team 1928.jpg and indicated that you are the author and that you're licensing your photo under the terms of the {{Cc-by-sa-4.0}} copyright license. However, the EXIF information in the photo suggests that this is a Getty Images photo from the Planet News Archive. This photo may well be in the public domain, but if it is, you need to accurately indicate in the source field where you obtained the photo. It seems unlikely that you are the author and that you can grant a Creative Commons license for this photo. More than one of your uploaded photos seem to have this same issue — please update them with correct sources, authors, and copyright information. Without correct information you uploads may get deleted. —RP88 (talk) 01:47, 10 January 2022 (UTC)[reply]

Hi RP88 - you are correct. I purchased the photograph from Getty Images. However, UK law states that copyright for photographs taken before 1 August 1989 lasts for only 50 years (see - https://www.dacs.org.uk/latest-news/copyright-uncovered-photographs?category=For+Artists&title=N). As the photograph was taken in 1928, copyright expired in 1978 and Getty have no legal basis to claim ongoing copyright. As I bought the image from them I therefore considered my image to belong to me. I am happy to grant a Creative Commons license for this photo. Can you:
1) Confirm if you agree with my interpretation of legal status of intellectual property rights under UK law as pertaining to this image?
2) Advise me how I can grant creative commons license?
many thanks,

Thanks for uploading File:St Peter upon Cornhill church and location above London Roman Forum.jpg. I notice that the file page either doesn't contain enough information about the license or it contains contradictory information about the license, so the copyright status is unclear.

If you created this file yourself, then you must provide a valid copyright tag. For example, you can tag it with {{self|GFDL|cc-by-sa-all}} to release it under the multi-license GFDL plus Creative Commons Attribution-ShareAlike All-version license or you can tag it with {{PD-self}} to release it into the public domain. (See Commons:Copyright tags for the full list of license tags that you can use.)

If you did not create the file yourself or if it is a derivative of another work that is possibly subject to copyright protection, then you must specify where you found it (e.g. usually a link to the web page where you got it), you must provide proof that it has a license that is acceptable for Commons (e.g. usually a link to the terms of use for content from that page), and you must add an appropriate license tag. If you did not create the file yourself and the specific source and license information is not available on the web, you must obtain permission through the VRT system and follow the procedure described there.

Note that any unsourced or improperly licensed files will be deleted one week after they have been marked as lacking proper information, as described in criteria for deletion. If you have uploaded other files, please confirm that you have provided the proper information for those files, too. If you have any questions about licenses please ask at Commons:Village pump/Copyright or see our help pages. Thank you.

Pay attention to licensing
Wikimedia Commons only accepts free content: images and other media files that can be used by anyone, for any purpose.

File:Anne (Hopkins) Babington, 1615-1648, by Daniel Mytens.jpg seems to be free (or it would be proposed for deletion), but it was identified as having a wrong license. Usually, it is because a public domain image is tagged with a free license, or because the stated source or other information is not sufficient to prove the selected tag is correct. Please verify that you applied the correct license tag for this file.

If you believe this file has the correct license, please explain why on the file discussion page.
