50 years if created before 1945

en:Template:PD-NZ-50-years and the en.article Crown Copyright adds that the Crown Copyright in New Zealand can be of 50 years if the picture was produced before 1945. A new template may be needed ? Sebjarod 09:35, 16 September 2007 (UTC)[reply]

review of upgrade with non crown limits

The template needed to be ugraded to cover not just expiration of crown copyright, but other NZ copyright expirations covered in the 1994 act (ammended in 1998 to cover computer works in the class including audio and television). Some notes:

  • Format follows PD-AU. This sets precedence rules simply. For instance if a photo was taken by a crown photographer after 1944, it doesn't matter than the photographer died more than 50 years ago. The crown copyright has precedence.
  • Length. The table is now no longer than the australian PD template, but further compression is possible.
    • Removed: I have abbreviated the exceptions, eliminated the typographic case and various explanatory text in order to reduce table size. This version[1] has a fuller list.
    • Not mentioned: This does not mention commercial publication (25 years) due the complexity of qualification rules. Also omitted are special cases such as when a work was thought to be anonymous whose author is later revealed whose death is less than 50 years ago. ,
    • Ideas for further compression: Make the template refer to images only. Non image cases could be moved to a separate template since those will rarely be exercised. That would eliminate the legal bills exception line and the audio/television case.

  • example 2: author of the photo is from New Zealand and died before 1959 and firstly published his photo outside New Zealand? NO, do not apply this template
  • example 3: author of the photo is outside of New Zealand and died before 1959 and firstly published his photo in New Zealand? ???

Major revision needed

The broken links should be changed or deleted. The latest update on the NZ Copyright Law is that prepared as the LIANZA Public Document Number 1/2005, ISSN 1174-7897, and dated May 2011. According to it, there is no reservation for any works by the Crown dated 1944 or earlier or published works by the Crown after 1945. That means that the template requires a major revision in accordance with the current NZ Copyright law. I am going to do this revision. --Michael Romanov (talk) 14:54, 7 June 2011 (UTC)[reply]

In the Copyright Act 1994, there is Schedule 1: Transitional provisions and savings. It sounds like this Schedule 1 does provide certain provisions and exceptions that are qualified under the previous NZ Copyright Acts. Then, a careful consideration and revision by a person competent in laws (and especially in NZ laws) would be required. 50 years

I want to use a photograph taken by Stanley Polkinghorne Andrew. He died on 20 September 1964.
1. Can I upload it on 21 September 2014? or must I wait until 1 January 2015
2. Can I just upload it to Wikipedia right now and place the non-commercial restriction on it?

Pre-1944 images?

My understanding is that any photograph taken before 1 January 1944 had its copyright expired before the 1994 Act came into force, and so is public domain - see discussion here.

{{PD-Canada}} and {{PD-Australia}} - countries with similar provisions, 1949 and 1955 respectively - both mention this on the public domain template, but we don't seem to deal with this for New Zealand. Any reason why it's not listed? Andrew Gray (talk) 01:28, 11 November 2014 (UTC)[reply]

After having looked at a recent question, I would agree -- the 1962 act expired photographs the Jan 1 following 50 years from creation. Photos created in 1994 were set to expire on Jan 1 1995, but that is when the new copyright law took effect and extended them to 50pma. But photos from 1943 and before would have expired and not been restored, as the 1994 law appears to have been non-retroactive; it applied only to works which were still under protection of the earlier law "immediately before commencement" of the new law. Published editions

{{Edit request}} According to Copyright Act 1994, "a typographical arrangement of a published edition" will have been out of copyright after 25 years of the editions' first publication year. It should be added to reflect that, but that would also mean changing the template's Layout subpage or just adding an extra {{{#}}} in that subpage.
