RE: Copyright violations[edit]

Hi, I am indeed completely lost. I thought I followed the instruction carefully and provided all the info. I obtained the images from a public domain http://www.beijingupdates.com/. As a matter of fact, the photographer is a friend on that web site which I visit everyday. He actually shared those photos with all of us in the forum of that web site. Why do you think they are not free? By studying this picture at http://en.wikipedia.org/wiki/Image:Tianning_sita.jpg, it seems all I need to modify is changing "Permission" to "Released under the GNU Free Documentation License." Is it correct? Just as plain text or code it, which I'll need your help to do so. Your help is greatly appreciated. ----PoZoPOCO 15:40, 3 April 2008 (UTC)[reply]

For your convenience, your message is quoted below

"Hello PoZoPOCO,

You have uploaded several images that are copyright violations and you have done so despite our requests not to do so, and despite our instructions. If you do not stop uploading pictures that are not free, your account will be blocked. See Commons:Licensing for the copyright policy on the Wikimedia Commons. Please do leave me a message if you have further questions. Yuval Y § Chat § 23:47, 2 April 2008 (UTC)"

again me[edit]

Hi, it's me again. I want to know if uploading my images to flickr and select "Some rights reserved CC-BY-SA", i can upload it on commons?Srmagnetismo 01:19, 2 February 2008 (UTC)[reply]

i checked it. I uploaded this image Image:Kamael.jpg (i selected and uploaded the rights in flickr with my account). Tell me if i can upload more images like that one. If i can't, just delete it. Srmagnetismo (marquinahundry) 00:42, 4 February 2008 (UTC)[reply]

Why?[edit]

Why mi picture has been deleted and it's on english commons? I only want to link it from wikipedia. Aleix87 18:11, 4 February 2008 (UTC)[reply]

The grey text is fading on the grey background... Can you choose a different color..? Yuval Y § Chat § 22:38, 5 February 2008 (UTC)

What coulour would you like? And why? This one is only for my internal logo for portal on Czech Wikipedia. Regards -- Petr.noha 22:51, 5 February 2008 (UTC)[reply]

Since you've uploaded the image to Commons, it can be used anywhere. I suggest a blue text, anyway.. =) Yuval Y § Chat § 22:53, 5 February 2008 (UTC)[reply]

I know it can be use anywhere, but the thing is that there is Czech name either, so not sure if it's useful for anyone... The reason why I asked you is if I shall make a logo for you and what text I shall put in. I can make a logo for you and put it on Wikicommons under the name you wish. --Petr.noha 23:00, 5 February 2008 (UTC)[reply]

Even if it's for your own webpage, think about the users who'd have difficulties in viewing the text. That's why I suggested blue on grey... Yuval Y § Chat § 23:37, 5 February 2008 (UTC)[reply]

As the logo has no informational value on the Portal I don't think it should be visable so good, there is original logo of Czech Wikipedie and my green logo is only for the final design of the Portál:Lidé

What can I?[edit]

Can this image actually be uploaded to wikimedia commons any way? It doesn't fit the usual flickr licenses that is compatible with wikipedia. But is there some kind of creative-commons license I can use? Thanks. Benjwong 20:55, 22 February 2008 (UTC)[reply]

Yes. I have contacted the user already. But apparently many people (not just this user) assume this license is compatible with wikimedia commons. But it is not. I just wanted to verify, since you know this stuff well. Thanks. Benjwong 01:00, 23 February 2008 (UTC)[reply]

The image was first deleted after a deletion debate since it was a Derivative work of the Sun logo. Taking your word that you're the copyright holder of the image - the procedure is to email this release form to the OTRS system, but pay attention - if you're not willing that anyone would be able to use your image everywhere including with a caption such as "this station sux", it's better that you'd upload the image to the wikipedia as a fair use image - if your wikipedia allows that. Pardon the English response, but I am away from a Hebrew keyboard at the moment. I am a little overwhelmed with the amount of wikibureaucracy. It is hard enough for me to figure it out in the English wikipedia that I would rather not try to figure it out for the Hebrew wikipedia also. If you must remove my pictures, I understand, but I just don't know what to do in order to meet all of the regulations.
Thank you for calling this to my attention. Screen stalker 22:28, 5 March 2008 (UTC)[reply]

Hannukah souvenir sheet stamps[edit]

Greetings. Thanks for notifying me that you put a speedy delete up for Image:Hannakah joint souvenir leaf.jpg. Your concern seems to be with the MFA source of the image. However, this particular image is not subject to the MFA copyright claims because from what I understand Israeli stamps are not subject to copyright. So, would you mind withdrawing the speedy or else provide me with more info? Pls reply to my Talk. Thanks muchly. HG talk 03:10, 7 March 2008 (UTC)[reply]

Even if the postcard is free, or even pd-old (or pd-israel in that case) - the digital image belongs to MFA. If you have the actual postcard, you can scan it and tag it in any free tag you choose. Yuval Y § Chat § 12:28, 7 March 2008 (UTC)[reply]
Think of it - when you take a picture, or scan one, you own the copyrights of the digital image - which doesn't include the copyrights of the object itself. Same with MFA - they own the copyrights of the digital image. Yuval Y § Chat § 12:37, 7 March 2008 (UTC)[reply]
Well, I'm wondering if you are correct about that. There needs to be significant human creative input to be eligible for copyright at all. Otherwise, the image doesn't pass the threshold of originality. "Works must show sufficient human creativity to be eligible to copyright at all." "Photographic reproductions, as a form of derivative work, may inherit the copyright of the original work. If that artwork is in the public domain, then so is the photograph." (from WP:PD) So, just because I scan some free artwork, and upload it to the web, I don't thereby have a copyright claim to it. Plus, I don't see how Israeli agencies can copyright it's own free content. So, no, digital images of free content are not merely copyrighted. Thanks muchly, HG 13:13, 7 March 2008 (UTC)[reply]
As far as I recall, they can, and images from MFA are not allowed in the Hebrew Wikipedia, no matter how old the original images are. Please refer to he:ויקיפדיה:זכויות יוצרים/שאלות ותשובות. Yuval Y § Chat § 13:25, 7 March 2008 (UTC)[reply]

Images[edit]

Hello, I understand your concern about copyright violations, and support it fully, but I can assure you that I have the complete rights to use the images I have uploaded so far. They are from a public domain created by the artist Doctor Steel and he has expressed full rights given to me to use them for his wikipedia entry, and his sister entry for his fan-club Doctor Steels Toy Soldiers. I am technically a new wikipedia user, and do not know how to explain the pictures copyright status on the uploading page. --Aridnyk89 21:49, 28 March 2008 (UTC)[reply]

There's a procedure for that, it called OTRS. Pay attention - placing the image in Wikimedia Commons, means that anyone can do anything with those images. Are you sure that Doctor Steel allows that? If not, Please upload them to the wikipedia. Yuval Y § Chat § 22:29, 28 March 2008 (UTC)[reply]
Yes, I am absolutely positive that Doctor Steel gives me express and full rights to upload, share, and use his pictures. If you would like, I can get an email expressly from him describing these rights given to me. I thank you for your concerns. --Aridnyk89 22:35, 28 March 2008 (UTC)[reply]

Image License on Saint Sebald Church[edit]

Hi, noticed you tagged Image:Sebald cyark 4.jpg‎ that I posted to http://en.wikipedia.org/wiki/Image:Sebald_cyark_2.jpg with an Editor's summary: Warning: image missing source or licensing information. The site that I acquired the image from, www.cyark.org, is a nonprofit that has a great number of Creative Commons-licensed images that are freely usable with site attribution and share-alike license. As I am a big fan of the site, and it has a large amount of good material for suitable for wikipedia, I use its contents frequently when helping to flesh out archaeological and heritage site entries - Creative Commons material of this quality is unusual. Note open access statement at http://archive.cyark.org/about.php?subject_name=Grants and specific reference to Creative Commons licensing of images at http://archive.cyark.org/news_events.php?news_ID=12 . I took the liberty of removing the tag, if you disagree with this action please feel free to contact me on my page and we can discuss it further. Thanks for looking out for copyrighted materials... DuendeThumb 01:41, 3 April 2008 (UTC)[reply]

I marked the image on the Commons, not in the Wikipedia, as I guess you've noticed, and as for the image, it is lovely, though I haven't quite understood from the links you've added if the image is indeed free, and what about the other images from the site... Yuval Y § Chat § 10:15, 3 April 2008 (UTC):[reply]

From what I have understood, all images on the site are CC licensed, as that is part of their mission to provide free access. This quote from their representative John Loomis seems to cover the issue:

"Of equal importance to their technical accomplishments is their recognition that open access and open licensing adds value to the media documentation that they offer. The open terms of Creative Commons licenses enable users to incorporate these high-quality media items into new original works. Use of Creative Commons licenses makes sense, after all appeals to the "public interest justifies both funding and preservations laws and policies that support archaeology and historical preservation. These licenses help ensure that the members of the public can draw value and creative inspiration from the documentary record of the past."

However, as a wiki admin recently noted to me on an email, they did not provide a specific Creative Commons License under which they license their work; I will be writing them in hopes that they will provide specifics (and post them on their site, as that would be helpful to other people who might want to utilize this excellent resource). Hopefully they will write back soon, in the meantime I would greatly appreciate it if you didn't tag any more of the images for deletion, I wouldn't want to upload them all again. If it turns out that their license is invalid or they do not actually allow for CC use of such content, I will delete the images myself. Thanks! DuendeThumb 07:41, 5 April 2008 (UTC)[reply]
