Perhaps you could try and explain this to the uploader on their user talk page because they were asking about a different file at Commons:Undeletion requests/Current requests#File: Ukpong Ndifreke.jpg. A number of their other uploads are currently being discussed at DRs or have been otherwise tagged for various issues. They also seem to have been using multiple accounts to upload files. Duplicated files

Hi, thank you for taking care of these files. I think you noticed that I tagged some uploads by User:Seyed haji as duplicates and disagreed with my decision to redirect them. I feel that I should explain that the reason for these taggings was that the user tends to reduce the quality of files, as you may know .jpg files are prone to w:Lossy compression and the case with these files is that they are already low-quality (for example, please compare the 198 KB original file with this 88 KB cropped version). These unused uploads are not particularly an improvement for us because we can easily make lossless derivatives using CropTool (I have done so by overwriting their uploads when a cropped seemed useful), and secondly their messy upload style (use of w:Fingilish descriptions, naming files using Google Translate, putting wrong dates and generic licenses, instead of using templates such as Template:Tasnim with License Review) makes it very difficult to correct. Hi HeminKurdistan, we have a very strict policy regarding duplicate file handling with the template: {{Duplicate}}. It must be a an exact duplicate or scaled-down version - please see Commons:Deletion_policy#Duplicates for details. Files that have not exactly the same content (file type, color, quality, ...) are not considered as duplicate in this meaning. Possibly redundant files like in your case require a regular deletion request (DR) - feel free to start a DR (follow the process on Commons:Deletion requests).--Wdwd (talk) 20:43, 26 May 2023 (UTC)

I kept the older upload, that was my reason for the change. (Quality seems to me more or less equal, files are not exactly the same) - If you want to use the other file version, and this is also okay, I would like to suggest: Take the image from the source and upload it as a new file version - would be the easiest and has the advantage that we have both versions in the file history.--Wdwd (talk) 19:24, 28 May 2023 (UTC)

Übertragung von Bildern aus der deutschsprachigen WP nach Commons

Hallo Wdwd, wenn ich mich recht entsinne, hatte wir die Diskussion über das Verschieben der Bilder vor zwei oder drei Jahren schon mal. Ich meine mich zu entsinnen, dass wir vereinbart hatten, dass Du von mir in der deutschsprachigen WP hochgeladene Bilder nicht mehr überträgst. Ich arbeite fast ausschließlich mit mogul-indischen Buchmalreien. Die sind im Schnitt so vierhundertfünfzig Jahre alt und dürfen deshalb in der deutschsprachigen WP hochgeladen werden. Nach Commons dürfen sie nur dann, wenn sie AUSSERDEM VOR 1923 veröffentlicht wurden. So steht das in Wikipedia:Bildrechte unter 3.4.1. Pragmatische Regelung für Bilder, die älter als 120 bzw. 100 Jahre alt sind. Die allermeisten dieser Bilder sind sehr viel später als 1923 veröffentlicht worden. Deshalb dürfen sie bei Commons nicht hochgeladen werden. - Ich möchte in der deutschsprachigen WP gern mein Projekt zur indo-persischen Buchmalerei machen und bin ganz froh, wenn ich bei den verschiedenen Museen, Bibliotheken und Auktionshäusern nicht negativ auffalle, weil mein Name bei den nun auf Commons gespeicherten Bildern zu finden ist. Hi Von der Forst, ja erinnere mich. Verschiebungen Deiner Dateien habe ich in Folge auch ausgenommen, wenn doch was übertragen wurde waren das meinerseits Unachtsamkeiten/Fehler. Hast Du da einen Überblick welche Dateien (Dateinamen) das sind? btw, mit einem Alter von ~450 Jahren ist es auf commons auch behaltbar, auch wenn nicht vor 1923 veröffentlicht. Es gibt hier auf commons die pragmatische Grenze mit 120 Jahren, also etwas mehr als die 100 Jahre auf de.wp und die dafür passende Vorlage wäre {{PD-old-assumed}}. Und wenn man es ganz korrekt macht, was natürlich das Ziel ist , in Kombination mit {{PD-US-unpublished}} was dann die US-seite abdeckt. die Sachlage verändern sollte. Wenn man sich den §303 des Title 17 ansieht, auf den an dieser Stelle verwiesen wird, dann steht da:

303. Duration of copyright: Works created but not published or copyrighted before January 1, 19785

(a) Copyright in a work created before January 1, 1978, but not theretofore in the public domain or copyrighted, subsists from January 1, 1978, and endures for the term provided by section 302. Das deckt sich in etwa mit meiner bisherigen Information, dass es in den USA darauf ankommt, wann das Werk erstmalig veröffentlicht wurde. Für UK und Irland ist es ebenfalls nicht so einfach. Die Bilder sind in aller Regel mit einem Copyright versehen. Bei Commons dürfen sie nur dann hochgeladen werden, wenn sie, z.B. auch für kommerzielle Zwecke, frei verfügbar sind. Das sind sie aber nicht. Sie sind noch nichtmal für wissenschaftliche Journale ohne weiteres verwendbar.

Alles in allem stelle ich fest, dass sich die Sache nicht so leicht durchschauen lässt. Ob es möglicherweise rechtliche Regelungen gibt, die am Ende ein Hochladen bei Commons doch ermöglichen, kann ich nicht ausschließen. Ich bin bisher noch nicht davon überzeugt. Um euch aber entgegen zu kommen, schlage ich folgende Regelung vor: Ich lade die Bilder weiter nur in der deutschen WP hoch; damit fühle ich mich einigermaßen auf der sicheren Seite. Und wenn Wdwd die Bilder mit seinem Bot zu Commons zieht, ist das seine Sache. Dass mein Name daneben erscheint, nehme ich dann eben in Kauf. Hi Von der Forst, grundsätzlich habe ich kein Problem, bestimmte Dateien nicht zu transferieren bzw. wenn doch, dann auch das Duplikat auf de.wp zu belassen. Also quasi als "Gefälligkeit", das ist genauso ok. Und solche Fälle gibt es einige Beispiele, das ist nicht erstmalig so. z.B. hier File:Mechanical filter transducers.svg wo die Quelldatei en:File:Mechanical filter transducers.svg mit eigenen Template auf en.wp markiert ist, und dort explizit als Duplikat verbleiben soll weil es der Hochlader auf en.wp halt so will, warum auch immer. (meines wissen haben wir solch eine Vorlage auf de.wp dzt. gar nicht). Das ist, wenn es viele so machen, vom praktischen Standpunkt aus schon auch ein bisserl ungut, da die vielen Duplikate konsistent zu halten nicht einfach ist; Deswegen werden generell 1:1-Duplikate entfernt um den (ansich überflüssigen) Mehraufwand damit zu reduzieren.

Zu dem zweiten Punkt, der rechtlichen Seite: Ich bin auch sicher kein Profi im US-Recht sondern nur interessierter Amateur. Im Prinzip und so wie ich es erfasse hängt diese US-rechtliche Seite mit der Veröffentlichung bzw. in diesem Fall der Nichtveröffentlichung zusammen, da das US-Recht mit seinen Schutzfristen sehr deutlich an das (erstmalige) Veröffentlichungsdatum gebunden ist. Wenn es also glaubhaft bzw. hinreichend sicher dargestellt ist, dass diese von Dir hier hochgeladenen Bilddateien nicht vor diesem Datum (imo, diese Grenze verschiebt sich) veröffentlicht worden sind, erfüllen Deine Dateien sogar alle drei Kriterien aus der Vorlage {{PD-US-unpublished}}. Hallo Wdwd, zu Punkt 1) Also wie schon gesagt, wenn du die Dateien transferieren und dann in der de.wp löschen willst, kannst du das machen. Soweit ich sehe, bleiben die Namen für die Bilder ja dieselben, so dass ich in meinen Artikeln nichts verändern muss. Aber: ich war's nicht; ich habe die Bilder nicht bei Commons reingestellt. Zu Punkt 2) Ich halte mich an die Leitlinie von WM Commons: "Wir können keine Bilder akzeptieren, die nicht frei lizenziert oder eindeutig gemeinfrei sind – die meisten Bilder aus dem Internet sind nicht frei lizenziert." Commons:Erste Schritte/Dateien hochladen So ist es leider. Das PD-US-unpublished Template nützt meiner Meinung hier nichts. Die Bilder sind in UK nicht frei lizenziert, weil sie erst spät (teils vor teils nach 2003) veröffentlicht wurden. Und da das Wikipedia:Schutzlandprinzip angewendet werden muss, sind sie damit nicht bei Commons hochladbar. Wenn mir irgendwann ein sachkundiger Jurist glaubwürdig versichert, dass meine Bilder unbesorgt bei Commons hochgeladen werden dürfen, dann freue ich mich. Bis dahin setze ich die Bilder nur in die de.wp. Ich komme dir und Leyo also insofern weit entgegen, als ich mich nicht länger strikt gegen deinen Bot wehre und nehme in Kauf, dass mein Name dann die m.M. nach nicht rechtmäßig hochgeladenen Dateien begleitet, nehme mir aber weiter die Freiheit, Bilder nur in die de.wp zu laden. Hi Butch,do you mean File:ATR-switch.jpg? If so: you are already mention as the author of this photo, so I see no problem in this specific point. I removed the euro-coin (used to measured the object) from this image, nothing more. According to the file log, see here, User:Fastily deleted afterwards the first file version (your upload). I'm not sure why, maybe you can ask him directly. See also this related deletion request which was decided to kept the files or file versions.
