Image copyright issues[edit]

You may not use a copyright template for "life plus 70 years or fewer" without knowing the author's date of death. Many WWI photographs are still copyright in Germany because of this rule, so there is absolutely no way we can assume a 1933 image is OK. Buidhe (talk) 04:25, 5 April 2024 (UTC)[reply]

Oh, okay! Can you let me know where I'm misinterpreting this? https://commons.wikimedia.org/wiki/Commons:Copyright_rules_by_territory/Germany
"Anonymous and pseudonymous works" section is what I was basing it off of, I assumed since the image's author is pseudonymous that should apply. Wasianpower (talk) 04:33, 5 April 2024 (UTC)[reply]
I also just updated copyright template on the image -- I realized I had used the wrong one before. I'm not sure if that fixes anything or not, just wanted to let you know. (Apologies if I inadvertently violated any copyright rules, that was absolutely not my intention) Wasianpower (talk) 04:38, 5 April 2024 (UTC)[reply]
Hi Wasianpower, unfortunately the expiration for anonymous photographs is based on the publication date, not the creation date. The current tag that you placed on the article asserts that it was "published in Germany before... January 1, 1966. It does not indicate its author and was published by a legal entity under public law". There is no evidence I see that the photograph was published before 1966 (the creation date was 1933... but for all we know it could have been sitting unpublished in an archive into the 21st century) or that it was published by a "legal entity under public law".
Please don't be dismayed—Image copyright is hard to get right and it's unlikely that anyone will be sued over this image. I'm happy to answer questions if there are any other images you'd like to upload. Buidhe (talk) 08:05, 5 April 2024 (UTC)[reply]
Got it, thank you for the explanation. I had assumed it had been published, but in hindsight that is obviously not a safe assumption. Is the procedure from here to delete the image? Wasianpower (talk) 16:43, 5 April 2024 (UTC)[reply]
File:Former Eldorado nightclub in Berlin, 5 March 1933.png has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!
