Meaning of "own work"[edit]

Hi S Tallim. I strongly suggest that you carefully read through Commons:Licensing and Commons:2D copying. before you upload any more files because you seem to have some seriously misunderstanding about the meaning of "own work" and "copyright". The term "own work" means that you're the original creator of the work; it doesn't mean you uploaded or scan an image taken or published by someone else. You cannot upload scans of photos found in newspapers or other print publications unless you are are original publisher of the publication. It makes no difference as to whether you possess a physical copy of the publication; you need to actually be the publisher who owns the copyright on the publication. Same goes for photos taken by another person. These aren't you're own work and you can't upload them to Commons unless you follow the instruction given here. You continue to upload files with questionable licensing even after being mildly warned not to do so above by Jeff G. Commons understands the people uploading files occasionally make mistakes and is will to overlook a mistake once maybe even twice; however, editors who continue to repeat the same mistakes over and over again usually end up being blocked by a Commons administrator. So, if you don't want that to happen to you, I suggest you ask for help at Commons:Village pump/Copyright before uploading any more files unless you're 100% sure that it's an original photo that you've taken yourself and not just a photo or scan of someone else's work. -- Marchjuly (talk) 22:14, 4 April 2021 (UTC)[reply]

I will try to answer questions raised about various uploaded files. I readily admit I am not very conversant with copyright laws. I believe that a photographer hired by any institute is an agent and cannot hold a copyright of picture taken. I also believe that an institute that holds a public event (e.g. medal presentation) and has a picture taken has the event in public domain. All material (photos and documents) were furnished by Bhupinder Singh Mahal at my request. Now here is my response to the various files that were uploaded: 1. File: Bhupinder Singh Mahal.jpg – This photo was taken by Bhupinder Mahal’s spouse, Suneeta Mahal during one of their travels. 2. File: Queen’s Golden Jubilee Medal award 2003.jpeg – This picture was taken by Bhupinder Mahal’s spouse, Suneeta Mahal at the award ceremony. 3. File tagging: Hamilton CCAC Board.jpg – This is a group photo of Directors of Hamilton CCAC Board published in the local paper that became insolvent around 2012 and is no longer in publication. 4. File tagging: Multicultural Committee 1.jpg – This was a group photo of the 37 members appointed to the Canadian Multiculturalism Advisory Committee (CMAC) taken at the behest of the Chairperson Dr. Karen Mock and was published in CMAC’s bulletin published for general release to the public. The committee had an 8-year mandate and was dissolved at the expiry of its mandate. CMAC no longer exists. 5. File Tagging: College of Physiotherapists of Ontario Council Award 2002.jpg – This picture was taken at the Annual General meeting of the College that was open to general public. The picture was published in the College’s annual report that was generally released to the public. Mr. Mahal could ask the College for permission to publish it if you so desire. 6. File: Chairperson Board of Referees.jpg – This is a Governor-General’s appointment letter given to Bhupinder Singh Mahal, as is indicated in the document. It is like a diploma that, for example, an MD hangs in his office. 7. File tagging: Medal recipients.jpg – This was a picture taken at a public event held by the authorities awarding medals to selected members of the community for services rendered to the community. It was published in the local community paper in Brampton that is no longer in print as of 2009.

Hi S Tallim. A couple of things.
  1. Please try to remember to login into your account when you post on either Wikipedia or Commons. This will make it clear to others that it's the same person (or at least the same account) that is discussing things, and it will also stop your IP address from being publically visible in your posts and in page histories.
  2. Wikipedia and Commons are part of the same family, but they are different projects with their own policies and guidelines. There are lots of similarities between the two projects, but there are also some big differences. The notifications you've received on this talk page have to do with files you've uploaded to Commons; so, if you want to discuss issues you're having on Wikipedia, please do so there.
  3. Please take a look at the #Meaning of "own work" post I left above because I think it explains some of the reasons why the files you've uploaded so far have been flagged for review.
  4. If you upload a copy or scan of a photo or work created by another person, then that person is most likely going to be considered the copyright holder. Please follow the instructions given in COM:OTRS#If you are NOT the copyright holder in such cases.
  5. If you want to upload your own original photos or content, then please carefully take a look at COM:L, COM:CONSENT and COM:LRV to make sure you understand what it means to upload your own original content.
  6. If you want to upload your own original photos or content but this content has previously been published online (e,g. personal website, social media account) or in some other type of print publication (e.g. newspaper, magazine), then please follow the instructions given in COM:OTRS#Licensing images: when do I contact OTRS?.
  7. The term public domain has a special meaning when it comes to copyright law; it doesn't necessarily mean available free of charge to the public or something presented at a public event. Even when photos are taken at a public event, the copyright of the photos would most likely still belong to the photographer unless they transferred their copyright ownership to another party or there's some reason why the photos aren't eligible for copyright. Even if the photographer is no longer living or the newspaper or organization which commissioned the photo is no longer in existence, the photo might still be under copyright. Copyright laws can vary quite a bit from country to country, but generally it's best to assume something is copyrighted unless it can clearly be demonstrated otherwise.
  8. A diploma, award certificate, etc. might seem like nothing more that some text and images, but some of the elements (including the layout) might be eligible for copyright protection; simply possessing a physical copy of it doesn't mean that any copyright over its content is automatically transferred to the recipient. This means that it can't automatically be assumed that the a photo or scan of the photo is OK to upload to Commons per COM:2D copying.
As I posted above, copyright laws can vary from country to country. Commons is really only concerned about the copyright status of the content it hosts in two places: the United States (because that's where the Commons servers are located) and the country of origin (because that where the content was generated and the country whose copyright laws are applicable). So, for Commons to keep a file, it need to be 100% freely licensed or within the public domain in both the United States and its country of origin. Moreover, sometimes verifiable proof needs to be provided to ascertain this; in other words, simply saying that something isn't protected by copyright or that the copyright holder said it was OK to upload their work often isn't enough per COM:PCP.
If you've got any additional questions about a particular file, you're not sure whether something you want to upload might be protected by copyright or you just want to get the opinions of others, then you can ask for help at COM:VPC. What you need to try avoid doing is simply re-uploading files which have been previously deleted or re-uploading the same file under different names with different descriptions or copyright licenses because that might be seen by a Commons administrator as an attempt to get around Commons policy. If a file is deleted, it's not gone forever and can be restored by a Commons administrator once its licensing issues have been resolved; so, it's much better to try and resolve existing file issues first than to create new issues by uploading new files or new versions of the same file under different names. -- Marchjuly (talk) 23:18, 5 April 2021 (UTC)[reply]

I was away during Easter holidays. On my return I saw a number of communications from you. I will shortly try to respond to them. Meanwhile, I express my deepest and sincerest apologies if I have in any way or form wronged and violated Wikipedia policies. I will try to answer questions raised about various uploaded files. I readily admit I am not very conversant with copyright laws. I believe that a photographer hired by any institute is an agent and cannot hold a copyright of picture taken. I also believe that an institute that holds a public event (e.g. medal presentation) and has a picture taken has the event in public domain. All material (photos and documents) were furnished by Bhupinder Singh Mahal at my request. Now here is my response to the various files that were uploaded: 1. File: Bhupinder Singh Mahal.jpg – This photo was taken by Bhupinder Mahal’s spouse, Suneeta Mahal during one of their travels. 2. File: Queen’s Golden Jubilee Medal award 2003.jpeg – This picture was taken by Bhupinder Mahal’s spouse, Suneeta Mahal at the award ceremony. 3. File tagging: Hamilton CCAC Board.jpg – This is a group photo of Directors of Hamilton CCAC Board published in the local paper that became insolvent around 2012 and is no longer in publication. 4. File tagging: Multicultural Committee 1.jpg – This was a group photo of the 37 members appointed to the Canadian Multiculturalism Advisory Committee (CMAC) taken at the behest of the Chairperson Dr. Karen Mock and was published in CMAC’s bulletin published for general release to the public. The committee had an 8-year mandate and was dissolved at the expiry of its mandate. CMAC no longer exists. 5. File Tagging: College of Physiotherapists of Ontario Council Award 2002.jpg – This picture was taken at the Annual General meeting of the College that was open to general public. The picture was published in the College’s annual report that was generally released to the public. Mr. Mahal could ask the College for permission to publish it if you so desire. 6. File: Chairperson Board of Referees.jpg – This is a Governor-General’s appointment letter given to Bhupinder Singh Mahal, as is indicated in the document. It is like a diploma that, for example, an MD hangs in his office. 7. File tagging: Medal recipients.jpg – This was a picture taken at a public event held by the authorities awarding medals to selected members of the community for services rendered to the community. It was published in the local community paper in Brampton that is no longer in print as of 2009.

Please guide me as to what needs to be done. I am sorry if I have wronged Wikipedia in any way or form. I am simply ignorant of legal implications of publishing photos. I am 88 and frail. I thank you for your indulgence. S Tallim 70.51.132.168 15:01, 5 April 2021 (UTC)[reply]

Your image or other content was recently deleted, or will soon be deleted, in accordance with our process and policies, because it was not, or is not, within our scope. Please review our project scope, but in short, Commons is targeted at educational media files including photographs, diagrams, animations, music, spoken text and video clips. The expression “educational” is to be understood according to its broad meaning of “providing knowledge; instructional or informative”. Wikimedia Commons does not contain text articles like encyclopedia articles, textbooks, news, word definitions and such. Each of these other kinds of content have their own projects: Wikipedia, Wikibooks, Wikisource, Wikinews, Wiktionary and Wikiquote. If the content seems to fit the scope of one of those other projects, please consider contributing it there. Otherwise, consider an alternative outlet. If you think that the deletion was in error because the contribution really was in scope, you can appeal it at Commons:Undeletion requests, giving a reason why it fits our scope to help others evaluate the matter.
