File importing[edit]

Hello, I saw you've been transferring several images I've uploaded to en.wiki here to Commons. Can you explain why you ignored this note? Parsecboy (talk) 11:43, 8 September 2023 (UTC)[reply]

Bonjour,
An image published under PD US license may have an import restriction on commons? S. DÉNIEL (talk) 12:24, 8 September 2023 (UTC)[reply]
Yes, if it's not the country of origin. On Commons, images must PD in the US and the country of origin (if different). Since that illustration was first published in a British newspaper, we need to be able to establish the copyright status in the UK. Parsecboy (talk) 13:15, 8 September 2023 (UTC)[reply]
sorry, I thought US law was more restrictive than UK law. S. DÉNIEL (talk) 13:53, 8 September 2023 (UTC)[reply]
In some ways, yes, it is, but in other ways, it's less restrictive. For example, anything published (anywhere in the world) before 1928 is automatically PD in the US, while that work might still well be copyrighted in the UK (say a 20-year-old photographer published a photo in the UK in 1927 and lived another 60 years - that photo would be public domain in the US, but would still be copyrighted in the UK until 2057).
I've since learned of Commons' consensus to adopt {{PD-old-assumed-expired}}, which basically means there's a reasonable basis to assume anything that was created more than 120 years ago is in the public domain, so this one is probably fine. Parsecboy (talk) 15:23, 8 September 2023 (UTC)[reply]
Ok, thank you for this information. S. DÉNIEL (talk) 15:27, 8 September 2023 (UTC)[reply]

Claxton Ray Photographs[edit]

I noticed you had relabelled and created a Cat for ˞˞Category: Claxton Ray Photography It is mainly of Brest france in WWII I have updated it to include most of his CATː photographs. Where are the originals from which you relabelled. There are about 600 negatives at memorial University Archives Category: Photographs of Brest (France) in Memorial University Archives in St. John's Newfoundland I think it would be better and benificial if you changed the name to Claxton Ray photographs of WW II and Korean War in Memorial University Archives in St. John's Newfoundland or something similar and more inclusive. Then I can copy all of his images there. Just a suggestion. Thanks. photoarchives.ca has the original scans and updated photo editing of them as well.

Bonjour,
This is not a good way to use categories. This modification is not correct: a "source + location" category can not be classified by author. Are you a new contributor? do you work for an institution?
PS: please add signature. Merci --S. DÉNIEL (talk) 08:28, 10 September 2023 (UTC)[reply]
Please, @Photo Archives, follow the discussions you start. You make changes without taking into account the rules in force. It is customary not to continue to edit a topic that is being discussed. S. DÉNIEL (talk) 07:09, 13 September 2023 (UTC)[reply]
Hi I didn't know there was a discussion going on. These are my business partner's father's photographs and all 600 negatives are at Memorial University so I logically connected the page you did with his Cat you also created. I try to add signature "photo archives" but it didn't show up.I thought you were unaware of his other Cat's re WWII that were put up between 2010 & 2016 so I connected them as well. Steve Fraser photoarchives.ca. All or most of his images are where you found the link Changed to the search word on archive.org = photoarchives.ca originally under HMS Press
https://archive.org/details/@photoarchives_ca is our photo collection and the WWII etc photo collections ̃ Photo Archives (talk) 15:55, 14 September 2023 (UTC)[reply]
@Photo Archives, When we leave a message on a user's talk page, it is to exchange questions and answers. Discussions are used to find together the best way to do the work.
As you seem to be a newbie, I want to inform you that you are not following the community guidelines. You have to learn the rules and follow them, thank you : read Help.
You act like you know what you're doing, but you don't. this attitude is not appreciated on the commons.
In doubt, the best practice is to ask before making the change (especially for a beginner).
You've made a lot of mistakes. Do you want to fix them? S. DÉNIEL (talk) 17:26, 14 September 2023 (UTC)[reply]
Sure let me know what and where? I am new but i thought I was placing like minded Cat's together? Quest que c'est je desire a fait? ̃ Photo Archives (talk) 18:23, 14 September 2023 (UTC)[reply]
@Photo Archives, As it is complicated I suggest you proceed in several steps.
first: license.
Generally, American soldiers in operation have the "moral right" of their photos but it is the American army which has the reproduction rights. The US army systematically put photos in the public domain. For all photos when Ray took photos during his work for army the license {{cc-zero}} is not correct it must be replaced by {{PD-USGov-Military-Army}}.
for photos that are not taken during work for Us army: you must respect the author. As you are not the author you do not have the right to use the {{cc-zero}} license. You need to replace {{cc-zero}} with {{cc-by-4.0}}. You need to do the same thing at https://archive.org.--S. DÉNIEL (talk) 06:36, 15 September 2023 (UTC)[reply]
˞˞File:360th WWII France misc 028.jpg is a test. I have put both of the License suggestions there. So if I read you correctly, this and similar photos should be with the PD-USGov-Military-Army ? And personal pics during the same time period but not military should be the cc-by-4.0 OK it wioll take some time but I will endeavour to correct all of them. Similarly tho and probably petty but if he took a candid war photo and was just his personal pic, it still falls into the PD-USGov-Military-Army license listing? Merci bien. ̃ Photo Archives (talk) 15:38, 18 September 2023 (UTC)[reply]
Ok have re-licensed under 100 images. Still working on it Mercĩ Photo Archives (talk) 18:18, 18 September 2023 (UTC)[reply]
@Photo Archives, 360th Second World War France misc 028.jpg: A photo cannot have two licenses. In my opinion, all the photos taken in his free time while he was in the army are personal work (photos with civilians, soldiers without uniforms, leisure activities, etc.)--S. DÉNIEL (talk) 07:09, 20 September 2023 (UTC).[reply]
As I said it was a test image for the licensing. I will remove one of them, merci. Photo Archives (talk) 15:29, 20 September 2023 (UTC)[reply]
Step Two: Author
@Photo Archives, The author is always the person who took the photo, made the drawing... An institution cannot be an author because an institution cannot have moral rights. the family beneficiaries (Wayne Ray) cannot replace the author. The author is Claxton Ray. To make the work easier, I created a template to put in front of the author={{Creator:Claxton Ray}}.--S. DÉNIEL (talk) 08:44, 21 September 2023 (UTC)[reply]
OK great. I have been mislead for a long time about photos , I see your point and I think I have done the right thing but I was wrongly told he who owns the negatives, owns the photo (Rights). I will be more careful in the future. ̃ Photo Archives (talk) 15:50, 21 September 2023 (UTC)[reply]
No, authorship of a work is inalienable (no time limit, and for all countries). The owner of the negatives is a source. For reproduction rights, it's different.
The claxton heir has the rights for 70 years after his father's death. It is he who can decide to publish in CC-BY (except for US Army photographs). S. DÉNIEL (talk) 16:15, 21 September 2023 (UTC)[reply]
OK that clears it up for me. Thanks for all your help. Mon francais c'est pauvre j'ecrit en englais . merci.̃ Photo Archives (talk) 16:25, 21 September 2023 (UTC)[reply]
