Banyan[edit]

Hi ! I took the picture mentioned and I know for sure that the tree in question is not a Banyan (Ficus bengalensis) or even one of the related species. It is one of the strangler figs of the Western Ghats and although I might be able to find the approximate group in due time. It would be best to treat all common names with caution as they are often used for a variety of species that only botanists may be able to distinguish and even that only in flower. Hello,

I create categories only when we need them. However, I agree with you: categorizing pictures according to regions of Africa doesn't help browsing, so Category:Markets in North Africa is useless at the moment.

Notice also that Category:North Africa is a category for a region of Africa, and Category:Middle East is a category for a region of Asia. --Juiced lemon 09:03, 30 May 2007 (UTC)[reply]

Hi there. I see your point. However, I also note that the caption does state, "Photo is circa 1989 and was set up for a local newspaper photo shoot" [my emphasis], not that it was taken by the newspaper. It's possible that Alan Light also took (or someone else took for him) a second photo at the same time as the newspaper took theirs, over which he owns copyright. I suppose it's a bit difficult to determine which is the case, although Alan Light does seem to respond to queries quite quickly. I don't have a flickr account to contact him though. I would like to ask you to restore Image:Antanas-Zmuidzinavicius-1954-01-namie.jpg. This is a old photo of famous Lithuanian painter. This copy comes from my family archive. We are ready to publish it under GNU FDL. (Probably it is already PD because of oldness.)

Hello, the image description states that the image is from 1954. As {{PD-old}} states, copyright expires 70 years after the death of the copyright holder, in this case the photographer. As the photographer clearly did not die before 1937, it is not in the public domain. The next step is to figure out the identity of the photographer and who holds the copyright. If the photographer was, for example, your grandfather and you, on behalf of his estate, wish to put the photo into the GFDL, that would probably be acceptable. If, for example, a family member bought this photograph, then you and your family have no rights to the image and cannot release it under a free license. I hope that clarifies what is needed. Regarding Malabar Whistling Thrush[edit]

Kindly note that Image:Malabar_Whistling_Thrush.jpg is the properly named duplicate of the earlier photo named Image:Malabarwthrust.jpg. Here you replaced the img with the proper name with the older one. I wanted to let you know so that Image:Malabarwthrust.jpg be deleted. The newer one seems to have been deleted instead! I noticed you deleted this image and I was wanting to know why.
The comments by User:Vanjagenije and User:VIGNERON said that it wasn’t a breach of copyright, even in Alderney, and looking at the section quoted by User:Killiondude I can’t see how this applies. The reference to 2 D images only applies to graphic works; this is a memorial plaque, which should be a work of artistic craftsmanship. It’s debatable whether it is even only 2 D seeing as it is metalwork with raised type (like bas relief)

Y'know, in the course of writing a long post, which I've commented out so it's visible in the edit window here, about how this falls between the criteria for braindead required for {{PD-text}} and "artistic craftsmanship" required for UK-FOP, I convinced myself that the plaque could fall under "artistic craftsmanship" if someone in the discussion had made that argument. Given that plaques haven't come up in the courts and I don't have firm guidance, I'm going to reverse myself though it's still a bit of toss-up in my mind. I don’t know a lot about copyright law; I suppose I’m surprised that things in public like hoardings could be copyrighted in the UK, just because they are 2D. And does this apply to things like road signs? Murals? Street names? We’ve got all of them in Commons...
On the subject of authorship ( I read your mull!) wouldn’t that require someone to assert authorship? Put their name on it, for example?
On the difference between a graphic work and a piece of craftsmanship, I was attracted to the idea that a metal plaque had more in common with a piece of ironwork than a poster, and I also thought the raised surface would take it out of the category anyway (as with “fabrics with a highly textured surface including 3D elements”)
On a more pragmatic note, doesn’t copyright only become an issue if someone tries to appropriate the ownership; say, to make money out of it? And doesn’t the fault then lie with the person who takes it? As far as WP goes, isn’t its responsibility limited, the same as any other internet host? If I put an image in Commons, I’m asked about the copyright. If I make a false or incorrect statement, isn’t that my lookout? Isn’t WP’s liability only if it fails to act on a complaint? You actually state the ambiguity. You think it involves artistic craftsmanship, which would make it copyrightable. The reason FOP exists is to allow people to take pictures of copyrighted works on display display. If it was not copyrightable, and I think we both agree a roadsign saying "Airport next right" is not copyrightable as involving no creativity whatsoever, then FOP would be irrelevant. My initial impression was that these plaques were mass produced, and thus not works of "artistic craftsmanship" and therefore don't fall under FOP, but I can't be sure about the "artistic craftsmanship" involved and so erred towards keeping it, under FOP. Of course, I could be wrong either way. Copyright is often baffling.
As your latter point, I have two points. The first is that the start of a deletion discussion is "a complaint", so we're under some pressure to come up with a decision that isn't obviously an absurd smokescreen to do whatever we want. The second is that the free software/culture movement, in which Commons is deeply embedded, by its nature cares deeply about what is given versus what is taken. Taking a picture from a newswire and posting it to Commons under a fake free license is as much an example of theft as taking a garden gnome off someone's lawn, whether or not you get caught. Just because it's easy doesn't make it ethical. There are many grey areas in copyright, in which Commons will tend to err on the side of keeping because of its ideological bias towards expanding the sphere of "free", and far too much work evaluating images for the number of users we have, but when someone brings up an issue you'll generally find Commons to be quite by-the-book. - BanyanTree 05:27, 30 August 2009 (UTC)[reply]

Deleted now. I tried using the new gadgets for deletion discussion closing, since I decided to just churn through a month or two of stale discussions, and found myself doing all sort of weird things. Thanks for noticing. Regarding my uploading a new version, no, not certain at all about the original photo. That user Gerald Farinas created many pictures five or six years ago and claimed they were all from "state archives". I suspect they were just copied from random web sites. He says he is "on leave". I have been trying to track down better sources for several of them, and this is the closest I could come to this one. The ksbe.edu source (his foundation) says Bishop's age was about 70 at the time. So my guess was that the photo was retouched to make him look better. This seems to be common in those days, there are many examples of people artisitically "enhancing" photos of famous people, often after they are dead. It does show signs of airbrushing, but I am not an expert.

Now that you mention it, there is a bit more white visible in the collar near the bow tie, so it could very well be a different pose. He did live another 30 years. But I still think this is a better photo, and the source it a bit more certain. W Nowicki (talk) 17:59, 10 March 2010 (UTC)[reply]
