Wikimedia Commons only accepts free content—that is, images and other media files that can be used by anyone, for any purpose. Traditional copyright law does not grant these freedoms, and unless noted otherwise, everything you find on the web is copyrighted and not permitted here. The file you added has been deleted. If you have written permission from the copyright holder, please have them send us a free license release via COM:VRT. If you believe that the deletion was not in accordance with policy, you may request undeletion. (It is not necessary to request undeletion if using VRT; the file will be automatically restored at the conclusion of the process.) Warning: Wikimedia Commons takes copyright violations very seriously and persistent violators will be blocked from editing.

- Cited from the deletion-request "This isn't "a work prepared by an officer or employee of the U.S. government as part of that person's official duties", this is a personal photo that was taken despite that person's official duties, so much so that it is a part of charges being brought against that soldier. Further, this photo has been altered by the Spiegel Group (blurred, etc.) and as such contains their intellectual property. The copyright information listed is wrong, this isn't published under a free license, this particular version belongs to the "SPIEGEL Group" which states: "Unser Material ist urheberrechtlich geschützt" (our material is protected by copyright)". --Túrelio (talk) 08:13, 23 March 2011 (UTC)

- As far as I know, No. The only person, who could give you the required permission, is the photographer himself. This photo could eventually be uploaded to :en-Wikipedia under fair-use, which somehow ignores the copyright. But Commons does not and cannot allow fair-use.
