Zdjęcie na Allegro zostało wykorzystane przez jakąś firmę do reklamy sprzedaży naszywki orła na rękaw a nie munduru !Zostało opublikowane min na FB bez zastrzeżeń mojego autorstwa. Wykonane w prywatnej kolekcji umundurowania .Tak samo jak i inne wzory umundurowania zamieszczone na Commons..Powinieneś je przywrócić bo niczego nie narusza. Tak samo jak i to

@Pibwl Strona WITU Zielonka pozwala na publikację materiałów /w tym zdjęć/ z ich stron na podanej licencji za podaniem strony www.. Nie rozumiem pytania o wolną licencję taka nie jest podana. Polskie prawo - Ustawa z dnia 23 maja 1994 r. o prawie autorskim i prawach pokrewnych nie wymienia czegoś takiego jak wolna licencja. Wg. Ustawy m.in. materiały wykonane metodą fotograficzną - /ale tylko w zakresie sposobu przedstawienia obiektu/ wykonane niepowtarzalną metodą, w niepowtarzalnej scenerii itp. - /wykonanie artystyczne/ - a nie samego obiektu na zdjęciu podlegają ochronie autorskiej. Nie podlegają ochronie opublikowane publicznie fotografie prasowe bez podania autorstwa i bez wyraźnego zastrzeżenia praw autorskich. Tyle polskie prawo ..... na polskiej Wikipedii. Na Commons.. nieudolnie pomieszano pierwszeństwo polskiego prawa z publikowaniem w Polsce materiałów z amerykańskim - w sprawach spornych będzie miało jednak zastosowanie polskie prawo przed Sądami polskimi. W tym wypadku to nie narusza polskiego prawa. Masz jakieś obawy i wątpliwości usuń...ze szkodą dla polskiej Wikipedii. Ponad to ..Prawo USA m.in. Rozdział 107 ustawy USA, o prawie autorskim definiuje ..

Przy ustalaniu, czy korzystanie z utworu w konkretnym przypadku jest dozwolonym użytkiem, należy wziąć pod uwagę następujące czynniki: Cel i charakter korzystania z utworu, w tym to, czy takie korzystanie ma charakter komercyjny, czy też służy niekomercyjnym celom edukacyjnym;

Obawiam się, że nie zdajesz sobie sprawy, że na Commons akceptowane są tylko utwory na wolnych licencjach, czyli umożliwiających bezpłatnie KAŻDY użytek, łącznie z komercyjnym. Ogólnie chodzi o utwory, do których (1) majątkowe prawa autorskie wygasły, albo (2) udostępnione przez autora lub właściciela praw do domeny publicznej, albo (3) wyraźnie udostępnione przez autora lub właściciela praw na wolnej licencji, czyli takiej, która umożliwia dowolny użytek (przede wszystkim cc-by-sa). Osobną "furtką", ale budzącą wątpliwości, są utwory, do których prawa autorskie nie powstały (np. pod rządami dawnych polskich ustaw). Spróbuj przekonać adminów na Commons, że w sprawach spornych będzie miało jednak zastosowanie polskie prawo - powodzenia. Zresztą to, że "nie podlegają ochronie opublikowane publicznie fotografie prasowe bez podania autorstwa i bez wyraźnego zastrzeżenia praw autorskich", to dawno nieaktualne w polskim prawie - nie znajduję takiego wyłączenia w ustawie. Także jeśli chodzi o cytowany przez Ciebie amerykański dozwolony użytek, to nie obejmuje celów komercyjnych, czyli nie jest dopuszczalny na Commons. Jeśli bierze się zdjęcia ze strony, to muszą być wyraźnie określone jako udostępnione np. na licencji cc-by-sa, a nie np. "udostępnione jako materiały prasowe". Zaś strona WITU ma wprost znaczek copyright na dole - nie widzę, gdzie jest informacja o możliwości publikacji materiałów z ich strony. Więc, nawet jeśli zainteresowany podmiot nie upomni się o naruszenie praw autorskich, to niestety i tak prędzej czy później ktoś te zdjęcia stąd usunie. @Pibwl Problemy Techniki Uzbrojenia (ptu-biuletyn.pl) tu jest zgoda i licencja.Teksty publikowane w PTU udostępniane są na warunkach licencji „Creative Commons Uznanie autorstwa Użycie niekomercyjne – Bez utworów zależnych 3.0 (CC.BY-NC-ND 3.0). Nie muszę przekonywać adminów na Commons, mam za sobą polskie prawo

Na cytowanej przez Ciebie stronie Commons:Licensing wprost jest napisane, że Wikimedia Commons only accepts free content, that is, images and other media files that are not subject to copyright restrictions which would prevent them being used by anyone, anytime, for any purpose. O ile Commons i Wikipedia nie są komercyjne (i nawet nie publikują reklam), to idea im przyświecająca jest taka, że publikowane na nich treści i media mogą być pobierane przez każdego, przekształcane i używane także do celów komercyjnych (pod warunkiem oczywiście poruszania się w granicach licencji). Stąd w Polsce bywają wydawane i sprzedawane albumy z np. samochodami czy lokomotywami oparte w całości na zdjęciach z Commons. Licencja podana niech korzystają w jej ramach ale.. tu jednak chodzi o kasę! Cóż, przykro mi, że rozwiałem Twoje błędne przekonanie o co chodzi w wolnej encyklopedii i repozytorium wolnych mediów - ale na tym właśnie to polega, że tworzy sie coś do użytku publicznego. Nie chodzi o kasę (przynajmniej nie dla Wikipedii), tylko o wolność informacji, jak ruch oprogramowania open source. Dlatego nie możemy zamieszczać zdjęć jeśli ich autorzy świadomie nie wyrazili zgody na taki użytek. A ten MON to zdaje się chodziło o wyrażenie przez nich zgody (czyli udzielenie licencji) na użycie iluśtam zdjęć załadowanych przed 2013 rokiem, do których mają prawa. Licencja MON, udzielona tylko do zdjęć już załadowanych do czasu wyrażenia zgody, zezwala na dowolny użytek, w tym modyfikację i użycie komercyjne. Licencja CC-BY-NC-ND nie zezwala na modyfikacje ani na użycie komercyjne i dlatego takie zdjęcia nie mogą być na commons, które jest "repozytorium wolnych mediów". PD-Poland powołuje się na obowiązująca ustawę z 1994, ale tylko w tym zakresie, że uchyliła poprzednią ustawę z 1952 i wtedy wolne użycie fotografii bez zastrzeżenia prawa autorskiego się skończyła. Tyle, że to, że WITU jest instytucją państwową, nie znaczy, że jest "urzędem" w rozumieniu ustawy, a tym bardziej że wszystkie zdjęcia przedmiotów jego prac wykonywane przez różne osoby są materiałami urzędowymi. Nie jest na pewno organem władzy publicznej, i nie dotyczą spraw urzędowych. To nie jest prawo USA, gdzie wszystkie efekty twórcze pracowników rządu w ramach obowiazków służbowych wchodzą do public domain. W cytowanym opracowaniu jest trafna uwaga, że wyłączenia ochrony trzeba interpretować – jako stanowiące wyjątek od zasady – w sposób ścisły. Nie sądzę, żeby na ten temat było jakieś orzecznictwo, prawdopodobnie jeszcze nie powstały spory na gruncie ochrony praw autorskich tego typu w Polsce - ale polityką Commons (z którą się można zgadzać lub nie, ale taka jest) jest "dmuchanie na zimne" i akceptowanie jedynie mediów, co do których wolnego użytku nie ma wątpliwości, a nie że dopiero okaże się przed sądem. Co do publikowania zdjęć na Commons - jak Pan chce, ja osobiście publikuję liczne zdjęcia mojego autorstwa na wolnej licencji CC-BY-SA - nie będę przekonywać. WITU jest Urzędem .....Urząd – zespół osób i środków (finansowych, rzeczowych) zapewniających realizację zadań organów państwowych / tu organem jest MON/ i samorządowych.

Wierz mi przeczytałem, założenie, że tego nie zrobiłem jest nie na miejscu. Zamieszczona tam zgoda w mojej opinii nie jest zgodna w licencją CC BY-SA – nie znamy autora zdjęcia, nie mamy jak go podać, nie mamy żadnych podstaw, by twierdzić, że jest w domenie publicznej, lub na CC-0 – na dole strony jest copyright, postaraj się o pozwolenie zgodne z licencją, którą zamieściłeś pod fotką, bo póki co nie ma żadnych podstaw, do wybrania tej licencji (autora, daty i miejsca publikacji – nic). pozdrawiam, Piastu (talk) 13:10, 11 November 2023 (UTC)[reply]

Za źródło podałeś stronę internetową, ona daty (przed 1994), ani miejsca nie podaje – tam nie ma tego jak zweryfikować (co więcej, narzuca jakieś niezgodne ze zwykłym PD, które by obowiązywało przy przed 1994, warunki, dotyczące samej strony). Co więcej – sama publikacja przed 1994 niczego nie zmienia, należy się upewnić, że opublikowano je bez zastrzeżenia praw, tylko wtedy można zastosować PD – więc potrzebne są szczegóły co do miejsca i czasu publikacji. @Piastu Zgodnie z art. 4 pkt 1 i 2 ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych (Dz. U. z 2022 r. poz. 2509 z późn. zm.) „nie stanowią przedmiotu prawa autorskiego akty normatywne, ich projekty, urzędowe dokumenty, materiały, znaki i symbole”. Powyższa grafika należy do tej grupy. Podałeś ten adres strony jako źródło, dodałeś że Autor to WITU a Lic. za podaniem strony – oczywiście instytucja nie może być autorem, i nie wiadomo co znaczy Lic. za podaniem strony, a pod adresem, który podajesz można jedynie odnaleźć zapis © 2021 - 2023. Wojskowy Instytut Techniczny Uzbrojenia. Powołujesz się też na akt normatywny/urzędowy dokument – jego nie podałeś jako źródła. To jakiś żart? To ja jestem autorem tego zdjęcia i mam prawo zrobić z nim co tylko zechcę bez zgody kogokolwiek. Książka jest w mojej bibliotece. Nie kwestionuję, że sam wykonałeś zdjęcie, ale jest ono pracą pochodną względem okładki współczesnej książki, która jest chroniona prawami autorskimi. @Cybularny art. 155 ust. 1 Prawa własności przemysłowej, zgodnie z którym „Prawo ochronne na znak towarowy/ tu okładka i wydawnictwo/ nie rozciąga się na działania dotyczące towarów ze znakiem, polegające w szczególności na ich oferowaniu do sprzedaży lub dalszym wprowadzaniu do obrotu towarów oznaczonych tym znakiem, jeżeli towary te zostały uprzednio wprowadzone do obrotu na terytorium Rzeczypospolitej Polskiej przez uprawnionego lub za jego zgodą.”.Według poglądu reprezentowanego na gruncie anglosaskiego systemu common law, dopuszczalne jest udostępnianie zdjęć okładek książek o niskiej rozdzielczości (tzw. minaturek) w ogólnodostępnej przestrzeni sieciowej. Przyjmuje się, że w przypadku udostępnienia zdjęcia okładki w takiej postaci nie dochodzi do eksploatacji, korzystania z utworu. Miniaturka nie jest bowiem egzemplarzem utworu ani jego kopią, w związku z tym poprzez udostępnienie obrazu o niskiej rozdzielczości nie mamy do czynienia z rozpowszechnieniem utworu, jego zwielokrotnieniem. Przykładem tego typu praktyki jest portal jednak Wikimedia, który masowo udostępnia m.in. okładki książek w formie miniatur.... ale Wasze interpretacje prawa na Commons to nie jasna domena.. zbiór bzdurnych i wykluczających się nawzajem 'przepisów- podpieranych niby polskim prawem. Ochrona znaków towarowych nie ma znaczenia dla kwestii możliwości publikacji na Commons i nie jest tożsama z ochroną praw autorskich. Jeśli jakiś plik przedstawia materiał będący znakiem towarowym, to oznaczamy go szablonem Template:T, który nie jest licencją, a jedynie informacją i niezbędne jest wówczas niezależne od tego określenie sytuacji prawnoautorskiej. Co do zdjęcia, które pokazałeś jako przykład, to działa w nim zasada de minimis – tematem zdjęcia nie jest konkretna książka, lecz ich cała kolekcja leżąca na regale, gdzie każda okładka z osobna jest tylko szczegółem całości, a nie istotną częścią kompozycji. Nie wykadrujesz z tamtej fotografii pojedynczej okładki, uzyskując zdjęcie o użytecznej rozdzielczości. W przypadku Twojego zdjęcia okładka stanowi praktycznie jedyny element zdjęcia, więc zasada de minimis nie wchodzi w grę. Jeśli myślisz nad lekkim poszerzeniem kadru w celu wykorzystania tej zasady, to od razu ostrzegam, że wytyczne zasady de minimis wyraźnie wskazują, iż fakty, że zdjęcie ma ilustrować zawarte w nim dzieło, odnosi się bezpośrednio do tego dzieła, dzieło jest ewidentnie celem wykonania zdjęcia, a jego wycięcie/zamazanie uczyni zdjęcie bezużytecznym zmniejszają szansę na uznanie zdjęcia za de minimis. Z kolei korzystanie z okładek na gruncie prawa anglosaskiego to fair use. Ten tryb jest dozwolony w niektórych projektach Wikimedia np. anglojęzycznej Wikipedii i może tam widziałeś takie grafiki, ale jest zakazany zarówno w plwiki, jak i na Commons. Współczesne dzieła zazwyczaj po prostu nie mogą być zilustrowane, chyba że właścicel praw autorskich wyrazi na to pisemną zgodę potwierdzoną w VRT. Moje pytanie do IPN cyt. Materiały udostępnione w serwisach internetowych Instytutu Pamięci Narodowej, tj. zdjęcia, dokumenty archiwalne, nagrania audio i video podpisane jako pochodzące z zasobu archiwalnego IPN, mogą być swobodnie wykorzystywane przez dziennikarzy pod warunkiem precyzyjnego podania źródła pochodzenia tych materiałów.

Pytanie; czy tylko przez dziennikarzy ? Czy inni mogą też korzystać na podanych warunkach?

Template:Ec Działa, o ile usunięcie zawartości chronionych okładek ze zdjęcia byłoby nieistotne z punktu widzenia całości pracy i jej znaczenia. O ile te regały po zamazaniu konkretnych okładek by cos sensownego prezentowały, to tyle twoje zdjęcie byłoby bezwartościowe. Jeśli się z tym nie zgadzasz, możesz zgłosić wniosek o odtworzenie na stronie COM:UDR pod decyzję innych adminów Commons. Z kolei, jeśli uważasz, ze okładki chłopów są na tyle istotnym elementem zdjęcia, że ich usunięcie pozbawi je wartości, to możesz zgłosić to zdjęcie do usunięcia.
