I'm not sure I completely understand. I believe the photo to be in the public domain as per the 1911 Copyright Act, by which this photo's copyright expired in 1980. I had uploaded the photo with the belief it had to be used as per the terms of the Creative Commons 3.0 license (as the National Portrait Gallery insisted), however I soon found I was mistaken and therefore updated the photo to abide only by the 1911 Copyright Act, it therefore being in the public domain.
