Goodies, tips, and tricks

You can find the files you have uploaded in your Uploads.
Please sign your name on Talk pages by typing ~~~~.
To link to an image page without embedding the image, type: [[:File:Foo.jpg]], which produces: File:Foo.jpg.
You may enable gadgets (custom features) for your account.

Hei, når det gjelder samleverk som en avis, så er det flere forhold som spiller inn i forhold til vernetiden verket har etter opphavsrettsovgivingen. Journalisten som har skrevet teksten har opphavsretten til teksten, fotografen som har tatt bildene har opphavsretten til bildene, og avisen som har samlet det i en avis har opphavsretten til samlingen. Denne vernetiden regnes i de fleste tilfeller til flere tiår etter opphavspersonens død, så selv om 1997 føles lenge siden, så er det dessverre ikke lenge nok til at det er sannsynlig at vernetiden til noen av de som er nevn over, har utløpt. Det innebærer også at bilder av forsiden til avisen ikke kan lastes opp til Wikimedia Commons uten at det innhentes tilatelse fra avisen. TommyG (talk) 11:27, 19 September 2022 (UTC)[reply]

Det er en egen prosesss for å innhente tillatelse fra tredjeparter. Du kan lese mer om det på COM:VRT og COM:ET. Du må da mao. sende en e-post til Dagsavisen og be om lov til å laste opp bildet, og Dagsavisen må sende inn en e-post til permissions-commons@wikimedia.org hvor de bekrefter at de har gitt tillatelse til dette. Jeg tror det greieste er å slette bildet av Arbeiderbladet 1997. SÅ interessant er det ikke.

Dette er et bilde av fire puslespill produsert tidlig på 1960-tallet. De er altså ca. seksti år gamle. Hvor lenge kan noen påberope seg rettigheter til sånt? Og hva vil du jeg skal gjøre ellers? Kolbkorr (talk) 09:52, 19 September 2022 (UTC)[reply]

Jeg svarer for alle 3 her, siden det samme gjelder for alle. Du kan lese en del om denne problemstillingen på COM:DW, men det det kommer ned til er at når man tar et bilde av et verk som inneholder opphavsrettsbeskyttet materiale, så har man ikke full råderett til det bilde, men må også ta hensyn til opphavsretten til de som har laget verket som det er tatt bilde av. For Disney-puslespillet så har generelt Disney-figurer en vernetid på 95 år i henhold til amerikans opphavsrettslovgiving, som man må forholde seg til, siden Wikimedia Commons sine servere står i USA. Det vil si at noen av de tidligste figurene Walt Disney lagde snart kan brukes fritt, men figurer som er avledet av disse og endret senere, fremdeles har flere tiår igjen før man kan bruke de fritt. For puslespillet som ikke inneholder Disney-figurer så er det kanskje innenfor i henhold til amerikansk copyright, men der setter nok norsk opphavsrett en stopper for publikasjon. For samleverk uten kjent opphavsperson så gjelder en vernetid på 70 år fra førstegangs publikasjon. Det innebærer at dersom disse puslespillene ble utgitt i 1960, så vil du måtte vente til 2031 før de fritt kan lastes opp til Wikimedia Commons.

Opphavsrett og copyright er dessverre fryktelig komplisert og varer urimelig lenge, når man snakker om å laste opp filer som inneholder ting man selv ikke har laget. Jeg håper ikke dette minsker lysten til å fortsette å bidra til Wikimedia Commons og Wikipedia, siden du har bidratt med mye bra. Om det er noe mer du lurer på, så er det bare å spørre. Hvordan kan et nøytralt og ikke-manipulert bilde av en hermetikkboks som selges i alle slags butikker og til alle slags kunder komme i strid med åndsverklover?
