Wikimedia Commons does not accept fair use content.
We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules. In addition, fair use is not compatible with our aim as a collection of freely distributable media files. Therefore, Commons cannot legally rely on fair use provisions. Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

A file that you have uploaded to Wikimedia Commons, File:001 Suzanne Ciani - LIVE Quadraphonic Box Art 201115-1920x1920.png, is a derivative work, containing an "image within an image". Hi KamranV,
you have now uploaded this album cover/box image for the 3rd time without providing evidence of permission. This is a blockable offense. In case you do indeed represent the group/producer KamranV, you should sent an email from your official/business email address to permissions-commons@wikimedia.org (OTRS) confirming that you are the rightsholder for this image and that want to release it under the choosen free license. --Túrelio (talk) 09:31, 28 February 2021 (UTC)

- Hi Kamranv. There are two copyright issues which need to be considered: (1) the copyright of the photo you uploaded and (2) the copyright of the cover art shown in the photo. If you're the copyirght holder of both, then you should state as much in your email to OTRS and added information about the copyright status of the cover art to the description on the file's page. If, on the other hand, you don't own the copyright on both, you still may need the consent of the other copyright holder for Commons to keep this file. If you own the copyright on the cover art but not the photo, then easiest thing to do might be to simply upload another photo of the cover art that you have taken yourself. If this situation is reversed (i.e. you own the copyirght on the photo but not the cover art), then things get trickier and you may actually need to also have that copyright holder email their COM:OTRS/Consent to Wikimedia OTRS. Finally, one last thing about Commons is that you're basically giving anyone anywhere in the world advance permission to download whatever you upload to Commons and reuse for pretty much any purpose (including commercial and derivative uses). You can choose a license that requires any one who reuses the file to properly attribute you as the original copyright holder of the work, but that's about the only restriction you can place on the file's reuse. So, if you thought that the file would only be used on Wikipedia or for educational non-commercial purposes, then you misunderstand Commons:Licensing; moreover, once you agree to release a file under a license that Commons accepts, you can't change your mind and revoke the license at a later date. Even if the file eventually ends up deleted from Commons per your request, anyone who downloaded the file prior to its deletion will continue to be able use it as long as they abide by the terms of the license you choose. Commons licenses don't cover non-copyright restrictions; so, if these are things that concern you, you probably shouldn't upload your work to Commons. -- Marchjuly (talk) 01:23, 1 March 2021 (UTC)
- Thx for this extra feedback. I do admin the copyright to both however commercial use use isn't something I intended. Only non-profit and educational use. I’ll let it go. Kind of a shame that there aren’t options for non-commercial use. Is this not the way old encyclopedias worked? Kamranv (talk) 01:30, 1 March 2021 (UTC)
- There are options that some local Wikipedia may provide for some types of copyrighted content as explained in COM:FAIR, but not all Wikipedia projects allow it. English Wikipedia does and you can find out more about it at en:Wikipedia:Non-free content; however, English Wikipedia's policy is quite restrictive as explained here and non-free album cover art is generally only allowed to be used for primary identification purposes at the top of or in the main infobox of stand-alone articles about the actual albums they identify. So, if there was an English Wikipedia article about this album, then this photo could probably be used there for primary identification purposes, but it most likely wouldn't be able to be used in any other articles and it couldn't be used in any drafts for articles. As for this file, since you have already emailed OTRS, you might want to send them another email stating that you've changed your mind. Then, you can nominate the file for deletion yourself as explained here or ask Túrelio to re-delete it for you. -- Marchjuly (talk) 23:03, 1 March 2021 (UTC)
