fixing Commons:Deletion requests/File:Johnny Gioeli.jpg, but what have I done wrong? --Gripweed (talk) 20:42, 3 June 2012 (UTC)

Help

Dear JuTa, I'm not an expert of commons and some files uploaded from me was deleted. One is an audio file ("Universal mantra") recordered from a gathering of some unknown persons. The source (the person that recordered the audio file) is a friend of mine that published it on Youtube as an audio-video file (without any copywright limitation). Anyway yesterday I write him a mail to ask a written permission but I don't know how to reinsert again the file and how to prevent a new deletion. Another one is an old photo of the late Ernesto Barba (I inserted it on the en-WP), this is taken from an older one (with other persons that I deleted for privacy reasons) i think it was without exif and it's also free (and I can grant for it). I obtain this photo by mail, directely from a close friend of Barba (Giovanni Bravin) that write on the talk page of the en-WP (as you can also see if you take a look at the Barba's article talk). If you take a look at my uploads I've recentely uploaded new images (all were taken by me and a few of them are quite old) but what can I do to demostrate that I'm the owner and to prevent deletion? I thank you very much if yo can help me 'couse I'm a little distressed of all this problems.--Cornelius383 (talk) 00:15, 7 June 2012 (UTC)

Hi Cornelius,
1) about the music recording: Not only the recoring person has a copyright. The main thing is the players of the music own the copyright of their play. So, even if your friend would send a mail to COM:OTRS we would need the same of the playing music group.
2) I could not find an deleted image from you about Ernesto Baba. But missing EXIF data say nothing about copright. We need to know who made this image when and perhaps where. When did the fotografer died (if so). In most cases the fotografer need to be 70 years dead to make any work of him/her public domain. If we don't have a good evidence for that we can't keep such images. The only way arround would be th the real author would send a permission mail to the so called OTRS, which keeps the correspondence privatly but confirms that the real copyright holder gave the required permission. --JuTa 00:37, 7 June 2012 (UTC)
Thank you JuTa for your fast answer. So, for example, I have many audio records of big group of people (sometimes spiritual gatherings of thousands of unknown people) singing spirituals mantras in the streets (in India). I cannot upload it to commons? If it's so it's really a pity. Another question is: how I can show that I have done a photo (old) without exif? Take for example my recent upload to commons [file:DadasKirtan3.jpg]. I have done this photo from my own on July 1978. How can I do to prevent it from deletion (in that period cameras didn't have exif data). Is there a system or a template that permits me to release a free copyright for the file?--Cornelius383 (talk) 06:49, 7 June 2012 (UTC)
1) Yes, you should not upload those ogg-files. You will minimum have a high risk that they will get deleted because their copyight status is unclear. And I would strongly recommend that you, if you upload anyhow, upload only ogg-files which you have self recorded.
2) Its according this, correct? As far as I understood you: A friend sent you a foto via mail. You cropped it and uploaded it here claiming "own work". Correct? But thats not your work. Its not clar for me if that is the work of "your friend" or of somebody else and "your friend" just had this foto. That is not realy increasing the trust in your other uploads, isnt it? You need to state and/or find out who is the real author (who pressed the button at the camera). This you stating at the deletion request page. Then this person needs to send a reliesment mail to the OTRS.
regards --JuTa 20:17, 7 June 2012 (UTC)
Now I understand.. So: 1)if (for example) I personally record a group of people singing spiritual mantras in a public place (in India f.e.) I can't upload this file to commons.. It's real a pity 'couse I've some beautiful files like this (shade!!). 2)In the case of the late Ernesto Barba's image my work was to crop that image from the original photo (a big one with many people that I didn't upload for privacy reasons). I wrote that was "my own work" 'couse I croped and trasformed all the image with Gimp. The original big photo was sent to me from a en-Wp user (Giovanni Bravin) that contacted me from the talk page of the late Ernesto Barba's article in the en-Wp. 3)Other recent photos that I have uploaded (like this one were personally taken by me many years ago, but the question is: how can I prove that are my own work avoiding another distressing deletion from commons? Thank you for your help--Cornelius383 (talk) 18:51, 8 June 2012 (UTC)
Hi Cornelius,
1) correct
2) the original fotograf needs to be named and he (not you) has to confirm that he is willing to put this image under a free license of his choise. Nearly every license accepted on Commons would allow i.e. anybody in the world to print and sell t-shirts with this image on as long the license is fullfitted (attribution on the author etc).
3) We normmaly assume good faith here. As long we have impression you contributing in good will and trying to fullfit the licenses and rights required here, we just trust your words. As long as your given sources, dates, reasons etc. sounds reasonable and we cannot find the images elsewhere which would indicate a possible copyright violation, you are a not running a high risk that those images gets deleted.
Cheers. --JuTa 11:33, 9 June 2012 (UTC)
Thank you very much JuTa your advices were very helpful. It seems that I've done some errors before.. But now I think I understand much better the commons phylosophy... I hope it will be better in the future!--Cornelius383 (talk) 15:28, 9 June 2012 (UTC)

Photobucket photos

Hi JuTa,

Would like to ask you whether the PhotoBucket terms and condition as below is suitable as a license granting permission to use?

- If you make your Content public, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to copy, distribute, publicly perform (e.g., stream it), publicly display (e.g., post it elsewhere), reproduce and create derivative works from it (meaning things based on it), anywhere, whether in print or any kind of electronic version that exists now or later developed, for any purpose, including a commercial purpose. You are also giving other Users the right to copy, distribute, publicly perform, publicly display, reproduce and create derivative works from it via the Site or third party websites or applications (for example, via services allowing Users to order prints of Content or t-shirts and similar items containing Content, and via social media websites).

Hi, that sounds good in my ears :) I "tuned" the description page a little bit and removed the problem tag. Ceers. --JuTa 13:17, 17 June 2012 (UTC)

Why

On what basis do you delete photos from my medals page??? Senior Strateg (talk) 13:25, 17 June 2012 (UTC)

Hi, as I tried to link in the deletion-reason. It was because Essential information were missing.

  1. you provided just no license (Compare Commons:Licensing)
  2. you just copied it from a google search result. Then you have to provide in the decription page a comprehensible reason why this image is PD or published unter a free license. Compare i.e. here

File:Вп низкиничский монастырь.jpg - license problem

This file has been published first in Russian Wikipedia, where its author used both GFDL and Creative Commons Attribution-Share Alike licenses (see here). So, it's certainly free and can be also used in Commons. Unfortunately I'm not able to insert the proper license template (I did try but apparently without success). I would be grateful if you could help. Regards, Loraine (talk) 23:08, 20 June 2012 (UTC)

I've just noticed that a similar problem occurs with my two other recent uploads, here and there. The situation is perfectly the same. I've uploaded the files which were published in ru.wiki with a proper license but I was not able to describe them properly here. I tried to correct it, please verify if now it's all right. Loraine (talk) 23:10, 20 June 2012 (UTC)

Hi, I fixed th description pag - see here. You should consider using the Commons helper in future: You will get much more correct description pages with it. Could you try to do it similar with the other images youself pls. If you still have problems I will try to help you.. regards. --JuTa 23:25, 20 June 2012 (UTC)

Are you sure there were no OTRS permissions for Karyn Marshall photos

Photos were:

It was my impression that permissions had been sent and accepted.--Tomwsulcer (talk) 22:16, 30 June 2012 (UTC)

Well, there was nothing stated in the desription files than the {{OTRS pending}} template set by you. Normaly an OTRS volounteer sets {{OTRS received}} when he start working on the case and {{OTRS}} when he/she's happy with the case an the release is valid. Here nothings happened like that. I guess the release was not valid or no mail arrived at OTRS. regards. --JuTa 23:58, 30 June 2012 (UTC)
Ok, I'll look into it on my end. I'll email Karyn Marshall. Apparently her mother took the photos (and she may be too old to do "email"?) but my sense is that according to KM, that her mother freely consents to the photos in Wikipedia.--Tomwsulcer (talk) 00:08, 1 July 2012 (UTC)

Hey thanks. I suppose I'll try Karyn first, then go to the noticeboard if KM thinks the emails were sent.--Tomwsulcer (talk) 00:50, 1 July 2012 (UTC)

Removal of picture of John Maynard Smith

Hello JuTa

I think you were involved with the removal of this image from Wikimedia Commons or have the authority to reinstate it. I cannot understand why it was removed. I provided a full release of copyright from the copyright owner (the Web of Stories) in the exact form that Wikimedia Commons requires... see copy of release below (this was sent with the released image attached). Getting the right to use this image was a lot of work for me and a lot of work for the copyright ownde. It was the Managing Director of the copyright holder who was involved in this decision to release copyright. The release was properly sent to Wikimedia Commons email address required. Then the image was removed. I cannot see why. It is very disheartening to do so much work and to ask for copyright holders to do more work when all this effort comes to nothing. Please help, at make this investment in time that we have made worthwhile.

Hi, sorry for your trouble. As I saw the image has been undeleted inbetween. To explain why I deleted it. I working on some old backlogs. In the image there was only a {{OTRS pending}} template set. Normaly an OTRS volounteer sets {{OTRS received}} when he start working on the case and {{OTRS}} when he/she's happy with the case an the release is valid. Here nothings happened like that. After a month such images are eliggible for deletion. In this case it seems that the working on OTRS volounteer just forgot to set the {{OTRS}} template. regards. --JuTa 00:13, 2 July 2012 (UTC)
PS: I now undid the "delinker activity" in no:John Maynard Smith, en:John Maynard Smith and en:Evolutionary game theory. regards. --JuTa 00:21, 2 July 2012 (UTC)

I am not sure how this can happen considering the wording of the Commons:Deletion policy#Duplicates and looking how User:CommonsDelinker/commands is set up. Has there been a recent decision to allow this of which I am unaware? Lack of consistency is problematic, and makes for defence of one's (in)actions similarly problematic.  — billinghurst sDrewth 13:58, 1 July 2012 (UTC)P

Well the PNG image was marked as no license, no source, no permission and duplicate. In the history I could not find a version realy credible. The "duplicate" deletion seemed to me the less restrictive solution. If you are different opinion you happily can either remove the redirect or restore the PNG image and correct the decscription page in an anyhow comprehensible way. regards. --JuTa 00:01, 2 July 2012 (UTC)

Hi, this file that you eliminated is in the same OTRS permission sent for this. I received the confirmation messange, but i do not know why the staff did not aproved it, cause all pics were sent together in same OTRS. +PrinceWilly 16:07, 2 July 2012 (UTC)

Hi, I now left a note at User talk:Krd. This is the OTRS member who confirmed the release of the other image. If he confirmes the releaseis valid for this one I will undelete it. regards. --JuTa 22:25, 2 July 2012 (UTC)

Restoration

Hallo JuTa, can you please temporarily restore a group of images you've deleted? Having seen they were deleted, I wrote to the source and it appears he simply forgot to send his permission; also, he may not be the owner of all. Could you please restore them for a week or so, so he can see which is which and have the permission sent? The images are: File:Eileen Szymin-Shneiderman with her children Ben Shneiderman and Helen Sarid in 2003.jpg; File:S. L. Shneiderman & Eileen Szymin-Shneiderman in Paris in 1931-1933.jpg; File:S. L. Vielen Dank, Aviados (talk) 22:11, 2 July 2012 (UTC)

Hi, I now temp. undeleted those images and updated the {{OTRS pending}} date to today. This gives you, Mr. Shneiderman and OTRS-stuff another month to clarify the situation. regards. --JuTa 23:12, 2 July 2012 (UTC)
Wunderbar. Many thanks, Aviados (talk) 14:22, 3 July 2012 (UTC)

Hello, still quite new and did take quite some time to get used to the format of things and getting some of the info required to post that image, could you please let me know what I can do to put back this logo(for dcl) on commons? This image still has a valid copyright but I have permission to post it here, what is the proper procedure or do I simply post it like a big company as trademarked logo? Regards, Bocalt07

Hi, I guess you are talking about File:Dcl logo.jpg, correct? Well generaly every image does need a comprehensible license template, best set by the uploader. See Commons:Licensing. You didn't provided any license. This logo is on the borderline of Commons:Threshold of originality. You could try to reupload th image using {{PD-textlogo}} and {{Trademarked}}. But I cannot guarantee that nobody will think the threshold is exceeded. Perhaps it will be nominate it for deletetion by somebody. It could be also an idea to upload the image localy to your project. As I don't know the rules in french wikipdia I recommend to ask on i.e. fr:Wikipédia:Le Bistro first. regards. --JuTa 11:42, 3 July 2012 (UTC)

Hi. I am afraid what you ca not understand in an agreement of an author of file File:Meriones crassus Torsten Pröhl.jpg. After full description od CC-BY-SA terms an author wrote clearly he agreed to use his picture with Wikimedia in every form. It is a pity you prefer to delete a file in a week (email dated 23 June) after your proviso. For the next time - would you mind to wait a little longer, please? An author leaved home for few days, and OTRS team received an information about it. I am afraid some your activities are a little to much illconsidered. Constructiveness is much more dificoult. Greetings. Jacek555 (talk) 21:25, 3 July 2012 (UTC)

Well the OTRS volounteer User:Krd added the {{No permission}} tag together with a change from {{OTRS pending}} dated from April to {{OTRS received}} on June 10, there was nothing stated in the image about an OTRS-Mail from June 23 but from April 25. This indicates strongly that the OTRS ticket does not give a valid release for this image. I deleted it today, which is more than 3 weeks after June 10 and more than 3 months after the OTRS mail was first stated. But you might ask yourself the OTRS volounteer on User Talk:Krd about the status and chances of this ticket. In case it is or will become valid, I will be happy to undelete the image. regards. --JuTa 22:51, 3 July 2012 (UTC)
PS: The ticket number was: ticket:2012041110012221. --JuTa 22:52, 3 July 2012 (UTC)
PPS: I just noticed: you reuploaded File:Meriones crassus.jpg a day after it was deleted as no OTRS permission since April 11. I will mark it now again as no permission and hope you will have better luck this time. But please: if there will be again no release pls. don't re-re-upload it again. Thx. --JuTa 23:05, 3 July 2012 (UTC)
  • I reload File:Meriones crassus.jpg file, because in that same day I sent a mail to <permissions-commons@wikimedia.org> inluding author's new agreement. You marked it to fast, too. • Thats fine and resolved now (see below). I cannot check OTRS-mails because I'm not a member of the OTRS-Team. I'm a "normal" admin working on some old backlogs. --JuTa 10:11, 4 July 2012 (UTC)
PPPS: I now left a note myself at User talk:Krd#File:Meriones crassus Torsten Pröhl.jpg and File:Meriones crassus.jpg. --JuTa 23:25, 3 July 2012 (UTC)
File:Meriones crassus.jpg now has permission. --Krd 07:08, 4 July 2012 (UTC)
After reasking Krd for File:Meriones crassus Torsten Pröhl.jpg we got the answer (quote):
For this file the permission is still incomplete. Last email from OTRS agent at 23 Jun was not replied to. --Krd 09:54, 4 July 2012 (UTC)
As we still have no valid release for this one, I don't undelete it now. But I will be happy to undelete it as soon the release becomes valid. Pls. Jarek555 or Krd leave me a message when this is the case. In the case of I will be unavailable then pls. start a Commons:Undeletion request. regards. --JuTa 10:11, 4 July 2012 (UTC)
