Magazine covers are copyrighted and cannot be uploaded under a free license without the written permission by the rights holder. And why do you think a magazine cover from 2009 "should be classified as public domain"? --Túrelio (talk) 13:56, 24 February 2009 (UTC)[reply]

Hello Jameshcarman,

You have uploaded several files that are copyright violations and you have done so despite our requests not to do so, and despite our instructions. If you do not stop uploading pictures that are not free, your account will be blocked. See Commons:Licensing for the copyright policy on Wikimedia Commons. You may also find Commons:Image casebook useful. Please leave me a message if you have further questions. --Túrelio (talk) 15:03, 24 February 2009 (UTC)[reply]

re: your note on my talkpage[edit]

Hi James,
I'm sorry for the surely unfriendly-looking impression you got at your first encounter on Commons as you tried to contribute valuable content. But, believe me, this happened because we try to protect rights and intellectual property. The practical reason behind this is, that we often experience that someone uploads an image that is clearly copyrighted and then, in addition, claims to be the artist or whatsoever, though he/she actually isn't. Therefore, in cases of obviously copyrighted material we simply require a written permission.
But getting it right is easier than it may look. I can un-delete all your deleted images in a few minutes. What you have to do is to prepare a written permission and send it to permissions-commons@wikimedia.org (OTRS) using on your side an email account whose name is evidently associated with the journal. You don't need to develop a permission text by yourself, but you should simply take the boxed template text on Commons:Email templates, fill in the filenames (you can see the deleted ones here), add a license name, add the name of a representative of the rights holder and the date.
About choosing a fitting license: I've seen that you choose "public domain". That's nice for us and for all re-users of your images, but do you think that is wise? With a PD-license you have no say at all in the (re-)use of the images; you can't even ask for attribution. Just to enhance your imagination, originally Commons was developed as a media repository for the Wikipedias, but today it is far more. Anybody can and is allowed to use the media files on Commons, and in regard to copyright for any purpose; printing images on T-shirts and selling those, for example. As Commons requires free licenses that allow derivatives, anybody could take one of your cover images, cut out the artwork and use it. You should eventually check with your artists if that would be o.k. or included in your original license agreement with them.
You can choose any license that is acceptable on Commons (see: Commons:Licensing). Personally I would recommend you to take Creative-Commons-Attribution-ShareAlike (CC-BY-SA) 3.0(details). This license requires the re-user to attribute the artist (you should think about, who shall be credited as artist/author of the covers) and additionally to release modifications under this very license. If you want to hinder any non-online use, you may choose a GFDL-license(details) as these require printing the whole license text together with the image. You can also combine licenses. Additional easy-help in finding a license is available here. I want to propose you the following procedure. Take your time to think about it. If you have taken a decision about the license and about who shall be credited with any cover (it can be different for each cover, of course), place that information on my talkpage. I will then un-delete the images, enter your additional informations and put an OTRS-pending tag an them (to avoid deletion by anybody else). In between you should send the permission email to OTRS (your email will not be published, but can only be accessed by OTRS team members). After some time they will put a so-called OTRS-ticket on each of the image pages covered in that permission and everything is fine. Cheers.--Túrelio (talk) 19:46, 24 February 2009 (UTC)[reply]

WQAut76.jpg which you uploaded has been tagged with {{OTRS pending}} for more than 30 days. This tag indicates that an email setting out permission to use the file was sent to the Volunteer Response Team. Unfortunately, we cannot find any record that such an email has been received, and accordingly the file remains without permission. Unless the Volunteer Response Team receives evidence that permission has been granted within 15 days of today's date, the file will be deleted. If you have already sent the permission, please re-send it to permissions-commons@wikimedia.org now. Please quote the file name ("WQAut76.jpg") in your email. At the same time, please leave a message at the VRT noticeboard so that a volunteer can follow this up or contact a VRT member directly.
