A file that you have uploaded to Wikimedia Commons, File:Karl Tõnisson – Kārlis Tennisons – Vend Vahindra.jpg, is a derivative work, containing an "image within an image". Examples of such works would include a photograph of a sculpture, a scan of a magazine cover, or a map that has been altered from the original. In each of these cases, the rights of the creator of the original must be considered, as well as those of the creator of the derivative work.

While the description page states who made this derivative work, it currently doesn't specify who created the original work, so the overall copyright status is unclear. If you did not create the original work depicted in this image, you will need to specify the owner of the copyright.

Please edit the file description and add the missing information, or the file may be deleted. If you created the original content yourself, enter this information as the source. If someone else created the content, the source should be the address to the web page where you found it, the name and ISBN of the book you scanned it from, or similar. You should also name the author, provide verifiable information to show that the content is in the public domain or has been published under a free license by its author, and add an appropriate template identifying the public domain or licensing status, if you have not already done so. Please add the required information for this and other files you have uploaded before adding more files. If you need assistance, please ask at the help desk. Thank you!

1. File:Karl Tõnisson – Kārlis Tennisons – Vend Vahindra.jpg, is a crop of the original file from a postcard found here: https://www.researchgate.net/figure/The-text-on-the-postcard-is-written-in-Estonian-and-Latvian-and-translates-into-English_fig2_26513641. 2. The original file contains a swastika that can be misunderstood. It might be good to upload the original file. It is an old Hindu-Buddhist symbol. In India and Nepal, it is a very common sight to see. Only in Europe does it have a negative meaning when Nazis used it. 3. "During the first decade of the 20th century, for some reason, Tennisons traveled to Riga, which became his second hometown. He lived at a local Jewish merchant's place. One of Tennisons's leaflets mentions that this was a summer cottage belonging to someone called Glazovski29, which is a quite typical Jewish surname." From https://www.researchgate.net/publication/292286463_Karlis_A_M_Tennisons_and_Friedrich_V_Lustig_-the_first%27practicing%27_Buddhist_in_Estonia, December 2015, pp. 385. 4. This is a very old photo and it is very unlikely that copyright is a problem. Editorq35 (talk) 10:25, 13 September 2023 (UTC)[reply]
Belbury will probably not notice your reply unless you ping them. I see no date at your postcard link, but if we assume he's 40 then, the photo is from 1923. Per Help:Public_domain#Copyright_terms_by_country and Template:PD-old-assumed, we can't assume it's in the PD yet. Gråbergs Gråa Sång (talk) 11:01, 13 September 2023 (UTC)[reply]
To prove the age of the photo:
1.He (Karl Tõnison) left Europe in 1930 for Asia.
2.The postcard says 1928. It is written on the bottom.
From the link you provided, the copyright in Estonia is 70 years. So it is more then 70 years since the copyright ended. It is safe to say it is PD. Editorq35 (talk) 11:30, 13 September 2023 (UTC)[reply]
Belbury @Belbury A few points to consider. Editorq35 (talk) 11:32, 13 September 2023 (UTC)[reply]
Hi, I don't remember this image, but assume I only flagged it because the photographer wasn't credited. You can request undeletion at Commons:Undeletion requests if you want the image restored. Belbury (talk) 12:10, 13 September 2023 (UTC)[reply]
Read again, it's life of author/photographer +70 years. Gråbergs Gråa Sång (talk) 11:32, 13 September 2023 (UTC)[reply]
(He left Europe in 1931.)
That's right. Copyright will end for sure +70 years after the passing of the author. Public domain status is still uncertain. I will contact Mait Talts, the author of the publication from which this photo is sourced. He likely obtained it from archives in Estonia Editorq35 (talk) 11:48, 13 September 2023 (UTC)[reply]
Adding that you can't declare other people's pictures "Creative Commons Attribution-Share Alike 4.0 International". You can do that with pictures you have taken yourself with your own camera. Gråbergs Gråa Sång (talk) 14:44, 13 September 2023 (UTC)[reply]

In Estonia, works created before 1992 are in the public domain if the author died more than 70 years ago, or if the work was published anonymously or pseudonymously and the author died more than 70 years ago. In Latvia, works created before 1945 are in the public domain if the author died more than 50 years ago, or if the work was published anonymously or pseudonymously and the author died more than 50 years ago.
Therefore, if a work was created in Estonia before 1992 or in Latvia before 1945 and meets the aforementioned criteria, it is in the public domain. Editorq35 (talk) 22:51, 13 September 2023 (UTC)[reply]

One will be asking permission from the person who took the photo. Editorq35 (talk) 11:14, 13 September 2023 (UTC)[reply]
That can work, but note per template that there's some bureaucracy involved. You stating on Commons "She says it's ok" won't work. If you do decide to try to communicate with the photographer, my advice is to be clear that even if she does release a version of the photo under a Commons usable license, you can't guarantee it will be used on Wikipedia. As stated before: 'I will contact Mait Talts, the author of the publication from which this photo is sourced. He likely obtained it from archives in Estonia.' Editorq35 (talk) 12:04, 13 September 2023 (UTC)[reply]
@Polarlys, I attempted to contact the person who used this work without success. The photograph in question is of historical vintage, and regrettably, the identity of the photographer remains elusive. Nevertheless, this lack of attribution does not appear to present a significant issue, as the image has found wide and unrestricted distribution across various online platforms. To confirm this, please consult the file's source. Considering its potential value as a Wikipedia addition, we are receptive to your recommendations regarding the most suitable Creative Commons license for this image." Editorq35 (talk) 21:20, 13 September 2023 (UTC)[reply]
There is no suitable Creative Commons license. You can use this type of license for your very own work, but can’t apply it to the work of someone else. Either this file is in the public domain or it is not. --Polarlys (talk) 21:39, 13 September 2023 (UTC)[reply]
@Polarlys According to the Copyright Act of Estonia and Latvia, photographs are protected for 70 years after the death of the author. If the author of the photograph is unknown, then the copyright protection would have expired 70 years after the photograph was first published. Therefore, if the photograph was taken 1928 or before and the author is unknown, then it would have entered the public domain in 1999. Am I correct? This should work perhaps: Creative Commons CC0 1.0 Universal License: This license waives all rights like public domain. Editorq35 (talk) 22:26, 13 September 2023 (UTC)[reply]
You can't add a {{cc-zero}} to a work you copied from the internet and you have no idea who it originally created. Please stop changing anything in the licensing just to make it "somehow fit". --Polarlys (talk) 08:00, 14 September 2023 (UTC)[reply]

File:The Most Ven. Friedrich V. Lustig.png has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!
