United States[edit]

OK for buildings only {{FoP-US}}

Buildings are works subject to copyright in the U.S. according to 17 USC 102(a)(8) since the Architectural Works Copyright Protection Act was passed in 1990. It applies to all buildings that were completed after December 1, 1990, even if begun before, or where the plans were published after that date.

However, the U.S. federal copyright law explicitly exempts "pictures, paintings, photographs, or other pictorial representations" of copyrighted buildings from the copyright of the building in 17 USC 120(a). Anyone may paint, draw, or photograph buildings from public places. This includes such interior public spaces as lobbies, auditoriums, etc. The creator holds the exclusive copyright to such an image (the architect or owner of the building has no say whatsoever), and may publish the image in any way. 17 USC 120 applies only to architectural works, not to other works of visual art, such as statues or sculptures.

This means that for buildings completed before December 1, 1990, there is complete FoP, without regard to whether the building is visible from a public place, because the building is public domain, except for the plans. For photos of such buildings, the license tag {{PD-US-architecture}} can be used (along with a license tag for the photo.) For buildings completed after December 1, 1990, freedom is given only to photograph such a building. This includes style elements such as gargoyles and pillars, which are protected only from three-dimensional reproduction (Leicester v. Warner Bros.).

Note that copyright applies only to "buildings".

"The term building means structures that are habitable by humans and intended to be both permanent and stationary, such as houses and office buildings, and other permanent and stationary structures designed for human occupancy, including but not limited to churches, museums, gazebos, and garden pavilions."

All such works are copyrighted and, therefore, covered by the FOP exemption only if they are visible from a public place.

"Bridges, cloverleafs, dams, highways or walkways are not ‘buildings’ under the definition of architectural works."

In the U.S., such works do not have a copyright and therefore may be photographed freely, whether or not from a public place. They do have copyrights in many other countries.

Originality requirement[edit]

This discussion must be considered qualified by the requirement under US law that a work, including a derivative work, must display originality to be protectable under copyright law. See Feist Publications, Inc., v. Rural Telephone Service Co. in the English Wikipedia. More specifically, in the case of derivative works, it has been held, in Durham Industries, Inc. v. Tomy Corp. and earlier in L. Batlin & Son, Inc. v. Snyder. that a derivative work must be original relative to the underlying work on which it is based. Otherwise, it cannot enjoy copyright protection and copying it will not infringe any copyright of the derivative work itself (although copying it may infringe the copyright, if any, of the underlying work on which the derivative work was based). Artworks and sculptures  Not OK.

For artworks, even if permanently installed in public places, the U.S. copyright law has no similar exception, and any publication of an image of a copyrighted artwork thus is subject to the approval of the copyright holder of the artwork. However, public artwork installed before 1923 is considered to be public domain, and can be photographed freely. In addition, any public artwork installed before 1978 without a copyright notice is also in the public domain (unless the copyright owner actively prevented anyone from copying or photographing the work until 1978). In these situations, document the date of installation and the creator (sculptor) of the pictured work as much as possible. (A good resource for finding information about U.S. sculptures is the Smithsonian Art Inventories Catalog.)

The line of argument that a large sculpture or memorial is a building and therefore covered by the FOP exemption was specifically rejected in Federal claims court (Gaylord v. The United States, 2008), which noted that the building exemption to the Architectural Works Copyright Protection Act (AWCPA) does not extend to "The Column" sculpture in the Korean War Veterans Memorial because "[t]he structures used in the definition of 'building' by the Copyright Office are intended to house individuals; either for the sake of providing shelter or for another purpose such as religious services."[15] While the court ruled in favor of the defendant under a fair use rationale it was later overturned in favor of the plaintiff; the photograph was deemed a derivative work. The court also contended that had Congress intended to extend the AWCPA to monuments and memorials, the law would have been drafted to reflect that in the first place.

Foreign works from countries that have a relevant freedom of panorama may fall under US law for copyright issues within the US. Under the choice-of-law principle lex loci protectionis U.S. courts might apply U.S. freedom-of-panorama standards in such cases, rather than the standards of the source country. However, in practice it is unsettled whether and how this approach would be applied in real-world U.S. legal cases involving freedom-of-panorama elements.

Duplicate Images[edit]

I would like to request deletion of this image because there is an exact duplicate image (except better resolution) existing in the same category (Episcopal Church (USA)). Is this something that would qualify for "speedy deletion"? In future, is this the way to request removal of an image or is there a better way? Working with uncategorized[edit]

Category: Sorting[edit]

A category about a person would not be the right sort string. Insert just before the categories a line like (squiggle squiggle)DEFAULTSORT:Lastname, firstname (squiggle squiggle) for the correct sorting. See meta:Categories#Sort key for more information.

Hi Auntof6, I read the topic "Seeking info about sorting of "main categories" in Village Pump and your reply. You mentioned sorting keys. I would like to know more about that topic, so thought to write to you directly.

   @Drbones1950: I recently looked for this info, too, and didn't find much. Commons:Categories#Creating a new category says this:
       A question mark is sometimes used to begin the sort key for categories related to unidentified things. For an example, see Category:Buildings in Argentina, where Category:Unidentified buildings in Argentina‎ is sorted under a question mark.
       An asterisk is sometimes used to group some subcategories. This seems to be done in some cases in lieu of creating a metacategory. An example of this is in Category:National Register of Historic Places, where some categories are grouped under asterisk. Some of those subcategories would fit in a metacategory for NRHP properties by type if there were such a category.
       An asterisk is also sometimes used to set apart subcategories that are related but may not really fit under the main category. An example of this is in Category:Metropolitan areas in the United States, where Category:Boroughs in the United States‎ is sorted under asterisk.
       Metacategories are usually given special sort keys. There is disagreement as to what character that is. I have most often seen a space used for that, and the templates that define metacategories use a space. However, I have recently been discussing this with another editor who uses a period.

Cat Sorting[edit]

The effect is to sort it in Category:Churches in Connecticut exactly where it would be if there were no explicit sort at all. If that's your intent, you did just the opposite at https://commons.wikimedia.org/w/index.php?title=Category:Former_churches_in_South_Carolina&diff=210965530&oldid=204339807. Your edit effectively removes the cat sort (basically it says "Sort this under 'f' but ignore 'ormer churches in South Carolina', which only moves it ahead of other 'F' entries). I came here to point out something similar: it doesn't really make sense to change the "Postcards of churches in xxx" categories to sort under "p" (as you did here), since they're another grouping similar to "former" etc. rather than a specific church or locale... at least, I believe that's the consensus. --Junkyardsparkle (talk) 22:21, 28 October 2016 (UTC)[reply]

Thanks for the feedback, guys. Jmabel, you are right, in category:Churches in South Carolina I made a mistake. I have now corrected it, take a look. A better state category that shows my intentions for sorting would be category:Churches in New York. That shows a section for "Churches by..." followed by "Former Churches", then alphabetical subcats.
As for Postcards, I do not believe that it is "another grouping similar to 'former' etc." for the following reason: the other subcats describe the subject of the main category, Churches, in some way. Postcards describes the medium in which the church is presented. So Postcards is actually dissimilar to all of the other subcats. But, given that fact, it could be argued that Postcards belongs in a separate section from all of the others! Now, Postcards could be a subcat of (new category) "Churches by medium". But that would be an example of overcategorization, I think. Or, it could be alone after "*Former Churches", set off by its own separator. Let me know your thoughts. Uploading a whole book[edit]

I have located a digitized book online that is copyright expired, and the only request of the webmaster of the site in which it appears is that credit be given to the site as the provider of the material.    Books can be uploaded in PDF or DjVu format (see COM:FT#Texual formats and Help:Creating a DjVu file). The Upload Wizard can handle these file types. You can also upload the book in certain formats (like an archive of page scan images) to the Internet Archive, which will convert it to DjVu, which can then be transferred here to Commons (see wikisource:Help:Internet Archive). clpo13(talk) 23:41, 13 October 2016 (UTC)

   Your friend's email per COM:OTRS can authorize you to upload on their behalf (rather than listing specific images), but probably should also contain an explicit statement of what license they intend for their images. Once that email is sent, when you upload images, give that photographer's name (or however they wish to be attributed) as the author, and mark any such uploads with {{OTRS pending}} until such time as you have a specific OTRS number to mark them with. - Jmabel ! talk 23:25, 26 October 2016 (UTC)
  

Episcopalian bishops[edit]

Believe this category should be deleted, as only contains "Bishops of the Episcopal Church (United States)" as a subcategory. Bishops of the Episcopal Church are not referred to as "Episcopalian bishops". If "Episcopalian bishops" is a common search phrase, then it should be a redirect, with "Bishops of the Episcopal Church (United States)" as the target category.. This suggests a category "Bishops of the Episcopal Church in Scotland" ("in Scotland" to avoid confusion with the Church of Scotland). Hence I'd suggest this category is renamed to Bishops of the Episcopal Church and the addition of the category for Scotland. "Bishops of the Episcopal Church (United States)" should be renamed to "Bishops of the Episcopal Church in the United States", since brackets in disambiguation mean "is a" rather than "is in". How can I link from a Wikimedia file to a foreign Wikipedia article? I am thinking of File:Adolph Chlumksy, who has a cs.wikipedia.org about him. Here is my reasoning: first, from a previous conversation about categorizing Episcopal subjects, it was agreed that Episcopalian should only be used to describe members of the Episcopal Church. It is not a general adjective, for example, there is not an Episcopalian Church, it is The Episcopal Church. Altars in Episcopal churches might be titled Episcopal Altars, but then there could be confusion with Roman Catholic altars because there are Episcopal Cathedrals in the Roman Catholic Church. It also occurred to me that elsewhere all Episcopal subjects are rightly included in the higher Anglican categories. So if there is an Episcopal altars category, then it should be part of Anglican altars, and Anglican altars by country, then Episcopal altars under United States (and possibly Scotland, because the Anglican Church is Scotland is the Scottish Episcopal Church).
Now, I should have created an Anglican altars category first, then moved the items from "Episcopalian altars" into it. Instead I moved those items back into the general Altars category. That was my bad. Your comment is appropriate, and what I would like to do now is to create "Anglican altars" with "Episcopal Church altars" as a subcategory.
Also, I didn't mean to step on anyone's toes. I thought that what I did by moving the items and requesting a deletion of the category was the correct way to do it. Let me know if it should have been done differently. Drbones1950 (talk) 14:47, 14 February 2017 (UTC)[reply]
I think your own comments above make it clear what would have worked better: if you had created the new Category:Anglican altars first, and moved things into it, it could have been done trivially with any of a number of tools (Cat-a-lot, VFC, movecat in Commons delinker, etc.). As it is, the information is basically lost as to what was previously in Category:Episcopalian altars. (later) Hi, Jmabel, I reponded to your post on my talk page, don't know if you saw it. I also wanted to let you know that I intend to make another change to the category Anglican Bishops. I see that there are separate sub-cats for various provinces of the Anglican Communion, including Bishops of the Episcopal Church, Bishops of the Church of Ireland, Bishops of the Church of Uganda, etc. etc., BUT, there is not a sub-cat Bishops of the Church of England. I intend to create that category, and populate it with the various diocesan bishop subcats. Then, I want to move the subcat "suffragan bishops in England" (which is the only entry in the cat Anglican bishops by diocese in England) into the newly created cat and delete its old parent, Anglican bishops by diocese in England, which would then be empty (and which is titled ambiguously anyway, since it never contained all of the Anglican bishops in England). I can't agree. I moved Crista Ministries to Christian Organizations because I believe that it is adequate categorization for Crista Ministries. I don't believe that this organization is on the same level of categorization as the other subcategories of Protestantism, which are themselves nationwide or international denominations. Crista Ministries is not a denomination, simply an organization. If you feel that Christian Organizations belongs under the higher level category Protestantism, I would see the logic.
