Would you mind explaining to me how this image is appropriate for a public domain template which says that its "first publication occurred prior to January 1, 1923"? According to Gurdial Singh (mountaineer), he was born in 1917, so for this tag to be correct he would have to been no older than five when this photo was taken. While his age is not obvious in the picture, the fact that the English Wikipedia caption says this is was taken at the top of a mountain suggests this image has been uploaded with a false copyright status. This is the only upload of yours I have looked at so far, and I'm taking no action until you have had a chance to respond to what I have said

That said, it should be noted that copyright is taken very seriously on Commons and it is the responsibility of the uploader to ensure that they do not uploaded copyright violations and the files they do upload have the correct copyright status. If you are uploading a photograph which was not physically taken by yourself, Commons requires that evidence of copyright status, such as permission from the copyright holder or evidence of public domain status, be provided. This evidence can be shown by sending it either to permissions-commons@wikimedia.org or by providing a link to a webpage containing it. The web link at File:Gurdial Siingh of The Doon School on Mt. Photo uploads[edit]

I notice you have uploaded a lot of photos related to The Doon School under the claim that they are your "own work". I am not convinced that these uploads are your "own work" for several reasons including...

  • The copyright issues with your other recent uploads
  • The low resolution and lack of camera metadata in the images, suggesting they were not taken directly from a camera
  • That the images are all present on at least one other website, in a similar resolution, such as this

Update on your uploads[edit]

I'm afraid that with the dates given for File:Gurdial Singh, mountaineer, The Doon School.jpg and File:Gurdial Siingh of The Doon School on Mt. Trisul.jpg, it appears that neither are PD in the United States, and so cannot be hosted as free content either on the English Wikipedia or Commons; the latter image isn't PD in India either. Due to these findings I have had to nominate both images for deletion as you can see above.

File:R.L. Holdsworth, The Doon School.jpg which was the DYK image seem to be okay, since photos from before 1941 only had 50 years of protection in India. What is the source for the year given and how accurate is it? Is there a possibility it might have been published later than 1940?

File:Jack Gibson, The Doon School.gif is going to be very dodgy without any information on author and year taken. Given that this person was around 33 in 1941, and he looks older in this photo, I suspect that it is still copyrighted in the US, as it would not be PD in India on URAA date of 1 January 1996.

I still need more information on File:J.A.K. Martyn, The Doon School.JPG and File:Sheel Vohra, The Doon School.jpg, and the author if possible on File:The Oxford Cricket Team (with RL Holdsworth), 1922.jpg. CT Cooper · talk 12:00, 24 June 2012 (UTC)[reply]

The Oxford Cricket Team photo is straight from ESPN Cricinfo (I've provided the link in summary), which unfortunately does not mention any author. But having been published in 1922, it's out of copyright in the US, I suppose. So maybe we can put ESPN as the author? I don't know really. As for R.L. Holdsworth date, I merely looked at this Flickr photograph which shows him smoking his pipe at Mt. Kamet in 1931 and made a loose guesstimate that the photograph must have been clicked shortly after the event. Of course, providing the exact date is beyond me. I have provided the year and author for JAK Martyn, whose photograph I took from the school records. And, as for the Gibson image, I have provided the exact link which, again, is without author or date but I don't understand what's wrong with the present tag, as the image was first published outside the USA!? --DoscoinDoon (talk) 13:08, 24 June 2012 (UTC)[reply]
Content on Commons has to be free both in the US and the country of origin, and the entire idea of URAA was to grant US copyright protection to works that weren't published in the US, even if that means copyrighting works that have become public domain in the country of origin.
On File:The Oxford Cricket Team (with RL Holdsworth), 1922.jpg, ESPN Cricinfo is just the website hosting the content and is unlikely to the author, so leaving it as unknown is probably more accurate. As you say it is PD in the US and photos can be PD in the UK as well with the author is unknown in certain circumstances, which this image should meet, although having the actual author is always more desirable.
On File:R.L. Holdsworth, The Doon School.jpg, using another image as a source of the year is not ideal, but I can see where you are coming from. Given that it appears most likely that the photo was snapped before 1941, I have decided to take no further action here.
File:J.A.K. Martyn, The Doon School.JPG was taken in 1944 and so gets sixty years of protection in India rather than fifty, and hence only became PD in India in 2004/5, way over the URAA date, meaning it won't become PD in the US until 2039/40. As a result of this finding I'm going to have to also nominate this image for deletion.
On File:Sheel Vohra, The Doon School.jpg, given that the subject wasn't born until 1936, it is almost certain that this was still copyrighted on the URAA date (and may well still be copyrighted in India now), and hence I am also going to have to also recommend deletion of this image, even if the exact year isn't clear.
I'm sorry it had to be this way, I was rather hoping they would all be PD, but I cannot ignore my own findings which make clear some aren't. There is one other route to allow the images to stay on Commons, which is to get permission (i.e. to release the images into the public domain or under a free license) from the copyright holder (i.e. the photographer or their descendants if the photographer is deceased). If you wish to try and do this, I can provide further help. Another option for some cases is to re-upload the images onto the English Wikipedia as non-free content, as non-free images of people are allowed in their biographies if they have died and no free images of them are available, with a limit of normally one such image per biographical article - see w:WP:NFC and w:WP:NFCC. Perhaps, you can transfer these files to the English Wikipedia (under non-free tag) instead of deleting them from Commons??If that's not possible, I'll upload them again on Wikipedia for their biographies under non-free tag.
