Thanks for uploading File:Smile machine photo.jpg. This media is missing permission information. A source is given, but there is no proof that the author or copyright holder agreed to license the file under the given license. Please provide a link to an appropriate webpage with license information, or ask the author or copyright holder to send an email with copy of a written permission to VRT (permissions-commons@wikimedia.org). You may still be required to go through this procedure even if you are the author yourself; please see Commons:But it's my own work! for more details. After you emailed permission, you may replace the {{No permission since}} tag with {{subst:PP}} on file description page. Alternatively, you may click on "Challenge speedy deletion" below the tag if you wish to provide an argument why evidence of permission is not necessary in this case.

Please see this page for more information on how to confirm permission, or if you would like to understand why we ask for permission when uploading work that is not your own, or work which has been previously published (regardless of whether it is your own).

The file probably has been deleted. If you sent a permission, try to send it again after 14 days. Do not re-upload. When the VRT-member processes your mail, the file can be undeleted. Additionally you can request undeletion here, providing a link to the File-page on Commons where it was uploaded ([[:File:Smile machine photo.jpg]]) and the above demanded information in your request.

Hi Dickturner. If this photo is truly your "own work", then please follow the instructions in the above template and send a declaration of consent email to Wikimedia OTRS (OTRS's address is also given in the same template). However, be advised that the copyright holder of photos such as this is generally considered to be the photographer who takes the photo and not the subject of the photo. I am only mentioning this because your username and the name of the person depicted in the photo are the same. So, if you're the "Dick Turner" in the photo and the photo was taken by someone else, you cannot really claim it as your "own work" unless there has been en:Copyright transfer agreement which gives you the rights to the photo. In the absense of such a thing, you will most likely need to follow COM:OTRS#f you are NOT the copyright holder and obtain the permission of the person who took the photo. Please note that this also applies to File:Smile Machine package front.jpg, File:Dan Carney.jpg, File:Me holding my ad copy.jpg and File:Me holding Village Voice.jpg. It's possible to send in one permission email for multiple files, just make sure that each of the files you are claiming copyright ownership is clearly specified.
Moreover, it's really not a good idea to upload any more photos intended to provide some kind of "proof of copyright ownership" because (1) doing so may actually unintentionally violate someone else's copyright for other content shown in the photo (see the below discussion thread), and (2) it's not really proof at all since nobody can verify who you really are just from seeing a photo and it still doesn't verify who created the advertisement you're holding. The best thing to do is continue discussing things via email with Commons OTRS or ask for assistance at COM:OTRSN. OTRS often is backed up since there tends to be more files needing verifiaction than there are OTRS volunteers, so it may take some time for someone to get back to you. Just be patient and someone eventually will. If by chance a file is deleted while you're waiting, don't panic. Deleted files are not gone forever, but rather are only hidden from public view. Such files can be easily restored once their licensing has been verified.-- Marchjuly (talk) 00:47, 10 May 2018 (UTC)[reply]
I just sent a mail to permissions concerning this image. The photo was taken at my request, using my camera, in a museum in 2005 by a person unknown to me - I asked someone in the audience to take it.Dickturner (talk) 18:10, 10 May 2018 (UTC)[reply]
Thank you for doing that Dickturner. You should get an automatic response from OTRS containing an OTRS ticket, so keep file that away because you can use it later on if have any questions about the status of the file or the review process. Once you've gotten that ticket number, replace the {{No permission since}} template I added to the file's page with {{OTRS pending}}. This will let others know that an email was sent in and that the file's copyright ownership is in the process of being verified. The OTRS volunteer who processes the email will add {{OTRS received}} and the one who verifies it will add {{OTRS permission}}. It may take some time for the entire process to be completed, so just be patient. Just for reference, only OTRS volunteers will be able to see the contents of your email (I'm not a volunteer so I can't), so if you have any questions about the specifics of email as it relates to this image, feel free to ask for help at COM:OTRSN. OTRS volunteers will not reveal private information on that noticeboard, but they can provide general information there and follow it up with more detailed instructions by email. -- Marchjuly (talk) 00:53, 11 May 2018 (UTC)[reply]

Hi Dickturner. While I kinda understand why you uploaded this photo, you probably should avoid doing something similar in the future. The copyright of the content on those two particular VV pages is mostly the property of the paper/magazine itself or the person(s) who created it, so you really cannot claim ownership over all of it. Moreover, it really doesn't do anything to prove that you are the copyright holder of the ad you created since there's no way to verify that all all. The best thing to do is keep in touch with OTRS and try to sort things out that way, or provide links to external websites where the same imagery can be seen if you feel compelled to provide "photographic proof" of some kind. -- Marchjuly (talk) 01:15, 10 May 2018 (UTC)[reply]

File:The Smile Machine.jpg[edit]

You're claiming that "This is an original photograph by Dona Ann McAdams", but you are licensing it as you if you are the author (i.e., photographer who took the photo). You cannot really do this unless (1) you are Dona Ann McAdams or (2) Dona Ann McAdams has officially transferred copyright ownership to you. You also added that you received permission from McAdams to upload the photo and have sent that email on to OTRS. If that's the case, please add the template {{OTRS pending}} to the file's page, so that others can more easily see that this file's licensing is in the process of being OTRS verified and don't nominate it for deletion by mistake.

Finally, a few more things about releasing images under free licenses deemed acceptable for Commons. When you do such a thing, you are basically agreeing in advance to permit anyone anywhere in the world to download the image at anytime and use for any purpose they want, including for commercial or derivative purposes. You can require that these downloaders provide attribution as to where the image came from and who created it, but that's about it. Licenses which try to restrict use to only Wikipedia or for only so and so purpose are not going to be accepted. Moreover, a free license, etc. cannot be revoked or cancelled if you decide to change your mind at a later date. So, Commons needs to be extra careful when it comes to uploaded content and needs to be as sure as it can be that noone's copyright is being infringed upon. Whenever there's any reasonable doubt, further verification may be requested or files may even be deleted per COM:PCP. -- Marchjuly (talk) 01:34, 10 May 2018 (UTC)[reply]

File:The Smile Machine.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

Hello, I write in response to a demand that I express myself on this photo. In fact, unless I am mistaken, I have expressed myself on this photo elsewhere...in different posts... I have received and sent permission to wiki-permissions from it's author, Dona Ann McAdams...I did this at least two weeks ago. The photo was taken in Barcelona in 1993 for a small arts magazine. At that time, Dona said it was OK for her for me to use it anytime, but to put her name with it. Thus, on the page for the photo her name is there....She signed, scanned and sent a note to me to this effect which I send to permissions. I also sent her email address in case you'd like to check with her directly. If I need to do something, tell me and I'll do it. thank you, Stargazer9000 (talk) 10:33, 16 May 2018 (UTC)[reply]

PS It looks, unless I am mistaken, that the article has been accepted...the word draft was removed...THANK ALL OF YOU ! Stargazer9000 (talk) 10:33, 16 May 2018 (UTC)[reply]
