In principle, the person taking a photo, not the subject of the photo, is considered to be the copyright holder of the photo and only the copyright holder can release their photo under a Creative Commons license. If the photo was part of a work for hire arrangement between you and the photographer and the photographer then transferred all of their copyright ownership to you, then you can cases upload the file if you want under a free license accepted by Commons. However, if the photographer still retains any copyright ownership over the photos, you will need to have them email their consent to the Wikimedia Volunteer Response Team as explained here and in the above notification template. Furthermore, even if you are the sole copyright holder of the photo, it has been published online on other websites prior to it being uploaded to Commons which further complicates things since then standard licensing of those websites is not suitable for Wikimedia Commons purposes. So, you should follow the guidance given here and send an consent email to VRT for verification purposes.
Finally, before you do anything else, you should take a carefull look at this, this and this and make sure you and the copyright holder (if that's a different person) understand what it means to upload your work to Wikimedia Commons. Bascially, by uploading this photo to Commons, you agreeing to allow anyone anywhere in the world to download it at any time and reuse for any purpose, even if this means for commercial or derivative reuse, or reuse in a way that you mightn't otherwise approve. As long as those who download and reuse the file comply with the terms of the free license you choose, you will have a really hard time stopping them from doing so. Sometimes people upload images to Wikimedia Commons because they want to use them on some Wikipedia page for education purposes only; however, some people don't realize that there's no way to prevent others from reusing the image outside of Wikipedia for other reasons as long as the reuser complies with the terms of the copyright license the file has been released under. So, please make sure that you or whomever is the copyright holder understands and agrees to this.
